ORDINANCE No. 16-012

AN ORDINANCE MAKING APPROPRIATIONS FOR ALL CORPORATE PURPOSES FOR THE VILLAGE OF SAUK VILLAGE, COUNTIES OF COOK AND WILL, STATE OF

ILLINOIS, FOR THE 05/01/2016-04/30/2017 FISCAL YEAR

WHEREAS, the Village of Sauk Village, Counties of Cook and Will, State of Illinois (the “Village”) is a duly organized and existing village and unit of local government created under the provisions of the laws of the State of Illinois, and is operating under the provisions of the Illinois Municipal Code, as supplemented and amended, with the full power to enact ordinances and adopt resolutions for the benefit of its residents; and

WHEREAS, the Village is a municipality operating under the annual appropriation system pursuant to Section 8-2-9 of the Illinois Municipal Code (65 ILCS 5/8-2-9); and

WHEREAS, Section 8-2-9 of the Illinois Municipal Code (65 ILCS 5/8-2-9) requires a municipality with less than five hundred thousand (500,000) inhabitants to adopt and pass an ordinance appropriating such sums of money as are deemed necessary to defray all necessary expenses and liabilities of the municipality and which specifies the objects and purposes for which these appropriations are made and the amount appropriated for each object or purpose; and

WHEREAS, the annual appropriation for the 05/01/2016-04/30/2017 fiscal year (FY 2016-17) (or a formally prepared appropriation document upon which this Ordinance is based) has been and currently is conveniently available for public inspection in the Village of Sauk Village Municipal Center, the office of the Village Treasurer, the office of the Village Clerk, at the Village’s customer services desk and at the Nancy L. McConathy Public Library as required by law; and

WHEREAS, the Board of Trustees of the Village (the “Village Board”) and the Village Mayor, (the “Mayor” and with the Village Board, the “Corporate Authorities”) have held all hearings and caused all notices and publications to be posted and published in accordance with the laws of the State of Illinois; and

WHEREAS, the Corporate Authorities have reviewed the annual appropriation ordinance for FY 2016-17 (the 2016-17 Annual Appropriation Ordinance”) and have determined that said appropriations are in the best interest of the Village and the residents of the Village.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Sauk Village, Cook and Will Counties, Illinois as follows:

SECTION 1: The foregoing preambles are restated and incorporated herein by reference as though fully set forth herein. This ordinance is adopted pursuant to the authority granted to the Village by the Constitution of the State of Illinois and the Illinois Compiled Statutes. All applicable provisions of the Illinois Compiled Statutes, including the Illinois Municipal Code, as may be amended from time to time, relating to the purposes of this Ordinance are incorporated herein by this reference.

SECTION 2: There be and hereby is appropriated for corporate purposes of the Village for FY 2016-17 the sum of Sixteen Million, Six Hundred Thirty-Four Thousand, Nine Hundred and Seventeen Dollars and 00/100 and ($16,634,917.00), to be provided for by the general taxes for the years 2015 and 2016 and from other sources of revenue. The various objects and purposes for which said appropriations are herein made are set forth as follows:

SECTION 3: If any section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this Ordinance.

SECTION 4: Any ordinance or portion of any ordinance in conflict with any provisions of this Ordinance is hereby repealed solely to the extent of such conflict.

SECTION 5: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form as provided by law.

ORDINANCE NUMBER 16-013

AN ORDINANCE AMENDING THE VILLAGE CODE TO ADD SECTION 42-28 (PART TIME POLICE OFFICERS)

WHEREAS, the Village of Sauk Village, Cook and Will Counties, Illinois (the “Village”) is

a duly organized and existing municipal corporation created under the provisions of the laws of the

State of Illinois and under the provisions of the Illinois Municipal Code, as from time to time

supplemented and amended; and

WHEREAS, the Village of Sauk Village wishes to employ part time police officers; and

WHEREAS, the Illinois Municipal Code, 65 ILCS 5/3.1-30-21, requires that

municipalities employing part-time police officers shall establish hiring standards for said officers

and shall submit those standards to the Illinois Law Enforcement Training and Standards Board;

and

WHEREAS, the Mayor and Board of Trustees of the Village (the "Corporate

Authorities") may from time to time amend the text of Village Code when it is determined to be

in the best interests of the Village; and

WHEREAS, the Corporate Authorities have determined it necessary and in the best

interest of the Village to establish part-time police officer regulations as well as hiring standards

for the Village in order to maintain compliance with Illinois State Statutes.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Board of Trustees of

the Village of Sauk Village, Cook and Will Counties, Illinois, as follows:

SECTION 1. That the above recitals are found to be true and correct and are hereby

incorporated herein and made a part hereof, as if fully set forth in its entirety.

