1. Summary Centro Independence LLC requested KHarts Consultants to conduct a Phase I Environmental

Site Assessment (ESA) of the property Wachovia Bank located at 3750 Oleander Drive, Wilmington, NC 28403. This property will be named “the subject property” in this report. This assessment was prepared in general accordance with the American Society of Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM Designation: E1527-05). The purpose of the Phase I ESA was to identify any potential sources of environmental risk or liability on the subject property. This assessment included a site reconnaissance as well as research and interviews with representatives of local and state agencies.

The subject property is a 0.9813 acre tract located at the southwest corner at the intersection of Oleander Drive and Floral Parkway. The subject property is located in neighborhood 6171, classed Commercial, with the land use code 601-Finance Banks. The Zoning is RB for regional business. The current property use is finance bank. The following buildings and structures are located on the subject property:Age No. of Stories Usage Construction15 years 1 Finance Bank Brick building with a wood frame and a

The results of this assessment have revealed the following current recognized environmental conditions associated with the property:

Reported leak from UST on adjacent properties to the east, north, and west Drums on the subject property that could contain hazardous substances or petroleum

products Soil vapor extractor on the subject property 12 monitoring wells on the subject property 8 clean-up wells on the subject property

The results of this assessment have revealed that the subject property is a voluntary remediation site that is undergoing clean-up. The impact on the property of the current recognized environmental conditions identified in the Findings section of this report are:

Petroleum leaked from adjacent properties could have impacted surrounding soil and potentially the groundwater on the subject property.

In our professional opinion it is recommended that the following additional investigation be conducted to detect the presence of hazardous substances or petroleum products on the subject property:

Soil and groundwater testing should be conducted to determine if they have been impacted.

The data gaps and failures are also listed in the Findings. No additional services beyond the scope of the ASTM Standard 1527-05 were conducted as part of this assessment.

2. Introduction

Centro Independence LLC requested KHart Consultants to conduct a Phase I Environmental

Site Assessment (ESA) of the property Wachovia Bank located at 3750 Oleander Drive,

Wilmington, NC 28403. This property will be named “the subject property” in this report. This

assessment was prepared in general accordance with the American Society of Testing and

Materials (ASTM) Standard Practices for Environmental Site Assessments: Phase I ESA Process

(ASTM Designation: E1527-05).

The purpose of the Phase I ESA was to identify any potential sources of environmental risk

or liability on the subject property. This assessment included a site reconnaissance as well as

research and interviews with representatives of local and state agencies.

The scope of work for this assessment was in general accordance with the American Society

of Testing and Materials (ASTM) Standard Practices for Environmental Site Assessments: Phase I

ESA Process (ASTM Designation: E1527-05). These methodologies are described as representing

good commercial and customary practice for conducting an ESA of a property for the purpose

of identifying recognized environmental conditions.

While this report provides an overview of potential environmental conditions, the

environmental assessment is limited by the availability of information at the time of the

assessment. Unreported waste disposal or illegal activities may have impacted the

environmental status of the subject property that could not be identified. The conclusions and

recommendations regarding environmental conditions are based on ASTM standard practices;

however, it is virtually impossible to identify all contaminants or all conditions above and below

ground.

3. Site Description

The subject property is located at 3750 Oleander Drive in Wilmington, North Carolina. The

subject property is within the City of Wilmington in New Hanover County. The subject property

is a 0.9813 acre tract located at the southwest corner at the intersection of Oleander Drive and

Floral Parkway (Please see Figure 1 in the appendix). Oleander Drive is a six lane road and

Floral Parkway is a four lane road. The parcel is rectangular in shape, with 228 feet along

Oleander Drive, and 195 feet along Floral Parkway. The parcel ID is R05517-008-009-003. The

subject property is located in neighborhood 6171, classed Commercial, with the land use code

601-Finance Banks. The Zoning is RB for regional business. On the parcel is a single story

building built in 1995. The building itself is 6,706 square feet including an attached canopy of

2,280 square feet.

The building has a slab brick construction. It is currently being used as a bank. The vicinity

includes other commercial buildings such as a large shopping mall, fast food restaurants,

grocery stores, and auto repair shops. The subject property uses natural gas heating and has

different water sources for drinking water and irrigation water from the City of Wilmington.

The adjoining properties include Independence Mall to the west, with large tracts of paved

parking lot spaces (Please see Figure 2 in the appendix). The six lane Oleander Drive is

immediately north of the subject property with a large commercial complex on the other side

of Oleander Drive. The two buildings closest to the subject property within the commercial

complex are a fast food restaurant and a bank. To the east of the property is the four lane Floral

Parkway. On the other side of Floral Parkway is a parking lot for another large commercial

complex. The parking lot provides parking spaces for a large grocery store, hair salon, and a

vacant office building. To the south of the property are more parking lots for Independence

Mall and further down Floral Parkway there are single family residential homes.

4. User Provided Information

The user provided the address of the subject property and the current deed number. The

user also provided access to the subject property for site reconnaissance. The subject property

is currently owned by Centro Independence LLC and is currently occupied by Wachovia Bank.

The Phase 1 ESA was prepared by KHart Consultants at the request of the client. This Phase 1

ESA was requested for the following reasons:

Sale of the property for another commercial use

5. Records Review

The purpose of the records review was to obtain and review records that will help identify

recognized environmental conditions that could be a concern for the property. Some records

reviewed include the subject property as well as properties within an additional approximate

minimum search distance. This was done to help assess the likelihood of problems from

migrating hazardous substances or petroleum products. The approximate minimum search

distances used below were as specified in the ASTM Standard 1527-05.

