BY AMBER GILLENWATER [email protected] GALLIPOLIS — A 2010 case against a regis- tered sex offender who was alleged to have been in the possession of child pornography, among oth- er charges, has been dis- missed in the Gallia County Court of Com- mon Pleas. Gary D. Arnold, 36, Gallipolis, was scheduled to appear in the common pleas court on March 24 for a jury trial, how- ever, the jury tri- al was post- poned and two journal entries were later filed with the clerk of courts indicating that the Gallia County Prosecutor Jeff Adkins was unwilling to pursue counts one and six of the indictment. Moreover, the defendant moved to dis- miss counts two through five of the indictment and the court later granted this request. Arnold had been arrested by detec- tives with the Gallia County Sheriff’s Office on Oct. 28, 2010, on charges of hav- ing weapons under dis- ability after a firearm was discovered during a search of his residence located on Hubbard Avenue in Kanauga. The search came as a result of allegations that Arnold had been having sexual relations with an underage girl. The investi- gation into the alleged sexual relations began after information was pro- vided to a school resource deputy who subsequently contacted sheriff’s detec- tives. In relation to this inves- tigation, a case against Arnold was later taken to the grand jury and he was indicted on six counts. Count one of the indict- ment alleged that Arnold was in the possession of a pistol on Oct. 28, 2010, while being under weapons disability as he had been convicted of an offense of violence. Arnold had been convict- ed of “gross sexual impo- sition” in 1995 in the Meigs County Common Vinton man charged with forgery in Gallia County BY AMBER GILLENWATER [email protected] GALLIPOLIS — A Gallia County man who was recently arrested by deputies with the Gallia County Sheriff’s Office was arraigned in the Gal- lia County Common Pleas Court on Thursday. Donald L. Denny, II, 25, Vinton, pleaded not guilty to one count of forgery on March 31 in the common pleas court after he allegedly forged a traffic citation form on Feb. 4, 2010, as the act of Darrell R. Waugh. A status conference in this case has been sched- uled for May 19. A nego- tiated plea may be filed with the clerk of courts by July 15. Denny had been arrest- ed and served with an indictment from the com- mon pleas court on the evening of March 29 fol- lowing an investigation of Denny’s alleged involvement with a breaking and entering offense. Reportedly, at approxi- mately 11:52 p.m., deputies responded to Denny’s residence locat- ed on Scott School Road in Huntington Township to investigate Denny and Michael D. Sellers, 27, Vinton, who were allegedly in the posses- sion of stolen property from a break-in that had occurred earlier that day. Upon arrival, neither Denny nor Sellers were present and, subsequent- ly, the suspects’ vehicle was seen on Orpheus Road in Jackson County and struck a guard rail just prior to entering Gal- lia County on Coal Valley Road. The vehicle later hit a ditch near the intersection of Coal Valley and Scott School Roads and the suspects fled on foot. Denny was apprehend- ed while Sellers was nev- er located. Reportedly, the truck contained a large amount of metal, allegedly to be stolen, including tools, a large electric motor and a vat mixer. The vehicle was towed from the scene and the Ohio State Highway Patrol completed a crash investigation. Denny was arraigned in the Gallipolis Municipal Court on March 30 on one count of obstructing official business in rela- tion to this incident. A court pre-trial has been scheduled for April 14 in this matter. Sellers was later arrest- ed and arraigned in the Gallipolis Municipal Court on April 1. He was charged with two counts of obstructing official business. A court pre-trial in this matter has been scheduled for April 11. The investigation into the alleged break-in con- tinues and charges are pending. Gallia Co. local Easter egg hunts planned STAFF REPORT GALLIPOLIS — Sev- eral organizations in Gal- lia County have planned Easter egg hunts that are open to the entire commu- nity. The Gallipolis Church of Christ in Christian Union is sponsoring a community Easter agg hunt on Saturday, April 16. The hunt will begin at 2 p.m. at Canaday Park, located on Central Avenue in Gallipolis. Organizers say the event is open to children ages 2-12. The hunt will be canceled if inclement weather occurs. For infor- mation, call 446-7119. First Church of the Nazarene in Gallipolis will host a community egg hunt from 4-7 p.m. on Palm Sunday, April 17. The event is open to chil- dren ages 2-12. Organizers say they will have prizes available for children in attendance and special family door prizes. STAFF REPORT GALLIPOLIS — Animal cruelty charges are expected to be filed against a Gallia County man following an inci- dent that occurred on Saturday after- noon at his residence. At approximately 12 p.m. on April 2, emergency response personnel were dispatched to the residence of John Smith, 50, 3979 Ohio 141, Gallipolis, following a 911 call by neighbors who reported that Smith’s horse was in a nearby creek, nearly drowning. Officials with the Gallipolis Fire Department and the Gallia County Sheriff’s Office responded to the scene and the horse was rescued from the creek. Veterinarian Brian Hendrickson of River Bend Animal Clinic was called to the scene to assist the emergency officials and administer aid to the two- year old horse. According an on-scene official, Hen- drickson gave the horse three bags of IV fluids and the animal ate a small amount of hay. However, the horse died Sunday night from apparent neglect and malnutrition. The official further reported that the animal, a breed of draft horse, weighed half of that of other horses of its breed and age and may have gone to the creek looking for water or food. According to Gallia County Sheriff Joe Browning, the sheriff’s office is investigating the incident and will file animal cruelty charges against Smith through the Gallipolis Municipal Court. Browning is also hopeful that the court will impose sanctions against Smith in regard to the treatment of the several other horses under his care. year? Here are 10 things the IRS wantsyou to know about your refund.

