RISK ACKNOWLEDGEMENT & WAIVERI, hereby agree to the following:

I am participating in a yoga retreat (the “Retreat”) which includes yoga classes, meditation and breath work, health programmes, workshops and other exercise and healing arts activities (collectively, the “Activities”) offered by Zephyr and Gaia Limited trading as “Living Yoga Immersion” (the “Company”) and/or its owners, directors, instructors, teachers, workshop presenters, employees and independent contractors. I recognise that I must be in good physical and mental health to participate in the Retreat. I understand that the Activities require physical exertion and I represent and warrant that I am physically fit in proper physical condition to participate in the Activities and that I have no medical condition which would prevent my participation in the Activities. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Activities. If I have consulted a physician, I confirm that I have taken the physician’s advice. I understand that the Company reserves the right in its sole and absolute discretion to refuse my participation in the Activities on medical or fitness grounds or to require a physician’s certificate prior to approving my participation. I am aware that participation in the Activities, like any any other physical activity, involves an element of risk and could, in some circumstances, result in abnormal blood pressure, fainting, heartbeat disorders or other physical injury. I also understand that I could experience muscle, back, or bone injuries during exercise. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured. I also understand that it is my continuing responsibility to inform the Company before the start date of the retreat of any previous or current medical conditions (whether physical or psychological), injuries or surgeries prior to the commencement of the Retreat and any future changes to my medical condition.

In consideration of being permitted to participate in the Retreat and save as set out herein, I agree to assume full responsibility for any risks, direct or indirect losses or damages to to myself or to my personal belongings and for any injuries which I might incur as a result of participating in the Activities save as set out below. In further consideration of being permitted to participate in the Activities, I knowingly, voluntarily and expressly waive any “Claims” (as defined below) I may have against the Company, its owners, directors, employees, and/or its instructors, teachers, employees, volunteer staff, interns, and/or independent contractors and the retreat venue(s) (each, a “Released Party” and together the “Released Parties”) for any Claim that I may sustain as a result of participating in the Activities in the Retreat (except for death or personal injury caused by the negligence of the Released Parties) or in relation to the loss and/or damage of my personal belongings. I agree to indemnify and hold harmless each Released Party from any loss or liability incurred in defending any Claim made by me or anyone making a Claim on my behalf, (except where such Claim is in respect of death or personal injury caused by the negligence of a Released Party). “Claims” include but are not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering and distress, or death that I may suffer (including any legal fees or expenses) in connection with participation in the Activities. Save where a Claim is in respect of death or personal injury caused by negligence, I, my heirs and legal representatives forever release, waive, discharge and covenant not to sue any Released Party for any Claim. I further agree to waive and release the Released Parties from any and all claims, liabilities, damages, and expenses (including, without limitation legal fees and expenses) which I may suffer as a result of any misstatements or misleading information which I have made or provided in the application form or from my failure to disclose any physical or psychological condition which may influence the decision of the Released Parties to allow you to participate in the Retreat or the Retreat activities. I further agree to waive and release the Released Parties from and and all claims, liabilities, damages, and expenses (including, without limitation legal fees and expenses) which I may suffer as a result of my own recklessness or negligence in failing to or electing to not follow the instructions of any of the Released Parties.

I understand that the Retreat includes training relating to hands-on assists and adjustments and massage and that the teachers and instructors on the Retreat will use touch techniques to correct alignment and/or to focus my concentration on a particular muscle area to be targeted. I understand that such touch techniques are an inherent part of a yoga class, however I feel uncomfortable or experience any type of discomfort in relation to such touch techniques, I confirm that I will immediately request that the teacher or instructor discontinues using this technique. I further understand that the Company may from time to time photograph or video classes or events occurring at its studios and place such photographs and videos on its website and/or social media feeds and those of any guest instructors or teachers. I hereby consent to the use of my image that may appear in any such photograph or video.

This agreement shall be construed in accordance with, and governed by English law and is subject to the exclusive jurisdiction of the courts of England and Wales. I acknowledge that I have carefully read this release and waiver of liability and fully understand its contents. I voluntarily and knowingly agree to the terms and conditions stated herein with full knowledge of their meaning, significance and implication. This Release shall be binding upon my heirs, executors, administrators and assigns.

