RECOMMENDATION Approve purchase order 1618 for $4,000

BACKGROUND The RAD 57 is a diagnostic devise to assess the hemoglobin saturation of blood. The difference with this devise is we can in seconds determine if a patient has been exposed to carbon monoxide (CO). Every year we respond on carbon monoxide alarms going off and we are unable to determine if a family has truly been exposed and to what levels they have been exposed. Treatment of CO poisoning is time critical and must be accomplished in a hyperbaric chamber.

Patient exposure is not our only risk in this issue. Many homes do not have CO detectors installed. We are called for flu like symptoms and our firefighters enter the home unaware of the CO. We have a small monitor on one of our bags that should alert us, but at that point we are exposed. This devise will tell us to what extent we have been exposed and we can determine if we need to send them to the hospital or not.

The other use for this tool is in firefighter rehab. At a fire scene there is a vast amount of CO. After being exposed to the environment, firefighters are sent to rehab for evaluation and recovery. NFPA rehab guidelines require a CO reading

RESTRICTIONS: The products contain Masimo's proprietary software ("Software"), trade secrets and other proprietary information (collectively, "Intellectual Property"). Masimo grants to Buyer a non-exclusive, non-transferable, perpetual license to use the Intellectual Property in connection with its authorized use of the products. This Agreement does not constitute a sale of the Software or any lntellectual Property.

OPTIONAL SOFTWARE PARAMETERS. Masimo offers optional software parameters ("Software Parameters") with additional functionality at the term license fees detailed herein. The optional Software Parameters contain Masimo Intellectual Property, and are licensed separately from the Software mentioned above. If Buyer elects to purchase term license(s) for optional Software Parameters, Masimo shall grant to Buyer, subject to the Payment paragraph above, a non-exclusive, non-transferable, non-sub licensable, revocable limited term software license to use the optional

Software Parameters for the term license period. Any license granted to Buyer is limited to use of the optional Software Parameter solely on a single Masimo Oximeter.

ADDITIONAL SOFTWARE PARAMETER UCENSES. Additional term licenses for optional Software Parameters may be purchased.

NO IMPUED UCENSE. Possession or purchase of Masimo's pulse oximeters (UOximeters") does not convey any express or implied license to use the Oximeters with unauthorized sensors or cables that would, alone, or in combination with the Oximeters, fall within the scope of one or more of the patents relating to the Oximeters. Sensors designated for single patient use only are licensed to Buyer under patents owned by Masimo to be used on a single patient only, and Buyer shall not use Masimo's patented single-patient use sensors which have been reprocessed or previously used with a different patient, unless specifically authorized by Masimo. There is no license, implied or otherwise, that would allow use of disposable Sensors beyond their intended single use. After use of sensors designated for single patient use only, there is no further license granted by Masimo to use the sensors and they must be discarded.

UMITED USE. Buyer will not permit the Oximeters to be used by anyone other than Buyer's qualified and trained personnel. Except for use of the serial port to transmit data from Masimo's Oximeters to other oximeters, modification or connection of other equipment to Oximeters, including software, hardware and related instruments cannot be made without Masimo's prior written authorization, which authorization may be withheld at Masimo's sole discretion. The Oximeters and other products or services acquired hereunder may not be used for any processes, procedures, experiments or any other use for which the products/services are not intended for use or cleared for use by the Food and Drug Administration (FDA). Buyer may not disclose, publish, translate, release, distribute copies of, modify, adapt, translate, or create derivative works of the products, services deliverables, software/firmware or written materials. Buyer may not reverse engineer, decompile or disassemble the products, services deliverables or software.COMPUANCE WITH LAWS: Masimo warrants that in performance of a Purchase Order it has complied with or will comply with all applicable federal, state and local laws and ordinances including, but not limited to, OSHA, the Fair Labor Standards Act as amended, and Executive Order 11246, as amended. In addition, Masimo shall secure and maintain adequate Worker's Compensation coverage.

GOVERNMENT CONTRACTS: Masimo warrants that in the performance of a Purchase Order it has complied with or will comply with all Federal Acquisition Regulations or their counterpart for other govemmental agencies, which are applicable to the products or services purchased hereunder. Upon request, Masimo shall certify compliance with any of the aforementioned rules or regulations.

RELATIONSHIP BETWEEN PARTIES: Nothing in this Quotation shall be construed as creating any partnership, joint venture, or agency between the parties.

