INTRODUCTIONGovernment of India has enacted the Energy Conservation Act, 2001 keeping in viewof importance and benefits of energy efficiency. The Schedule t o the EnergyConservation Act provides list of energy Intensive Industries and other establishments,specified as Designated consumers. As the notified Designated consumer has to take upcertain activities mandatory under the Act, the Bureau of Energy Effi ciency (BEE) hasapproved notification of such of the industrial units as Designated Consumers.

A Designated Consumer has to designate or appoint energy manager possessing aminimum qualification [to be notified in the Regulation]. The energy manager occup iesan important position and is focal point of all the activities pertaining to energyManagement in the organization. He will have certain mandatory duties &responsibilities that will be prescribed in the Regulation to the Act. The energy manageris expected to develop an energy Management Action Plan for the industrial unit andcan play key role in the formulation of corporate energy policy. The energy managerhas also to furnish information relating to energy consumption of the industrial unit tothe BEE and state level designated agency as required under the Act. The energymanager has to also implement the recommendation of the Accredited energy auditor.

Energy AuditAn energy audit is an inspection, survey and analysis of energy flows in a buildin g,process or system with the objective of understanding the energy dynamics of thesystem under study. Typically an energy audit is conducted to seek opportunities toreduce the amount of energy input into the system without negatively affecting theoutput(s). When the object of study is an occupied building then reducing energyconsumption while maintaining or improving human comfort, health and safety are ofprimary concern. Beyond simply identifying the sources of energy use, an energy auditseeks to prioritize the energy uses according to the greatest to least cost effectiveopportunities for energy savings.

Types of Energy Audit

The term energy audit is commonly used to describe a broad spectrum of energy studiesranging from a quick walk-through of a facility to identify major problem areas to acomprehensive analysis of the implications of alternative energy efficiency measuressufficient to satisfy the financial criteria of sophisticated investors. Three common auditprograms are described in more de tail below, although the actual tasks performed andlevel of effort may vary with the consultant providing services under these broadheadings. The only way to ensure that a proposed audit will meet your specific needs isto spell out those requirements in a detailed scope of work. Taking the time to prepare aformal solicitation will also assure the building owner of receiving competitive andcomparable proposals.

Preliminary Audit

The preliminary audit (alternatively called a simple audit, screening audit or walk-through audit) is the simplest and quickest type of audit. It involves minimal interviewswith site-operating personnel, a brief review of facility utility bills and other operatingdata, and a walk-through of the facility to become familiar with the building operationand to identify any glaring areas of energy waste or inefficiency.

Typically, only major problem areas will be uncovered during this type of audit.Corrective measures are briefly described, and quick estimates of implementation cost ,potential operating cost savings, and simple payback periods are provided. This level ofdetail, while not sufficient for reaching a final decision on implementing a proposedmeasures, is adequate to prioritize energy -efficiency projects and to determine the needfor a more detailed audit.

General Audit

The general audit (alternatively called a mini -audit, site energy audit or detailed energyaudit or complete site energy audit) expands on the preliminary audit described above bycollecting more detailed information about facility operation and by performing a moredetailed evaluation of energy conservation measures. Utility bills are collected for a 12to 36 month period to allow the auditor to evaluate the facility's energy/demand ratestructures and energy usage profiles. If interval meter data is available, the detailedenergy profiles that such data makes possible will typically be analyzed for signs ofenergy waste. Additional metering of specific energy -consuming systems is oftenperformed to supplement utility data. In-depth interviews with facility operatingpersonnel are conducted to provide a better understanding of major energy consumingsystems and to gain insight into short and longer term energy consumption patterns.

This type of audit will be able to identify all energy-conservation measures appropriatefor the facility, given its operating parameters. A detailed financial analysis is performedfor each measure based on detailed implementation cost estimates, site -specificoperating cost savings, and the customer's investment criteria. Sufficient detail isprovided to justify project implementation.

Investment-grade Audit

In most corporate settings, upgrades to a facility's energy infrastructure must compete forcapital funding with non-energy-related investments. Both energy and non -energyinvestments are rated on a single set of financial criteria that generally stress theexpected return on investment (ROI). The projected operating savings from theimplementation of energy projects must be d eveloped such that they provide a high levelof confidence. In fact, investors often demand guaranteed savings.

