Executive Summary
1. The Government of Bangladesh (GOB) has undertaken the Second Urban Governance
and Infrastructure Improvement (Sector) Project (UGIIP-II) with financial assistance from
the Asian Development Bank (ADB) (Loan No. 2462 BAN (SF) together with co-financing
from KfW and GIZ to improve governance and urban service provision initially in 35
selected municipalities. Based on their performance and due to change of status of some
Pourashava, 4 of these municipalities were dropped in the 3rd phase and 16 new
Pourashavas were included in the project program covering a total of 51 Pourashavas all
over the country. Out of these 51 municipalities, 37 were financed by ADB and the
remaining 14 were funded by KfW
2. The project was implemented over a period of five years (2010 -2015) and variety of
subprojects have been undertaken under UGIIP-2 viz. Urban Transport (UT), Drain (DR),
Municipal Facility (MF), Sanitation (SN), Water Supply (WS), Solid Waste Management
(SWM) and Slum Improvement (SI). In total in phase 2, 1367 schemes (354 packages)
were implemented in 35 pourashavas. The project improved/upgraded 489872 m of
roads and 102666 m of drains. It also contributed to development of 2 no. municipal
markets, 14 no. kitchen markets, 2 no. community halls, 2 no. river fronts/ boat landing
ghats, 3 nos. truck/bus terminals/ parking, 3 nos. dumping grounds, street lighting, city
beatification schemes, production tube wells and water supply schemes, contributed
towards improvement of sanitation by developing community toilets and improvement of
living conditions in the slums areas through slum improvement schemes.
3. In phase 3, 1016 schemes (144 packages) were implemented in 47 pourashavas. The
project improved/upgraded 590382 m of roads, 43769 m of drains. It also contributed to
development of 2 no. municipal markets, 2 no. truck/bus terminals/parking, 2 no.
community halls/auditorium, river ghats, street lighting and city beatification schemes.
4. In phase 2, the highest number of road km developed is in Natore pourashava (36.27)
followed by Rangpur (29.45) and Jamalpur (29.35). These 3 pourashavas contributed to
19.4% of all the road length developed in the 35 pourashavas. For the drain projects the
highest number of drain km developed were in Comilla (5.78) and Noakhali (5.78)
pourashavas followed by Kurigram (5.77). These 3 pourashavas contributed to 16.88%
of all the drain length developed in the 35 pourashavas.
5. In phase 3, the highest number of road km developed is in Jamalpur pourashava (47.84)
followed by Faridpur (30.91) and Satkhira (22.38). These 3 pourashavas contributed to
17.13% of all the road length developed in the 47 pourashavas. For the drain projects
the highest number of drain km developed were in Chuadanga (10.17) pourashavas
followed by Kurigram (5.77) and Jhalakathi (4.92). These 3 pourashavas contributed to
47.66% of all the drain length developed in the 47 pourashavas.
6. UGIIP-2 draft RF was prepared following Bangladesh’s Acquisition and Requisition of
Immovable Property Ordinance (ARIPO) of 1982 (and its succeeding amendments) and
ADB’s Involuntary Resettlement Policy, 1995 (pre-Safeguard Policy Statement - SPS)
during project preparation in 2009. The RF was revised in January 2011 by MDS
consultants to include implementation facilitation and voluntary resettlement (including
voluntary removal of assets and land donations for the project). The UGIIP-2 project is
classified as category B for involuntary resettlement and category B for indigenous
peoples in considerations of the ADB Safeguard Policy Statement, 2009.
7. Initially MDS Regional Resettlement Specialists visited the proposed subprojects and
conducted the screening to identify potential IR impacts following a structured screening
form. The proposed subprojects were categorized as per the identified potential IR
impact. Under Phase 2 implementation 10 packages were assessed to have IR impacts
therefore SRPs for each package were prepared. Under Phase 3 implementation 8
SRPs were prepared. The SRPs were submitted to ADB for review and no objection.
8. Impacts are limited to removal of a few trees, temporary/permanent boundary walls,
shifting of business activities during the construction period and the like. Subsequent to
identification of the impacts through the screening exercise, socio-economic surveys of
the affected persons have been conducted to address the negative impacts and the
costs towards compensation as well as other assistances have been estimated in the
short RP. Because of the priority need for the proposed subprojects, there have been
instances where the local community have been forthcoming in voluntarily removing the
structure/assets to facilitate their implementation. In such cases, written consent of the
affected person(s)/ local community and the respective pourashava officials have been
documented. Where necessary, the SSA reports also included Short Resettlement Plans
(SRPs) that identified the APs and the compensation/assistance to be paid to the APs.
9. Total compensation paid under this project is BDT 33,516.00. This money has been paid
mostly for shifting/removal of trees, tea stall, shops etc from the project alignments.
10. In order to minimize land acquisition and resettlement, LGED adopted measures like
community consensus on the location of community facilities viz. sanitary latrines and
deep tube wells; realignment of ROW for community roads and bridges to achieve
minimum impacts on houses and structures and utilization of vacant Pourashava land for
solid waste management that will not pose health hazards to human settlements etc.
11. Out of 47 pourashavas, 14 PSs submitted proposal to Project Management Office (PMO)
for land acquisition to construct dumping ground and Bus Terminal (Bus Terminal-
Patgram PS). Total proposed land for acquisition of 14 PSs is 32.122 Acre’s. The land acquisition activities amounting to 24.792 acres that includes the fixation value of
TK.20,02,13,491.00 of which TK. 18,07,48,721.00 has been paid in 10 PSs (Faridpur,
Bhanga, Satkhira, Sreemongal, Chowmuhani, Patgram, Ghorashal, Benapole, Nachole
& Cox’s Bazar) were completed. Among the 10 Pourashavas that acquired land, 7 PSs
have been given payment fully.
12. Among the districts where the project pourashavas are located, possibility of affecting
indigenous people occured in Khagrachari, Banadarban and Mymensing. The
subprojects under UGIIP-II are located only within the urban area and do not impact any
cluster/habitation area where indigenous people reside. However, to ensure that
indigenous people are not adversely impacted, UGIIP-II undertook screening of all the
subprojects adopting a screening checklist before start of any project work.
13. MDS regional resettlement specialists were placed primarily to assist the PIUs in
monitoring, consultation with affected persons and stakeholders, liaison work with
pourashava, PIU, MDS safeguard unit, contractors and other persons involved in the
project. Monitoring reports by the safeguard team in the project are submitted every
month highlighting safeguard issues during the screening, implementation and operation
stages.
14. The Safeguard team of UGIIP II organised orientation cum training programmes on
implementation of safeguard issues during design, construction and operation stages of
the project for the PIU and contractor staffs and Municipal Engineers. To cover all the
pourashavas in the project, nine training programmes were planned where participants
were invited from 4/5 pourashavas at one regional venue.
15. The project has been complying with all the safeguard related loan covenants viz.
compliance to ADB”s safeguards policy, land acquisition, involuntary resettlement, ADB's
Policy on Indigenous People (1998), ADB’s Environment Policy (2002), local laws and
policies, labour laws etc. during various stages of the project.
16. Some of the important lessons learnt from the project that could be adopted in future
projects of similar nature include the following:
participatory approach with parallel activities viz. consultations, socioeconomic
surveys, visioning and planning meetings involving coordination committees at
ward and town level to prepare the Pourashava Development Plan (PDP) and
investment plan for sector wise priority schemes
Safeguard assessment and categorization of the schemes should be an integral
part of the template to review the project proposals submitted by the pourashavas
There should be clear procedures laid out in the RF including participation of
prominent citizens of the pourashava/ TLCC members etc. on negotiated land
acquisition and donation of land and/or non-land assets. The Resettlement
Framework should be clear on the process for documenting voluntary donation
by individual/community as the locals in the pourashavas actively participate in
the development process.
Workshops should be conducted periodically focusing on orienting the
participants on safeguard compliances during project planning and
implementation. Conduct of the workshops should be linked to the schedule of
award of the subprojects. There is a possibility that new contractors not involved
in earlier phases of the project would be inducted in to the project and training
programmes should be repeated in each phase of the project to cover all the
contractors.