NOTICES: All notices shall be in writing and delivered either by hand, facsimile or certified mail at the addresses set forth herein. Notice shall be deemed to have been given upon receipt if delivered by hand or facsimile, or if given by certified mail, upon expiration of seven days after mailing.

Date of City Council Meeting: 22 June 2010 Title: Discussion/Public Comment: Water Rate Increase RECOMMENDATION Increase the monthly water rates by $14 per connection. BACKGROUND Now that the city has completed the bidding process for both the Reservoir #4 project as well as the water line replacement project, staff has been able to determine and is recommending a $14 increase. Marc Edminster (LYRB) completed his analysis this week and has determined that an increase of $14 a month is sufficient to complete both improvement projects as well as generate the necessary debt service coverage of 1.25 that will be required by the rating agencies. The good news is that these figures are close to our estimates (see slide below) that were prepared and discussed with the public during the city’s public open house.

After reviewing this information with staff, Marc asked what the city’s thought process was relative to implementing the new rates. He commented that it looks good for the rating agencies to see that the city is already planning and preparing to increase the rates when we present our projects to them. As such, we felt like a good way to start

the process would be to agenda a discussion about the likely rate increase as well as provide (although neither state law nor city ordinances require) some time for public comment on the possible rate increases. With the costs now becoming finalized and with property acquisitions nearing completion it seems as though the area of most discussion has turned to the connection road to Layton City. During our last meeting, as well as during the Planning Commission meeting wherein the 1900 East connection to Layton City was discussed, I mentioned that I was not sure how the Barlow’s would feel about donating their property and easements if the city decided against constructing the wider access road. Since the last meeting I have had the opportunity to talk with Haven Barlow about his thoughts on the matter. Haven communicated to me that their willingness to donate property and work with the city is in no way tied to an expectation the city will construct a particular access road to the tank. Staff is currently working to gather estimates from the contractors on what the city might expect to save/spend should the council decide to construct a narrower access road to the tank. We hope to have this information before Tuesday’s meeting and will forward it to you as it is completed. Have a great weekend.

NOTICE OF PUBLIC HEARING AND BONDS TO BE ISSUED SOUTH WEBER CITY, UTAH

NOTICE IS HEREBY GIVEN pursuant to the provisions of the Utah Local Government Bonding Act, Title 11, Chapter 14, Utah Code Annotated 1953, as amended (the “Act”) that on May 25, 2010, the City Council (the “Council”) of South Weber City, Utah (the “Issuer”) adopted a resolution (the “Resolution”) in which it authorized the issuance of the Issuer's Water Revenue Bonds, Series 2010 in an amount of not more than $5,000,000 aggregate principal amount (the “Bonds”), to bear interest at a rate or rates of not to exceed seven percent (7.0%) per annum, to mature in not more than thirty-five (35) years from their date or dates, and to be sold at a price not less than ninety-seven percent (97%) of the total principal amount thereof, plus accrued interest, if any, thereon.

NOTICE IS FURTHER GIVEN that the Issuer called a public hearing for the purpose of inviting public comment on the proposed issuance of the Bonds and the economic impact that the improvements proposed to be financed with the Bonds will have on the private sector. The public hearing will be held on June 22, 2010, at 6:00 p.m. or as soon thereafter as feasible, at the South Weber City Office, 1600 East South Weber Drive in South Weber, Utah. As water revenue bonds, no taxes will be pledged to repay the Bonds

The Bonds, pursuant to the Resolution, a General Indenture of Trust and First Supplemental Indenture of Trust (collectively, the “Indenture”) and a Final Bond Resolution to be adopted authorizing and confirming the sale of the Bonds, are to be issued for the purpose of (i) improvements to the Issuer’s culinary water system, including a water tank, and related improvements; (ii) funding a deposit to a debt service reserve fund, if desired, and (iii) paying issuance expenses to be incurred in connection with the issuance and sale of the Bonds.

The Bonds are to be issued and sold by the Issuer pursuant to the Resolution, including as part of said Resolution a form of the Indenture and Final Bond Resolution which were before the Council and attached to the Resolution at the time of the adoption of the Resolution and said Indenture shall contain such terms and provisions as shall be approved by the Issuer at the time of adoption of the Final Bond Resolution, and said Final Bond Resolution is to be adopted by the Council in such form and with such changes thereto as shall be approved by the Council upon the adoption thereof; provided that the principal amount, interest rate or rates, maturity and discount of the Bonds will not exceed the maximums set forth above.