1. Refund Options You have threeoptions for receiving your individual feder-al income tax refund: direct deposit, U.S.Savings Bonds or a paper check. You cannow use your refund to buy up to $5,000in U.S. Series I Savings Bonds in multi-ples of $50.

2. Separate Accounts You may useForm 8888, Allocation of Refund (Includ-ing Savings Bond Purchases), to requestthat your refund be allocated by directdeposit among up to three separateaccounts, such as checking or savings orretirement accounts. You may also usethis form to buy U.S Savings Bonds.

3. Tax Return Processing Times If youfile a complete and accurate paper taxreturn, your refund will usually be issuedwithin six to eight weeks from the date it isreceived. If you filed electronically, yourrefund will normally be issued within threeweeks after the acknowledgment date.

4. Check the Status Online The fastestand easiest way to find out about yourcurrent year refund is to go to IRS.govand click the “Where’s My Refund?” linkat the IRS.gov home page. To check the

status online you will need your SocialSecurity number, filing status and theexact whole dollar amount of your refundshown on your return.

5. Check the Status By Phone You cancheck the status of your refund by callingthe IRS Refund Hotline at 800–829–1954.When you call, you will need to provideyour Social Security number, your filingstatus and the exact whole dollar amountof the refund shown on your return.

6. Check the Status with IRS2GoIRS2Go is a smartphone application thatlets you interact with the IRS using yourmobile device. Apple users can downloadthe free IRS2Go application by visiting theApple App Store. Android users can visitthe Android Marketplace to download thefree IRS2Go app. Simply enter yourSocial Security number, which will bemasked and encrypted for security pur-poses, then select your filing status andthe exact whole dollar amount of yourrefund shown on your return.

7. Delayed Refund There are severalreasons for delayed refunds. For thingsthat may delay the processing of yourreturn, refer to Tax Topic 303 available onthe IRS website at http://www.irs.gov,which includes a Checklist of Common

Errors When Preparing Your Tax Return.8. Larger than Expected Refund If you

receive a refund to which you are not enti-tled, or one for an amount that is morethan you expected, do not cash the checkuntil you receive a notice explaining thedifference. Follow the instructions on thenotice.