SECTION 2: Section 42-28 (Part Time Police Officers) is added to Article II (Police

Department) of Chapter 42 (Law Enforcement) of the Village Code to provide as follows:

SECTION 42-28. PART-TIME POLICE OFFICERS. A. Employment. The Village of Sauk Village may employ part-time police officers from time to

time as they deem necessary. That for the purposes of this section, part-time police officers shall be defined as those persons hired as police officers who work less than 40 hours per week and are not appointed by the police and fire commissioners.

B. Duties. A part-time police officer shall have all the responsibilities of a full-time police officer and such specific duties as delineated in the General Orders of the Village of Sauk Village Police Department, but the number of hours a part-time officer may work within a calendar year must be restricted. Part-time police officers shall not be assigned to supervise or direct full-time police officers. Part-time police officers must be trained in accordance with the Illinois Police Training Act (50 ILCS 705/1 et. seq.) and the rules and requirements of the ILETSB.

C. Hiring Standards. Any person employed as a part-time police officer must meet the following

standards:

1. Be of good moral character, of temperate habits, of sound health, and physically and mentally able to perform assigned duties.

2. Be at least twenty-one (21) years of age. 3. Pass a medical examination. 4. Possess a high school diploma or GED certificate. 5. Possess a valid State of Illinois driver’s license. 6. Possess no prior felony convictions. 7. Any individual who has served in the U.S. military must have been honorably discharged. 8. Be a U.S. Citizen 9. Be not more than 65 years of age (65 ILCS 5/10-2.1-17) 10. Submit to a criminal history investigation including but not limited to fingerprints check

and driving history and be free of criminal violations and major traffic offenses. 11. Must show proof of passing a psychological and/or physical examination including a drug

screening. 12. Must have completed 400 hours of certified training as prescribed by the state law

enforcement and standards board or eligible to receive a waiver of such training. D. Discipline. Part-time officers shall be under the disciplinary jurisdiction of the chief of police.

Part-time police officers serve at the discretion of the chief of police or his/her designee, shall not have any property rights in said employment, and may be removed by the chief of police or his/her designee at any time. Part-time police officers shall comply with all applicable rules and General Orders issued by the Police Department. Part time police officers shall serve a probationary period for one year after the completion of in-service training.

SECTION 3: If any section, paragraph, clause or provision of this ordinance shall be held

invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance.

conflict.

SECTION 5: This ordinance shall be in full force and effect from and after its passage,

approval and publication as provided by law.

ORDINANCE No. 16-014

AN ORDINANCE AMENDING SECTIONS 74-333 AND 74-338 OF DIVISION 2 (IMPOUNDMENT) OF ARTICLE XI (IMPOUNDMENT OF VEHICLES FOR

ORDINANCE VIOLATIONS) OF CHAPTER 74 (TRAFFIC AND VEHICLES) OF THE VILLAGE CODE

WHEREAS, the Village of Sauk Village, Cook and Will Counties, Illinois, is a non-home

rule municipality pursuant to the Illinois Constitution; and

WHEREAS, the Mayor and Board of Trustees have determined that the use of motor vehicles during the commission of criminal activities poses a threat to the public health, safety and welfare; and

WHEREAS, the Corporate Authorities of the Village of Sauk Village have determined that it is in the best interest of the Village and its residents that Section 74-333 and 74-338 of Division 2 (Impoundment) of Article XI (Impoundment of Vehicles for Ordinance Violations) of Chapter 74 (Traffic and Vehicles) of the Village Code regarding violations authorizing impoundment and administrative fees be amended as further set forth herein.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Board of Trustees of the Village of Sauk Village, Cook and Will Counties, Illinois, as follows:

SECTION ONE. Recitals. The foregoing recitals are adopted as express findings of the Corporate Authorities of the Village of Sauk Village and are incorporated herein by specific reference.