A copy of the Resolution, the Final Bond Resolution and the Indenture are on file in the office of the City Recorder in the City offices in South Weber, Utah, where they may be examined during regular business hours of the City Recorder from 7:00 a.m. to 5:00 p.m., Monday through Thursday and 7:00 a.m. to 11:00 a.m. on Friday for a period of at least thirty (30) days from and after the date of publication of this notice.

AMENDED AGREEMENT BETWEEN SOUTH WEBER CITY AND JONES AND ASSOCIATES CONSULTING ENGINEERS

WHEREAS South Weber City entered into an agreement with Jones and Associates

Consulting Engineers for Engineering Services on September 26, 2006; and WHEREAS the terms of the agreement state the contract may be amended by mutual

consent of both parties; and WHEREAS the South Weber City Council has reviewed the Amended Agreement and

deems it is in the best interest of the City to amend the agreement; NOW, BE IT THEREFORE RESOLVED by the City Council of South Weber City, State

of Utah, that the contract between South Weber City and Jones and Associates shall be amended.

PASSED AND RESOLVED THAT:

Section 1: APPROVAL OF AGREEMENT

The City Council of South Weber City has reviewed and agree to the provisions set forth in the Agreement for Engineering Services between South Weber City and Jones and Associates Consulting Engineers, which is attached to this resolution. The City Council is authorized to execute the agreement for and on behalf of South Weber City. AGREEMENT (Amended)

THIS AGREEMENT made and entered into by SOUTH WEBER CITY CORPORATION, hereinafter called the CITY, and JONES AND ASSOCIATES CONSULTING ENGINEERS INC., hereinafter called the ENGINEERS. WHEREAS, the CITY desires to enter into this agreement with the ENGINEERS providing for their services to the extent and upon the terms and conditions as hereinafter set forth, and WHEREAS, the ENGINEERS are willing to enter into this agreement with respect to their employment and services upon the terms and conditions hereinafter set forth; NOW THEREFORE, in consideration of the provisions and the mutual agreements as hereinafter set forth, the parties hereto agree as follows: 1. The CITY agrees to retain and contract with ENGINEERS to serve CITY as its CITY ENGINEERS

from the date of official appointment, September 12, 2006, until such time as either party may give reasonable notice to terminate this agreement. Reasonable notice shall be construed herein to mean a minimum of sixty (60) calendar days prior to such termination unless a shorter period is mutually agreed to by both parties.

The ENGINEERS agree that during the period of the contract, the ENGINEERS shall perform all regular and routine engineering work as requested by CITY, such work to be requested by duly authorized verbal or written work order. ENGINEERS agree to perform said services in a timely manner after receiving reasonable notice. The general scope of City Engineering services are as follows:

a. Review, checking, processing and approval of subdivision plans, commercial development

plans and industrial development plans submitted to the City for development purposes.

b. Field inspections of subdivision and public works improvements. Inspection work will be supplemental to the work of the City staff. Inspection services will be as directed by the CITY and will be periodic or full time as needed for the specific circumstance.

c. Assistance in the preparation of required City Ordinances. d. Preparation of City Technical Specifications and Public Works Standards. e. Complete engineering planning, design, drafting, specifications, bidding and construction

management of the following municipal oriented projects:

Storm Drainage Systems Public Street and Highways Park Development

and consult with the regulating body as requested. i. Preparation of legal property descriptions as required for City purposes. j. General field surveying services. k. Specialized engineering services, if needed, would be through associated subconsultants

which would provide: Structural Engineering Geotechnical Engineering Material Testing Aerial Mapping Electrical Engineering

l. Consult with and aid the City Attorney in resolving disputes which require the input or opinion of the City Engineer.

m. Act as a member of the City Emergency Response Team as requested by the City. Assist

in the event of an emergency where engineering services are needed for immediate and /or long-term stabilization of the area impacted.

n. Provide mapping in AutoCAD and/or GIS formats as requested by the City for the

following: Utility Maps (Water, Sewer, Storm Drain, etc.) Zoning Maps General Plan Maps (Land Use, Sensitive Lands, Annexation, etc.) Street Maps Other Miscellaneous Maps as needed

2. Brandon K. Jones, Professional Engineer, Utah License # 5148758-2203 shall be appointed as

South Weber City Engineer, and shall be designated as the direct contact engineer for all daily engineering services to the City. In the absence of Mr. Jones, any other registered professional engineer employed by the ENGINEERS, is authorized by the CITY to sign plats and provide required City services and approvals as needed.