9. Smaller than Expected Refund If youreceive a refund for a smaller amountthan you expected, you may cash thecheck. If it is determined that you shouldhave received more, you will later receivea check for the difference. If you did notreceive a notice and you have questionsabout the amount of your refund, wait twoweeks after receiving the refund, then call800–829–1040.

10. Missing Refund The IRS will assistyou in obtaining a replacement check fora refund check that is verified as lost orstolen. If the IRS was unable to deliveryour refund because you moved, you canchange your address online. Once youraddress has been changed, the IRS canreissue the undelivered check.

Dear S.S.: Some peo-ple feel trapped by anykind of routine that ismandatory and uponwhich their livelihooddepends. Because youneed the money so des-perately, you naturallyplace a great deal ofemphasis on not rockingthe boat, trying to like orlove your job and not loseit. But if all this effort isbeing put into a job youdon’t really like, just tomake sure you can liveday to day without finan-cial problems, you couldbe fighting a losing battle.Keeping a career goingtoday is a difficult under-taking — especially ifyou don’t really like whatyou are doing.

A new study out of theAustralian National Uni-versity has confirmed thatnot just any job will dowhen it comes to beinghappy; in fact, peoplewho went from the unem-ployment line to a less-than-satisfactory job weremore likely to bedepressed than those whohad no place to work. So

if the place where you areworking is not thrillingyou, it would be a gooduse of your time to turn toa bit of self-analysis andsee what factors enter intoa happy environment foryour career.

Injuries have a negativeimpact on Ohio’s healthand on Ohioans pocket-books.

In one year, Ohioansspend $1.5 billion onmedical costs related toinjuries and $28.4 billionon work loss and qualityof life loss related toinjuries. In addition tocosting our state billions,unintentional injuries arethe leading cause ofdeath and disability forOhioans ages 1 through44 and the fifth-leadingcause of death for allOhioans. Non-fatalinjuries and violence alsolead to an average ofeight hospitalizations perhour and three emer-gency department visitsevery minute in Ohio.

It only takes a momentfor an injury to happen-afall on a stair, a moment’sglance away from theroad, a biking or sports-related injury or a med-ication mix-up.

This year, duringNational Public HealthWeek (April 4-11), it’simportant to rememberthat safety is no accident.We can prevent injuries

from happening by tak-ing small actions. For

example wearing a seat-belt, properly installingand using child safetyseats, wearing a helmetand using prescriptionmedications only as theyare prescribed are impor-tant ways to proactivelypromote safety and pre-vent injuries.

Over the past ten years,the overall number ofinjury-related deaths inOhio has increased by 44percent. ODH is workingto address this issue inmany ways.

Through the Violenceand Injury Preventionprogram, ODH fundscommunity-based injuryprevention programs innine counties to addressfalls among older adults,child injury and prescrip-tion drug overdose. ODHalso has a statewide childpassenger safety pro-gram, providing car seatsto low income families inall 88 counties.

In addition, we havecreated a statewide pub-lic-private action groupcalled the Ohio InjuryPrevention Partnership(OIPP). Through theOIPP, we are buildingOhio’s capacity to helpevery Ohioan live his orher life to its fullestpotential by reducingdeath and disability asso-ciated with intentionaland unintentional injury.

The work of the OIPPis critical to reversing theimpact of injury on ourstate. One focus area ofthe OIPP is unintentionaldrug overdoses, whichsurpassed motor vehicletraffic and suicide as theoverall leading cause ofinjury death in Ohio in2007 and continued in2008.

An average of fourOhioans die each dayfrom unintentional drugoverdoses and prescrip-tion drugs are associatedwith more of these deathsthan heroin and cocainecombined. In addition tothe impact on communi-ties and families, thesepreventable deaths costour state an estimated$3.5 billion each year.

ODH, in coordinationwith our federal, stateand local partners, hasand will continue to workto raise awareness andeducate the public aboutthe state’s overdose epi-demic. While uninten-tional drug overdoses arethe leading cause ofinjury death, there aremany other injuries thatimpact the well being ofour state.