Introduction
1.1 Background
The Government of Bangladesh (GOB) has undertaken the Second Urban

assistance from the Asian Development Bank (ADB) (Loan No. 2462 BAN (SF) together with
co-financing from KfW and GIZ to improve governance and urban service provision in 35
municipalities. These municipalities include Sunamganj, Srimangal and Golapganj in Sylhet
Division; Sreepur, Mirzapur, Ghorashal, Munshiganj, Jamalpur, Mymenshingh, Bhanga,
Faridpur in Dhaka Division; Brahmanbaria, Comilla, Chandpur, Parshuram, Noakhali,
Chowmuhani, and Cox’s Bazar in Chittagong Division; Jhenaidah, Narail, Benapole, Satkhira, and Bagerhat in Khulna Division, Thakurgaon, Kurigram, Rangpur, Dinajpur,
Nachol, Sirajganj, Nator and Gaibandha in Rajshahi Division; and Jhalakati, Bhola, Barguna
and Kolapara in Barisal Division.
In 3rd phase, 4 Pourashavas were dropped from the original program based on their
performance in phase - 2 and due to change of status of some Pourashava, those are
Rangpur and Dinajpur Pourashava in Rangpur Division, Comilla in Chittagong Division and
Bagerhat in Khulna Division. Moreover 16 new Pourashavas were included in the project
program. These Pourashavas are Dhanbari, Gopalganj, Madaripur, Madhabpur, Kakanhat,
Pabna, Nilphamari, Patgram, Kushtia, Chuadanga, Bandarban, Haziganj, Bashurhat,
Khagrachari, Lalmohan and Patuakhali. Overall, Phase - 3 included a total 47 Pourashavas
all over the country.
Out of 47 Pourashavas, ADB finances following 35 Pourashavas:
Bandarban, Barguna, Basurhat, Benapole, Bhanga, Bhola, Brahmanbaria, Chandpur,
Chowmuhani, Chuadanga, Cox’s Bazar, Dhanbari, Ghorashal, Golapganj, Gopalganj,
Haziganj, Jhalakati, Jhenaidah, Kakanhat, Kalapara, Khagrachari, Kushtia, Lalmohan,
Madaripur, Madhabpur, Munshiganj, Nachol, Narail, Noakhali, Pabna, Parshuram,
Patuakhali, Satkhira, Srimangal, and Sunamganj.
Remaining 12 Pourashavas as under are funded by KfW:
Faridpur, Gaibandha, Jamalpur, Kurigram, Mirzapur, Mymenshingh, Natore,
Nilphamari, Patgram, Sirajganj, Sreepur, and Thakurgaon
1.2 Context
This Social Safeguards Project Completion Report presents activities carried out at various
stages of the project to comply with ADB’s social safeguard policy and adherence to legal requirements of Government of Bangladesh.