3. The services of the ENGINEERS shall be provided in accordance with the Jones and Associates

Consulting Engineers Terms and Conditions attached to this agreement as Exhibit "A." 4. Compensation to the ENGINEERS shall be on an hourly rate basis in accordance with the Jones

and Associates Consulting Engineers standard hourly rate schedule of fees attached to this agreement and shown as Exhibit "B." In December of each year, the ENGINEERS shall provide written notification to the CITY of any hourly rate modifications together with the proposed new hourly rate schedule for the upcoming calendar year. In January of each year the modified hourly rate schedule shall become the new basis of payment under the terms of this agreement.

5. The ENGINEERS are retained and contracted for with the CITY for the purposes and to the extent set forth in this agreement and their relation to the CITY during the period of this contract shall be that of an independent practitioner and they shall be free to dispose of such portions of their time, energy and skill during their regular business hours as they deem appropriate provided they perform services for the CITY as agreed upon. The ENGINEERS shall not be considered under the provisions of this agreement or otherwise as having an employee status or being entitled to participate in any plans, arrangements or distributions by the CITY in connection with any fringe benefits provided to regular employees.

6. The ENGINEERS agrees to indemnify the CITY, it officers and employees against, and hold

them harmless from, claims for liability for injury or damage caused by any negligent act or omission of any of the ENGINEERS officers, employees, volunteers, or agents in the performance of this Agreement.

7. This agreement is considered the controlling contractual document notwithstanding anything to

the contrary in any exhibit, including, but not limited to, the Terms and Conditions Exhibit. 8. This contract may be amended by mutual consent of both parties. E X H I B I T “ A “ TERMS AND CONDITIONS OF THE AGREEMENT JONES AND ASSOCIATES CONSULTING ENGINEERS INC. South Ogden, Utah ____________________________________________________________________________________________ 1. Compensation for Services: Compensation for engineering services received will be as stipulated in the engineering services proposal. If an hourly rate compensation is specified, then services will be compensated based on the current Jones and Associates Hourly Rate Schedule. If a lump sum fee is stipulated, the specified work will be performed for the total dollar amount indicated. Said hourly rates and lump sum fees will include all compensation for payroll and overhead costs, secretarial, copy machine reproduction, CAD services, telephone calls and vehicle mileage costs. All other direct expenses incurred during the project will be billed at actual cost. 2. Authorization to Proceed: The signed acceptance of the engineering services proposal shall be construed as authorization by CLIENT for Jones and Associates Consulting Engineers (J&A) to proceed with the work as described in the engineering services proposal, unless otherwise provided for in the authorization. 3. Estimate of Probable Cost: Any cost estimates by J&A will be on the basis of experience and judgment, but since J&A has no control over market conditions or bidding procedures, J&A cannot warrant that bids or construction costs will not vary from these cost estimates. 4. Professional Standards: J&A agrees that the services performed under this Agreement are performed to the level of competency presently maintained by other practicing professional engineers at the same time and in the same type of work in CLIENT'S community (or allowed by J&A's professional liability insurance). 5. Termination: Either CLIENT or J&A may terminate this Authorization by giving 60 days written notice to the other party. In such event, CLIENT shall forthwith pay J&A in full for all work previously authorized and performed prior to effective date of termination. If no notice of termination is given, relationships and obligations created by the Authorization shall be terminated upon completion of all applicable requirements of this Authorization. 6. Payment to J&A: Monthly invoices will be issued by J&A for all work performed under the terms of this agreement and are due and payable upon receipt. Finance charges will be computed at a rate of 18% per annum (but not exceeding the maximum amount allowed by law) and will be charged on all past-due accounts over 30 days old from the date of original invoice unless otherwise provided by law or by contract. Payments will be credited first to interest then to principal.

