General Terms & Conditions of Tender

1.0 PREFACE

1.1 Tenders for rate contract for supply of Lime Stone Powder.

1.2 The Cattle Feed Plant, LAMBIYAKALAN invites sealed competitive bids from the bonafide manufacturer or approved supplier for the following strictly in adherence to the detailed specifications stipulated in the schedule of this tender.

1.3 The Manager, Cattle Feed Plant, LAMBIYAKALAN reserves the right to reject or accept any or all the tenders in full or part thereof which in his opinion justifies such action without further explanation to the tenderers.

2.0 TENDERING PROCEDURES :

2.1 The tenders should be sent by Registered post with acknowledgement due so as to reach the Manager, Cattle Feed Plant, Lambiyakalan, NH-79, Lambiyakalan, Via-Rayla, Distt.- Bhilwara not later than as specified in the NIT. Alternatively the tenderers or their agents can also submit their tenders personally at the office of the Cattle Feed Plant, Lambiyakalan, NH-79, Lambiyakalan, Via-Rayla, Distt.- Bhilwara and obtain the acknowledgement latest by the time and date mentioned in the NIT.

2.2 The tender must be submitted, strictly as per the special Notes- (Section-I & Section-II) as well as Annexure-I(A) & Performa rate quot I (B) to the tender i.e. form of tender.

2.3 The tender thus prepared should be put in properly sealed double cover and super-scribed giving the tender reference number and date of opening. The covers should bear address of Cattle Feed Plant, Lambiyakalan, NH-79, Lambiyakalan, Via-Rayla, Distt.-Bhilwara. Only one tender should be kept in one cover. In case more than one tender is kept in a cover, all the tenders thus kept shall be liable to be ignored.

2.4 No responsibility shall be taken for the premature opening of the tender which is not properly addressed and identified.




2.5 No tenders/rates by way of Fax/Telegram/Telephone/Telex etc. will be accepted/considered unless Cattle Feed Plant specifically asks for rates through such mode of communication.

(a) Rates must be quoted F.O.R. Cattle Feed Plant, LAMBIYAKALAN.

(b) The rate must be offered against the specified item. The net rate must be inclusive of all charges and any other levies or duties etc. chargeable on the products. (Octroi wherever applicable will be paid extra over the net rate. Octroi shall be paid on actual basis at Cattle Feed Plant on producing octroi receipts.

(c) Since the Cattle Feed Plant is eligible to issue C Form (if, applicable), Sales Tax/VAT will be payable at the concessional rate prevailing during the period of the tender.

(d) Excise duty or Surcharge prevailing upto the date of submission of the rates must be included in the net rate. This however, should be shown separately, so that in the event of any subsequent change in these charges by the Government (State or Central), the same will be considered extra over the net rate. However, the increase Excise Duty due to change in slab on higher turnover shall be payable by the tenderer.

(e) The rate should confirm as far as possible to the packing unit mentioned in the quality specification and different rates for difference packing should be avoided. Further, only total price should be offered against the specified item. However, the details of the cost of the item may be shown separately on item wise basis and it’s entirely upto the Cattle Feed Plant to give any consideration to the same. Approval of rate will be for the item as a whole as specified in specification.

(f) The rate must be written both in words and figures. There should be no erasures and or over writings, corrections, if any, should be made clearly and initiated with date. In case if there is variation observed in the rates in between words & figures, the lowest rates shall be considered.




(g) The validity of letter of approval can be extended upto 3 months. The tenderers are required

to note that purchase orders released by the Cattle Feed Plant within the contract period and extended period, if any, i.e. the first day to the last day of the contract period (Including the extended period, if any) shall have to be executed by them.

(h) The words ‘No Quotation’ should be written across any or all the items in the list which a tenderer does not wish to tender. Any change or insertion of any other conditions or stipulations of blanks in the above terms of supplies are not allowed and if found so, shall render the tender liable to be rejected without notice.