2.1 Overall Achievements
This section presents the project
achievements in terms of physical achievements in
infrastructure development in various sectors and
the expenditure incurred in developing the same
2.1.1 Overall Physical Achievements
The Second Urban Governance and
Infrastructure Improvement (Sector) Project (UGIIP-
II) project was implemented in 2 Phases viz. Phase
2 and Phase 3. The project was implemented over

2.1.2 Overall Financial Achievements
For all the 51 pourashava estimated project cost was 7684.3 Million BDT and total
contract amount was 8017.9 Million BDT. In this project up to 31st May 2015 amount
of 8017.9 million BDT payments has been made. Hence overall financial
achievement is 100%

It is evident from table 2.3 above that urban transport sector subprojects dominated both
during the phase 2 (63.42%) and Phase 3 (94.29%). During Phase 2, Urban Transport
sector subprojects were followed by subprojects under drains (16.31%), municipal facilities
(10.39%), solid waste management (5.19%), sanitation (3.8%) and water supply (0.88%).
During phase -3, in addition to urban transport drain (3.15%) and municipal facility (2.56%)

2.2.2 Sector wise Financial Achievements
Sector wise financial achievement in all the sectors up to 31st May 2015 were found
to be 100% in all the sectors in each and every participating pourashava .
2.3 Pourashava wise Achievements
2.3.1 Pourashava wise Physical Achievements
Pourashava wise distribution of road and drain lengths and number of other
infrastructure facilities created in the pourashavas in phase -2 and phase 3 is
presented in table 2.4 and table 2.5 respectively.
In phase 2, the highest number of road km developed is in Natore pourashava
(36.27) followed by Rangpur (29.45) and Jamalpur (29.35). These 3 pourashavas
contributed to 19.4% of all the road length developed in the 35 pourashavas. For the
drain projects the highest number of drain km developed were in Comilla (5.78) and
Noakhali (5.78) pourashavas followed by Kurigram (5.77). These 3 pourashavas
contributed to 16.88% of all the drain length developed in the 35 pourashavas.
Pourashava wise length of road and drains developed in phase 2 is presented in
figure 2.11 and figure 2.12 respectively.
In phase 2, the highest number of road km developed is in Jamalpur pourashava
(47.84) followed by Faridpur (30.91) and Satkhira (22.38). These 3 pourashavas
contributed to 17.13% of all the road length developed in the 47 pourashavas. For the
drain projects the highest number of drain km developed were in Chuadanga (10.17)
pourashavas followed by Kurigram (5.77) and Jhalakathi (4.92). These 3
pourashavas contributed to 47.66% of all the drain length developed in the 47

2.3.2 Pourashava wise Financial Achievements
In all the 51 pourashava analysis of financial achievement up to May 2015 reveal the fact
that all the pourashava have utilised the total mony that was allocated to them as contract
amount for different dvelopmental activities. In all the pourashava maximum budget were
allocated for urban transport sector except the Noakhali poiurashava where maximum
budget was allocated for drain sector sub projects.Hence it may be stated that up to
May31,2015 financial achievement of all the participating pourashava were 100% .

Social Safeguards Compliance
3.1 Resettlement Framework (RF)
UGIIP-2 draft RF was prepared following Bangladesh’s Acquisition and Requisition of
Immovable Property Ordinance (ARIPO) of 1982 (and its succeeding amendments) and
ADB’s Involuntary Resettlement Policy, 1995 (pre-Safeguard Policy Statement - SPS) during
project preparation in 2009 and was finalized when the loan agreement was signed. The
main objective of the RF is to provide the policies and procedures in preparing and
implementing the resettlement plans (RPs) for all subprojects under the project. The RF was
revised in January 2011 by MDS consultants to include implementation facilitation and
voluntary resettlement (including voluntary removal of assets and land donations for the
project).
3.2 Project Categorization
The UGIIP-2 project is classified as category B for involuntary resettlement and
category B for indigenous peoples in considerations of the ADB Safeguard Policy
Statement, 2009. However, many of the Subprojects selected for implementation though fall
into Category B but during implementation it was found that for which Category C applies,
since these are likely to have minimal or no adverse Involuntary Resettlement (IR) impacts
or if any, are not considered significant. S ubprojects that have potential for Category-A
impacts are not included in the project.
3.3 Social Safeguard Compliance during Project Implementation
3.3.1 Updating Short Resettlement Plans prepared by PPTA Consultants
During project preparation, pilot subprojects in 3 pourashavas (Bhanga, Rangpur, and
Cox’s Bazar) were prepared as examples for the project. One of the tasks for the MDS consultants was to update these SRPs; however, this was not necessary because of the
following reasons:
(i) Bhanga draft SRP. The subproject (bus terminal) was not yet taken up. As of date
no progress has been done therefore updating of SRP is not necessary.
(ii) Rangpur draft SRP. The subproject (water supply) was not included in the list of
subprojects funded under UGIIP-2. Therefore updating of SRP is not necessary.
(iii) Cox’s Bazar draft SRP. The subproject (roads) was not selected during project implementation. Therefore updating of SRP is not necessary
3.3.2 Screening and Categorization of subprojects
Pourashavas submitted their subproject proposals to PMO.The PMO after its internal
review forwarded the proposal to MDS team leader who then forwarded it to the design team
for preparation to finalization of the subproject design. MDS Regional Resettlement

