Description of Proposal
Our client, Robert Laurance Anderson, proposes to carry out a 2 Lot subdivision of his propertybeing Lot 10 DP 206268. It is proposed to create Lot 1 with an area of 3000rr12 and Lot 2 with anarea of 4991 m2 Both sites are vacant.
It is also proposed to create Rights of Way A and B, being mutual access for the application site andthe adjoining property, Lot 9 DP 206268 which is in the process of being subdivided to create Lots 1and 2 DP 528823.
Refer to Scheme Plan attached as Appendix 1.
Site Description
The property is zoned Coastal Residential under the District Plan. The property contains noresource features as shown or listed in the District Plan.
The application site is legally described as Lot 10, DP 206268, comprised in Certificate of TitleNA134C/78, dated April 2001, with an area of 8812mt
The application site is located on the left and at the lower end of Fuller Terrace. The topography hasa combination of steep land with the lower end reasonably level.
This is a Residential area.

Planning Provisions
District Plan
The application site is zoned Coastal Residential. The District plan has provision for unseweredsites in this zone to have an area of 30002. Both proposed Lots have areas of 3000mi or greater.
In my opinion this is an application for a controlled resource consent.
Regional Plans
This application has had regard to the Regional Policy Statement for Northland, and the RegionalWater and Soil Plan for Northland.
NES
The application site has not been used for horticulture. In my opinion this is not a Hail site.
Environmental Effects and Mitigation
Allotment Sizes and Dimensions
Appropriate for their residential use.
Buildable Areas
Both sites can accommodate the requisite buildable areas.
Property Access
It is proposed to create Easements B and C as mutual Rights of Way with the neighbouringproperty. Proposed lot 1 will receive a Right of Way over Easement B and Lots 1 and 2 DP 528823will receive a Right of Way Easement over Easement C.
This mutual Right of Way will provide access for the properties to the elevated ground. Theformation in those easements is going to be concreted.
Proposed Lot 2 has existing access. It is the servient tenement of existing Easement F.
Earthworks
The only earthworks involved will be the formation of the access drives.
Natural & Other Hazards & Site Stability
There are no hazards recorded for the application site.
Water Supply
Roof catchment is available for domestic water supply.

Stormwater Disposal
The application site adjoins the esplanade reserve which adjoins the Kerikeri Inlet. No need forstormwater detention. Rip rap for stormwater velocity reduction could be needed. Proposed Lot 2has a stormwater easement over Lot 1 via E.
Wastewater Disposal
Refer to Appendix 4 for the wastewater report.
Power Supply & Telecommunications
Refer to Appendix 5 for copy of correspondence with Top Energy and Chorus.
Existing Easements & Covenants
The application site is subject to the Right of Way easement described above and a stormwater andpedestrian easement for the benefit of the properties above.

Heritage, Cultural Resources
There are no archaeological, heritage, or Sites of Significance to Maori recorded in the District Planor the NZAA Archaeological Site Recording Scheme:
Flora and Fauna
There is no vegetation on site worthy of protection and being a residential location it is not within akiwi zone.
Visual Effects, Character and Amenity
Being a controlled application, the proposed subdivision will not create any visual effects expectedfor the zone.
Consultation
Given the category of consent and the fact that, in my opinion, there are only minor adverse effects,[ have not considered it necessary to obtain any neighbours' approvals.

In my opinion:
(a) The proposal is a controlled activity under the District Plan ; and
(b) Is consistent with the controlled provisions of the District Plan; and
(c) The effects on the environment will be no more than minor; and
(d) Written approvals from neighbours are not required; and
(e) No additional consents are required under Regional Plans.
I request that Council grant consent to this application under delegated authority.

RE: SITE SUITABILITY REPORT FOR WASTE WATER FOR A PROPOSED SUBDIVISIONLOT 10, DP 206268, FULLER TCE
On the 24th of October a site inspection was carried out to assess the soil types and soakage ofproposed lots 1 and 2 for effluent treatment and waste water disposal.Proposed lot 1.
The soil is classed as Kerikeri Friable clay with large boulders with well to moderately well drainage.The soakage test showed good soakage but due to the gradient of the hillside an advanced secondarywaste water treatment system with effluent disposal by dripperlines would better suit this site.I have classed the site as category 4 with the soakage rate as 5mm per sq M per day.
As the gradient of the site is over 10 degrees the dripperlines can be dug into the topsoil which has adepth of approximately 0.3M. The setback to the lower boundary must have a buffer of lOM plus the1.5M secondary treatment set back because ofthe gradient.
An example of a three bedroom house is attached.Proposed lot 2.
This site is similar to lot 1 but has a planted bush area of flaxes and Te Tree that the dripperlines couldbe laid out in and pinned to the ground with the mulch being formed by the bush over a period of time.The soil is classed as Kerikeri Friable Clay with large boulders with well to moderately well drainage.This site is classed as Catergory 4 with a loading rate of 5mm for an advanced secondary waste watertreatment system.
The lower boundary near the estuary also will need the lOM buffer and 1.5M setback for secondaryeffluent disposal or 30M from the high water mark which ever one is greater.