(i) Supplies of Lime Stone Powder required to be made direct to the Cattle Feed Plant, LAMBIYAKALAN in Rajasthan within 30 days from the date of receipt of orders. The purchase orders shall be issued by The Cattle Feed Plant, LAMBIYAKALAN on their monthly requirement basis.

(j) The above period of execution will be counted from the date of receipt of orders. Liquidated damages will be recovered for the days in excess of the period prescribed for supply. It will also be open to the Purchasing Officers to return the goods which are delivered later than the stipulated period and effect risk purchase in case it is found that the goods received are not as per the prescribed specification.

(k) The quantities to be allocated shall be subject to various other provisions given in the tender document. However, the maximum quantity allocated shall not exceed the quantity offered for which earnest money has been deposited.

(l) Cattle Feed Plant reserves the right to select one or more firms for supply of tendered items for operational flexibility, consistent and regular supplies etc. Normally this shall be done at the rates of the qualified lowest. Cattle Feed Plant also reserves the right to allocate quantities in the ratio it deems appropriate with higher weightage to the qualified lowest tenderer. Such ratio could be 65:35- higher/greater part being that for the lowest. Cattle Feed Plant may decide to allot lower quantities to tenderers whose supplies as approved suppliers have not been consistently found to be conforming to the quality/service and specifications during the past contracts.




(m) Cattle Feed Plant also reserves the right to approve more than one supplier at different rates. The party other than the lowest shall be termed as alternate supplier(s). Purchase orders on such alternate supplier(s) shall be placed on failure of the first party on account of non-conformance to the prescribed quality/services/ other terms & conditions as given in the tender/ Rate Approval Letter. This shall be deemed risk purchase as given in point No 2.20 and provisions given therein shall apply accordingly.

2.6 LEGAL COMPETENCY OF SIGNING THE TENDER

Induvidual signing the tender or other documents connected with this tender must specify whether he signs as:- (a) ‘Sole Proprietor’ of the firms or constituted attorney of such proprietor. (b) The partner of the firm, if it is a partnership firm in which case, he must have authority to

refer to arbitration disputes pertaining to business of the partnership either by virtue of the partnership deed or by holding the power of attorney.

(c) Constituted attorney of the firm if it is a company.

NOTE: 01 In case of (b) above, a copy of the partnership deed or general power of attorney duly

attested by a Notary Public should be furnished or an affidavit on stamp paper of all the partners admitting execution of the partnership deed of the general power of attorney should be furnished.

02 In case of partnership firms, where no authority to refer disputes concerning to the business of the partnership has been conferred on any partner, the tender and all other related documents must be signed by every partner of the firm.

03 A person, signing the tender form or any documents constitutes an integral part of the contract, or on behalf of another shall be deemed to warranty that he has authority to bind such other and if, on enquiry it appears that the person so signing has no authority to do so, the buyer may without prejudice to other civil remedies, terminate the contract and hold the signatory liable for all costs and damages.




2.7 EARNEST MONEY DEPOSIT (a) Earnest money in form of DD in favour of Cattle Feed Plant, LAMBIYAKALAN as

mentioned in the special note shall be deposited alongwith tender. The tenders accompanied by Cheques or any other mode of payment instead of Demand Draft or Bankers Cheques towards Earnest Money will not considered.

(b) Any tender which is not accompanied by Earnest Money deposit will be rejected out rightly. Earnest Money of unsuccessful tenderer will be returned within 30 clear days from the date of opening of tender and no interest shall be payable on that.

2.8 The tenders received earlier shall be opened on scheduled date and time at the office of the Manager, Cattle Feed Plant, LAMBIYAKALAN. The tenderers or their accredited agents if they wish so will be allowed to be present at the time of opening of the tender.

2.9 Negligence on the part of the tenderer in preparing the tender confers no right to withdraw the tender after it has been opened.

2.10 The specifications, conditions, schedules drawing of the tender constitute and integral part of the tender.

2.11 All tenders in which any of the prescribed conditions are not fulfilled or which have been vitiated by errors in calculations, totaling, or other discrepancies or which contain over writing in figures or words or corrections not initiated and dated will be liable to rejection.