The investment-grade audit (alternatively called a comprehensive audit, detailed audit,maxi audit, or technical analysis audit) expands on the general audit described above by

providing a dynamic model of energy -use characteristics of both the existing facility andall energy conservation measures identified. The building model is calibrated againstactual utility data to provide a realistic base line against which to compute operatingsavings for proposed measures. Extensive attention is given to understanding not onlythe operating characteristics of all energy consuming systems, but also situations thatcause load profile variations on short and longer term bases (e.g. daily, weekly, monthly,annual). Existing utility data is supplemented with submetering of major energyconsuming systems and monitoring of system operating characteristics.

Energy Managers and Auditors

Within the framework of the Energy Conservation Act, 2001 there is a provision tointroduce energy managers as well as energy auditors.These powers and functions of the Bureau are expressed in Chapter IV, Section 13(o)(p) (q) (r) and (s) of the Act.(o) maintain a list of accredited energy auditors as may be specified by regulations;(p) specify, by regulations, qualifications for the accredited energy auditors;(q) specify, by regulations, the manner and intervals of time in which the energy auditshall be conducted;(r) specify, by regulations, certification procedures for energy managers to bedesignated or appointed by designated consumers;(s) prepare educational curriculum on efficient use of energy and its conservation foreducational institutions, boards, universities or autonomous bodies and coordinate withthem for inclusion of such curriculum in their syllabus;

Energy Managers Responsibilities

Energy Managers Duties

» Report to BEE and State level Designated Agency once a year. The information withregard to the energy consumed and action taken in the recommendation of theaccredited energy auditor, as per BEE Format.» Establish an improved data recording, collection and analysis system to keep track ofenergy consumption.» Provide support to Accredited Energy Audit Firm retained by the company for theconduct of energy audit.» Provide information to BEE as demanded in the Act, and with respect to the tasksgiven by a mandate, and the job description.» Prepare a scheme for efficient use of energy and i ts conservation and implement suchscheme keeping in view of the economic stability of the investment in such firm andmanner as may be provided in the regulations of the Energy Conservation Act.

Eligibility criteria for Energy Managers & Energy Auditors

a) Energy Managers:

1. a graduate Engineer (Bachelor of Engineering/Bachelor of Technology) orequivalent with three years of work experience involving use of energy in operation,maintenance, planning, etc.; or

2. a post-graduate Engineer (Master of Engineering/Master of Technology) orequivalent with two years of work experience involving use of energy in o peration,maintenance, planning, etc.; or

3. a graduate Engineer with post -graduate degree in Management or equivalentwith two years of work experience involving use of energy in operation, maintenance,planning, etc.;

or

4. a diploma Engineer or equivalent with six years of work experience involvinguse of energy in operation, maintenance, planning, etc.;

or

5. a post-graduate in Physics or Electronics or Chemistry (with Physics andMathematics at graduation level) with three years of work experience involving use ofenergy in operation, maintenance, planning, etc.

b) Energy Auditors:

1. a graduate Engineer (Bachelor of Engineering/Bachelor of Technology) orequivalent with three years of work experience involving use of energ y in operation,maintenance, planning, etc.; or

2. a post-graduate Engineer (Master of Engineering/Master of Technology) orequivalent with two years of work experience involving use of energy in operation,maintenance, planning, etc.; or

3. a graduate Engineer with post -graduate degree in Management or equivalentwith two years of work experience involving use of energy in operation, maintenance,planning, etc.

Candidates without requisite work experience are not eligible to register for theexamination.

ESCO

What is ESCOS ?

Definition of an ESCO (Energy Service Company) - An energy service company isa professional business providing a broad range of comprehensive energy solutionsincluding designs and implementation of energy saving s projects, energyconservation, energy infrastructure outsourcing, power generation and energy supply,and risk management. The ESCO performs an in -depth analysis of the property,designs an energy efficient solution, installs the required elements, and m aintains thesystem to ensure energy savings during the payback period The savings in energycosts is often used to pay back the capital investment of the project over a five - totwenty-year period, or reinvested into the building to allow for capital upgr ades thatmay otherwise be unfeasible. If the project does not provide returns on theinvestment, the ESCO is often responsible to pay the difference.

