ORDER:
In the G.O. first read above, Government have introduced a new housing scheme
under the heading Housing for Rural Poor with a view to upgrade 20,000 temporary houses
(existing thatched roof and kutcha or mud walls) during the year 2004-2005 and 1,00,000houses during the year 2005-2006.
2. The Registrar of Cooperative Societies has requested the Government to issue
necessary orders for permitting the Cooperative Banks to finance the rural housing scheme.
This requires exempting the District Central Cooperative Banks and Primary Agricultural
Cooperative Banks from the operation of Rule 75 of Tamil Nadu Cooperative Societies
Rules, 1988 to the extent necessary for making the recovery of such loans in 70 installments
with a moratorium of 3 months so as to implement the scheme ordered in the G.O. first read
above.
3. The Government after careful examination accept the proposal of the Registrar of
Cooperative Societies and direct that the new housing scheme under the heading Housinf for
Rural Poor ordered in the G.O. first read above the implemented through the Cooperative
Banks as per the guidelines detailed in the Annexure to this order.
4. In exercise of the powers conferred by Section 170 of the Tamil Nadu Cooperative
Societies Act, 1983 the Governor of Tamil Nadu hereby exempts the District Central
Cooperative banks and Primary Agricultural Cooperative Banks from the provisions of Rule
75 of Tamil Nadu Cooperative Societies Rules, 1988 to the extent necessary so as to
implement the scheme ordered in para 3 above and recover the loan amount in 70 instalments
with a moratorium of 3 months.

ANNEXURE
Guidelines for implementation of the new rural housing schemes through
Cooperatives.
1) The pattern of subsidy, credit assistance and beneficiary contribution has been
ordered as detailed below:
i) State Government Subsidy - Rs. 2,500/-
ii) Loan from banks - Rs. 7,000/-
iii) Beneficiary contribution - Rs. 500/-
Total unit cost - Rs.10,000/-
2) Eligible member under the Scheme:The beneficiaries of the scheme shall be members
of women Self Help Groups, who have been formed through Mahalir Thittam, Rural
Development Department and Banks linked to SGSY Programme.
3) Responsibility of the Self Help Groups:The responsibility of the Self Help Groups is to
identify the eligible members/beneficiaries after duly assessing the need and repayment
capacity of the members. The SHGS may identify the beneficiaries, arrange loans through
banks monitor the utilization of the amount, recover the loans amount and remit it to the
banks.
4) Front End subsidy: Immediately on receipt of loan sanction orders from the banks theProject Officer, DRDA will release the subsidy amount to the banks.
5) Credit Assistance:Banks and financial institutions shall extend a loan of Rs.7,000/- for
each house through Self Help Groups.
6) Rate of Interest: The interest will be as per the priority sector lending rates. The
connected Self Help Groups may levy service charge at the rate of Rs.5.00 per instalment.
7) Repayment Period:In seventy monthly instalments.
8) Moratorium for the loan:The moratorium for the loan amount will be three months from
the date of final disbursement of loan to the beneficiary.

Government in their order 1st cited, have issued directions to implement
the Interest Reduction Scheme in the Urban Cooperative Banks to provide relief to the
borrowers of the banks so as to facilitate recovery of long pending overdues.
2. Accordingly, in the reference 2nd cited, dated 13.4.2005 necessary
instructions have been issued to implement the Interest Reduction Scheme
immediately, by giving wide publicity to the scheme so as to create asareness among
the borrowers.
3. It has been brought to the notice of the Registrar of Cooperative
Societies that between the date of the G.O.and the date of receipt of copy of the
G.O.in the Urban Cooperative Banks, some of the borrowers have settled their dues
fully and also partly without any notice of the scheme and such borrowers request for
refund of the excess amount.
4. It is considered that the requests of such borrowers are reasonable and
acceptable and conform to the G.O.Accordingly it is decided that such of theborrowers who are otherwise eligible under the Interest Reduction Scheme as per
operational guidelines issued in the G.O.cited, and who have fully remitted the entire
loan outstanding with interest, penal interest, legal charges and other charges as per
the normal procedure after 13.4.2005 may be refunded the excess amount. In the mean
time those who have remitted any part amount of the dues upto 25% of the amount
eligible for entering into agreement may also be brought themselves for coverage
within the purview of the G.O.
5. I request the Regional Joint Registrars to give necessary instructions toall the Special Officers of the Urban Cooperative Banks to take immediate action to

refund the benefit of Interest Reduction Scheme to those eligible borrowers (who have
fully remitted their dues only) by way of Account Payee and Not Negotiable Crossed
Cheque/Demand Draft, only as the case may be immediately. This should be done
within 7 days.
6. I also request the Regional Joint Registrars to give instructions to the
Special Officers of all the Urban Cooperative Banks to send the communications tothe concerned eligible borrowers immediately and to ensure that all eligible borrowers
are covered without room for any complaint.
I also request you to give wide publicity of this instructions by giving
individual notice to the concerned individual borrowers and also in affixing the list of
the eligible borrowers in the notice board of the Urban Cooperative Bank and also
press release through District Cooperative Unions/Posters etc.,