TERMS & CONDITIONS: Santorini Spring Revival Retreat 2017 with Sarah Thompson and Julie Montagu (Monday 15th May – Sunday 21 May 2017)

1. TERMS AND BOOKING ARRANGEMENTS 1.1. The Terms apply to all retreat bookings made by you via Sarah Thompson and/or Julie Montagu (the “Hosts”) for the Santorini Spring Revival Retreat 2017 (the “Retreat”) at the Rocabella hotel, Santorini (the “Hotel”). 1.2. We intend to rely upon the Terms in relation to the contract between you and us. We have the right to revise and amend these Terms from time to time and you will be notified in writing of any such changes. 1.3. The prices for the Retreat are as stated in this application form and on the Hosts websites (www.fivefeathersyoga.com and www.juliemontagu.com) (the “Retreat Fees”). The Company reserves the right to amend or increase the prices which are published or advertised prior to the time that you book the Retreat in its absolute discretion. 1.4. Full payment of the Retreat Fees will become due immediately upon booking in order to secure the place. Payment is accepted via bank transfer to the account details below: Zephyr and Gaia Limited (trading as The Living Yoga Immersion) Bank: HSBC Bank plc, Fulham Broadway Branch Sort code: 40-07-14 Account number: 01614568 1.5. Once payment of the Retreat Fees has been made any subsequent cancellation will incur cancellation charges as set out in section 3 below. 1.6. Your booking is considered definite and a contract will exist between you and the Company when the payment is received and your application form has been received and accepted (typically via email confirmation from the Hosts). If your application is not accepted, the Company will provide a full refund of any Retreat Fees that you have paid. 1.7. The Retreat dates are Monday 15th May to Sunday 21 May 2017. All bookings are offered in respect of the full week. Any part-week bookings or reduced rates are offered in the discretion of the Company. 1.8. The Company reserves the right to accept or refuse bookings in its absolute discretion. 1.9. For the avoidance of doubt the Contract is between you and the Company and no contract exists between you and the Hosts.

These Terms and Conditions (the “Terms”) set out the agreement between you, the participant in the Santorini Spring Revival Retreat 2017 (“you” or “your”) and Zephyr and Gaia Limited, trading as the Living Yoga Immersion, a company incorporated in England and Wales with company number 10165837 whose registered office is at 28 Wilton Road, Bexill-on-Sea, East Sussex, England, TN40 1EZ (“we”, “us”, “our” or the “Company”) (each a “Party” and together the “Parties”).

2. RETREAT FEES 2.1. The Retreat Fees includes accommodation, pre-practice beverages and light refreshments, brunch for Tuesday to Sunday (inclusive), supper for four nights and a final farewell dinner at a local restaurant on the Saturday night. 2. 2. Beverages, alcoholic drinks, additional meals and snacks are not included in the Retreat Fees and must be arranged separately with the Hotel. You must pay the Hotel directly for such additional extras. 2.3. The Retreat Fees also exclude flights, travel insurance, tips, spa treatments and any other optional individual or group activities. 2.4. The Company reserves the right to increase the price of your transfer arrangements to allow for variations in transportation costs due, taxis or fees chargeable for services and the exchange rate applicable to your travel arrangements.

3. CANCELLATION, REFUNDS AND INSURANCE 3.1. You may cancel your place on the Retreat at any time providing that the cancellation is communicated to the Hosts in writing or via email. Cancellation will take effect the day such notification is received by us. It is your responsibility to confirm that the Hosts have received your notice of cancellation. 3.2 . The following charges will apply in the event of cancellation. 3.2.1. 90 calendar days or more before start of Retreat (15 May 2017): A refund of 50% of your Retreat Fees will be given by the Company. 3.2.2. Under 90 calendar days before start of Retreat (15 May 2017): No refund of Retreat Fees will be given. 3.3. No refunds will be available from the Company for your flight costs or other incidental or consequential expenses under any circumstances. 3.4. Once the Retreat has commenced, no refund or part-refund on any unused portion of the Retreat will be repaid in the event of cancellation by you. 3.5. If you are prevented from attending the Retreat by genuine circumstances (e.g. insurable risks or other circumstances beyond your control), you may transfer your booking to another person provided that they meet all registration requirements relating to the Retreat. In such circumstances a refund of your Retreat Fees will be provided by the Company when full payment of Retreat Fees has been made by the person to whom your place has been transferred. 3.6. In the event of you being unable to attend the Retreat, the Company is under no obligation to assist in reselling your place.

4. CHANGES BY US 4.1. It is unlikely that we will have to make any changes to the Retreat but occasionally reasonable changes may have to be made (e.g., to itineraries, venue accommodation, scheduled yoga teacher, or other arrangements). The Company reserves the right to make such changes at any time. No refunds (full or partial) will be offered by the Company as a result of such changes. 4.2. The Company reserves the right in any circumstances to cancel your holiday, in which case we will offer a refund in full of all monies paid. Compensation will not be paid if the Company is forced to cancel or in any way change the Retreat arrangements due to events or circumstances beyond their control. Such circumstances include war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, or other circumstances which amount to force majeure. 4.3. Whilst the Company will use reasonable care and skill in providing the services included in the retreat, no guarantees, stated or implied are made by the Company regarding any aspect of the Retreat. In particular, there is no guarantee, stated or implied, regarding: 1) the number of participants or the age of participants taking the Retreat; 2) the amount of time that either of the Hosts or other teachers or guides will be personally leading the Retreat; 3) the time spent at any given location on the Retreat; 4) the nature of yoga classes, workshop sessions, or other subjective experiences on the Retreat; 6) any other aspect of the Retreat.