SECTION TWO. That Section 74-333 and 74-338 of Division 2 (Impoundment) of Article XI (Impoundment of Vehicles for Ordinance Violations) of Chapter 74 (Traffic and Vehicles) of the Village Code are amended to add the underlined language provide as follows:

74-333: IMPOUNDMENT OF MOTOR VEHICLES USED IN CONNECTION WITH ILLEGAL ACTIVITIES:

A. Violations Authorizing Impoundment: A motor vehicle, operated with the permission, express or implied, of the owner of record, that is used in connection with the following violations, shall be subject to tow and impoundment by the village, and the owner of record of said vehicle shall be liable to the village for an administrative fee in addition to any towing and storage fees, as hereinafter provided:

1. Operation or use of a motor vehicle in the commission or attempted commission of any offense for which a motor vehicle may be seized and forfeited pursuant to 720 Illinois Compiled Statutes 5/36-1 et seq., shall subject the owner to an administrative fee of five hundred dollars ($500.00).

2. Driving under the influence of alcohol, other drug or drugs, intoxicating compounds, in violation of 625 Illinois Compiled Statutes 5/11-501, shall subject the owner to an administrative fee of five hundred dollars ($500.00).

3. Operation or use of a motor vehicle in connection with the commission or attempted commission of any felony offense in violation of the provisions of the Illinois Cannabis Control Act, 720 Illinois Compiled Statutes 550/1, shall subject the owner to an administrative fee of five hundred dollars ($500.00).

4. Operation or use of a motor vehicle in connection with the commission or attempted commission of any offense in violation of the Illinois controlled substances act, 720 Illinois Compiled Statutes 570/100 et seq., shall subject the owner to an administrative fee of five hundred dollars ($500.00).

5. Operation or use of a motor vehicle in connection with the commission or attempted commission of an offense in violation of 720 Illinois Compiled Statutes 5/24-1 (unlawful use of weapons), in violation of 720 Illinois Compiled Statutes 5/24-1.5 (reckless discharge of a firearm), or in violation of 720 Illinois Compiled Statutes 5/24-3.1 (unlawful possession of firearms and firearm ammunition), shall subject the owner to an administrative fee of five hundred dollars ($500.00).

6. Driving while a driver's license, permit, or privilege to operate a motor vehicle is suspended or revoked pursuant to Section 6-303 of the Illinois Vehicle Code or a reciprocal code of another state shall subject the owner to an administrative fee of five hundred dollars ($500.00); except that vehicles shall not be subjected to seizure or impoundment if the suspension is for an unpaid citation (parking or moving) or due to failure to comply with emission testing.

7. Operation or use of a motor vehicle while soliciting, possessing or attempting to solicit or possess cannabis or a controlled substance, as defined by the Cannabis Control Act or the Illinois Controlled Substances Act, shall subject the owner to an administrative fee of five hundred dollars ($500.00).

8. Operation or use of a motor vehicle with an expired driver's license, in violation of Section 6-101 of the Illinois Vehicle Code, if the period of expiration is greater than one year, shall subject the owner to an administrative fee of five hundred dollars ($500.00).

9. Operation or use of a motor vehicle without ever having been issued a driver's license or permit, in violation of Section 6-101 of the Illinois Vehicle Code, or operation of a motor vehicle without ever having been issued a driver's license or permit due to a person's age, shall subject the owner to an administrative fee of five hundred dollars ($500.00).

10. Operation or use of a motor vehicle by a person against whom a warrant has been issued by a circuit clerk in Illinois for failing to answer charges that the driver violated Section 6-101, 6-303, or 11-501 of the Illinois Vehicle Code, shall subject the owner to an administrative fee of five hundred dollars ($500.00).

11. Operation or use of a motor vehicle in the commission of or in the attempt to commit, an offense in violation of article 16 or 16A of the Criminal Code of 1961 or the Criminal Code of 2012, shall subject the owner to an administrative fee of five hundred dollars ($500.00).

12. Operation or use of a motor vehicle in the commission of, or in the attempt to commit, any other misdemeanor or felony offense in violation of the Criminal Code of 1961 or the Criminal Code of 2012, shall subject the owner to an administrative fee of five hundred dollars ($500.00).