Sub: Banking Regulation Act 1949 (AACS) Investments in Government
and other approved securities by Urban Cooperative Banks
Exemption under Section 24A.
Please refer to our circular UBD.No.BR.Cir/42/16.26.00/2000-01 dated April 19,
2001 on the above subject advising Primary (Urban) Cooperative Banks (Urban Cooperative
Banks) to maintain a certain percentage of assets under section 24 of the Banking Regulation
Act, 1949 (AACS) in the form of Government and other approved securities.
2. It has been represented by Urban Cooperative Banks and their Federations that
many Urban Cooperative Banks are facing difficulties in making investments in government
securities due to lack of access to the government securities market or necessary expertise inthe matter. Taking this into consideration, it has been decided that limited exemption from the
requirement could be granted to a class of Urban Cooperative Banks. Accordingly, the non-
scheduled primary a single district, having a deposit base of Rs.100 crore or less would be
exempted from maintaining SLR in prescribed assets upto 15% of their DTL on keeping the
required amount, in interest bearing deposits, with State Bank of India and its subsidiary
banks and the public sector banks including Industrial Development Bank of India Ltd.
3. For the purpose of eligibility for exemption, deposit base of Urban CooperativeBanks will be determined on the basis of fortnightly average of the DTL in the immediate
preceding financial year.
4. The exemption will be applicable with immediate effect in respect of above
categories of Urban Cooperative Banks and shall be in force upto March 31, 2008. During
this period Urban Cooperative Banks should build up adequate infrastructure, risk
management practices including human resource and technological up-gradation so as to
reduce market related risk.
5. A copy of the notification UBD.PCB.6657/16.26.000/05-06 dated December 26,
2005 published in Part III section 4 of the Gazette of India (Extraordinary) dated December
31, 2005 is enclosed.

As you are aware, hallmarking of gold jewellery ensures the quality of gold used
in the jewellery as to caratage, fineness and purity. Therefore, banks would find granting of
advances against the security of such hallmarked jewellery safer and easier. Preferential
treatment of hallmarked jewellery is likely to encourage practice of hallmarking which will
be in the long-term interest of consumer, lenders and the industry.
2. Therefore, banks while considering granting advances against jewellery may
keep in view the advantages of hallmarked jewellery and decide on the margin and rates of
interest thereon.3. Other conditions in respect of grant of advances against gold ornaments and
jewellery remain unchanged.

In the Government Order first cited, orders have been issued on therecommendations of the Streamlining Committee constituted for streamling the pay scalesand service conditions of the Employees Cooperative Thrift and Credit Societies.
Government in their orders second cited (copy enclosed) have permitted toimplement the G.O. (Ms) No.89, Cooperation, Food and Consumer ProtectionDepartment, dated 16.5.2000 to the employees of Employees Cooperative Societies whichhave not yet implemented the G.O. first cited, subject to the following conditions:-
(i) The above Government Order first cited shall be implemented only in thoseEmployees Cooperative Societies which are working on profit and havingoperating expenses below 50% of the average of the net interest income i.e. (netinterest earned net interest paid) for the last three years as per the audit reports.
(ii) The pay package be allowed with effect from 1.1.1996 nationally and themonetary benefit given with effect from the date of the above GovernmentOrder first cited, i.e. from 16.5.2000.
(iii) The Employees Cooperative Societies which have made a specific provision forpayment of arrears are permitted to pay the arrears with effect from 16.5.2000.
Those societies which have surplus reserves after providing for statutoryreserves and paying dividend of not less than 10% to the members, are also
permitted to pay the arrears only to the extent of their general reserves permit.
(iv) The arrears of pay shall be paid in two yearly instalments or more dependingupon the financial position of the society.
(v) Only audited accounts should be taken into account for the purpose ofdetermining whether the societies have adequate surplus for payment of arrears.
(vi) In the case of other Employees Cooperative Societies which are making losses,a case by case analysis shall be made and decisions may be taken whether theG.O. (Ms) No.89, Cooperation, Food and Consumer Protection Department,