Specialists visited the proposed subprojects and conducted the screening to identify potential
IR impacts following a structured screening form. The proposed subprojects were categorized
as per the identified potential IR impact. The National and International Resettlement
Specialists conducted sample checks of the proposed subprojects and their categorization.
3.3.3 Preparation of Short Resettlement Plans

combination of subprojects/schemes) after the review of screening checklists and conduct of
transect walks/reconnaissance surveys:

MDS social safeguard team prepared SRPs for Category-B packages. Under Phase 2
implementation 11 packages were assessed to have IR impacts therefore SRPs for each
package were prepared. Under Phase 3 implementation 8 SRPs were prepared. The SRPs
were submitted to ADB for review and no objection.
3.3.4 Compensation and Rehabilitation
It has been observed in a large number of subprojects that the impacts are limited to
removal of a few trees, temporary/permanent boundary walls, shifting of business activities
during the construction period and the like. Subsequent to identification of the impacts
through the screening exercise, socio-economic surveys of the affected persons have been
conducted to address the negative impacts and the costs towards compensation as well as
other assistances have been estimated in the short RP. Because of the priority need for the
proposed subprojects, there have been instances where the local community have been
forthcoming in voluntarily removing the structure/assets to facilitate their implementation. In
such cases, written consent of the affected person(s)/ local community and the respective
pourashava officials have been documented. Where necessary, the SSA reports also
included Short Resettlement Plans (SRPs) that identified the APs and the
compensation/assistance to be paid to the APs. Total compensation paid under this project is

BDT 33,516.00. This money has been paid mostly for shifting/removal of trees, tea stall,
shops etc from the project alignments.
Pourashava wise details of APs and payment of compensation is presented in
appendices -1.
3.4 Land Acquisitions
3.4.1 Most land parcels are owned by local governments; o r Willingness to donate
land/non-land assets for the project by people. However, some subprojects, if require any
minor land acquisition and involuntary resettlement involving either physical or economic
displacement, restrictions to land use that will be duly complied with the IR and SPS of
ADB.
UGIIP-II is implementing as a sector project which aims to cover 47 Pourashavas
(secondary towns). The subprojects in UGIIP–II eligible for loan assistance from Asian
Development Bank (ADB) include roads, bridges, water supply, low cost sanitation, solid
waste management (SWM) and town center development as well as public markets and
upgrading of low-income communities. Project implementation is divided in three phases
over the period of 6 years. In Phase 2 when infrastructure improvement works has started.
Eligible subprojects shall have different area requirements and there are chances that land
acquisition would take place in their locations. In order to minimize land acquisition and
resettlement, the LGED has adopted the following measures for compliance by the
Pourashavas:
Utilization of existing lands for the rehabilitation of public markets, upgrading of
low-income communities, water supply and distribution, and town centre
development;
Community consensus on the location of sanitary latrines and deep wells;
Realignment of rights-of-way for community roads and bridges to achieve
minimum impacts on houses and structures;
Vacant Pourashava lands will be utilized for solid waste management that will not
pose health hazards to human settlements.
The Local Land Registration Office (LLRO) under the Office of the Deputy
Commissioner has assisted in verifying the status of ownership on lands to be acquired
following the request from the PMO. The ownership can be ascertained with the use of
cadastral maps that show the subproject area boundaries marked on lots that would be
affected. The LLRO identified the Affected Persons who have The LLRO identified the

who have lease agreement with any government agency and/or legitimate land owners. Such
assistance will be very useful for PIUs in knowing the APs that shall receive compensation for
the land. Status of land acquisition in UGIIP-2 up to May 2015 is given in table-4.1.

Study of table 4.1 indicates the fact that, 14 Pourashavas (out of 47 PSs) have submitted
proposal to Project Management Office (PMO) for land acquisition to construct dumping
ground and Bus Terminal (Bus Terminal-Patgram PS). The land acquisition activities of 10
Pourashavas (Faridpur, Bhanga, Satkhira, Sreemongal, Chowmuhani, Patgram, Ghorashal,
Benapole, Nachole & Cox’s Bazar) have been completed among 14 PSs. Total proposed
land for acquisition of 14 PSs is 30.682 Acre’s. Total acquired land in the 10 Pourashavas is
23.352 acres of which TK. 18, 07, 48,721.00 has been paid to the respective pourashavas by
the PMO.
PMO paid to Ghorashal Pourashava TK.2, 48, 80,385.17 for purchased the 1.100 acre land
instead of proposed land 2.540 acre for the purpose of Dumping ground. But Pourashava
paid to D.C office TK.2, 46, 94,857.Rest money is TK.1, 85,528 should be return to PMO.
The land is not yet under the possession of the said Pourashava

