4.SUPPORTING DOCUMENTS

The applicant shall submit with this application:

(a) Original or copy of Test Report(s)/Assessment Report(s) bearing recognised accreditation logo with the certificate number issued to the laboratory. (For report issued more than 5 years ago, a verification of the product may be required.)

(b) The product specification e.g. component list, material list, technical drawing and product sample.

(c) Orginal or Certified true copy of latest Instant Information (Business Profile) extract from the Accounting and Corporate Regulatory Authority (ACRA).

(d) Original or certified true copy of the Letter of Authorisation from owner of test report if applicant is not the owner of test report confirming that the applicant is entitled to use the test report.

(e) Appendix A: Checklist for Document Submission & other required supporting documents (as detailed in Appendix A) of the relevant Product Assessment Guideline.

(f) Duly signed user agreement in Appendix B.

APPENDIX B

SINGAPORE GREEN BUILDING PRODUCT (SGBP) LABELLING SCHEME

User Agreement

This Agreement is made on between TV SD PSB Pte Ltd (TV SD PSB) of the one part and (the Company) of the other part

WHEREAS:

(1)The Company has requested for SGBP labelling scheme from TV SD PSB for the Product set out in the Licence issued by TV SD PSB and has agreed to be bound by the terms and conditions of the Scheme as prescribed by TV SD PSB.

(2)Upon successful certification, the Company wishes to use the SGBP labelling scheme mark (set out in the Schedule).

(3)The parties now wish to enter into this Agreement to set out the terms of the Companys use of the SGBP labelling scheme mark.

NOW IT IS AGREED as follows:

1. Subject to the terms of this Agreement, TV SD PSB grants the Company the right to use the SGBP labelling scheme mark set out herein with respect to certified product for a term commencing on the date of issue of the SGBP certificate and expiring upon the expiry or earlier termination or revision of the SGBP certificate. For the avoidance of doubt, the Company shall have no right to use the SGBP labelling scheme mark in the event it is not successful in SGBP certification or if the SGBP labelling scheme is suspended or cancelled for any reason.

2. The Company shall use the SGBP labelling scheme mark set out herein solely to identify the nature and extent of the SGBP certificate issued by TV SD PSB to the certificate holder for the Product. The SGBP labelling scheme mark shall not be used on products which have not been certified under the SGBP labelling scheme. In using the SGBP labelling scheme mark, the Company shall comply with the Guidelines set out in this Agreement or as otherwise specified from time to time. The Company shall immediately discontinue the use of the SGBP labelling scheme mark and/or return or destroy all materials bearing the SGBP labelling scheme mark, if instructed by TV SD PSB to do so.

3. Any proposed advertising and promotional materials which displays the SGBP labelling scheme mark or the name or logo of TV SD PSB and SGBC shall be submitted to TV SD PSB for approval prior to publication.

4. All goodwill generated by the Companys use of the SGBP labelling scheme mark shall accrue to TV SD PSB and SGBC.

5. TV SD PSB makes no warranties or representations whatsoever in relation to the SGBP labelling scheme mark. The Company uses the SGBP labelling scheme mark at its own risk. The Company shall not have any claim against any of TV SD PSB Parties for any damages, loss, expenses or costs in the event that SGBP labelling scheme mark or any part of it infringes or is alleged to infringe the rights of any third party.

6. TV SD PSB shall have control of all proceedings in any court of law or tribunal in respect of any infringement of the SGBP labelling scheme mark. If TV SD PSB wishes to bring or defend any such proceedings, the Company shall, at TV SD PSBs request and expense, render such assistance as TV SD PSB may request in relation to such proceedings.

7. Nothing in this Agreement shall be deemed to grant the Company any right to use any mark other than the SGBP labelling scheme mark set out in the Schedule hereto.

8. This Agreement constitutes the entire agreement between TV SD PSB and the Company on the use of SGBP labelling scheme mark. The Company shall not assign or transfer this Agreement or any rights herein, or sub-contract or delegate any duty or obligation hereunder, except with the prior written consent of TV SD PSB. Any person or party who or which is not a party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of the terms and conditions herein.

9. The right to use the SGBP labelling scheme mark does not relieve the Applicant from guarantees/warranties as to the material, workmanship, and performance of the Product according to the relevant standard as listed.

10. The right to use the SGBP labelling scheme mark does not indicate or imply in any way that the Product would be approved for use. The Company is advised to seek approval from the relevant authorities, where applicable, before supplying the Product.

11. This Agreement shall be governed by and construed in accordance with the laws of Singapore and the parties agree to submit to the jurisdiction of the Singapore courts.
