The English’s are new to the retail business. Judy worked in El Dorado County as a Deck Hand for the Real Mc Coy Ferry for 5 ½ years and Tom still works for Caltrans as a Draw Bridge Operator. Tra- din Post is open Monday thru Saturday from 10-6. Their Grand Opening Cel- ebration will be Saturday January 29 all day long. They will be serving hot dogs and soda. Rio Vista City Council

Annexation of land into the Lighting and Landscaping District (LLD) No. 95-2(Summerset Rio Vista) dominated the discussion during the City Council meeting held January 20, 2011. Recently, questions have been raised concern-ing whether land at Trilogy has been officially annexed into the District. In an ef-fort to resolve the issue, the City Council directed staff to do everything possible to locate the original docu-mentation that includes the provision permitting subsequent phases of the development to be auto-matically annexed and/or a provisionof approval that future properties be annexed into the District. According to the staff report, nosuch documentation has been found. Due to past practices and past filing procedures, it has notbeen uncommon for staff to be unsuccessful in locating historical documents. How-ever, City staff has been

able to locate documenta-tion that formation of the District was approved by the City Council during a public meeting on April 18, 1996 and on May 16, 1996. No written protests to the formation of the District were received, and on May 16, 1996, the City Counciladopted the formation of the Summerset Rio Visa LLD No. 95-2. The City Council will have to decide whether to proceed with a ratification process. This would entail the Council approving a resolution that adopts the position that the remainder of the District is in fact a part of the District because property owners in subsequent phases of Trilogy were assessed and because they received a special benefit from the as-sessment. The Councilreceived one written protest to this ratification. The protest asks for the City to undergo a Prop 218 process to allow the property owners to vote on whether to continue to be

part of the LLD.Moving forward toward a way to resolve the issue, the City Council will hold a meet-ing at Trilogy to discuss the appropriate next steps. During last night’s Council meeting, I raised several concerns. Here are a few of them:• The City is current-ly preparing for a Prop 218 vote on water and sewer rates The City has limited staff There is a $460,000 deficit in the General Fund If annexation into the LLD is not approved, the City will be responsible for the landscape and lighting now covered by the LLD How will the City pay for the landscape and light-ing maintenance? Wll the maintenance provided by the LLD funds continue if the City cannot pay for maintenance? Will the areas around Trilogy be-come blighted? What will happen to property values at Trilogy? At the time of this writing a date for the meeting had not been set. It is anticipated that one will be scheduled soon. Upcom-ing Special City Council Meeting On Wednesday, January 23, 2011 at 5:30 p.m., the City Council will hold a special meeting to discuss the budget. Also on the agenda will be a proposal for an alternative plan of action in light of the filing of the Citizens’

Initiative to Rollback the Water and Sewer Rates. I will present the Council with a proposal for a Plan B. It is imperative that the City investigate and exam-ine all possible options. For the past few years, many conversations have started with “in these eco-nomictimes…”. We have all changed our spending habits either from necessity or fear and when I meet people that take time out of their busy schedules to help others, I amhonored. That is how I feel about the people in the Senior Coalition of the East Bay. This is a group of caring volunteers that get together once a month to share ideas and solutions to issues involving seniors. They provide me with a world of information and I am a sponge, absorbing everything I can and writ-ing the rest down so I don’t forget anything.I will be sharing this wealth with you over the next several articles.Without Walls is a program that blew me away when I heard about it. It’s free and simple and just plain great!

Senior Center Without Walls offers activities, friendly conversation and an assortment of classes to adults over 60 who find it difficult to get to activi-ties in their communities. From the comfort of your own home you can use the telephone to connect to their programs. Some of the activities include things like a book group,guided tours of other coun-tries, word games, puzzles, bird watching and support groups. These are just a few! You can call them to see how you can participate at 510 444 5974 or toll free at 1 877 797 7299. Susan-nah Meyer is the program manager for Friendly Visi-tors at Meals on Wheels by Senior Outreach Services and I learned that it’s not just an organization that provides needed meals. They offer a program for seniors that are isolated and would like to have acaring, dependable visitor with a positive outlook and a big smile come and spend some time with them. They can set up one visit or one each week. These sweet people offer their time free of charge to take a walk, share memories, have a cup of tea or just chat

The California Highway Patrol in Fairfield will be conducting a Start Smart class. The CHP will be host-ing a class on January 27th , 2011. These classes will be held at the CHP Office at 3050Travis Blvd. in the city of Fairfield. Classes will run from 6-8 P.M.Start Smart is an education program for both teenage

drivers and their parents. Statistics show that young drivers who have recently received their driver’s license are five times more likely to be involved in an accident than more seasoned, experienced drivers. Traffic accidents continue to be the leading cause of death for young people, age 15-20. Start Smart is a review of the

rules of the road, some video clips and related movies designed to inform parents of the restrictions on teen drivers and give some important informa-tion to those teens that are about to or have recently received their license. There is no cost for the classes, no need to sign up and parentsare welcome to attend.