After getting the land value certificate from DC office, Mirzapur pourashava has submitted
estimated cost to PMO but it has not been paid yet. Narail Pourashava needs No Objection
Certificate (NOC) from Directorate of Environment. Local MP claimed against the proposed
land of Kurigram Pourashava, Bagerhat DC office has estimated land value for Bagerhat
pourashava and Pourashava has submitted the proposal to the PMO but it is not payable for
the Pourashava being dropped out from the Project

3.4.2 Pourashava wise Status of Land Acquisition
Money for Land acquisition in Faridpur, Ghorashal Bhanga, Benapole, Satkhira,
Nachole, Sreemongal, Chowmuhami, Cox’s Bazar and Patgram Pourashavas have been
given by the PMO. Total amount paid is BDT 18, 07, 48,721.
3.5 Compliance of Indigenous Peoples Safeguard
Safeguard Requirements 3 outlines the requirements that borrowers/clients are
required to meet in delivering Indigenous Peoples safeguards to projects supported by ADB.
It specifies the requirements pertaining to
Undertaking the social impact assessment and planning process;
Preparing social impact assessment reports and planning documents;
Disclosing information and undertaking consultation, including ascertaining
consent of affected Indigenous Peoples community to selected project
activities;
Establishing a grievance mechanism; and
Monitoring and reporting.
UGIIP-II is being implemented as a sector loan and originally covered 35 pourashavas
(secondary towns) that was later increased to cover 47 pourashavas during implementation.
Among the districts where these 47 pourashavas are located, possibility of affecting
indigenous people occurs in Khagrachari, Banadarban and Mymensing districts. However, it
may be mentioned that the subprojects under UGIIP-II in these districts are located only
within the urban area and do not impact any cluster/habitation area where indigenous people
reside. However, to ensure that indigenous people are not adversely impacted by the project,
UGIIP-II undertook screening of all the subprojects adopting a screening checklist before start
of any project work in all the 47 pourashavas. Compliance to the above specific requirements
for addressing Indigenous Peoples safeguard issues in the project has been carried out as
under:
3.5.1 Undertaking the social impact assessment and planning process
The planning process for identification of subprojects for inclusion in UGIIP-II followed a
participatory approach with parallel activities: consultations, socioeconomic surveys, and
initiation of Pourashava Development Plan (PDP) by means of open and facilitated ward level
coordination committee (WLCC) and town level coordination committee (TLCC) visioning and
planning meetings where potential schemes in each sector were proposed and discussed.
The visioning and planning workshops included participants from the communities directly
affected by the proposed schemes, members of ward committees, representatives of local
NGOs, and representatives of local government agencies. The PDP process is well
documented for each of the 47 pourashavas under UGIIP-II.

3.5.2 Preparing social impact assessment reports and planning documents
Under UGIIP-II all subprojects were screened for their impact on indigenous people
using a screening checklist Social Assessment Reports was prepared for each sector (roads,
bridges, water supply, low cost sanitation, solid waste management, drainage and other
municipal services such as market, slaughterhouse and bus terminal etc.), subprojects were
categorized as per ADB norm and SRPs were prepared wherever necessary.
3.5.3 Disclosing information and undertaking consultation, including ascertaining
consent of affected Indigenous Peoples community to selected project activities
In addition to the consultations held during project selection as part of PDP, detailed
consultations were held with local community while carrying out screening of the subprojects.
Participants in these consultations included local community representatives, other
community members/local residents including women participants.
3.5.4 Establishing a grievance mechanism
Each participating pourashava has grievance redress committee headed by the
mayor for redressal of any grievances due to the project. Each of the 47 pourashavas has
complaint boxes accessible to all to receive complaints/grievances.
3.5.5 Monitoring and reporting
Monitoring Reports by the safeguard team in the project is being submitted every
month highlighting safeguard issues during the screening, implementation and operation
stages.
3.6 Social Safeguard Unit and Management
Social issues of the project are coordinated by a Safeguard Officer within the PMO,
who ensures that all subprojects, comply with social safeguards. An social team who is part
of the MDS team implement the Social issues and RP Plan from each SRP to ensure that
mitigation measures are provided and protect the environment as intended. Figure 3.2
shows institutional responsibility for implementation of environmental safeguard monitoring at
different level.
SRP shows that most of the mitigation activities are the responsibility of the PIU.
Responsibility for the relevant measures assigned to the PIU and Contractors via the
contracts through which they are appointed, so they legally required taking the necessary
action. There are also some actions that need to be taken by LGED/ PMO in their role as
project proponent, and some actions related to the design that would be implemented by the
MDS consultant
A program of monitoring would be conducted to ensure that all parties take the
specified action to provide the required mitigation, to assess whether the action has
adequately protected the environment, and to determine whether any additional measures