7. Professional Liability Insurance: J&A agrees to maintain professional liability insurance in the amount of $ 1,000,000.00 during the duration of the contract for engineering services. Certificates of insurance will be issued to clients upon request. 8. Right of Entry: Unless otherwise agreed, CLIENT will furnish right-of-way for J&A to make field surveys and investigations as requested by CLIENT. 9. Job Site: For projects involving construction, CLIENT agrees that the construction CONTRACTOR will be required by J&A to assume sole and complete responsibility for job site conditions during construction of the project, including safety of persons and property. CLIENT further agrees to indemnify and hold J&A harmless from any and all liability in connection with the performance of work during construction of the project, except liability arising directly from the negligence of J&A. J&A shall not undertake any of the responsibilities of the CONTRACTOR, SUBCONTRACTOR, or CONTRACTOR'S superintendent. J&A shall not supervise construction or advise on, issue directions relative to or assume control over any aspect of the means, methods, techniques, sequences or procedures of construction unless such advice or directions are specifically required by the Construction Contract Documents. 10. Engineering Services Documents: All drawings, surveys notes, computer files, project files, reports and other instruments of service are and shall remain the property of J&A except where by prior agreement, or by law or precedent these documents become public property. Provided, however, that all drawings, computer files, project files, reports, documents, other files, media of any type and all other items prepared in connection with an authorized project or work agreement, whether by J&A or any other individual or entity hired to work on an authorized project or work assignment, and paid for by the CLIENT, shall become and remain the property of the CLIENT. The CLIENT agrees to hold harmless, indemnify and defend J&A against all damages, claims, expenses and losses arising out of any reuse of the plans and specifications without the written authorization of J&A. 11. Disputes: All claims, disputes or controversies arising out of, or in relation to the interpretation, application or enforcement of the Agreement shall be decided through alternative dispute resolution. The method of alternative dispute resolution shall be mutually agreeable to both the insurance carriers of the CLIENT and J&A. Should it be determined that a mutually agreed method can not be found, and a resolution must be obtained through formal court hearings, then it is agreed that the prevailing party shall be entitled to recover his costs, expenses and reasonable attorney's fees.

BACKGROUND In 2008 when this ordinance was last approved, there were a few items that were overlooked. Below is a list of the omitted areas and how each has been corrected:

1. Requirement of Curb, Gutter, and Sidewalk was omitted from the General Requirements Section (11-4-2); however, it was included in the Improvements Section (11-4-10). This has now been added to the General Requirements Section (11-4-2K-5).

2. Requirement of seal coating prior to final acceptance. The previous version

allowed for the money for seal coating to remain in escrow and final acceptance permitted before the seal coat was complete. The requirement of completing this prior to final acceptance has been added to 11-4-2L & 11-4-10.

General: The following Sections of this Chapter are general requirements of all subdivisions relating to streets, blocks, lots, easements and other public spaces, improvements, etc. Additional requirements for subdivisions shall also apply as outlined in other sections of this Title. 11-4-3: ADEQUATE PUBLIC IMPROVEMENTS:

A. Required: Adequate public improvements are required to be available concurrent with subdivision approval. No application for subdivision approval shall be granted, approved or issued unless the subdivider can establish that existing public improvements in the area affected by the proposed development have sufficient capacity, at the adopted level of service standards, to accommodate the proposed development.

B. Essential Public Improvements: Essential public improvements to which this requirement will apply include the following:

sufficient detail to accurately define location, size and type of proposed drainage facilities. All design shall be in compliance with the adopted Storm Drainage Master Plan and City standards and drawings.

F. Design Preparation: All design work related to this Section shall be performed by a licensed civil engineer and approved by the City. A copy of all final design calculations, drawings, etc., shall be submitted to the City along with the final plat.

G. UPDES Permit: Where required by State, County, and/or local law, a Utah Pollutant Discharge Elimination System (UPDES) permit shall be obtained by the subdivider. The subdivider shall provide evidence of having filed a "notice of intent" form for the discharge of storm water to the state department of environmental quality, division of water quality, to the city along with the final plat. 11-4-10: CURB, GUTTER, SIDEWALKS AND ASPHALT PAVING:

A. Required: Curbs, gutters, sidewalks and asphalt paving shall be provided in front of

all commercial and residential lots. Curb, gutter and paving shall be required on all industrial property. At the discretion of the planning commission, sidewalks may also be required for industrial property. All curb, gutter, asphalt and sidewalks must be installed prior to “Conditional Acceptance” by the City. Seal coat in accordance with city standards shall be completed prior to “Final Acceptance” by the City; seal coat my only be installed between May 1 and November 15.

B. Exception to Requirement: In certain circumstances standard curb and gutter may

be substituted for the city’s standard roll curb and gutter. Additionally, in certain circumstances city standards for park strip and sidewalk widths may be exceeded. The granting of an exception to the standards shall be at the discretion of the Planning Commission and subject to the approval of the City Council. To qualify for an exception, the subdivision must meet the following requirements: (Ord. 08-15, 10-28-2008, eff. 11-05-2008)

1. Contain no less than five (5) acres or be contiguous to another subdivision

using the same street development standard proposed for the new subdivision and for which the varied street development standard would be the logical extension of the existing curb, gutter, and storm water management system.

