Commissioners Court

The members of Commissioners Court desire toundertake all necessary and reasonable steps toensure that disadvantaged, minority-owned andwoman-owned businesses (“D/M/WBEs”) areafforded equitable opportunities to participate inlocal government and other contracts within therelevant marketplace from which the Countyroutinely purchases goods and services.

The County is keenly interested in ensuring thatour public contracting and purchasing funds arenot spent in a manner that in any way contributesto or perpetuates the effects of marketplacediscrimination.

SMWBE/DBE PoliciesSmall, Minority and Women Owned Business Enterprises (SMWBE) Program

Bexar County is committed to increasing the involvementof SMWBEs in the procurement process. It is the intent ofthe County to afford SMWBE a fair opportunity tocompete for all Bexar County contracts. Similarly, theCounty promotes SMWBE participation in its Tax Phase-inProgram to support the growth and diversity of a regionaleconomy.

Disadvantaged Business Enterprise (DBE) Program

On March 12, 2007 Commissioners Court adopted theTexas Department of Transportation (TXDOT) Local AreaManagement Agreement. Under this Agreement, the Countyis required to established a Disadvantaged BusinessEnterprise (DBE) program in accordance with regulationsof the U.S. Department of Transportation (DOT), 49 CFRPart 26.

Bexar County is committed to increasing the involvement of SMWBE in itsprocurement process. Similarly, the County promotes SMWBE participation inits Tax Phase-in Program to support the growth and diversity of a regionaleconomy.

The Commissioners Court, through its County offices, will closely monitorparticipation rates of minority and women-owned and small businessenterprises for maximum practicable receipt of Bexar County procurementdollars in the areas of Commodities, Equipment, Services, Maintenance,Professional Services and Construction.

Historical data indicates that minority and women-owned businesses arecapable of performing work for 20% of those dollars and that all smallbusinesses are capable of performing as much as 30% of that business.

SMWBE Program Credibility

What are the objectives?

• To assist in the development of firms that can compete successfully in the marketplace

• To help remove barriers to the participation in contracts • To provide appropriate flexibility in establishing and providing

opportunities• To ensure non-discrimination in the award and administration of

contracts• To ensure that the County’s program is narrowly tailored in

accordance with applicable law, if there is a third party burden • To ensure that only firms that fully meet the certification eligibility

standards are reported as SMWBEs or DBEs

Oversight

The Small, Minority and Women Owned Business Enterprise (SMWBE) ProgramAdvisory Committee functions only in an advisory capacity and makesrecommendations to the Commissioners Court on various issues and policiesconcerning and impacting the SMWBE Program and its activity.

The committee is composed of 15 members: 3 members being appointed by eachmember of Commissioners Court.

Qualifications: Bexar County resident or representative of a local business enterprise oradvocacy organization.

The Advisory Committee is composed of four Subcommittees: Policy, Opportunities, Outreach

and Vendor Certification

S/M/W/DI/V/DBE Certification

“Certification”

A designation as a HUB, SBE, MBE, DBE, or WBE awarded by any authorizedagency that a company is a for-profit independent operating business that is atleast 51% owned, operated and controlled by minority person (s) and/or a womanor women. The ownership by minorities and women must be real and substantial.

“Certification Agency”

An authorized local, state, federal or private sector entity that providescertification services, which consist of vendor submittal of a certificationapplication with supporting documentation, review, and often a personal interviewor site visit to validate claims of SMWBE status.