Falls are the leadingcause of injury-relateddeath and hospitalizationfor older adults. Manyolder adults believe thatexperiencing a fall is a

natural part of the agingprocess. It’s not, you canprevent falls by remov-ing environmental haz-ards, having your eyeschecked regularly andincreasing your physicalactivity.

In children, suffoca-tions, motor vehiclecrashes and falls aresome of the leadingcauses of hospitaliza-tions and death. Thesecan be prevented by pro-viding a safe sleep areafor your child, ensuringchild safety seats areproperly installed andthat your child wears ahelmet when participat-ing in wheeled sports.

For teens and youngadults — ages 15-24 —motor vehicle crashes arethe leading causes ofdeath and hospitaliza-tions. But these crashescan be prevented byensuring your teens knowsafe driving rules, includ-ing not driving while dis-tracted or while texting.

He marriedMarry Emma (Bailey)Waugh on October 5, 1946,at Catlettsburg, Kentucky.Merrill was a tobaccofarmer and retired from the Gallia County School Dis-trict as a School Bus Driver. He attended Mt. Zion Mis-sionary Baptist Church. Merrill enjoyed tractor pulls andblue grass music.

Surviving are his wife, Mary Emma Waugh of CrownCity; his children, Judy (Cliff) Wolfe of Gallipolis,Charles Waugh, Richard (Sue) Waugh, and James(Rose) Waugh, all of Crown City and a stepson, Scott(Judy) Bailey of Eureka, Ohio; eight grandchildren,Mark Chevalier, Nathan Waugh, Mike Waugh, RachaelChambers, Tiffany Waugh, Jay Waugh, Alan Bailey, andPhil Bailey; 10 great grandchildren; two brothers,Howard Waugh of Gallipolis and Carl (Emily) Waugh ofRodney; a sister, Jewell Steel of Point Pleasant, WV; anda sister-in-law, Maxine Waugh of Columbus, Ohio.

Pleas Court.Counts two and five of the indictment alleged that Arnold knowing photographed,

created, directed, produced, or transferred materials depicting minors, 16 and 17 yearsof age, respectively, in the state of nudity on Oct. 22 and Oct. 28, 2010, both seconddegree felonies.

Count three of the indictment alleged that Arnold was in the possession of or viewedmaterial that shows a 16-year-old in the state of nudity on Oct. 28, while count fouralleged that Arnold was in the possession of or viewed material of a 17-year-old in thestate of nudity, both fifth degree felonies.

Count six of the indictment alleged that Arnold burglarized the residence of one ofthe female victims in the case on Oct. 22, 2010, a second degree felony.

According to a motion to dismiss filed by the defendant on March 25, counts twothrough five of the indictment that deal with child pornography charges are “fatallydefective,” and the motion further cites a Fourth District Court of Appeals ruling asgrounds for a dismissal.

According to the motion, the appellate court ruled that “an indictment that chargesthe possession of photographs of nude children ... but fails to include the allegations of‘lewd’ or graphic focus on the genitals, fails to set forth a punishable offense.”

Furthermore, the motionargued that the prosecutorcould not move to amendthe counts in this case relat-ing to the charge pornogra-phy charges, but the “lewdor graphic focus on the gen-itals” must be an elementdetermined by a grand jury.

Therefore, the court dis-missed, without prejudice,counts two through five ofthe indictment and orderedthe defendant released fromjail and subject to any out-standing holders for otherjurisdictions.

The State of Ohio, rep-resented by Gallia Coun-ty Prosecutor Jeff Adkins,with leave of the court,further stated that he wasunwilling to pursue countone, as to the havingweapons while under dis-ability charge, and countsix, as to the burglarycharge.

The journal entry filedby the prosecutor’s officefurther stated that “theState of Ohio will beindicting the defendantagain in the near future.”
