Session Three:

Types of Fathers

Paternity: state of being a father, fatherhood.

Biological: his sperm caused the baby to be

conceived

Alleged: a man who someone claims is the

biological father of the baby but whose paternity

has not yet been established

Presumed: A man who was married to the baby’s

mother at or within 300 days of the time of the

baby’s birth

Legal: A man who has signed an AOP form or whom

the court finds responsible for supporting the baby

A biological father can become a legal father by

acknowledging paternity or being found to be

father by a court

An alleged father can become a legal father by

signing an AOP with the mother. He can also be

court-ordered to be legal father

If a baby’s mother is married to someone at the

time of the birth, her husband is presumed to

be the baby’s father. He is not necessarily the

baby’s biological father. If he thinks his wife’s

baby is NOT his he can deny paternity if the bio

father is willing to acknowledge paternity. The

presumed father can have a DNA test to exclude

him as the legal father