74-338: Administrative Fee:

If an administrative fee is imposed pursuant to this Ordinance, such fee shall constitute a debt due and owing to the Village. If a cash bond has been posted pursuant to this Ordinance the bond shall be applied to the fee. If a vehicle has been impounded when such a fee is imposed, the Village may seek to obtain a judgment on the debt and enforce such judgment against the vehicle’s owner as provided by law. Except as provided otherwise in this Section, a vehicle shall continue to be impounded until the fee is paid to the Village and any applicable towing fees and storage fees are paid to the tow company, in which case possession of the vehicle shall be given to the person who is legally entitled to possess the vehicle, or the vehicle is sold or otherwise disposed of to satisfy a judgment to enforce a lien as provided by law. If the administrative fee and other applicable fees are not paid within forty-five (45) days after an administrative fee is imposed against an owner of record who defaults by failing to appear at the hearing, the vehicle shall be deemed unclaimed and shall be disposed of in the manner provided by the Illinois Vehicle Code for the disposition of unclaimed vehicles. In all other cases, if the administrative fee and applicable fee are not paid within thirty (30) days after the expiration of time at which administrative review of the hearing officer’s determination may be sought, or within thirty (30) days after an action seeking administrative review has been resolved in favor of the Village, whichever is applicable, the vehicle shall be deemed unclaimed and shall be disposed of in the manner provided by law for the disposition of unclaimed vehicles under the Illinois Vehicle Code.

Unless stayed by a court of competent jurisdiction, any fine, penalty, or administrative fee imposed under this Section which remains unpaid in whole or in part after the expiration of

the deadline for seeking judicial review under the Administrative Review Law may be enforced in the same manner as a judgment entered by a court of competent jurisdiction. All monies collected by the village pursuant to this division shall be deposited to the Sauk Village Police Department Tow Fund to be used for the purposes of said fund including, but not limited to, police vehicle replacement and repairs, overtime pay for special unit deployments by the village's police department, tools and equipment for use by the department's narcotics and gangs units and miscellaneous expenses of the department.

SECTION THREE. If any section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this Ordinance.

SECTION FOUR. Any ordinance or portion of any ordinance in conflict with any provisions of this Ordinance is hereby repealed solely to the extent of such conflict.

SECTION FIVE. This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form as provided by law.

AN ORDINANCE AMENDING SECTION 74-192 OF THE VILLAGE CODE OF THE VILLAGE OF SAUK VILLAGE

WHEREAS, the Village of Sauk Village, Cook and Will Counties, Illinois (the “Village”) is

a duly organized and existing municipal corporation created under the provisions of the laws of the

State of Illinois and under the provisions of the Illinois Municipal Code, as from time to time

supplemented and amended; and

WHEREAS, the Mayor and Board of Trustees of the Village of Sauk Village (the

“Corporate Authorities”) may from time to time amend the text of the Municipal Code of the

Village when it is determined to be in the best interests of the Village; and

WHEREAS, the Corporate Authorities find that it is in the best interests of the health, safety

and welfare of its citizenry to amend the text of the Municipal Code of the Village to amend the

Village Code provisions regarding the regulation of towing charges and the depositing of collected

funds.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Board of Trustees of

the Village of Sauk Village, Cook and Will Counties, Illinois, as follows:

SECTION 1. That the above recitals are found to be true and correct and are hereby

incorporated herein and made a part hereof, as if fully set forth in its entirety.

SECTION 2: Section 74-192 (Towing Charges Regulated) of Article VII of Chapter 74 of

the Village Code is amended in its entirety and replaced with the following language:

Sec. 74-192. - Towing charges regulated.

(a) Reason for towing. Before a vehicle that was towed at the direction of the department for any of

the reasons set forth in the Village Code will be authorized for release to the registered owner of the

vehicle, an administrative fee in the amount specified within the Village Code, or not less than $500

if not specified, must be paid in full to the village's administrative offices during regular business

hours

(b) Fees. The fees described in this section shall be exclusive of any fees imposed by the firm that

actually towed the subject vehicle.

(c) Collected monies to be deposited in Sauk Village Police Department Tow Fund. All monies

collected by the village pursuant to this section shall be deposited to the Sauk Village Police

Department Tow Fund to be used for the purposes of said fund including, but not limited to,

overtime pay for special unit deployments by the village's police department, tools and equipment

for use by the department's narcotics and gangs units and miscellaneous expenses of the department.

The chief of the department shall prepare an accounting of all department expenditures of funds

collected pursuant to this section upon request of the village's corporate authorities or upon request

of the authorized village official.

SECTION 3: If any section, paragraph, clause or provision of this ordinance shall be held

invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance.

SECTION 4: All ordinances in conflict herewith are hereby repealed to the extent of such

conflict.

