General Terms and Conditions for Building Society Retail Savings Accounts

1 Introduction

1.1 The terms and conditions (referred to as the “Conditions”) apply to all savings accounts with the Society, except if they are inconsistent with special conditions for particular accounts (in which case, those special conditions will apply). Special account conditions are documented in the individual account Terms & Conditions, which you will have received at the time of your initial enquiry.

1.2 In the Conditions:

•“theSociety”,“we”,“us”and“our”refertoBathBuildingSociety;

•“you”and“your”refertoholdersofsavingsaccounts,and

•“workingday”meansadayotherthanaSaturday,Sundayorbankholiday.

1.3 If you are a company, other form of corporation, partnership or unincorporated body(suchasaclub),pleaserefertoCondition22.

2 Membership

2.1 If these Conditions apply to your account you will (except where the account is a depositaccount)beaMemberoftheSocietyandthereforeourRuleswillapply.However, these Conditions, or any relevant special conditions for a particular account,willoverridetheRulesinthecaseofanyinconsistency.AcopyoftheRulesisavailableonrequestatanyofourBranchesoratourHeadOffice.

2.2 Ifyouhaveadepositaccount,youarenotaMemberoftheSocietybyvirtueofthataccount.Youare,however,boundbysomeofourRules.

2.3 New saving Members are subject to the Society’s Charitable AssignmentScheme,fulldetailsofwhicharesetoutinourSavingsAccountsbrochure.

2.4 If your account becomes overdrawn then, unlesswe have consented to theamount of the overdrawing, youwill stop being aMember in respect of theaccount as long as the account is overdrawn.

3. Opening an account

3.1 Wewillrequireevidenceofidentityandaddressbeforeanaccountisopened.If we receive money without evidence of identity that is satisfactory to us, then we may return the money or retain it pending instructions from any relevant authority.

3.2 Once you have opened an account, you have 14 days after the contract isentered into (or, if later, 14 days from the day you first receive, on paper orelectronically, these terms and conditions and other information relating to the account)tonotifyusinwritingatourHeadOfficethatyouwanttochangeyour

mind. If you notify us within this time, we will help you switch to another of ouraccountsor(assumingwehavereceivedclearedfunds)giveyoubackyourmoney together with any interest it has earned. We will ignore any notice period and any extra charges. Please note that this Condition 3.2, and the option to changeyourmind,donotapplytofixedrateaccounts(otherthanafixedratecashdepositISA),ortoaccountswherethepricedependsonrisesandfallsinfinancialmarketsoutsideourcontrol thatmayhappenduringthecancellationperiod (in other words, not sold at a distance).

Ifyoudonotexerciseyourrighttochangeyourmind,youwillcontinuetobeboundbythesetermsandconditionsandanyspecialconditionsthatapplytothe particular account.

4 Account Details

4.1 Theaddressthatyouprovideintheapplicationformfortheaccountwillbetheregistered address for you, and will remain the registered address for you until it is changed in our records.

4.2 It isyourresponsibilitytonotifyusofanychangeofaddress.Youshouldalsonotifyusofanychangeoftelephonenumberandemailaddress(ifyouhavetoldusyouwanttobecontactedinthisway).Allnotificationsmustbeinwriting.

4.3 Youagreetoproduceanyproofofnewnameoraddress,ifweasktoseeit.

4.4 Youagreetoprovideuswithspecimensignatures,ifweaskforthem.

4.5 Ifyouhavemorethanonesavingsaccountwithus,youmustmakesurethattheregistered address we have for you is the same in respect of each account.

4.6 If you loseyourpassbookandat,orabout thesame timeyounotifyusofachangeofaddress,wewill not issueanycheques from theaccountpayabletoanyoneotherthanyouforaperiodof14daysfromthedatewereceivethenotification.Thisistohelpprotectyouagainstpossiblefraud.

4.7 Youraccountwillhaveauniquenumber.Pleasequotethisincorrespondencewith us.

5 Minimum and maximum account balances

5.1 Theminimumandmaximumamountsthatcanbeheldinanyparticularaccountare set out in the special conditions for that account.