may be necessary. This would be conducted by a qualified Resettlement specialist (RS) from
the MDS. The RS is responsible for all monitoring activities and reporting the results and
conclusions to the social team and recommend remedial action if measures are not being
provided or are not protecting the people interest. Social team will report the same to the
MDS team leader who will in turn inform PMO. PMO is responsible for taking action against
the contractor and the implementing pourashava.
RPs will be required preparation for new subprojects having involuntary resettlement
involving land acquisition and physical or economic displacement of people, if any. The RPs
to be prepared for the new subprojects in accordance with the approved RF and RPs
prepared under the PPTA, as required. The RF already sets out the requirements for
payment, compensation, income restoration and relocation, consultation, participation and
disclosure and the grievance redress mechanism. The PIU and PMO ensures that any
physically or economically displaced persons will be compensated prior to commencement
of civil works of subprojects where applicable, following the approved RP/safeguard
documents to be prepared by the MDS consultants. However, the entitlement matrix included
in the RF prepared and approved by ADB is working as the basis for estimation of
compensation and payment for the affected properties and income loss to the DPs/APs and
which, to be followed during preparation of new RPs for the subprojects requires/involves
land acquisition, resettlement and rehabilitations of the affected people are as follows:

3.7 Monitoring during Project Implementation
MDS regional resettlement specialists were placed primarily to assist the PIUs in
monitoring, consultation with affected persons and stakeholders, liaison work with
pourashava, PIU, MDS safeguard unit, contractors and other persons involved in the project.
The regional resettlement specialists visited the pourashavas regularly and submitted
monitoring reports to MDS safeguard unit for compilation and submission of monthly, Bi-
annual and Annual Reports.
Activities related to non-category B social safeguard (such as no objection letters from
those who volunteered their assets and willingly moved out of the subproject sites) are also
monitored by MDS regional resettlement specialists.

Project Orientation and Training
4.1 Training and Orientation Progammes
The Safeguard team of UGIIP II organised orientation cum training programmes on
implementation of safeguard issues during design, construction and operation stage of the
project for the PIU and contractor staffs and Municipal Engineers. To cover all the 47
pourashavas, nine training programmes were planned where participants were invited from
4/5 pourashavas at one regional venue. The status as training programmes conducted by the
safeguard team till 30th November 2014 is provided in table 4.1.
4.2 Environmental and social issues discussed in training programme
The training programmes already conducted at 5 pourashavas covered the following:
Discussed the uniqueness of the UGIIP-II project that has new as well as
rehabilitation projects belonging to various sectors viz. transport, river front
development/ghat development, water supply, drain, solid waste management,
sanitation, municipal facilities encompassing development of markets, street
lighting, city beautification etc. and slum improvement.
Explained the need of safeguard documents and implementation of safeguard
measures in the project in light of the loan covenants, GOB and ADB
requirements..
Discussed the safeguard issues related with various stages of the project and
also presented some case study related to the UGIIP-II to explain the relationship
of safeguard issues and project cycles.
Discussed the various social issues in the participating pourashavas observed /
reported by safeguard team during implementation of the various subprojects.
Mitigation measures suggested and implemented in various pourashavas was
also discussed.
Typical non compliance of safeguard measures observed during implementation
of various subprojects in different pourashavas was also pointed out to the
pourashava representatives. Specific issues discussed included the following:
Design Stage
Necessity to assess appropriateness/feasibility of subprojects recommended for
implementation, identification of affected persons, details of impacts on various public
and private assets, preparation of Resettlement Plan and identification of location
specific mitigation measures.
Consultation with local community, affected persons, pourashava officials,
involvement of women and vulnerable in consultation at various stages of the
project
Documentation of the process during project design including written confirmation
of voluntary donation where ever applicable.

safety issues in various subprojects were intimated to the pourashava
representatives.
Contract document in light of the environment health and safety issues were also
discussed and it was explained to the contractor and pourashava representatives
that implementation of environment health and safety measures is the contractual
obligation of the contractor.
Consequences of non compliance were also explained to them.
Specific good and bad practices from environmental safeguard point of view in
the participating pourashavas during construction discussed during the training
program included the following:
- Non use of personal protection equipments (PPEs) like helmets, shoes,
gloves etc. by the workers. This is a common problem in all the pourashavas
that were participating in the training. There is generally no provision of
drinking water or emergency first aid at the construction site.
- Poor hygienic conditions, no toilet in the labour camp set up by the contractor
- The issue of slope protection measures for water bodies and proper disposal
of construction waste was discussed as a necessity to protect the road side
water bodies.
Various social and resettlement issues of the project and discussed the
techniques and methods to minimise the social and resettlement issues during
project design and implementation.
Contractor and pourashava representatives raised the issues they are facing
during project selection, design and implementation; adherences to safeguard
measures were discussed in details in the forum and all the participants took part
in the discussion.
MDS Safeguard Specialists appealed to the participating pourashava and
contractors to look in to the safeguard issues and explained them that
implementation of safeguard issues are beneficial for each pourashava.