5. INSURANCE AND TRAVEL ARRANGEMENTS 5.1. WE STRONGLY RECOMMEND THAT YOU HAVE FULL TRAVEL INSURANCE TO COVER FLIGHT CANCELLATION, DELAY AND CURTAILMENT, MEDICAL EXPENSES AND PERSONAL BELONGINGS. IT IS YOUR RESPONSIBILITY TO OBTAIN AND MAINTAIN SUCH INSURANCE. 5.2. You need to have your own travel insurance and bring the details with you in case of an emergency. You are also required to provide details of next of kin as part of the booking process and you consent to the Company contacting your next of kin in the event of an emergency or other difficulties during the Retreat. 5.3. We do not book flights or other forms of transport for you. We may recommend suitable flights and provide directions but the Company is not responsible for your travel plans and arrangements or for any delays or changes which might be made to these by the airline. 5.4. It is your responsibility to confirm your flight times with your airline before your outward and return journey and to ensure that you have all documentation required to travel. 5.5. The company is not liable for your transport arrangements or for any accidents, obstructions to traffic, delays and related changes in schedule, or any follow up costs, which you might suffer as a result of such arrangements.

6. RETREAT PARTICIPATION AND LIMITATION OF LIABILITY 6.1. Save as set out in Clause 6.2 and the Release (in respect of the liability of the Company in relation to your participation in the Retreat activities) or in relation to fraud our liability to you for all losses and damages (whether in contract or tort) arising from these Terms, shall be limited to and shall not exceed the amount of the Retreat Fees which you have paid to us. 6.2. Your participation in the activities included within the Retreat (the “Activities”) is subject to the terms of the accompanying risk acknowledgment and waiver (the “Release”). For the avoidance of doubt, the Release forms part of these Terms and sets out our liability and that of the Hosts and other released parties (the “Released Parties”) in relation to damage or loss to you arising out of your participation in the Activities. 6.3. You further agree to waive and release the Company and its owners, agents, representatives, employees, independent contractors, and teachers (each a “Released Party”) from any and all claims, liabilities, damages, and expenses (including, without limitation legal fees and expenses) suffered by you as a result of any misstatements or misleading information made or provided by you in the application form or from your failure to disclose any physical or psychological condition which may impair or affect your ability to participate in the Retreat or otherwise affect your participation in the Retreat. 6.4. The Company reserves the right to refuse your participation in the yoga classes or other activities on medical, aptitude or fitness grounds in its sole and absolute discretion. 6.5. You acknowledge that the Company is not liable in relation to the provision or performance of any services of a third party that are merely arranged by the Company but not performed by them (including but not limited to accommodation and services provided by the Hotel, transfers and excursions). Any claims in respect or such third parties will be against them and not the Company. 6.6. The Company is not liable for any damage that the participant might suffer from other Retreat participants or any third party. 6.7. Personal belongings are left at the Hotel at your own risk. The Company does not accept responsibility for any loss, theft or damage to your property or personal belongings. 6.8. Yoga mats and props and any other equipment that is loaned or provided by the Company or the Hotel should be treated with care by you. You will be held liable for any damage or loss. 6.9. The Company reserves the right to refuse admission onto the Retreat or to terminate your participation in the Retreat in its sole and absolute discretion. Refusal of admission or termination may occur, for example in the event of unethical, unacceptable or disruptive behaviour and/or misconduct or if information provided is misleading, incorrect, incomplete or withheld by you. If admission is refused prior to commencement of the Retreat, the Company will refund the Retreat Fees (including the deposit). If your participation is terminated after the commencement of the Retreat no refund of Retreat fees will be given.

7. MISCELLANEOUS 7.1. If you have a problem during the Retreat you must inform the Hosts immediately, who will endeavor to put things right. If your complaint cannot be resolved locally, you must advise us in writing on your return. Any complaints in relation

to the Retreat must be addressed to the Hosts in writing and sent directly to them within two weeks of the end of the Retreat. 7.2. A Party shall not be in breach of these Terms, nor liable for any failure or delay in performance of its obligations under these Terms to the extent that such delay or non-performance is due to circumstances beyond that Party’s reasonable control. 7.3. Save as expressly contemplated in the Release (in respect of the Released Parties), the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms. 7.4. If any provision of these Terms is determined to be void, voidable, invalid, inoperative or unenforceable the remainder of the Terms shall continue in full force and effect; and to the extent permitted and possible the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest in meaning to the original term. 7.5. These Terms, together with the Release constitute the entire agreement between the Parties in respect of the Retreat. No purported amendment shall be valid unless provided in writing (in the form of a complete revised version of the Terms). 7.6. These Terms shall be interpreted in accordance with the laws of England and Wales. The parties irrevocably submit to the exclusive jurisdiction of the English courts and agree that any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way related to these Terms (including any non-contractual disputes or claims) shall be construed in accordance with English law.