Last week we were in Covina. We left Rio Vista in sweaters and arrived in Covina to see people wearing summer clothes and shorts. It was a gift to see the surrounding mountains. Usually the smog obliterates the view, but this time we were given a glance at the majesty of the snow capped peaks. I was reminded of the song “There Will Be Peace in the Valley,” but peace there was not. Two high schools had to be shut down due to gunfire. One was in Garde-nia and one in Woodland Hills. Peace was replaced with fear. On our return to Rio Vista there was an Amber alert on highway five. All of this is on the heels of Tucson could give one a spirit of fear. The twenty third Psalm says,” Though I walk through the shadow of death I will fear no evil.”In my opinion we walk in the shadow of many things and one of them is fear. Norman Vincent Peale said that fear was a conglomeration of sinister shadows and a

shadow has no substance. It would be easy to allow the spirit of fear to perme-ate our lives especially with the recent event in Tucson. Some once said that fear is an acronym meaning False Expectation Appearing Real. The truth is a bridge to living without fear. The truth is Jesus. He enables us to exit from a position of fear to a posi-tion of faith. It is very easy to fall into a fear pattern when we look at all of the recent acts of violence cou-pled with the current eco-nomics . However scripture continually reminds us that in Christ there is no fear. If he is our Shepherd then he sends his angels,”Shirley Goodnest” and “Marcy” to follow us all the days of our lives. Jesus also told us,”See to it that you are not alarmed!” (Matthew 24:6) The Message reads,” “When reports come in of wars and rumored wars, keep your head and don’t panic!” When someone re-sponds to a request with,” I will see to it” it confirms their commitment. The

Lord tells us to see to it that we are not alarmed and by all means do not panic…he has the whole world in his hands. Though we walk through the valley of the shadow of fear our Shep-herd, the Lord Jesus Christ, goes before us and leads us. No matter what we see or hear that causes fear God is still in control.This week I tried to find the site of the Azusa Street Revival which was an amazing outpouring of the Holy Spirit in the early 1900s. It was a historical event that was the begin-ning of the Pentecostal movement. We had the address but there was nothing there. I thought that there might have been a placard or something to denote the miracle but there was nothing to be seen. However we know that a mighty movement of God happened. The Holy Spirit cannot be seen or contained but it can be experienced. The Azusa experience is one of history but it could happen again. I believe there is untapped power available to all Christians at this very moment. This is the power from the Holy Spirit .This power will zap the power of fear. When we walk in the spirit we can see Shirley Goodnest and Marcy following us. For those who do not remember

SUFFERING LENDER ABUSE

Q. Being laid off at work, my Wife was struggling to make payments and we fell behind on our house payment. Our lender of-fered a loan modification with a reduced payment, and if we made that payment on time for 3 months, then they would make that be the payment I made from then on. Instead, after I made the reduced payment on time for 3 months, they de-cided I didn’t qualify and told me I had to make up the difference of the new payment and original, plus late fees and penalties. That came to $7k which I don’t have, so now they are going to foreclose! What was the point of all the modification

nonsense? J.W. Rio VistaA. The federal government, in an effort to slow the rate of foreclosures, initiated the Making Homes Affordable program to force lenders to work with home owners. Before they can foreclose, if you are still living in the home, they must offer a loan modification. Mostly what is happening is the lenders/Banks are using a “check that box” attitude toward loan modifications. As long as they can show they at-tempted a modification, then they can move on to a short sale or foreclosure. The rate of successful modifications has to be less than 5% of applicants. Your lender is simply going to look at the most profitable aspect of your loan, and usually that involves selling and mov-ing on. Unfortunately, the process raises your hopes

and sets you up for a big letdown at the end, and it seems to me the lender should be made more ac-countable for stomping on your emotions and sending you into anxiety with fear of being homeless. There are no solutions to this horrible misuse of the good intentions of the Making Homes Affordable program, and the federal govern-ment cannot force evalua-tion policy on lenders and banks, so they dowhat is required and then foreclose.Some tips for the time after you have moved out and your lender if fin-ished abusing you, protect as much of your credit as possible. Don’t give up and just stop paying everything. You will probably have to rent, so you will need enough credit to pass a screening. Pay everything you can, especially utilities. A credit score as low as 550 can still put you in a rental, so mediate credit cards and anyone else you owe for smaller monthly pay-ments and be on time every month. When you get back to work, you can recover

