40 terms have been defined.


• The date on which a Government Servant attains an age for getting an entry in to the Service or becomes ineligible to get service.

Rule 7(1)


•A person deputed for training in a trade/ business with a view to employment in Government Service.

•He draws pay at monthly rates from Government during such training (Stipend)

•He is not employed in or against a substantive vacancy in the cadre of a Department.

• e.g. Appointments of 200 Drivers, 240 Conductors and 45

Mechanics in RSRTC and to keep them from April 2008 to

September 2008 as Apprentice and pay Rs. 2500/- p.m. as

stipend. Rule 7(2)


• Constitution of India adopted on 26 January 1950.

Rule 7(3)


•Strength of a Service or

•Part of Service sanctioned as a separate unit.

•Specific Service Rules for making Appointment, Promotion, Seniority etc. are made by the Governor.

• For Example: Rajasthan Administrative Service, Rajasthan

Medical and Health Service, Rajasthan Accounts Service,

Rajasthan Police Service, Rajasthan Education Service,

Rajasthan Agriculture Service etc. are CADRE.

• There are more than one PAY SCALES in each Cadre, e.g.

Junior Scale, Senor Scale, Selection Scale, Super-time

Scale etc.

• Sanctioned specific posts in each pay band are UNITS the

Rule 7(4)(A)


•An allowance granted to meet personal expenditure necessitated by the Special circumstances in which duty is performed.

•Includes: TA

•Does not include : a sumptuary

Rule 7(7)(A)


• Service as a probationer or apprentice provided that such service is followed by confirmation.

• Joining time

• In respect of a Government Servant returning from leave the days of taking over charge of the same post from which he proceeds on leave.

Rule 7(8)


(b) Government may issue an order declaring that in the following circumstances, or in circumstances similar thereto, a Government Servant may be treated on duty:

i. During a course of instruction or training in India.

ii. When he is entitled to be appointed to the service of Government on passing through a course of training at a University, College or School in India.

iii. When Government Servant on his first appointment to State Service receive orders to take charge of a specific post during the interval between the date of such report and the date on which they take charge of their duties.

iv. When a Government Servant is required to attend an obligatory departmental examination

v. When he attends an optional examination with the permission of competent authority. Rule 7(8)


The “Duty” starts at the hours Government Servant report for “Duty” on a particular day or takes charge of the post and ends at the hours he left his duty point. Accordingly, the period of journey from residence to office and vice versa is not a part of “Duty.”

•A recurring or non-recurring payment to aGovernment Servant from a source otherthan the Consolidated Fund whether madedirectly to the Government Servant orindirectly through the intermediary ofGovernment

But does not include:• Un-earned income such as income from property,

dividends and interest on securities; and

• Income from liberty, cultural or artistic efforts are not

aided by the knowledge acquired by the Government

Servant in the course of his service.

Rule 7(9)


•A service in which aGovernment Servant receives hissubstantive pay with thesanction of Government from asource other than from theConsolidated Fund.

•A Government Servant holding a post which may be declared by the Government to be a Gazetted post.

•A recurring or non-recurring paymentgranted to a Government Servant fromthe Consolidated Fund of the State/India/of another State as remunerationfor special work of an occasional orintermittent character.

• e.g. employees of Budget Division in FD are paid

honorarium when they work for additional hours inpreparation of budget.

• The monthly amount paid byGovernment to a GovernmentServant on leave.

Rule 7 (16)


– Title of a Government Servant to holdsubstantively, either immediately oron the termination of a period orperiods of absence, a permanent post,including a tenure post to which hehas been appointed substantively.• Conditions: Regularly appointed, Clear-cut vacant

permanent post, confirmation on that post.

Rule 7 (17)


• Revenues administered by bodieswhich by law or rules having theforce of law come under the controlof Government

• The revenue of any body whichmay be specially notified byGovernor as such.

• e.g. Municipal Council, Panchayat Samiti,

Municipalities, Agriculture Marketing Mandiesare the examples.

• Government Servant of asubordinate service whose dutiesare entirely clerical and any otherclass of servants specially definedas such by general or special orderof Government.