5.2 We can close an account if the amount in it is below theminimum for thataccount.Wewillgiveyouatleast30days’noticebeforedoingthis.Duringthisperiod,youcanpayinmoremoneytobringthebalanceuptotheminimum

6 Paying money into your account

6.1 Unless special conditions for a particular account specify otherwise, you can generallypaymoneyintoyouraccountatanyofourBranchesorHeadofficeduringournormalopeninghours (09:00hours to17:00hours)onaworkingday,oralternativelybybanktransferorpost.However,forsecurityreasonswedo not accept cash sent by post. Please seeCondition 7.2 regardingwhen

interest becomes payable. However please note that some of our Brancheshaverestrictedopeninghours(seeourwebsitewww.bathbuildingsociety.co.ukfor full details).

6.2 Ifyouarrangeformoneytobepaidintoyouraccountbybanktransfer,itisyourresponsibilitytoensurethatallyouraccountdetailsareprovidedcorrectly.

6.3 For security reasons, we reserve the right to refuse to accept large sums of money in notes or coins.

6.4 Youcanpaymoneyintoyouraccountbystandingorder(althoughyouwillneedtosetthisupdirectwithyourbank).Wecannotsetupstandingordersordirectdebitsoutofyouraccount.

6.5 ChequesmadepayabletotheSocietywillonlybeacceptedforpayment intoan account if they contain additional details (such as the name(s) of the account holder(s)ortheaccountnumber),sothatitisclearwhothemoneyisintendedfor.

6.6 Whenpaying inmoneybycash, youwill need toproduceyourpassbookorprovideyouraccountnumber.

6.7 Moneypaidintoyouraccountbycashorelectronictransferwillbeavailableforwithdrawal immediatelyafterwereceive it,subjecttoCondition9. Anysumsreceived by us outside normal business hours or on a non-working daywillbetreatedashavingbeenreceivedwhenwearenextopenforbusinessonaworkingday.PleaseseeCondition10belowregardingcheques.

7 Interest

7.1 We will tell you the interest rate that applies to your account (and when it is paid orcredited)whenyouopenit.Thisinformationisavailable:

•inourspecificproductTerms&Conditionssheets;

•onourwebsitewww.bathbuildingsociety.co.uk

•byaskingourstaffinourBranchesandAgencyOffices.

7.2 Onouraccountswegenerally:

•calculateinterestonasumdepositedincashorbyelectronictransferfromthedaywereceiveit.Anysumsreceivedbyusoutsidenormalbusinesshoursoronanon-workingdaywillbetreatedashavingbeenreceivedwhenwearenextopenforbusinessonaworkingday;

•calculateinterestonasumdepositedbychequefromthedaywereceiveit;

•calculateinterestonasumwithdrawnuptoandincludingthedaybeforeyoumakethewithdrawal;

•give you the choice of having the interest added to the account, paid intoanotheraccountwithus,orpaidintoyourbankaccount.

However,thismayvarydependingonthetypeofaccount.Youshouldcheck the special conditions for particular accounts. Further details of how and when interestispayableiscontainedinourindividualaccountTerms&Conditions.

7.3 Subjecttoanyspecialconditionsthatapplytoparticularaccounts(forexample,fixed rate or tracker accounts), we can change interest rates as set out inConditions7.4to7.6below.

7.4 Wemaychangeinterestratesatanytimeifwereasonablybelievethatthechangeis needed for any of the following reasons (which may relate to circumstances existing at the time or those that are expected to apply in the near future):

•torespondtochangesintheBankofEnglandbank(base)rateormortgageorinterestratesgenerally(includingtheinterestratespaidonsimilaraccountsbyotherprovidersoffinancialservices);

•torespondtochangesinthelaworthedecisionofacourtorombudsman;

•tomeetrelevantregulatoryrequirements;

•torespondtonew(orchangesto)statementsorcodesofpracticeorindustryguidancedesignedtoenhanceconsumerprotection;

•torespondtochangestoourcosts,includingadministrationcostsandcostsof providing services or facilities.

Anychangewemaketointerestrateswillbeproportionatetothecircumstancesgiving rise to the change.

7.5 We can also change the rate of interest for any valid reason (other than a reason mentionedabove)wherewereasonablybelievethechangeisappropriate.

