The Open Public Meetings Act (OMPA) waiver by the state legislative leadership was extended through December 7, 2020. As a result, City Hall Council Chambers will not be open for City Council Meetings. All business conducted will be considered essential as outlined in the Governor’s Proclamation

Call to Order: Mayor Frederick called the Council Workshop to order at 6:00 pm.

Present: Mayor Frederick; Deputy Mayor Gruba and Councilmembers Ballard, Barnes, Coffey, and Gorski, Harris. Councilmember Gasak was excused.

City Clerk Muir announced Councilmember Gasak has requested to be excused and Councilmember Harris will attend but will be late.

Councilmember Harris entered the meeting at 6:04 pm.

Deputy Mayor Gruba made a motion to allow an excused absent for Councilmember Gasak and Councilmember Gorski seconded it. Motion passed 5-0.

Staff Present: City Administrator Takata, City Attorney Karg, Finance Director Oaksmith, and City Clerk Muir

Public Hearing:

Mayor Frederick announced the Public Hearing for the proposed property tax levy or EMS levy and called upon Finance Director Oaksmith to speak.

The Public Hearing opened at 6:01 pm. Mayor Frederick asked if any Councilmembers had any conflict of interest. No Councilmember stated a conflict.

Mayor Frederick announced the meeting call in information and explained the process.

Finance Director Oaksmith presented information regarding the property tax levy in the amount of $1,971,024, which is the tax the City will collect and receive and covered new construction; the calculation of the City’s regular property tax; and a division per dollar showing how each dollar is spent.

Mayor Frederick asked if the City had received any written comments. Clerk Muir announced there had been none.

Mayor Frederick asked if the City had received any callers to make public comment via Zoom. Clerk Muir announced there were no callers.

Mayor Frederick closed the Public Hearing at 6:09 pm.

Mayor Frederick reopened the hearing 6:09 pm.

Finance Director Oaksmith presented information for the EMS Levy, including the property taxation calculation, totaling $858,742, a recap of the levy rates, a division of a dollar and how each dollar is spent.

Mayor Frederick asked if the City had received any written comments. Clerk Muir announced there had been none.

Mayor Frederick asked if the City had received any callers to make public comment via Zoom. Clerk Muir announced there were no callers.

Mayor Frederick closed the hearing at 6:12 pm.

Mayor Frederick asked if the Council had any comments or questions. The Council did not have any comments or questions.

Discussion Items:

Budget – Public Safety

Finance Director Oaksmith presented the informational slideshow showing the Police Department’s Mission Statement, Core Values, and Vision Statement; the organizational chart; strategic planning; activity comparison; and challenges.

Finance Director Oaksmith presented the informational slideshow showing the Fire Department’s mission statement core principals and priorities; organizational chart; incident statistics for 2020.

Deputy Mayor Gruba asked if the Safety Committee participated in the information in the presentation. Councilmember Ballard confirmed the departments are keeping the committee apprised of the information in the presentation.

City Administrator Takata mentioned the budget is essentially the same as last year and described the few differences.

Councilmember Coffey asked to have the presentations emailed to the Councilmembers. Mayor Frederick also offered the presentations will be both online and sent to the Councilmembers, as well as on PCTV and YouTube sites.

City Council Policies and Procedures

City Administrator Takata and City Attorney Karg presented the proposed changes from the subcommittee regarding the City Council Policies and Procedures manual.

In regards to 9.4.c, Councilmember Barnes asked if there will be a mechanism for adding any emergent items to the agenda; City Administrator Takata confirmed if there were emergent items needing to be placed on the agenda, they would be added to the agenda by Administration.

Councilmember Ballard discussed the verbiage regarding illness to be changed “attending meetings when away from the dais.”

Deputy Mayor Gruba, Gorski, and Coffey echoed Councilmember Ballard to remove the language of “illness.”

Attorney Karg suggested, language identifying the councilmember is compelled to be absent due to something out of the councilmember’s control.

