The Federal Convention convened in the State House(Independence Hall) in Philadelphia on May 14, 1787, torevise the Articles of Confederation. Because the del-egations from only two states were at first present, themembers adjourned from day to day until a quorum ofseven states was obtained on May 25. Through discus-sion and debate it became clear by mid-June that, ratherthan amend the existing Articles, the Convention woulddraft an entirely new frame of government. All throughthe summer, in closed sessions, the delegates debated,and redrafted the articles of the new Constitution. Amongthe chief points at issue were how much power to allowthe central government, how many representatives inCongress to allow each state, and how these representa-tives should be elected--directly by the people or by thestate legislators. The work of many minds, the Constitu-tion stands as a model of freedom for individuals underthe rule of law.

MORE PERFECT UNION: THE CREATION OF THEU.S. CONSTITUTION May 25, 1787, Freshly spread dirtcovered the cobblestone street in front of the PennsylvaniaState House, protecting the men inside from the sound ofpassing carriages and carts. Guards stood at the entrances toensure that the curious were kept at a distance. Robert Mor-ris of Pennsylvania, the "financier" of the Revolution, openedthe proceedings with a nomination--Gen. George Washingtonfor the presidency of the Constitutional Convention. Thevote was unanimous. The general expressed his embarrass-ment at his lack of qualifications to preside over such anaugust body and apologized for any errors into which hemight fall in the course of its deliberations.
The Father of our Country had almostremained at home. Instead, he helpedcreate a more perfect union.
Ratification. By January 9, 1788, five states of the nine neces-sary for ratification had approved the Constitution--Delaware,Pennsylvania, New Jersey, Georgia, and Connecticut. But theeventual outcome remained uncertain in pivotal states such asMassachusetts, New York, and Virginia. On February 6,withFederalists agreeing to recommend a list of amendmentsamounting to a bill of rights, Massachusetts ratified by a voteof 187 to 168. Although Massachusetts was now safely in theFederalist column, the recommendation of a bill of rights wasa significant victory for the anti-Federalists. Six of the remain-ing states later appended similar recommendations. The United
States Constitution was signed on Sep-tember 17, 1787. It was ratified by ninestates in July of 1988. By December1791 the “Bill of Rights” was ratifiedby 3/4 of the states.

When James Madison helped shape a new constitutional system for the US, he and his fellowframers had one overriding fear: tyranny.They divided power among three branches: Legislative, Judicial and Administrative and createdlines of separation that would prevent concentration of power in any one branch. Understandinghuman nature, they tried to create a system in which ambition would check ambition. However,they knew that citizens could be deceived into giving up their freedoms. Madison warned futuregenerations that “if tyranny and oppression come to this land, it will be in the guise of fighting aforeign enemy.” They knew how effective fear can be used to induce citizens to relinquish theirliberties. Recent years have proven them, once again, prophetic in their warnings.The constitution is intended as a protection of individual rights, by preventing one branch fromassuming power, enough power to become tyrannical. No branch was given enough power togovern alone. Checks and balances were established to prevent that event. Once power becomesconcentrated in the hands of a president, citizens are left only with the assurance that suchunchecked power will be used wisely. This event the framers repeatedly warned us to never accept.Benjamin Franklin said it best when he warned that they who would give up essential Liberty, topurchase a little temporary Safety, will receive neither Liberty nor Safety.Despite these warnings, many people have embraced largely unchecked presidential powers underthe assurance that the rising security state will keep them safe. The shift of power to the presi-dency certainly did not start with the current president. The trend has been gaining ground fordecades. But, this administration has accelerated the troubling trend, seemingly without objectionfrom the other two branches. This has created a very dangerous situation.For instance, warrantless surveillance has increased under this Presidency. War without declarationwas subverted in Libya because the current president declared only he has the right to define war.(See the trickery here? He defines war, then the Congress gets to declare it. If an action is notdefined by the president as war, the Congress has no authority regarding that action. A basic tenantof our Constitution boldly discarded.) The current president has asserted the right to kill any UScitizen without judicial involvement. (Citizens deemed by his administration to be terrorists) Thecurrent presidency has placed our press corps under surveillance thereby intimidating another ofour freedoms, that of the Press. Claiming executive privilege, he has refused to turn over anyinformation to which congress is entitled, regarding a number of scandals. Included in those scan-dals is the vindictive abuse of power in utilizing the IRS as agents of retribution against politicalenemies.Elections have consequences. Seek out those who have established themselves as strict constitu-tionalists and put them in office if you wish to continue enjoying what this great country hasoffered over the past two plus centuries.
