As human resource professionals, we are fortunate to have a variety of opportunities to connect and learn

through association chapter meetings and events; online learning sessions and webinars; social networking

sites and forums; and formal conferences. The reality is that it sometimes can be challenging to select which

resources and events will best allow for strategic learning that will benefit your current role and further your

professional development. RWHRMA developed a unique event to target senior level HR professionals,

creating sessions geared toward SPHR and GPHR strategic credit and networking opportunities for leaders

with over ten years of experience.

RWHRMA is pleased to share that the second annual Strategic HR Summit will be held on February 27 & 28 in

Downtown Raleigh. Keynote speakers will include Sandy Costa, sharing expertise from over 40 years in

executive and senior operating management positions in “The Attributes of Great Leaders” and Ben Casnocha,

award winning entrepreneur and author, leading “Reinventing the Employer-Employee Contract in an

Entrepreneurial Age.”

Amy Hoover, HR/Business Support Services Manager for Arysta LifeScience and leader of the planning efforts

for the Strategic HR Summit, exuded, “We are so excited to be hosting the Strategic HR Summit again in 2014.

This day and a half executive and senior level event is the first of its kind for NC. We offer an intimate setting of

approximately 100-150 HR leaders from large and small companies for thought provoking mega sessions

designed to challenge leaders to up their game in leading and growing their business. We are planning for

another outstanding line-up of strategic and global focused topics and spotlight key partnerships with a select

group of industry leading providers such as Ogletree Deakins, and Stanley Benefits.”

WORKPLACE PROTECTIONS FOR

SEXUAL ORIENTATION AND GENDER

IDENTITY INTRODUCED IN UNITED

STATES SENATE

On Wednesday, July 10, the United States Senate Committee on Health, Education, Labor and Pensions passed

a bill containing the first federal workplace protections for sexual orientation and gender identity since 2002.

The Employer Non-Discrimination Act (ENDA) has been sent to the Senate floor for further consideration and

it is expected to be considered by the full Senate this fall. If enacted, relevant considerations include the

following:

■ ENDA would apply to all employers, employer agencies and labor unions with 15 or more employees. It

would not apply to religious organizations, the military, unpaid volunteers, or various protected federal

employer classes.

■ ENDA would make it illegal for employers to refuse to hire, fire, or discriminate against an individual with

regard to his or her compensation, terms, conditions, or privileges of employment on the basis of such

individual’s actual or perceived sexual orientation or gender identity.

■ ENDA extends federal employment discrimination protections which are currently provided on the basis of

race, religion, gender, national origin, age and disability to sexual orientation and gender identity. Thus, it

contains no requirement to affirmatively hire or retain a specific percentage of LGBT employees. It also

contains no requirement that employers grant preferential treatment to any individual or group on the

basis of their actual or perceived sexual orientation or gender identity.

■ ENDA does not permit disparate impact claims but only disparate treatment claims on the basis of sexual

orientation or gender identity.

■ While the bill contains protections for transgendered employees, it nevertheless preserves employers’ rights

to enforce a workplace dress code for the employee’s chosen identity and during any transitional period

that may take place. The bill does not require employers to create new facilities for transgendered

employees.

If ENDA is passed, the federal government will join the twenty-one states and the District of Columbia which

have enacted laws prohibiting workplace discrimination on the basis of sexual orientation. Sixteen of these

states’ laws include provisions prohibiting discrimination on the basis of gender identity as well.

Gender identity is defined as an individual’s self-conception as being male or female. If a person’s self-

conception differs from their actual biological sex, they are said to be transgendered. Sexual orientation is an

enduring pattern of emotional, romantic, and/or sexual attractions. It also refers to an individual’s sense of

personal and social identity based on those attractions, behaviors expressing them, and membership in a

community of others who share them. Gender identity and sexual orientation are therefore similar in the fact

that both reflect an individual’s self-conception. They differ in the fact that sexual orientation also includes a

behavioral component and is therefore a more observable trait.

If you have questions or concerns about this pending legislation or other legal issues, please feel free to contact

Governmental Affairs Director Connie Carrigan at [email protected].