7.6 Exceptwheretheaccountisafixedtermaccount,wecanalsochangetherateofinterestbynotifyingyoupersonallybeforethechangecomesintoeffect.

7.7 Changesmayincludetheintroductionoralterationof“bands”underwhich:

•interestisnotpaidwheretheamountintheaccountisbelowacertainlevel,and/or

•differentratesapplydependingontheamountintheaccount.

7.8 Wherethechangeisanincreaseintheinterestratewewilltellyouaboutit:

•byplacingnoticesinourBranchesandonourwebsite:www.bathbuildingsociety.co.uk (exceptforaccountsthatarenotrunthroughourBranches),or

•within 30 days of the change, by letter if your account is postal or otherpersonal notice such as email or secure messaging.

7.9 Where the change is a reduction in the interest rate we will give you written notificationofthechangenotlessthan30daysbeforeitcomesintoeffect.

This does not apply to:

•interestratetiersapplicabletobalancesbelowtheminimumoperatingbalancefortheaccount(providedwehaveclearlytoldyouabouttheminimumbalancerequirements), or

•fixedrateortrackeraccounts;

•ifthechangeisnotmaterial.

Forthispurpose,achangeis“material”ifyouraccounthasabalanceof£500ormoreatthetimethedecisionistakentochangetheinterestrate,and:

•thereductionismorethan0.25%,or

•the reduction is 0.25% or less and this will result in there having been acumulative downward movement of the accounts interest rate over the preceding12monthsof0.50%ormore.

Wherethereductionisnotmaterial,wewilltellyouaboutitviaoneofthewaysmentionedincondition7.8.

7.10 IfwenotifyyouofamaterialreductionintheinterestrateunderCondition7.9,orifthechangeismadeundercondition7.6theneither:

•thenotificationwillbeprovidedatleast14daysbeforetheratechange.Youwillthenhaveaperiodof30daysfromthedateofthenotificationduringwhichyou may close or switch your account without having to give any period of notice or having to lose any interest or pay additional charges, or

•the notification will be provided at least 14 days plus the period of noticeapplicabletotheaccount.(or30daysiflongerthanthenoticeperiod)beforetheratechange.Inthiscasethenormalnoticeperiodformakingwithdrawalsfrom or closing the account will apply.

7.11 Ifyoudonotnotifyusthatyouobjecttoachangebeforethedateonwhichitcomesintoeffect,youwillbedeemedtohaveacceptedit.

7.12 Theinformationonourwebsitewillbeupdatedwithinthreeworkingdaysofaninterest rate change.

8 Account charges

8.1 Wedonotmakecharges for itemsrelatingto thedaytodayrunningofyouraccount.

8.2 Where a charge does not relate to the day to day running of your account we will tellyoubeforeweprovidetheproductorservice(exceptforchargesinrespectofunpaidcheques),oratanyothertimeyouask.However,wemaychargeforproductsorservicesrelatingtoyouraccount.Wewilltellyouaboutthesebeforewe provide the product or service. These charges are contained in the Tariff of Charges,whichcanbefoundinourSavingsAccountsBook.

8.3 Chargesincurredwillbedebitedtoyouraccount.

8.4 Wecanchangethechargeswemakeatanytimeifwereasonablybelievethatthe change is needed for any of the following reasons (which may relate to circumstances existing at the time or those that are expected to apply in the near future):

•torespondtochangestoourcosts,includingouradministrativecosts;

•torespondtochangesinthelaworthedecisionsofacourtorombudsman;

•tomeetrelevantregulatoryrequirements;

•torespondtonew(orchangesto)statementsorcodesofpracticeorindustry guidance designed to enhance consumer protection.

Anychangewemaketoourchargeswillbeproportionatetothecircumstancesgiving rise to the change.

8.5 Wecanalsochangethechargeswemake foranyvalid reason (other thanareasonmentionedabove)wherewereasonablybelievethechangeisappropriate.

8.6 Changes may include the abolition or alteration of existing charges or theintroduction of new charges.

8.7 Ifweintroduceorincreaseachargerelatingtotheday-to-dayrunningofyouraccount, wewill give you at least 30 dayswritten notice before the changecomes into effect.