dated 16.5.2000 should be implemented. For such cases the prior permission ofthe Registrar is necessary.
(vii) The above Government Order second cited should be implemented for theemployees of the Employees Cooperative Societies who have not obtained anyCourt stay against the above Government Order first cited. It should be ensured
by the implementing authorities.
(viii) The wage revision is applicable only to the regular employees who are withinthe cadre strength permitted in the above G.O. first cited and eligible tocontinue as per the Supreme Court Judgment.
No Employees Cooperative Society shall permit the wage revision withoutthe prior permission of the Regional Joint Registrars.
The Regional Joint Registrars should directly monitor the implementation ofthe Government order by ensuring whether the above conditions are fulfilled. They arerequested to issue the above suitable instructions to the Circle Deputy Registrars / SpecialOfficers / Management of Employees Cooperative Societies / Salary earners Bank / Urban
Cooperative Credit Societies which are functioning under their control for implementationof the G.O. as per the guidelines issued. Any deviation of the instructions issued will beviewed seriously and severe disciplinary action will be initiated against all the officersconcerned. The receipt of the instructions may be acknowledged at once.

*******ORDER:
In the Government Order first read above, orders have been issued on therecommendations of the Streamlining Committee constituted for streamlining the payscales and service conditions of the Employees Cooperative Thrift and Credit Societies.
2. The Registrar of Cooperative Societies in his proposals second and third readabove has stated the out of the total number of 1882 Employees Cooperative Societies,
1638 Societies are working on profit and 244 are working on loss. He has stated that outof the total number of 1882 Societies, only 475 Societies have implemented the G.O.(Ms.) No.89, Cooperation, Food and Consumer Protection Department, dated:16.5.2000due to certain restrictions. He has now requested the Government to permit theEmployees Cooperative Societies to implement the above Government Order.
3. The Government after careful examination accept the proposal of theRegistrar of Cooperative Societies and permit the Registrar of Cooperative Societies toimplement the G.O. (Ms.) No.89, Cooperation, Food and Consumer ProtectionDepartment, dated:16.5.2000 to the remaining Employees Cooperative Societies which
have not yet implemented the Government Order subject to the following conditions:-(i) The above Government Order shall be implemented only in those
Employees Cooperative Societies which are working on profit and havingoperating expenses below 50% of the net interest income.

*********Government in their order 1st cited have issued directions to implement the
One Time Settlement Scheme in the PCARDBs to provide relief to the borrowers of thebanks, so as to facilitate recovery of long pending overdues. Government have also issuedguidelines for the scheme and requested to issue necessary instructions to field level staff
on the Implementation of this scheme.2) Accordingly, in the reference 2ndcited, necessary instructions have been
issued to you to implement the One Time Settlement Scheme immediately, by givingwide publicity to the scheme to create awareness among the borrowers.
3) It has been brought to the notice of the Registrar of Cooperative Societiesthat, between the date of the G.O and the date of receipt of copy of the G.O in thePCARDBs some of the borrowers have settled their dues, without any notice of thescheme and such farmers request for refund of the excess amount eligible under thisscheme.
4) It is considered that the requests of the such borrowers are reasonable andacceptable and conform to the G.O.
Accordingly, it is decided that such of the borrowers who are otherwiseeligible under the One Time Settlement Scheme as per the operational guidelines issued inthe G.O cited and who have fully remitted the entire loan outstanding, with interest,interest on overdue instalments, penal interest, legal charges and other charges as per thenormal procedure after 13.4.2005 may be refunded the excess amount. Those who haveremitted upto 25% of the dues and brought themselves within the purview of the G.Oafter 13.4.2005 will also be covered under the G.O.

5) I also request you to give instructions to the Special Officers of all the
PCARDBs to take immediate action to refund the benefit of one time settlement scheme
to those eligible borrowers (who have fully remitted their dues only) by way of Account
Payee and Not Negotiable days crossed cheque/Demand drafts, only as the case may be,
immediately. This should be done within and not send the communications to the
concerned eligible borrowers immediately and to ensure that all eligible borrowers are
covered without room for any complaint.
6) I also request from you to give instructions to the Special Officers of all
the PCARDBs.
I also request you to give wide publicity of this instructions by giving
individual notice to the concerned individual borrowers and also in affixing the list of the
eligible borrowers in the notice board of the PCARDB and also press release through
District Cooperative Unions/Poster etc.,