A typical ESCO project includes the following elements: Investment grade energy audit;

Identification of possible energy saving and efficiency improving actions;

Comprehensive engineering and project design and specifications;

Guarantee of the results by proper contract clauses

Code compliance verification and guarantee;

Procurement and installation of equip ment;

Project management and commissioning;

Facility and equipment operation & maintenance for the contract period;

Monitoring and verifications of the savings results; and

Project financing.

While the ESCO will ensure all the above actions, the ESCO may n ot necessarilyconduct all the work itself. Some work can be and is subcontracted; however, theESCO has to ensure project implementation and be responsible for the result.

Customer benefits of using an ESCO’s services

A customer derives a number of bene fits through engaging an ESCO. Benefits ofusing ESCO include:

The customer does not need to commit its own human and financial resourcesinto non-core activities like energy efficiency improvement.

High probability of reduction in energy costs because th e ESCO’sremuneration is contingent upon savings being actually achieved andmeasured.

The ESCO service fee is paid from the savings achieved, so there is no burdenon existing cash flows, in fact there is usually a net positive cash flowthroughout the relationship with the ESCO.

The customer benefits from the latest energy efficiency expertise andtechnology

The ESCO can arrange financing for the project

The ESCO can arrange grant financing, potential subsidies and other publicinvestment incentives as carbon credits.

Misconceptions about ESCOs

There are a number of misconceptions in India about ESCOs.

1. An ESCO always finances its projects : This is about the most commonmisconception about ESCOs. Customers often believe that the only benefitthat an ESCO brings in is the finance required to implement the measure. Wehave seen above that this is only one way of financing energy efficiencyprojects and probably not the least expensive method of financing suchprojects.

2. An ESCO bring in technologies t hat we do not know: While ESCOs areusually aware of new energy efficient techniques they may consider deployingthem only if they believe that the risk of failure is low. An ESCO has toguarantee performance and is naturally risk averse. Since an ESCOimplements proven techniques for energy cost reduction, it is very likely thatthe measures recommended by an ESCO are well known to engineers workingin a facility where an ESCO is engaged.

So what is the benefit engaging an ESCO? This is more easily answered by ananalogy: while a physician knows and can diagnose and say that surgery isrequired to cure an ailment, only a surgeon can do the work efficiently. Soalso it is the ability to actually implement the solution that is vitally importantfor success in energy efficiency projects – and this is what the ESCOs bring tothe project.

3. An ESCO is a consultant/ energy auditor : This is another commonequivalence in the minds of customers. While consultants and auditorsprovide essential services they do n ot assume project risks. They provide feebased advisory services without bearing any risk of non -performance or poorperformance of the projects. This is one of the major distinguishing featuresof an ESCO: it carries performance risk!

Making ESCOs popular in India

ESCOs in India face a number of surmountable barriers that need to be worked on.Most of the barriers will fall with the lapse of time as the market becomes morefamiliar with the business, but some do need action by large organization or theGovernment.

1. The concept is new and not widely known. Many customers find the modeltoo good to be true, and believing that there is some “catch” in it, do not riskengaging an ESCO to help them.

2. Customers are reluctant to sign a long -term contract, which unfortunately hasto be a long document to cover all the eventualities that might arise during theassociation of the customer with the ESCO. Successful cases of ESCO -Clientprojects will help customers to surmount their fears about such relationship s.

3. There are too few ESCOs in India. This is largely because there are very fewpersons who have the technical, financial and contracting knowledge to beable to deliver a good service.

4. Most ESCOs are small companies with limited geographical reach who ca nnotmeet the most common demand that they invest in the projects promoted bythem.

5. Customers often want the contractual guarantees to be backed up by BankGuarantees. This places an enormous demand for capital to be locked up toprovide the collateral to be placed with banks that will extend the guarantee.This could be overcome by the creation of Guarantee Funds by a suitableGovernment agency or a large bank, insurance company or a financialinstitution.

6. As mentioned earlier, perhaps the greatest barr ier to energy efficiencyimprovement in India is that this is still considered to be the engineer’sdomain. Getting CEOs and CFOs interested in energy efficiencyimprovement will certainly give a fillip to ESCOs.