8.8 IfwegiveyounoticeofachangeunderCondition8.7then,atanytimeuptothedate the change comes into effect, 30 days after the date of the notice, you have the right to switch the account or close it without having to lose any interest or pay any additional charges.

8.9 Ifyoudonotnotifyusthatyouobjecttoachangebeforethedateonwhichitcomesintoeffect,youwillbedeemedtohaveacceptedit.

8.10 Theremaybeothertaxesorcoststhatarenotpaidthroughusorchargedbyus.

9 Withdrawals

9.1 Withdrawalsmaybemadeduringournormalbusinesshoursonworkingdays,subject to the special conditions for particular accounts and to our branch/agencywithdrawallimitswhicharesetoutinourSavingsAccountsBooklet.

9.2 Nowithdrawalwillbeallowed:

•ifitwouldcausetheaccounttobeoverdrawn,or

•fromapassbookaccount,unlessyouproducethepassbookatthetimeofwithdrawal.

9.3 Wemay refuse toallowawithdrawal ifwearenotsatisfied thatwehave theproper written authority for the withdrawal, in accordance with the mandate you havegivenus.Inordertomakeawithdrawalwewillrequireoneofthefollowing:

•Asignedwithdrawalform;

•Asignedletterofauthority;

•Aninstructionbyemailaslongasweholdasignedemailauthorityform;

•Aninstructionthroughonlinesecuremessage.

9.4 Wecanrestrictatanytimetheamountwhichcanbewithdrawnfromanyaccount.

We will only do this if:

(a)wereasonablybelievethattheremaybefraudulentactivityorotherfinancialcrimeaffectingtheaccount;

(b)wearerequiredtodosobyanylaw,regulationorcourtorder;

(c)thereisadispute(whichwereasonablybelievemaybegenuine)abouttheownershipof,orentitlementto,themoneyintheaccount;

(d)circumstances beyond our reasonable control prevent us from offering anormal service (such as in the event of terrorist threat, computer systems failureorstrikes),or

(e)circumstancesexistwhichleadusreasonablytobelieveourfinancialstabilityisunderthreat(suchaswhererumourscauseactualorpotentialabnormallevels of cash withdrawals).

Inthecaseof(d)and(e)above:

(i)wewillactproportionatelytothecircumstancesinquestion;

(ii)wewill takeall reasonablestepstoensurethattherestrictionsare liftedassoonaspracticableandtominimisetheinconveniencetoyou;

(iii)we will take into account the interests of the Society’sMembership as awhole;

(iv) we will, if practical, give advance notice, and

(v)wemayconsiderexceptionstotherestrictionsifwearereasonablysatisfiedthatsubstantialhardshipwouldotherwisebecaused.

Where the restrictions on withdrawals affect accounts generally, we will notify therestrictionbynoticesonourwebsiteandinourBranches.Iftherestrictionaffects your account only, we will write to you to notify you. You can contact us todiscussanyrestrictioninpersonatanyofourBranches,orbytelephoninguson01225423271.

9.5 Ifawithdrawalismadebyachequeinfavourofsomeoneotherthanyou,wewillnot stop payment of the cheque unless we have clear evidence of fraud, or that thechequehasbeenlost,stolenordestroyed.

9.6 Please note that:

•wewillnotsendchequestothirdpartiesbypost;

•wedonotpermitwithdrawalstobemadebydirectdebitorstandingorder.

10 Uncleared funds

10.1 Subjecttoanyspecialconditionsforparticularaccounts,andtoCondition9, wewillallowwithdrawalsagainstachequesixworkingdaysafter ithasbeen

depositedwithus,providedwehavenotreceivednoticethat ithasnotbeencleared. If the cheque is not cleared then you will have to repay us the amount of the withdrawal to the extent that there is not enough other money in the account to cover it.

Ifachequethatisdepositedbyyouisnotcleared,wewillcontactyou.

10.2 ForthepurposeofCondition10.1,thedayofdepositofthechequeisthedayitispaidinatabranchcounterorthedaywereceivethechequebypost,exceptthatineachcaseifthetimeofpaymentinorreceiptbypost(asthecasemaybe) isnotbefore14:00hoursonaworkingday,thenthedayofdepositisthenextfollowingworkingday.