SECTION 5: This ordinance shall be in full force and effect from and after its passage,

approval and publication as provided by law.

AN ORDINANCE ADOPTING THE PREVAILING WAGE STANDARDS IN THE VILLAGE OF SAUK VILLAGE, COOK AND WILL COUNTIES, ILLINOIS

WHEREAS, the State of Illinois (the “State”) has enacted the “Prevailing Wage Act,”

820 ILCS 130/1 et seq. (the “Act”) which is an Act regulating wages of laborers, mechanics and

other workers employed in any public works by the State, county, city or any public body or any

political subdivision or by anyone under contract for public works; and

WHEREAS, it is the policy of the State that a wage of no less than the general prevailing

hourly rate, as paid for work of a similar character in the locality in which the work is performed,

shall be paid to all laborers, mechanics and other workers employed by or on behalf of any and all

public bodies engaged in public works; and

WHEREAS, the Act requires that the Village of Sauk Village investigate and ascertain the

prevailing rate of wages, as defined in the Act, for laborers, mechanics and other workers in the

locality of said Village of Sauk Village, employed in performing construction of public works for

said Village; and

WHEREAS, the Village of Sauk Village has ascertained and examined the prevailing

wage classifications and rates determined by the Department of Labor for Cook and Will Counties

for July 2015, which is the last available date wage rates were published by the Department of

Labor.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the

Village of Sauk Village, Cook and Will Counties, Illinois, as follows:

Section 1. That the above recitals and legislative findings are found to be true and correct

and are hereby incorporated herein and made a part hereof, as if fully set forth in their entirety.

Section 2. To the extent and as required by the Act, the general prevailing rates of wages in

the Village of Sauk Village for laborers, mechanics and other workers engaged in construction of

public works coming under the jurisdiction of the Village of Sauk Village is hereby ascertained to

be the same as the prevailing rate of wages for construction work in the Cook and Will Counties

areas, as determined by the Department of Labor of the State of Illinois as of the last available date

wage rates were published by the Department of Labor, a copy of said determination is being

attached hereto and made a part hereof as Exhibit A.

Section 3. As required by the Act, any and all revisions of the prevailing rate of wages by

the Department of Labor of the State of Illinois shall supersede the Department’s July prevailing

rates and apply to any and all public works construction undertaken by the Village of Sauk Village

and that definition of any terms appearing in the Ordinance, which are also used in the Act, shall

be the same as in the Act.

Section 4. Nothing herein contained shall be construed to apply the prevailing rate of

wages as herein ascertained to any work or employment except public works of the Village of

Sauk Village to the extent required by the Act.

Section 5. The Village Clerk shall publicly post this determination or any revisions of such

prevailing rate of wages, and keep it available for inspection at the Village Hall by any interested

party. A copy of the determination or of the currently revised determination of the prevailing rate

of wages then in effect shall be attached to all contract specifications.

Section 6. The Village Clerk shall mail a copy of this determination to any employer, and

to any association of employers and to any person or association of employees who have filed or

file their names and addresses, requesting copies of any determination stating the particular rates

and the particular class of workers whose wages will be affected by such rates.

Section 7. The prevailing rate of wages as determined herein, or as subsequently revised,

shall be included in every contract for public works, and all ordinances, resolutions, calls for bids

and bid specifications relating to any public work shall state or provide that any person

performing any public works on behalf of the Village of Sauk Village shall be required to pay the

prevailing rate of wages to all laborers, mechanics and other workers employed for such public

works. All contractors’ bonds, provided by any contractor on any public works for the Village of

Sauk Village shall provide a guarantee that the contractor will faithfully perform his obligations

to pay the prevailing rate of wages as provided by the contractor for such projects and in

accordance with the Act.

Section 8. The Village Clerk shall promptly file a certified copy of this Ordinance with

the Secretary of State of Illinois, Index Department.

Section 9. The Village Clerk shall cause a notice to be published in a newspaper of

general circulation within the Village and such publication shall constitute notice that the

determination is effective and that said publication shall constitute notice that this is the

determination of the Village and it is effective.

Section 10. If any section, paragraph, clause or provision of this Ordinance shall be held

invalid, the invalidity thereof shall not affect any of the other provisions of this Ordinance.

Section 11. All ordinances in conflict herewith are hereby repealed to the extent of such

conflict.