6. Site Reconnaissance

The purpose of the site reconnaissance is to obtain information about the likelihood of

recognized environmental conditions in connection with the property. The subject property was

inspected by Katie Hart on November 20, 2010. There was little wind and mostly sunny skies. All

exterior areas of the subject property were accessible at the time of the inspection. There were

no visual or physical obstructions of the subject property. The current property use is financial

bank. There are no Recognized Environmental Condition (RECs) associated with the current

property use. The past property use was also a financial bank which has no associated

Recognized Environmental Conditions. The two tables below show the current and past uses of

the adjoining property.

The topography of the property is relatively flat with an elevation of 41 feet (Please see

Figure 2 in the appendix). The southeast and central areas of the property are high spots, with

a very gentle slope down. The topography of the surrounding area is also relatively flat. Based

on the topography and likely presence of hazardous substances or petroleum products on

adjoining property, there is a possibility that these substances could migrate to the subject

property and into the groundwater or soil. Petroleum products from LUST (Leaking

underground storage tanks) could migrate to soil around storage tanks and to nearby creeks.

The brick building has a wood frame and a concrete vault on a slab (Please see Photograph

5 in the appendix). There is an outdoor enclosed brick area with a locked fence that controls

the power source with two heat pumps. The natural gas is stored in the locked brick enclosure

on the south side of the building (Please see Photograph 6 in the appendix). There is also a

wooden enclosure for the trash dumpster on the south side of the building. No strong, noxious

odors are detected in the area. There is no standing surface water on the property.

There are drums on the property that could contain hazardous substances or petroleum

products (Please see Photograph 7 in the appendix). There is also a fenced area that contains a

soil vapor extractor, indicating a remediation site (Please see Photograph 8 in the appendix).

Throughout the property there are 12 monitoring wells and 8 clean-up wells (Please see

Photograph 9 in the appendix). Some of the wells are located right next to each other in a row.

These wells are most likely drilled to different depths to test different aquifers. The presence of

the wells indicates current or past contamination on the subject property. There are also two

stormwater drains that drain north to south. Across Floral Parkway there is another fenced in

area with a shed (Please see Photograph 10 in the appendix). This may indicate another clean-

up or remediation site on the adjoining property to the east.

There are various transformers nearby and utility poles along the edges of the property. The

past use of PCBs in electrical equipment was common, with less than 50 ppm of PCBs

considered “Non-PCB”; between 50 and 500 ppm is considered “PCB-Contaminated”; and

greater than 500 ppm is considered “PCB”. No electrical or hydraulic equipment known or likely

to contain PCBs were observed on the property.

No pits, ponds, or lagoons were observed on the property or the adjoining properties. No

areas of stained soil or stained pavement were observed on the property. No areas of stressed

vegetation were observed on the property. There was no waste water or other liquids being

discharged into a drain, ditch, or stream on or adjacent to the property. No septic systems or

cesspools were observed on the property.

I did not have access to the interior of the building, therefore I cannot determine the

presence of Recognized Environmental Conditions inside the building. The following form was

Herman Born has information about permits and hazardous materials around the subject

property. He has permits for previous gas stations across Oleander Drive and across Floral

Parkway on adjacent properties. He also has permits for garages in Sears and AAA which are

adjacent to the property. Mr. Born has no records of hazardous materials or tanks on the

subject property. He has records of several small automobile accidents on Oleander Drive with

spills of a few gallons of oil, gas, and antifreeze.

Bruce Reed has records of monitoring wells on the subject property as part of a remediation

system for a previous Fast Fare gas station (3800 Oleander Drive) on the same side of Oleander

Drive across Floral Parkway. The Fast Fare site had a big problem with leaking tanks that caused

soil and groundwater contamination. When the state fund became bankrupt in 1998, the Fast

Fare site was declared low risk and cleanup was stopped.

Diane Harvell has local records of contaminated wells. She said further down Floral Parkway

by the residential properties, there were complaints of foul odors in the wells. The foul odors in

the water stopped when those residences were connected to city water. All of the wells in that

area are now used only for irrigation.

8. Findings and Data Gaps/Failures

Based on the information gathered and on observations made during this investigation, the

Phase I Environmental Site Assessment has revealed the following environmental conditions

associated with the subject property:

There is evidence that the subject property has or had contaminated groundwater. The

contamination likely came from nearby leaking underground storage tanks. The subject

property is also a voluntary clean-up site.

There are multiple data gaps since KHart Consultants were not given permission to view the

interior of the building. We also could not see the soil on the subject property since most of the

land was paved for a parking lot. We had data failure due to the intervals of aerial photographs.

Aerial photographs were not taken every five years and older photographs were of poor

quality. There were no Sanborn maps for our subject property, either.

9. Opinion

Based on the results of the Phase I Environmental Site Assessment of the subject property,

the following further investigation is recommended at this time.

Collect groundwater samples from the monitoring wells and analyze for BTEX and MTBE

Collect soil samples and analyze for traces of gasoline

Based on the results of the Phase I Environmental Site Assessment of the subject property, a

Phase II Environmental Site Assessment is not recommended at this time unless further testing

of groundwater and soil samples are severely contaminated. Remediation and clean-up is

recommended to continue with monitoring. Since the adjacent properties are no longer gas

stations, the subject property has a moderate risk of contamination.

10. Conclusions

Khart Consultants has performed a Phase I Environmental Site Assessment in conformance

with the scope and limitations of ASTM Practice E1527-05 of 3750 Oleander Drive, the subject

property. This assessment has revealed evidence of a recognized environmental condition

including leaking underground storage tanks on adjacent properties and clean-up wells,

monitoring wells, and a soil vapor extractor on the subject property. KHart Consultants

recommends further testing of the groundwater and soil to determine the extent of

contamination. However, the ultimate assumption of risk lies with the buyer.