11 Closing your account

11.1 Youcancloseyouraccountatanytime,subjecttoanyspecialconditionsthatapply to particular accounts and to normal administration requirements.

11.2 We can close all or part of your account at any time without giving any reason, but(exceptinexceptionalcircumstances):

•wewillgiveyouatleast30days’writtennotice,orsuchperiodofnoticeyouwould have to give us in order to close your account (or to close it without havingtopayachargeorlosinginterest),whicheveristhelonger;

•wewillnotusethisrighttorepayafixedterminvestmentbeforetheendofthefixedterm,and

•wewillnotcloseyouraccount,orthreatentodoso,asaresponsetoavalidcomplaint that you have made.

Theexceptionalcircumstancesmentionedaboveare:

•youhavedeliberatelygivenusanyfalseinformationinrelationtoyouraccount;

•youwerenotentitledtoopentheaccount;

•you do not comply with any of your obligations under these terms andconditions,anddonotputthisrightwithinareasonabletimeofouraskingyoutodoso;

•youthreatenorareabusivetowardsourstaff;

•wereceivenotificationthatyouhavebeendeclaredbankrupt;

•thecontractbetweenusisvoidorunenforceableatlaw,or

•wehavealegalobligationtoclosetheaccount.

11.3 If we close the account, we will pay interest at the agreed rate up to and including thedateofrepayment.Wemaymakerepaymentbysendingyouacheque.

11.4 Ifweclosetheaccountinfullandmakerepaymenttoyou,inpersonorbypost,then you will have no further right or interest in the account.

12 Statements

We will send you an annual summary statement of account each year, or on request.Youshouldcheckallstatementscarefully.Ifitappearstobewrong,youshouldtellusassoonaspossible.

13 Taxes

Whererequiredbylegislation,interestwillbepaidorcreditedafterdeductionofincome tax at the appropriate rate. Please enquire for further details.

14 Joint Accounts and Trusts

14.1 If an account is held inmore than one person’s name, then only the holderwhosenameappearsfirst inourrecordswillbeentitledtomembershiprights (such as the right to receive notices of, and to attend and vote at, meetings). This issubjecttoanyrightsgiventootherholdersbyanylegislation.

14.2 You can choose the order in which the names appear in our records. Anychange in the order will happen when our records are actually changed. We will makethechangewithinareasonabletimeafteryoutellusaboutitinwriting.

14.3 For taxpurposesonly,wewill treat jointaccountholdersasbeingentitled tothe money in the account in equal shares. This does not affect the operation of Condition14.4,whichtakesprecedence.

14.4 Where one account holder dies, we will, on receipt of satisfactory evidence of thedeath,treatthesurvivingholder(s)asbeingentitledtotheaccount.Wedonotacceptaccountsonanyotherbasis.

14.5 Withdrawalsandother transactionsandaccountchangesona jointaccountneed the signatures of all account holders, unless all of them have authorised us to accept the signature of any one of them or (if there are more than two holders) anycombinationofthem.Ifwehavethisauthorisation,thenanyoftheaccountholders can withdraw all of the money in the account.

14.6 AnyauthorisationgivenunderCondition14.5canbestoppedbyanyaccountholder. However, we will need two days written notice to put this into effect.

14.7 Ifwehavereasontothinkthatthereisadisputebetweenaccountholderswemay (butwillnotbeobliged to) require thesignaturesofallaccountholders,despiteanyauthorisationthathasbeengiventouspreviouslyunderCondition14.5.

14.8 If there isa relationshipbetween theaccountholders,whichceases,youwillneedtoinformusinwritingiftheaccountistobeclosedoryouwantanynametoberemovedfromtheaccount.Ifyoudonotinformusthen,evenifweknowabout the relationshipbreakdown,wewillcontinue tooperate theaccount inaccordance with the instructions that you have given us. This may mean that withdrawalsand/orclosureoftheaccountwillbepermittedononesignature.

14.9 Wemay(inaccordancewithCondition9.4)freezetheaccountifwehavereasontothinkthatthereisadisputeinrelationtothemoneyintheaccount.However,wewillnotbeobligedtodothis,unlessweareorderedtodosobyacourt.