As we know that Electricity consumption in the commercial sector accounts for about8% of the total electricity consumption in the country, and it is today, the fastest -growing electricity end-use sector, increasing at more than 11% per year. This rapidgrowth is largely driven by the introducti on of energy intensive technologies incommercial buildings, primarily air conditioning, and a lesser extent, more -intensiveindoor and outdoor lighting. The addition of these energy -intensive technologies inexisting buildings undoubtedly contributes to g reater productivity of the people whowork in those buildings – but, as studies consistently show, these energy -intensiveapplications are not integrated optimally in buildings, and are, more often than not,operated inefficiently as well. These sub -optimized and inefficiently operatedbuildings are a financial drain for their users, and an economic and social loss for ourcountry which is afflicted by serious energy shortages.

It has been seen, time and again, that energy conservation in such buildings c an beachieved through well-known interventions, which are cost effective as well.

However, institutional, procedural and process barriers hamper the implementation ofthese interventions, particularly the inability of building managers to assess andguarantee the energy savings due to these interventions. In order to address thisinstitutional barrier, the Bureau of Energy Efficiency has taken up the task ofinstitutionalizing energy efficiency services, and of promoting energy efficiencydelivery mechanisms, such as the development of a market for Energy ServiceCompanies (ESCOs), which address the risks perceived by building owners.ESCOs provide a business model through which the energy -savings potential inexisting buildings can be captured, and the ris ks faced by building owners can beaddressed as well. The performance -contract based payments for energy savingsachieved through the interventions carried out by the ESCO ensures that savings areachieved, and that the payments by the building owners to t he ESCO are related to theachievement of these savings.

There is a need to increase the number of ESCOs with a view to tap the potential ofbringing about energy efficiency improvement in the existing buildings/ facilities.BEE took up an exercise of shortlisting of ESCOs which in turn would help intaking up energy efficiency improvement projects in their existing buildings/facilities. The empanelment exercise would help in providing the technicaldue diligence and reduce transaction cost of the government sector as they willbe required to only call for price bids from the empanelled ESCOs.

In order to create a sense of credibility amongst the prospective agencies that arelikely to secure the services of an ESCO as well as the financial institutions,BEE has undertaken a process of rating these applicants in terms of success inimplementation of energy efficiency projects based on performance contracting,availability of technical manpower, financial strength, etc. The rating exercise wasdone through SEBI accredited agencies of CRISIL and ICRA. The results ofthe exercise are being made available in public domain and to thevarious State Governments/SDAs, so as to facilitate them in implementingEnergy Efficiency programmes in their respective states.

CRISIL and ICRA developed an accreditation methodology which involved anassessment of Business Risk (Track record and Market position), Organizationalsetup and Financial capability of the organization and accreditating the ESCOs ona 5 point grading scale. The Assessments of the ESCOs on each of theparameters are a holistic one, designed to evaluate the organizational capabilityfor handling the ESCO assignment. Through the evaluation exercise CRISILand ICRA have also provided their recommendations that would aid inovercoming barriers to Performance Contracting.

Definition of the grading

CRISIL and ICRA define ESCO grading as “An ESCO grade reflectsCRISIL/ICRA’s opinion on the ability of the graded energy service company toundertake energy efficiency projects.”

MethodologyCRISIL and ICRA graded a set of ESCOs that have been empanelled with BEE.The grading is expected to aid ESCOs in being able to successfully bid for energyservices projects and to arrange financing for the execution of such projects.

In the enclosed report, CRISIL and ICRA present the criteria for grading and asummary of the gradings assigned to the ESCOs and their comparable scores on theparameters for assessment. CRISIL and ICRA also enclose their observations andrecommendations on how BEE can aid in building a system and culture thatpromotes energy efficiency in India.

book/previous years turnover. Number of energy management projec ts completed. Certification and quality systems. Technology tie-ups & R&D facilities. Constitution, ownership structure and parentage. Management evaluation and quality of organizational structure,

internal control and systems. Employee strength in terms of numbers, qualification and experience. Number of certified energy auditors. Maximum number of projects handled at a time. Annual turnover from the ESCO/energy management business. Profit margins of the ESCO business. Overall financial strength as reflect ed by the capital structure and debt

servicing indicators like net cash accruals/total debt Receivables management. Financial flexibility arising from access to cash -flows/profits from

other business.