ORDER:
The Registrar of Cooperative Societies has stated that he already sent Special
by-laws for 181 Primary Cooperative Agricultural and Rural Development Banks during
March 2003, recommending the sanction of cadre strength consisting of one Secretary andone Supervisor for a block level Primary Cooperative Agriculture and Rural Development
Banks and One Secretary and two Supervisors for Taluk level Primary Cooperative
Agriculture and Rural Development Banks. He has stated that neither the loan outstanding
nor the number of loan accounts was taken into consideration while sending the proposals
to the Government. He has stated that the banks may not function viably, if the number of
loan accounts taken as the parameter for fixing the cadre strength. After taking into
account the staff of the Bank, their financial position, actual need, issue of jewel loans
field activities such as collections of over dues, verification of loan accounts, borrowers
etc., He has suggested the following optimum cadre strength in the Primary Cooperative
Agriculture and Rural Development Banks:-

Instances have been brought to the notice of the Registrar of Cooperative Societies
that there is need for breadth of vision in management of the District Central Cooperative
Banks more particularly the funds of the Banks. The in-house expertise in the Banks in
the context of vast developments taking in the financial sector/economic front and stiff
competition needs upgradation. During the discussions convened by the NABARD with
the State Officials on 13.3.2006, it was suggested that a Advisory Committee may be
constituted to advise on the managerial issues. Hence with a view to advise the
management from time to time and to analyze the deployment of funds viz., sources anduses of the funds of the Bank from time to time and to take decisions with a broad
perspective and the overall growth of the Bank as well as its affiliates, it is considered that
a Committee may be constituted to advise on the deployment of funds of the District
Central Cooperative Banks under the Chairmanship of the Special Officer of the Bank.
Accordingly a Committee is constituted with the following members:
The Special Officer, District Central Cooperative Bank - Chairman
1. General Manager of the Bank - Member-Convenor
2. Any two senior officers of the Bank - Membersnominated by the Special Officer
3. Any two/three representatives from the
affiliates as nominated by the Special Officer.

The Committee has to periodically review the following aspects:
1. Review the sources and uses of funds of the bank and suggest ways for
prudential and profitable deployment of the funds.2. The Committee shall meet at least once in 15 days.

also been brought to the notice that the Regulated market Committees are sanctioningproduce pledge loans at 8% p.a.,
2) In the minutes of the meeting of Regional Joint Registrars, SpecialOfficers of District Central Cooperative Banks and other held in January and February2006, the Special Officers of District Central Cooperative Banks and Regional JointRegistrars were requested to avail the refinance facility from NABARD at 7% p.a. interestrate and to ensure distribution of loans at cheaper rates to the farmers availing produce
pledge loans.
3) In the Registrars circular 2nd cited, it has been stated that the rate ofinterest to borrowers for produce pledge loan may be fixed at 9% as in the case of crop
loans, if refinance is availed from NABARD or at 11% if refinance is not availed byDistrict Central Cooperative Banks from NABARD and loans are sanctioned from ownedfunds.

I am directed to state that an instance has been brought to the notice of the
Government wherein a Public Information Officer designated under the Right to
Information Act, 2005 (Central Act 22 of 2005) has returned the fee amount of Rs.50/- to
the applicant who had sought for the information under the said Act, informing that the
required information could not be obtained from the department concerned within in 30
days. The applicant who has also been informed that the information once received from
the department concerned will be furnished to hi, freee of charge, presumably that Public
Information Officer has relied on the provisions contained in sub section (6) of section 7
of the said Act.2. In this connection, I am to state that as per sub-section (1) of section 7 of
the said Act, the Public Information Officer on receipt of a request under section 6 of the
Act shall, as expeditiously as possible, and in any case within 30 days of the receipt of the
request, either provide the information on payment of such fee as may be prescribed of
reject the request for any of the reasons specified in section 8 or 9 of the Act. The fee
payable under section 6 (1) of the said Act is the fee which is to be acoompanied with
every application seeking information. Separate fee is payable under sub - sections (1)
and (5) of section of the said Act. As per sub-section (6) of section 7 of the said Act, if the
information is not provided within 30 days from the receipt of the request by the publicauthority the fee payable under sub-section (5) of section 7 shall not be levied and the
information is not provided at free of cost. It may be seen from the above that the term
charge occurring in sub-section (6) of section 7 refers to the fee prescribed under sub-
section (5) of section 7 of the said Act, and not the fee prescribed under sub-section (1) of
section 6 of the said Act. The duty cast on the Public Information Officer under sub-
section (1) of section 7 is very specific and he should take all efforts to secure the
information and ensure that the information is provided or refused within 30 days as
required therein.
3. I am to request you to bring the above instructions to the notice of PublicInformation Officers and Appellate Authorities designated under the Act, for due
compliance.