2. In cases where standard curb and gutter exists on arterial streets to the development, the roll curb and gutter exception shall only apply to interior subdivision streets with the standard curb and gutter standards applying to the arterial streets.

3. Construction of roll curb and gutter shall be in accordance with the city’s standards, as adopted by the city.

Matt Dixon joined the meeting at this time to discuss the extension of 1900 East. He said there is current language in the general plan that provides for a possible connection to Layton city. Matt said when the city reaches its build out of a population of 14,000 there will need to be a connection. He said this road makes sense and the geotech supports it. Scott stated road and sidewalk improvements written into the general plan influences where funds go when they become available. The draft of the general plan amendment recommendations will be provided to the Planning Commission prior to the public hearing. Matt Dixon left the meeting at this time. Ordinance Amending Title 10 for two-family dwellings: The ordinance amendment allowing two-family dwellings in all zones was discussed at the previous meeting, at which time the commission recommended a provision requiring the dwelling to be owner occupied. Scott discussed the difficulty of enforcing this provision unless county records are pulled. Requiring a business license was discussed. All rental properties require a business license in the city. Erika indicated city code requires any business that make more than $250 per year requires a business license. Scott said this would be a conditional use, and the home would then be approved for a renter regardless of who owns it; however, any new owner would have to get a new business license. Ordinance Amending Title 11 Subdivision Regulations: Scott reported the provisions being discussed were overlooked when the subdivision ordinance was amended. The amendments include the requirement of completion of seal coat prior to final acceptance. Conditional Use Permit – Debi Waters Preschool: Scott reported this preschool has been in operation for some time with no complaints. The back yard is fenced. The city is waiting for the fire inspection. There are no parking issues, but Ms. Waters needs to be asked about the one employee she has. The employee can only be someone who lives in the home; it is believed Ms. Waters daughter works with her at the preschool. Residential Moderate Zone (10-5A-3), Residential Low Moderate Zone (10-5B-3), and the Agricultural Zone (10-5E-3): Scott Hess, City Planner, stated currently, two family dwellings are only permitted as a conditional use in the Residential Low and Higher Density zones. This is much stricter than both the County and State Ordinances, which allow up to four non-related people to live in one dwelling and still be considered a “family”. Scott stated based on discussion of this ordinance it was decided it will be owner occupied. By adding this to the city ordinance as a conditional use, we will increase the number of potential rentals and the number of potential business licenses. It will also provide an option to residents who previously were prohibited from renting a portion of their home due to zoning requirements. Blayne Christensen, 7752 S. 2300 E., stated he is concerned about the zoning. He feels the current zoning creates certain characteristics that are different from other cities. He feels the amendment is somewhat short sited and he is in favor of keeping the ordinance “as is”. Arthello Cheney, 2279 View Drive, stated he brought this up in February. The ordinance is in both Davis and Weber Counties as well as the State. He feels with the addition of adding owner occupy, he doesn’t see this making a big difference. He stated he will not be able to remain in his home unless this ordinance is amended. He was told before he came to the city by two different individuals who are renting their homes that I shouldn’t go to the city. He feels owner occupancy is an advantage. Mr. Christensen stated he is a neighbor to Art. He stated this amendment will affect approximately 70% of the residents in South Weber City. He stated it will increase the density and traffic flow as well as the characteristics of the city. Commissioner Perkins moved to close the public hearing for Ordinance 10-06. Commissioner Stott seconded the motion. Commissioners Hyde, Grubb, Perkins, Stott, and Westbroek voted yes. The motion carried.

He stated it is already established in certain zones and he feels this will add consistency to the zones. Commissioner Perkins feels there is far more risk by allowing single family rentals that are not owner occupied. Commissioner Grubb agreed. Commissioner Perkins stated this does give us some control. Date of City Council Meeting: 22 June 2010 Title: Resolution 10-26 Interim Manager Contract In order to finalize some of the necessary work related to the water tank project and recognizing the city may need assistance at times during the transition, the council asked that I prepare a simple service contract. This contract will enable me to continue representing South Weber City as “interim manager” in negotiations with property owners, securing necessary permits and applications, presentations to the rating agencies, etc. The term of the contract is not expected to last more than two months and can be terminated at any time with seven days written notice by either party. As far as compensation is concerned I am requesting my hourly rate of $40. I have asked Steve Noel to finalize the contract and have something ready for your approval at the meeting. At the time packets went out this contract had not been finished by Steve. Staff will forward it along with the Resolution as soon as it gets completed.