Lessons Learnt
6.1 Project Selection
Subproject scheme identification began in Phase I of UGIIP-II as part of preparing
the PDP. This process followed a participatory approach with parallel activities:
consultations, socioeconomic surveys, and initiation of Pourashava Development Plan
(PDP) by means of open and facilitated ward level coordination committee (WLCC) and town
level coordination committee (TLCC) visioning and planning meetings where potential
schemes in each sector were proposed and discussed. The PDP included the vision for
Pourashava development and investment plan for sector wise priority schemes based on
this process.
The UGIIP-II programme is implemented over 5 years time period. During the
implementation period pourashavas had elections and in some case there were changes in
elected representatives. Initially schemes included only in the PDP and recommended to the
PMO by the pourashava were taken up for implementation. After the pourashava elections to
accommodate the opinion and priority of changed composition of elected representatives,
schemes originally not in the PDP but later approved in the TLCC meetings were included in
the programme for implementation
6.2 Contract Packaging
Initially, due to the work load and package sizes, the contract packages were worked
out for different sectors separately. Later during Phase III, works in some sectors became
relatively small and to make contract packages of workable size, works of related sectors
viz. roads, road side drains and street lights etc. were brought under same package to
attract good contractors. From social safeguard point view, a comprehensive assessment of
the impacts becomes easier as the assessor looks at a total sector project instead of sub-
sectors there by reducing the scope of any oversight.
6.3 Project Design
The proposals for various schemes from the pourashavas were routed to the design
team of MDS Consultants through the PMO and the reviewed schemes were recommended
to the PMO from design team of MDS consultants. The review by the design team focuses
on the engineering and financial feasibility leaving aside the safeguard reviews in detail. In a
large project like UGIIP II where safeguard team works as a different unit from the
engineering section, it is possible that some of these proposals may get recommended to
the PMO without proper assessment of the social impacts by the engineering team. The
safeguard assessment and categorization of the schemes should be an integral part of the
review template of the MDS team to avoid such possible occurrences.

6.4 Public Consultation
During preparation of the PDP, a wide range of stakeholders had the opportunity to
make substantive comments on existing conditions and preferences for infrastructure
improvement. Town residents were exposed to the concept of the project by their direct
involvement and through citizen’s groups and ward committees. The visioning and planning
workshops included participants from the communities directly affected by the proposed
schemes, members of ward committees, representatives of local NGOs, and representatives
of local government agencies.
During conduct of screening for categorisation of schemes, stakeholders from local
community including women, elderly and prominent citizens, school teachers, affected
persons were consulted on the likely impacts due to the project, suggestions for
improvement in the design and smooth implementation of the schemes. During these
consultations, pourashava officials and elected councillors along with the MDS consultants’ social experts were present. In some cases the community was eager to have the proposed
schemes and went to the extent of voluntarily providing land, cutting trees, removing
boundary walls for the project purpose. These consultations could be more effective if prior
intimation of the programme is given to the local community through pourashava.
6.5 Land Acquisition
Land acquisition in the project was required for SWM and Bus terminal schemes in
14 pourashavas. After initial assessment of the site and land requirement, pourashavas sent
their LA proposals to the PMO for administrative approval. Local Land Registration Office
(LLRO) under the Office of the Deputy Commissioner assisted in verifying the status of
ownership on lands to be acquired following the request from the PMO. The LLRO identified
the Affected Persons based on holding numbers on the cadastral maps and those who have
lease agreement with any government agency and/or legitimate land owners. The LA was
carried out as per the provisions under Acquisition and Requisition of Immovable Property
Ordinance of 1982 (ARIPO).
The RF for the project prescribes replacement cost to the APs losing land
permanently due to the project. To comply with the RF, it has to be ensured that there is
budgetary provision made by the PMO for the amount to be given to the APs as assistance
for replacement value of the acquired land on and above the award cost by the LLRO. This
amount is to be paid through the pourashavas and proof of payment is to be maintained for
independent monitoring. Alternatively pourashavas may opt to consider negotiated land
acquisition/willing seller willing buyer approach to fulfill land requirements of the subprojects
as this procedure is quicker that ARIPO’s. There should be clear procedures laid out in the
RF including participation of prominent citizens of the pourashava/ TLCC members etc. on
negotiated land acquisition and donation of land and/or non-land assets.
6.6 Documentation of voluntary donation process
During subproject screening and public consultations, most often the local community
and affected persons volunteered for donating land and/or non-land assets and expressed
full cooperation during implementation of the proposed subprojects. There was no clear cut

procedure in the RF for documenting the voluntary donation process. MDS consultants
developed a format for obtaining written confirmation from the affected persons. The written
confirmation documents of voluntary donation were also countersigned by the ward
councillors and other pourashava officials and became part of the Social Safeguard
Assessment (SSA) Reports that were submitted to the PMO.
6.7 Payment of Compensation/Assistance to APs
Compensation/assistance was paid to the APs for land and/or non-land assets.
Compensation for loss of land was paid as per the award from LLRO. For loss of non-land
assets viz. trees, structural loss of kiosks/small shops etc. assistance to APs as identified in
the Short Resettlement Plan (SRP), were paid by the pourashava. There was confusion on
the source of fund (PMO/Pourashava/project contractor) for payment of these assistances.
This assistance amount is part of the project cost and there should be clear procedures laid
out for including these costs as identified in the SRP in the overall project cost while
approving the subprojects.
6.8 Grievance Redress
The project adopted participatory approach that involved stakeholder consultation at
various levels for selection of priority subprojects, there by inviting reducing the scope for
grievance on subprojects taken up for implementation. However, during construction, there
were grievances regarding the contractors’ viz. transgression to private land and sometimes demolishing private structures, use of poor quality construction materials by the contractors,
non-provision of temporary access to houses etc. The RF outlined formation of GRCs at
different levels to address these grievances; pourashava being the nodal institution to
constitute the committees. Formation of committees to address grievances at local level
(ward level) will be more effective in this regard.
6.9 Institutional Arrangement
PMO at the head quarter level coordinates the safeguard compliance aspects in the
project. Initially during phase 2 implementation, it had a designated officer to oversee and
coordinate with MDS consultants as well as the pourashavas on both environmental and
social safeguard compliances. Subsequently, during phase 3 implementation the number of
staffs in the PMO reduced and coordination of safeguard aspects were carried out at the PD
and DPD level who are vested with other important administrative responsibilities. It is
recommended that the designated official be positioned till the end of the project as the
programme is continued as UGIIP III and lessons learnt from implementation of UGIIP II
would provide important inputs for successful implementation of UGIIP III.
6.10 Monitoring during Implementation
Random periodic monitoring of social safeguard compliances was carried out by
MDS consultant’s social safeguard experts. The location of the project pourashavas are
spread all over the country. Initially during phase II implementation Regional Social
Safeguard Experts were in place and monitoring of safeguard activities was carried out
every month in all the regions. Subsequently, during phase 3 implementation manpower