WHEREAS, the Corporate Authorities find it in the best interests of the Village to approve

the intergovernmental agreement to establish a joint 9-1-1 authority, to be known as CALCOMM.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Board of Trustees of

the Village of Sauk Village, Cook County, Illinois, as follows:

SECTION 1: That the Intergovernmental Agreement to Establish a Joint 9-1-1 Authority,

in substantially the form attached hereto, is hereby approved for and on behalf of the Village. The

Mayor and the Village Clerk are hereby authorized to execute the same for and on behalf of the

Village.

ORDINANCE No. 16-021

AN ORDINANCE FOR THE LEVY AND ASSESSMENT OF TAXES FOR THE

2016/2017 FISCAL YEAR FOR THE VILLAGE OF SAUK VILLAGE, COUNTIES OF

COOK AND WILL, ILLINOIS

WHEREAS, the Village of Sauk Village, Cook and Will County, Illinois (the AVillage@)

is a duly organized and existing municipal corporation created under the provisions of the laws of

the State of Illinois and under the provisions of the Illinois Municipal Code, as from time to time

supplemented and amended; and

WHEREAS, the Mayor and Board of Trustees have determined that it is advisable,

necessary and in the best interests of the Village to levy and assess taxes for the 2016/2017 fiscal

year; and

WHEREAS, in connection with the adoption of its tax levy, the Village has complied with

Sections 18-60 through 18-85 of the Illinois Truth in Taxation Law (35 ILCS 200/18-60 through

35 ILCS 200/18-85), the Open Meetings Act (5 ILCS 120/1, et seq.) and all other applicable state

and local laws.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the

Village of Sauk Village, Cook and Will Counties, Illinois, as follows:

Section 1. That the above recitals and legislative findings are found to be true and correct

and are hereby incorporated herein and made a part hereof, as if fully set forth in their entirety.

Section 2: The total amount of appropriations for all corporate purposes legally made to be collected from the tax levy of the current fiscal year is hereby ascertained to be the sum of Two Million, Three Hundred Twenty Seven Thousand, Eight Hundred Seventy and 36/100 Dollars ($2,327,870.36). Section 3: The sum of Two Million, Three Hundred Twenty Seven Thousand, Eight Hundred Seventy and 36/100 Dollars ($2,327,870.36) being the total appropriations heretofore legally made that are to be collected from the tax levy of the current fiscal year of the Village for all corporate purposes of the Village, for purposes of providing for a Police Pension Fund, Fire Fighters’ Pension Fund and such other corporate purposes as permitted by statute as set forth on Exhibit “A”, which is attached hereto and incorporated herein by reference, as appropriated for the current fiscal year by the annual appropriation Ordinance of the Village for the fiscal year 2016/2017, passed by the President and Board of Trustees at a legally convened meeting, be, and the same is hereby levied upon all of the taxable property in the Village subject to taxation for the current year, the specific amounts as levied for the various funds heretofore named being included

in Exhibit “A”, the tax so levied being for the current fiscal year of the Village, and for said appropriation to be collected from said tax levy, the total of which has been ascertained as aforesaid and being as provided in Exhibit “A”, as if fully set forth herein. Section 4: The total amount of Two Million, Three Hundred Twenty Seven Thousand, Eight Hundred Seventy and 36/100 Dollars ($2,327,870.36) ascertained above, be and is hereby levied and assessed on all property subject to taxation within the Village. Section 5: There is hereby certified to the Cook County Clerk and to the Will County Clerk the total amount of Two Million, Three Hundred Twenty Seven Thousand, Eight Hundred Seventy and 36/100 Dollars ($2,327,870.36) which total amount the Village requires to be raised by taxation for the current fiscal year of the Village, and the Village Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Cook County Clerk and the Will County Clerk. Section 6: If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance Section 7: All ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 8: This ordinance shall be in full force and effect following its passage, approval and publication in the manner required by law.

Pursuant to Section 8-3-1 of the Illinois Municipal Code (65 ILCS 5/8-3-1), the Village of Sauk Village, a municipality with corporate limits lying partly in Cook County and partly in Will County, does hereby certify that it has attempted to ascertain the total amount of all taxable property lying within the corporate limits of the Village of Sauk Village in Cook County and Will County, as the property is assessed or equalized by the Department of Revenue for the current year. The Village of Sauk Village does hereby further certify that it has been advised by the Illinois Department of Revenue that the Illinois Department of Revenue has not completed the 2016 assessment or equalization of said taxable property.