your higher credit rating, and after 2 or 3 years even buy another home. Q. My home is being sold on a short sale. I haven’t been able to make my house payment, but I couldmake a rental payment which is about a third as much. My problem is bad credit from inability to make the house payment, and rental companies keep turning me down. Is there any solution? T.V. Rio Vista A. Trying to rent through property management com-panies will be more diffi-cult; typically they manage but do not own the proper-ty, so they must meet owner guidelines on qualifications. What you want to look for is a “for rent” that is direct from the owner. They will be more con-cerned about ability to pay rather than credit. Often they don’t even pull the credit, so don’t go to them saying how bad your creditis! Be honest if asked, but also be advised that every time your credit is pulled, your score drops 8-23 points. So, if you are ap-plying direct to homeown-

When the coyotes wailed at night the shepherd threw more logs on the fire. As he did so he saw thousands of little lights all around him. He realized that they

were the eyes of his sheep. In the midst of danger the sheep were looking towards the shepherd not toward the coyotes. Look to Jesus…(Hebrews 12)….Look for his angels Shir-ley Goodnest and Marcy! They will follow us so we can dwell in the house of the Lord …not the house of fear. Courage is fear that has said its prayers.

One of the many decisions buyers have to make when purchasing a home is the way in which they want to hold title. There are many options available and each option differs in regard to the division of interest in the property and the way in which the property is con-veyed. Here are the most common ways to take title:

Sole Proprietorship: One person takes title. The owner may sell the orwill the property as he or she chooses. All decisions are made by a singleperson in regard to the dis-position of the property.

Community Property: Title can only be held by a husband and wife only. Each owns an equal share. Both manage and both must consent to a sale. Each may will his/her share to heirs. If there are no heirs, upon death, the share of the decedent passes to the surviving spouse.

Joint Tenancy: Any number of persons can hold title. Title can be between husband and wife or any number of individuals; corporations are excluded. All persons have equal and undivided interest. Upon

death, the share of the decedent passes to those remaining on title.

Tenancy in Common: Any number of persons or corporations can hold title. The shares can be equal or unequal. An individual share may be conveyed separately through a sale or through death. A new heir or purchaser will become a tenant in common with other existing owners.

Partnerships: Any number of persons or corporations may hold title. There must be at least two. A share may be sold or conveyed with the consent of all par-ties. An heir or new owner will become a partner withthose already holding title.

Trust: Title is held by a trustee. Interest in the property may be held byan individual, corporation, group or partnership. Dis-position of shares arestipulated by the terms of the trust. Each interest may be conveyed orwilled to heirs separately according to the terms of the trust.

Six Ways To Take Title

The Wall Street Journal is reporting that “affordability” is the top reason for home buying in 2010. Given the current market conditions, this makes sense. Accord-ing to another survey by Weicher Realtors, buyers are looking for a bargain, but more than ever, they are being drawn by low home prices and low interest rates.

What about pride in hom-eownership? Buying a home because they don’t want to rent was not the driv-ing force. Instead, it comes down to price. Another fac-tor was the desire for more living space. According to the survey, 28% of the re-spondents said they bought a house “because they wanted more living space or a larger property”. However, 11% of those surveyed said that “potential financial growth” motivated them to pur-chase a home. Only 12% of respondents said they bought a house in 2010 due to relocation.

Real estate agents believe that buyers are still motivat-ed by the potential financial growth, but indeed a good value in the form of low interest rate and discounted home prices is the driving force these days.

Currently the 30-year fixed-rate mortgage (FRM) averaged 4.74 percent with an average 0.8 point for the week, up from last week when it averaged 4.71 per-cent. Last year at this time, the 30-year FRM averaged 4.99 percent. The 15-year FRM this week averaged 4.05 percent with an aver-age 0.8 point, down from last week when it averaged 4.08 percent. A year ago at this time, the 15-year FRM averaged 4.40 percent. The 5-year Treasury- indexed hybrid adjustable-rate mortgage (ARM) averaged 3.69 percent this week, with an average 0.7 point, down from last week when it averaged 3.72 percent. A year ago, the 5-year ARM averaged 4.27 percent.

How long will prices remain low? The answer to this question involves a complex analysis of the depressed housing market. How many more foreclosures or short sales will we continue to see? Predictions vary. Somebelieve that in the latter part of 2011, five years after the last batch of five year ARMs drives homeowners to seek relief, we will begin to see a slow rise in home prices.