Councilmember Barnes identified an issue with having staff determine what is excused or not.

City Administrator Takata identified how the Council has the power to allow an absence, not the staff and that the staff’s role would only be passing along the information to the Council.

Attorney Karg described an example with a Councilmember asking to remote into a meeting and not being physically present. The City would need to set up the remote access and the Council would need to determine at the meeting if the remote access was approved by the Council.

Councilmember Harris requested an editorial change of using his/her/she/he to nonbinary words, such as their/them.

Deputy Mayor Gruba explained his comments regarding the Councilmember attendance were as Attorney Karg identified.

Councilmember Ballard discussed the issue of the need for the Council to approve/disapprove attendance whether in person or remotely and how the language needs to be carefully crafted.

Attorney Karg identified there could be a fine distinction of the definition of attendance and will research that information.

City Administrator Takata noted there is an RCW associated with attendance and read aloud how the participant needs to be heard and participate effectively. The law does not prohibit remote attendance.

Councilmember Harris requested clarification of a hypothetical situation of the inability for a Councilmember to attend. City Administrator Takata and Attorney Karg noted the decision would be the Council’s to make.

Deputy Mayor Gruba commented on the vagueness of the rule being the pathway to go down. Leaving the language vague allows the Council to police themselves and would accommodate situations the Council could not anticipate.

Attorney Karg agreed the discussion produced enough information for the Mayor, City Attorney, and himself to craft a rule that will encapsulate the rule that would meet the Council’s needs.

Regarding the Deputy Mayor position, Councilmember Barnes agreed the current process is working and doesn’t see any reason to change it. Administrator Takata clarified the current process where the most senior person would be asked first and a consensus was noted. There was a consensus from Councilmembers that this process would continue.

Public Comment During Council Meetings

City Administrator Takata discussed how public comment in the Zoom meetings would be allowed. There was a consensus to move forward with public comments at the Council’s next Regular Meeting.

Council Communication to the Public

Councilmember Gorski presented the concept of letting the Council have a voice to the public through written communication, such as through water bills or other direct mailings to members of the community. The purpose would be to update citizens on the work of the Council such as projects, decisions, and other work of the Council.

Councilmember Harris suggested “Council’s Corner” in the Parks and Recreation Guide.

Councilmember Barnes agreed to widening the opportunity to reach out to the citizens.

Deputy Mayor Gruba added there was not a financial burden to the City to add information to any already existing publication.

Councilmember Gorski added ideas about bringing information forward in ad hoc groups or as individual Councilmembers; a cadence of communication is the goal.

Administrator Takata suggested rotating a committee of three so there is no violation of OPMA and Attorney Karg agreed a review by all Council members of something drafted by a member or small committee could quickly turn into a serial meeting. Another avenue would be to have an individual Councilmember or committee draft a message and then it would be put on the agenda as a consent item.

Mayor Frederick suggested using multiple avenues.

Councilmember Harris asked Councilmember Gorski for clarification about whether he was suggesting one message or individual messages since the Council is not always going to be of one mind. He clarified there could be a few writers but in an instance where there was a vote that was not unanimous, it would give the dissenting side to have a voice. A singular message could be just as important as a message from the group.

Attorney Karg asked for clarification regarding the content to be for legislative decisions. Councilmember Gorski confirmed it would be.

Call to Order: Mayor Frederick called the Council Meeting to order at 7:00 pm.

Roll Call: Mayor Frederick, Deputy Mayor Gruba, and Councilmembers Coffey, Gasak, Barnes, Ballard, Harris, and Gorski.

Staff Present: City Administrator Takata, Finance Director Oaksmith, Public Work Director Lim, City Attorney Karg, Human Resource Director Sabrina Kearney, Fire Chief McElligott, Assistant Fire Chief Creekmore, Events and Recreation Coordinator Walker, and City Clerk Muir

APPROVAL OF THE AGENDA

Deputy Mayor Gruba moved to approve the agenda and Councilmember Coffey seconded the motion. Motion carried 7-0.