14.10 Anycorrespondencerelatingtotheaccountwillbesenttotheaddressofthefirst-namedaccountholder,unlessyouinstructusotherwise.

14.11 Theliabilityofjointaccountholdersisjointandseveral.Thismeansthateachofyouisseparatelyresponsibletousfortheperformanceofalltheobligationsoftheaccountholders,andnotjustashareofthem.

14.12 We do not have to recognise the interest or claim of any person other than the account holder(s) in respect of any money held in the account (and we will not haveanyliabilityforfailingtodoso),exceptasmayberequiredbylaw.Furtherdetailsabouttherightsandresponsibilitiesofjointaccountholdersarecontainedintheleaflet‘YouandYourJointAccount’.Acopyisavailabletodownloadat:https://www.bba.org.uk/publication/leaflets/you-and-your-joint-account

15 Transfers

Unless the special conditions for a particular account say otherwise, you may askustotransferyourinvestmenttoanotherperson.Wedonothavetoagreetothisand,ifwedoagree,itmaybesubjecttoconditionsand/orpaymentofacharge.

16 Unclaimed balances/Dormant Accounts

16.1 We may close your account in the following circumstances:

(a)youcannotbetracedafterreasonableenquiry,and

If you contact us at a later date and provide us with satisfactory proof of your identityandanewlycompletedapplication form,wewill re-opentheaccountandcredititwiththeamountweoweyouinrespectoftheaccount(whichwillbeequaltothebalancethatwasintheaccountwhenweclosedit,afteradjustingitfor the interest we would have paid and for any fees or charges we would have deducted if the account had remained open).

16.2 Condition16.1issubjecttoanyrulesthatmaybemadeunderanylegislation.

16.3 Anaccountbecomesdormantifyouhavenotwithdrawnordepositedanyfundsinthelastthreeyears.Wewillaskyouforpersonalidentificationwhenyoure-activate a dormant account. This does not apply if you have standing order or electronic payment transactions into or out of your accounts.

17 Account Documents

17.1 Wewillissueyouwithapassbook,certificateorothersimilardocumentrelatingto your account. Please note that, if issued:

•thepassbookwillbelongtous;

•youagreetoreturnittousforupdating,orforanyotherpurposewereasonablyrequire;

•youagreetokeepitsafe,andtotellusinpersonatoneofourBranchesorby telephoninguson01225423271,assoonasyoudiscoverithasbeenlostor

stolen, and

•thepassbookmustbeproducedtousbeforeanywithdrawalfromtheaccount is made.

17.2 Wemay issue a replacement for lost or stolen documents but this may besubjecttopaymentofachargeand/orotherconditions.Theseconditionsmayinclude:

•providinguswithreasonableevidenceofthelossortheft

•notifying,andco-operatingwiththepolice;and

•restrictingwithdrawalsfromtheaccountfromthedateyounotifyusofthelossor theft.

17.3 Ifsomeoneotherthanyouproducesyourpassbooktous,pretendstobeyouortobeauthorisedbyyou,andisthereforeabletowithdrawmoneyfromtheaccount,youwillbeliableforthefirst£50oftheunauthorisedwithdrawals.Youwill be liable for the amount of allwithdrawals if you have acted fraudulentlyor you have, intentionally or with gross negligence, failed to comply with your obligationsundertheseConditionsorfailedtotakeallreasonablestepstokeepyourpassbookoranypersonalaccountorsecurityinformationsafe.However,youwill not be liable for anywithdrawals after you have told us of the loss,theft or unauthorised use of your account document, unless you have acted fraudulently.

17.4 Youshouldcheckyourpassbookregularly.Ifthereisanentrywhichseemstobewrong,youshouldtellusassoonaspossible,inpersonatanyofourBranches,orbytelephoninguson01225423271sothatwecanresolvethematter. Ifyoudonotnotifyuswithin13monthsafter thedateof theentry,wewillnotbeobligedtocorrecttheerror.SubjecttoCondition17.3,wewillbeliableforunauthorised transactions on your account.