deployment in the project was reviewed and social safeguard experts were stationed at the
head quarter. The monitoring activities continued but suffered owing to frequent political
disturbances and difficulties in movement to pourashavas located at peripheral areas. It
would be better to continue with the regional positioning of the social experts for monitoring
purposes.
6.11 Logistical Support for Monitoring
A large project like UGIIP 2 that had in its ambit 35 and 47 pourashavas in phase 2
and phase 3 respectively spread all over the country and had 16 social and environmental
safeguard experts in the safeguard unit (2 International, 2 National and 12 Regional experts)
did not have the support of a dedicated transport for safeguard monitoring. Although the
logistical support in place was in the form of budgetary allocation, the fund gets utilised for
various types of other monitoring viz. quality assurance, administrative issues etc. It is
recommended that in a large project like UGIIP 2 there should be a dedicated transport for
safeguard monitoring.
6.12 Orientation and Training
Although capacity building of various stakeholders was part of a separate
consultancy assignment, MDS consultants conducted workshops at regional level for
pourashava staff and contractors’ personnel. The workshops focussed on orienting the participants on safeguard compliances during implementation. Conduct of the workshops
should be linked to the schedule of award of the subprojects. There is a possibility that new
contractors not involved in earlier phases of the project would be inducted in to the project
and training programmes should be repeated in each phase of the project to cover all the
contractors.
6.13 Studies and Feedbacks
The safeguard team visited various pourashavas for monitoring of the safeguard
compliances and had discussion on various project aspects with the pourashava senior
officials including the Mayor, Pourashava Secretary and Executive Engineer etc. They also
interacted with the contractors and their field personnel on the safeguard compliance issues
during project execution. Some of the views expressed by the participants are summarised
below:

It will be easier to monitor environmental safeguard compliances if the project
cost includes some budget for the workers accommodation at site, PPEs,
provision of emergency health care facilities like first aid box etc.
Need more budget/allotment for the maintenance of the completed works under
the project.

adherence to construction schedule has been a regular practice. It would be
better if a schedule programme of monitoring is drawn up right in the beginning
of the implementation and shared with the pourashava as well the contractors.
The Mayor got the opportunity for some external training that widened his vision
for better infrastructure planning and management. He would be undertaking a
tree plantation scheme along the improved roads soon.

The project has built awareness among citizens to pay for the services like water
& electricity, and property tax etc. This has improved financial health of the
pourashava.
Priority requirements in all sectors could not be taken up under the project due to
limited funds. The unfulfilled requirement of a solid waste dumping ground and
some new roads are the immediate priorities of the pourashava.

CONCLUSION
7.0 Conclusion
UGIIP II (Sector) Project took some innovative approaches towards urban
infrastructure development in project pourashavas viz.
Participatory approach in selection of subprojects &
Formation of Community Based Organisation (CBO) for collection smooth
opinion to selection priority projects and to established channels during
preparation of PDP
Formation of TLCC, WLCC etc. and regular meetings with them for smooth
project implementation
Preparation of Pourashava Development Plan (PDP) including annual
investment plans for priority projects
Negotiated land acquisition/ willing seller willing buyer approach to fulfill land
requirements and voluntary land donation for project activities
Capacity building for municipal revenue generation and infrastructure
management
The participating pourashavas in the programme were mostly of medium size and
the inherent infrastructure deficiency in them encouraged the local communities to visualize
UGIIP II as an opportunity for them and almost in all the subprojects they came forward to
facilitate smooth project implementation. In most of the cases, the local community offered to
voluntarily contribute land and other assets viz. trees, other structures like boundary wall etc.
that are likely to be affected by the project. The project being funded by the Asian
Development Bank, KfW and GIZ, MDS consultants had to develop a mechanism to
encompass local community’s desire and also to comply with the Bank’s safeguard policies. Thus, a documentation of the voluntary donation process was developed and incorporated in
the Social Assessment Reports.
The lessons learnt on various aspects of the project including selection, design,
procurement and implementation highlights the need for inclusion of feedbacks from project
stakeholders in future panning of urban development and infrastructure development
projects.