PUBLIC COMMENT

Mayor Frederick explained the process to make a public comment.

Mayor Frederick asked the Clerk if there were any callers or written comments for public comment; Clerk Muir stated there were none.

COUNCIL COMMENTS

Councilmember Ballard wished everyone in the community a Happy Thanksgiving. He also mentioned he is still lobbying for any future COVID money to be set aside for grants for families who have been affected. He added there are more funds/grants for small businesses through Pierce County Council; it can be found on their website – search grant programs for small businesses. Lastly, he asked for citizens to be more aware of the children playing in the community.

Councilmember Gasak mentioned the virtual programming through Parks & Rec. She also commented on the positive success with the Parks and Rec auction.

Deputy Mayor Gruba mentioned the Boy Scouts food drive being successful because of the donations from the citizens of DuPont and extended a thank you to the citizens.

Mayor Frederick announced the Public Hearing for the proposed Biennial Budget for 2021-2022.

The Public Hearing opened at 7:07 pm. Mayor Frederick asked if any Councilmembers had any conflict of interest. No Councilmember stated a conflict.

Mayor Frederick announced the hearing call in information and explained the process.

Finance Director Oaksmith presented information regarding the 2021-2022 Biennial Budget. She explained the budget is a policy document, noted the budget amount of $21,054,354 for 2021 and $17,645,578 for 2022; the changes to the staffing levels; capital projects with the Street Fund Projects; the Public Works Project; and the Water Fund Projects.

Mayor Frederick asked the Clerk if there were any written comments submitted.

Clerk Muir announced the City did not receive any written comments for the public hearing.

Mayor Frederick asked the Clerk if there were any citizens waiting to comment through the Zoom connection.

Clerk Muir announced the City did not receive any calls for the public hearing.

Mayor Frederick asked if the Council had any questions or comments; they did not.

Mayor Frederick closed the Public Hearing at 7:14 pm.

Councilmember Harris asked why the binary changes had not been made yet.

Administrator Takata answered the changes would be made when the additional changes were made. Clerk Muir added it will be modified by February.

Attorney Karg identified these changes were not ignored or refused and explained this was a first pass.

Administrator Takata noted the documents has been sent multiple times.

Deputy Mayor Gruba asked for confirmation this item will be presented in the future with the changes.

Administrator Takata answered this item was moved from an Ordinance to a Resolution.

Motion carried 7-0.

UNFINISHED BUSINESS

Ordinance No. 20-1085 Approving the 2021 Property Tax Levy, Second Reading

Finance Director Oaksmith recommends the Council moves to approve the 2021 Property Tax Levy.

Councilmember Coffey made a motion to approve Ordinance No. 20-1085 approving the 2021 Tax Levy and Councilmember Gasak seconded the motion. Motion carried 7-0.

Ordinance No. 20-1086 Approving the 2021 EMS Tax Levy, Second Reading

Finance Director Oaksmith recommends the Council moves to approve the EMS Tax Levy.

Councilmember Coffey made a motion to approve Ordinance No. 20-1086 approving the 2021 EMS Levy and Councilmember Gasak seconded the motion. Motion carried 7-0.

Director Oaksmith requested for the Council to move this ordinance to second reading.

Deputy Mayor Gruba made a motion to move the ordinance to a second reading and Councilmember Gorski seconded the motion. Motion carried 7-0.

Deputy Mayor Gruba made a motion to approve Ordinance regarding the third quarter Budget Amendment and Councilmember Barnes seconded the motion. Motion carried 7-0.

Section 3. The City Clerk is directed to transmit a certified copy of the budget hereby adopted to the Division of Municipal Corporations in the Office of the State Auditor and to the Association of Washington Cities.

Section 4. This Ordinance shall be in force and take effect January 1, 2021, after its publication according to law.