• In calculating a period expressed interms of months and days,complete calendar months shouldbe calculated and the odd numberof days added thereto.

• A Government Servant who holdssubstantively a permanent post orwho holds a lien on a permanentpost or would hold a lien on apermanent post had the lien notbeen suspended.

Rule 7 (22)


• A Government Servant officiates in apost when he performs the duties ofa post on which another personholds a lien. Government may, if itthinks fit, appoint a GovernmentServant to officiate in a vacant poston which no other Governmentservant holds a lien.

Rule 7 (23)


• Amount drawn monthly by aGovernment Servant as:

(i) The pay, other than special pay or pay grantedin view of his personal qualifications, which hasbeen sanctioned for a post held by himsubstantively or in an officiating capacity or towhich he is entitled by reasons of his positionin a cadre,

(ii) Special pay and personal pay

(iii) Any other emoluments which may be speciallyclassed as pay by the Governor.

Rule 7 (24)


• Gratuity

• Death-cum-Retirement Gratuity.

• A post carrying a definite rate ofpay sanctioned without limit oftime.

Rule 7 (26)


• Additional pay granted to aGovernment Servant:

To save him from a loss of substantive payin respect of a permanent post other than atenure post due to a revision of pay or toany reduction of such substantive payotherwise than a disciplinary measure, or

In occupational circumstances, or otherpersonal considerations.

Rule 7 (27)


• Leave earned in respect of periodsspent on duty.

Rule 7 (28)


• Pay to which he would be entitled ifhe held the post substantively andwere performing its duties but it doesnot include special pay unless theGovernment servant performs ordischarges the work or responsibilityor is exposed to the unhealthyconditions in consideration of whichthe special pay was sanctioned.

Rule 7 (29)


•A person appointed provisionallyagainst a substantive vacancy in thecadre of a service or on a substantivevacant post.

•A probationer has to complete trainingon probation and qualify writtenexamination after the end of training.

Rule 7 (30)


• Person appointed through directrecruitment against a clear vacancy inthe cadre of service and placed undertraining on fixed remuneration for aperiod of 2 Years or extended period,if any.

Rule 7 (30)(A)


• An addition to the emoluments of apost of a Government Servant grantedin consideration of:

– the specially arduous nature of theduties.

– a specific addition to the work orresponsibility.

• e.g. if any officer of Rajasthan Administrative Serviceis posted as Deputy Secretary to the Government,he/she gets special pay due to specific addition to thework and responsibilities.

•Any kind of service which is notClass IV.

•A monthly grant made to aGovernment Servant who is not inreceipt of pay or leave salary.

•The pay other than special pay,personal pay or emoluments classed aspay by Governor under Rule 7(24)(iii)to which a Government Servant isentitled o account of post to which hehas been appointed substantively orby reason of his substantive positionin a cadre.

•The appointment of a GovernmentServant on a permanent post andon which he acquires a lien.

Rule 7 (34)(A)


•A post carrying a definite rate ofpay sanctioned for a limited time.

•A permanent post which anindividual Government Servant maynot hold for more than a limitedperiod.

• Pay which rises by periodicalincrements from a minimum to amaximum.

e.g. ` 8000-275-13500,

` 10000- 325-15200,

` 12000-375-16500 etc.

Rule 7 (37)


• Movement of a Government Servantfrom one headquarter station inwhich he is employed to another suchstation, either:

–To take up the duties of a newpost, or

– In consequence of a change of hisheadquarters.

Rule 7 (38)


• A Department or a part of aDepartment to which regularvacations are allowed, duringwhich Government Servantsserving in the department arepermitted to be absent from duty.

• e.g. Summer Vacations from 16 June to 30

June in Schools, Colleges, Courts etc.

Rule 7 (39)


– An establishment whose salaries are not paid out of provision for Pay of Officers and Pay of Establishment in the Budget (Salary) but in any other manner like ‘Other Charges.’

– e.g. Keeping a person on ` 500 p.m. for cleaning for 3 months and paying him.