18 Changing these Conditions

18.1 We can change these Conditions and/or terms on which your account is held if wereasonablybelievethatthechangeisneededforanyofthefollowingreasons(which may relate to circumstances existing at the time or those which are expected to apply in the near future):

•torespondtochangesinthelaworthedecisionsofacourtorombudsman;

•tomeetrelevantregulatoryrequirements;

•tomakethetermsclearerorfairer;

•toprovideyouwithextrabenefitsorservices;

•torespondtonew(orchangesto)statementsorcodesofpracticeorindustryguidancedesignedtoenhanceconsumerprotection;

•exceptinrelationtofixedterminvestmentsforanyotherreasonthatwe reasonablyconsiderappropriate.

18.2 Any change we make under Condition 18.1 will be proportionate to thecircumstances giving rise to the change.

18.3 A changewhich is not to your disadvantagemaybemade immediately and withoutpriornotice.Wewilltellyouaboutthechangewithin30days.

18.4 Achangewhichistoyourdisadvantageandwillbeeffectiveonlyafteratleast30 days written notice is given to you.

18.5 IfwegiveyounoticeofachangeunderCondition18.4thenforaperiodof60days from the date of the notice you have the right to switch the account or close it without having to lose any interest or pay additional charges.

18.6 Ifyoudonotnotifyusthatyouobjecttoachangebeforeitcomesintoeffect,youwillbedeemedtohaveacceptedit.

18.7 Notices under Condition 18.4 will be sent by individual letter. Notices underCondition18.3maybegiveninthisway,orinsteadbegivenbygeneralnoticeinourBranches,Headofficeandwebsite.

18.8 ThisCondition18doesnotapplytochangestointerestratesorcharges,whicharedealtwithinConditions7and8.

18.9 Ifwehavemadeamajorchangeora lotofminorchanges inanyoneyear,we will give you a copy of the new terms and conditions or a summary of the changesandtellyouwhereyoucanfindafullcopy.

19 Notices

19.1 Youwillbetakentohavereceivedanyletterore-mailorotherpersonalnotice72hours after we have sent it to you.

19.2 If we, accidentally, fail to:

•sendtoyouacommunicationintendedforourinvestorsgenerallyoracategoryof investors of which you are one, or

•displayanoticeatanyofourBranchesorAgencyOffices.

thiswillnotmakethenoticeinvalid.

19.3 If an error ismade in a notice, but this is corrected shortly afterwards by asubsequentnotice,thenoticeperiodwillrunfromthedateoftheoriginalnotice.

20 Matters beyond our control

Wewillnotbeliabletoyouifweareunabletoprovideanyserviceinconnectionwithyouraccountbecauseofabnormalandunforeseeablecircumstancessuchasstrikes,powerfailuresorothercausesbeyondourcontrol.

21 Set off

We may use the money in your account towards payment of any money that you oweuswhichisdueforpaymentbuthasnotbeenpaid.Wewillnotifyyouifwedothis.Nointerestwillbeearnedonmoneyusedinthisway.

22 Companies, etc

22.1 If you are a limited company or other type of corporation, you will need to authoriseofficerstooperatetheaccount.Wewillalsorequireevidenceofidentityand address for these persons.

22.2 Accountsinrespectofunincorporatedorganisations,suchasEnglishpartnershipsandclubs,cannotbeheldinthenameoftheorganisation.Accountsmustbeheldinthename(s)ofindividualsonbehalfoftheorganisation.Theapplicationformhasfurtherdetails.YourattentionisdrawntoCondition14iftherearejointaccount holders.

Opening an account

To open an account with the Society, you will need to let us have:

Charitable assignment

This requirement does not apply to you if you have been aMember of theSocietycontinuouslyforfiveyearsonconversionannouncement.

Changing your mind

Thissectiondoesnotapplytofixedrateaccounts(otherthanafixedratecashdepositISA),ortoaccountswherethepricedependsonrisesandfallsinthefinancialmarketsoutside our control that may happen in the cancellation period.

Ifyouopenanewaccountandthenchangeyourmind,thenaslongasyoutellus(bywritingtousatourHeadOfficewithin14daysafterthecontractisenteredintoor, iflater,14daysfromthedayyoufirstreceive,onpaperorelectronically,thetermsandconditions and other information relating to it) you can:

•haveyourmoneyback,or

•switchtoanotheravailableaccount.