2.12 In the case of substantial non-conformity with the specifications or if it contains any inadmissible reservations seen or otherwise, in contravention to the spirit and letter of the tender documents such tenders shall be summarily rejected.

2.13 The successful tenderers will have to execute a contract in prescribed form with Cattle Feed Plant, LAMBIYAKALAN (after the acceptance of the tender is communicated by the party).

2.14 Remittance charges on payment made to the firms will borne by the firm. 2.15 All correspondence in this connection should be addressed to Cattle Feed Plant, Lambiyakalan,

NH-79, Lambiyakalan, Via-Rayla, Distt.- Bhilwara. 2.16 Direct or indirect canvassing on the part of the tenderers of their representatives shall disqualify

their tenders.




2.17 No refund of tender fee is claimable for tenders not accepted or forms returned or tenders not submitted.

2.18 The supplier will supply the tendered items within one month’s period from the date of placement of the order by the plant or as settled with the tenderers or as provided in the acceptance of tender. In case supplier fails to supply and deliver the tendered item within the prescribed time as mentioned in the order the Cattle Feed Plant reserves the right to effect risk purchases from other source on the supplier’s risk and cost. Plant also reserves the absolute right as to the method adopted for effecting such risk purchases. The extra expenditure incurred in making risk purchases shall be recovered from the suppliers due payments/security deposit lying with any Plant/RCDF notwithstanding whether such amount(s) pertain to current and/or previous contract(s).




In case risk purchase are not affected for any reasons and approved supplier supplies the goods beyond the prescribed time i.e. after expiry of the scheduled time and if such delayed supplies are accepted by the plant such late receipt of goods shall be subject to late penalty at following rates:-

(a) If the delay is less than one week beyond the scheduled period of supply then a penalty of 1%

will be imposed. (b) If the delay is more than one week but less than two weeks, deductions @ 2% will be imposed. (c) If the delay is more than two weeks but less than three weeks, penalty @ 3% will be imposed. (d) If the delay is more than three weeks but less than four weeks, penalty @ 4% will be imposed. (e) However, in case of persistent delay in the supply of material by the tenderers, the rate contract

may be cancelled and security forfeited by the Cattle Feed Plant.

Manager, Cattle Feed Plant, LAMBIYAKALAN reserves the right to reject the supplied goods or to accept the related supplies if it so desire by imposing deduction to maximum of 5% in case of delays beyond one month as stipulated above. Cattle Feed Plant further reserves the right to extend the period of supply in case a request in time giving full justification for the causes for factors leading to delay are reported by the supplier before the expiry of the delivery period.

3.0 PAYMENT

100% payment shall be released on receipt of test report from CFP lab. CFP lab may test material by itself or even get it tested from other labs.




4.0 REJECTION

4.1 Further the buyer reserves the right to reject the stores either in full or in part, if at the time of delivery it is noticed that the items/stores supplied do not confirm to the description and quality stipulated in the technical specification of the tender. In such event buyer shall inform the supplier immediately after such defect/quality problem is noticed.

4.2 If on rejection of stores by the buyer or consignee at destination the supplier fails to make satisfactory supplies within the stipulated period of delivery, the buyer shall be at liberty to:

(a) Allow the supplier to submit the store, in replacement of those rejected within a specified time, the supplier bearing the cost if any on such replacement without being entitled to any extra payment on that account.

(b) Purchase or authorize the purchase of quantity of the stores rejected or other of a similar description (which stores do not exactly comply with particulars, in the opinion of the buyer, which shall be final) without notice to the supplier’s liability as regards the supply of any further installment due under the contract.

(c) Cancel the contract and purchase or authorize the purchase of items or others of a similar description (stores do not exactly comply with the particulars in the opinion of the buyer, which shall be finally) at the risk and cost of the supplier.