In this case, you will not have to:

Tax

Unless the special conditions for a particular account specify otherwise, accounts can beopenedinthenamesoftwoormorepeople(uptoamaximumoffour).Althoughjointaccountscanbeconvenient,itisveryimportantthatyouunderstandtheconsequencesof having an account in more than one name.

Data Protection and Confidentiality

Membership Rights

IndividualsholdingshareaccountswiththeSocietyareMembersoftheSocietyandareboundbyourRules.YoucangetacopyoftheRulesbyaskingatanyofourBranchesandAgencyOfficesorfromHeadOffice.

TheRulessetouttherightsandobligationsattachedtomembership.WhilejointaccountholdersareallMembers,onlythefirst-namedcanexerciseanymembershiprights(forexample, the right to vote at meetings) arising from the account. Please see the terms and conditions for more details.

Cheque Clearing

The central clearing cycle for cheques (and automated payments, including those overthetelephoneor internet) isthreeworkingdays.Ournormalpractice istoallowwithdrawalsagainstachequesixworkingdaysafterithasbeenpaidin.Interestonachequepaidinwillbecalculatedfromthedaywereceiveit.Formoredetails,pleaseseeconditions7.2and10ofthetermsandconditions.

Telegraphic Transfers

Atelegraphictransfer(TT)isthetransferofclearedfundselectronicallywithin24hours.Youcan instructustosendfundsbyTTtoaUKbankbutthere isa feepayableasdetailedintheTariffofChargesinourSavingsAccountsbrochure.

Next day faster payments

TheSocietyprocessesbankpaymentsusingthefasterpaymentssystem.Customersarenowable to requestnextday fasterpayments fromtheiraccounts fromMondayto Friday each working week (excluding bank holidays) providing that the Society’sCustomerSupportTeamreceivestheirwithdrawalrequestsby15.30hours.

Requests receivedbefore the15.30hours cut offwill beprocessedbefore closeofbusiness to ensure that fundswill be paid to destination accounts on the followingcalendar day.

Requestsreceivedafter15.30hourswillbeprocessedbytheSocietyonthenextfull businessday.

TheSocietyisnotproposingtochargeitsMembersandCustomersforthenextdayfaster payments service, however the maximum transaction size will be limited to£100,000.Customerswhowishtosendsumsinexcessof£100,000willhavetodividetheirpaymentsintoanumberofsmalleramounts.

Same day faster payments

This service is available fromMonday to Friday eachworkingweek (excludingbankholidays).Onceprocessed,thesepaymentswillarriveatdestinationaccountsonthesamebusinessdaythatpaymentsarerequested.TheSocietyagainoperatesa15.30hours cut off for processing same day faster payments. The Society has introduced an initialfeeof£5forprocessingsamedayfasterpayments.

The initial fee of £5 is significantly cheaper than the current alternative of aCHAPStransaction(currently£25),withtheaddedbonusthatsamedayfasterpaymentsareplannedtobesignificantlyquickercomparedwithwhattheCHAPSsystemcanprovide.Amaximumindividual transactionsizeof£100,000againappliestosamedayfasterpayments.Iflargersamedaypaymentsaretobemade,thenMembersandCustomerswill have the choice of either choosing to send multiple same day faster payments, or alternatively,choosingtosendasingleCHAPSpaymentwhichwillincurtheSociety’scurrentpublishedCHAPSfee(£25).

Payments from other financial institutions to accounts held at Bath Building Society

CustomersshouldnotethattherearenoplannedchangestotheCHAPSsystemandthatCHAPSpaymentstotheSocietyshouldcontinuetobesenttotheSociety’smainbankaccount,thedetailsofwhichwillbeprovidedbytheSociety’sstaffonrequest.

Overdrawn accounts

We do not offer overdraft facilities. If your account becomes overdrawn you mustimmediately repay theamount youareoverdrawnby, in addition to thechargeswemake.

Youmustnotmake,orallowawithdrawalifitwillmakeyouraccountoverdrawnorifyour account is already overdrawn.

Ifweaddchargestoyouraccount,makeawithdrawal,oranyothertransactionwiththeresultthatyouraccountbecomesoverdrawn,thiswillnotmeanwehaveagreedanoverdraft on your account.