4.3 Any stores rejected shall under all circumstances lie at the risk of the supplier from the moment of such rejection till their removal and if such stores are not removed by the supplier within such reasonable period as may be decided by the buyer, the buyer may dispose of such stores at the supplier’s risk and account & retain such portion of proceeds as may be necessary to cover any expenses incurred in connection with such disposal. The buyer shall also be entitled to recover handling and storage charges for the period during which the rejected stores are not removed. This will include the cost of disposal when necessary.




5.0 It may be noted that tenderers can quote for minimum half quantity. In case the rates given are for part quantity, the tenderers must indicate the quantity for which the rates have been given failing which Cattle Feed Plant, LAMBIYAKALAN decision with regard to quantity shall be final and binding.

6.0 In the event of any dispute in the interpretation of the terms of this agreement/purchase order or difference of opinion between the parties on any point in the purchase order arising out of, or in connection with the agreement/accepted purchase order or which regard to performance of any obligations hereunder by the either party, the parties hereto shall use their best efforts to settle such disputes or difference of opinion amicable by mutual negotiations. In case of any disputes, Manager Cattle Feed Plant or person nominated by him shall be the sole arbitrator to settle these disputes.

7.0 The present contract shall be governed overall by Rajasthan Cooperative Societies Act and allied laws.

8.0 This order is not transferable. 9.0 All the documents and drawing supplied by the buyer must be treated as ‘CONFIDENTIAL’

must not be copied, reproduced, transmitted or discussed otherwise in whole or part, not duplicated, modified, divulged or discussed to any third party nor used in any other way without the consent of buyer in writing.

10.0 (a) All the tenderers without fail should furnish full technical details about their items

tendered. (b) Tender forms as issued from this office must be returned with all enclosures to this office

on the date of receipt of tenders. If the tenderers desire to obtain an additional copy of the tender, he can do so at cost to be deposited with the cashier.

(c) Tenderers must submit their offer in “Annexure I(A) & I(B). One sheet should use for one item only.




(d) Samples must be submitted along with the tender, irrespective of whether the tenderer is present supplier or not, without which the tender will not be considered for any evaluation.

Samples are intended to be reflection on the quality of goods to be supplied by the firm, if approved. It is, therefore, extremely important that samples conform to all the specifications given. In case the samples fail the bid/tender will be liable for outright rejection. The decision of Cattle Feed Plant, LAMBIYAKALAN shall however be final and absolute in this regard.

(e) Tenderers should sign each paper in token of having read and understood and accepted the terms and conditions.

11.0 The quantities mentioned in the tender are tentative and the actual quantities to be procured may

vary upward or downward shifting to the actual requirements. 12.0

(a) Tenderers have to submit invariably an Income Tax clearance Certificate/copy of latest return from the Income Tax Officers of the circle concerned and Sales Tax clearance Certificate from the Assessing Authority alongwith the tender.

(b) The Material shall be tested at CFP lab. The test reports of CFP shall be considered final. However on rejection / high rebate party can request CFP within 7 days of receipt of quality report for resting. Retesting shall be carried out at ITA lab Mumbai / NDDB. The report of such IInd test shall be acceptable to both the parties. The amount / fee required for IInd test shall be borne by the supplier tenderer.

(c) The cut off level, for the actual supplies indicates the acceptability level, with suitable

deductions, as specified in the “Deduction Structure” (copy of the same enclosed herewith alongwith specifications), beyond which the material supplied shall be rejected. The cut off level of acceptability given in the next column has relevance for the actual supplies in respect of successful tenderers. The same is not applicable for the samples to be given or rates to be quoted in the tender.




13.0 (a) Cattle Feed Plant also reserves the right to blacklist, if the performance of approved

supplier with respect to quantity and time of supply etc. is found unsatisfactory. Cattle Feed Plant also reserves the right to forfeit the Earnest Money/Security Deposits side by side to recovering other due amounts in any other way including legal recourse.

(b) Cattle Feed Plant may not consider the application of such applicant who has earlier been debarred/censured/black listed or even those firms who have on their rolls employees/executives/proprietors/partners of another already debarred/censured/black listed firms in one or the other capacity. However, decision of Cattle Feed Plant, LAMBIYAKALAN shall be final in this regard.

(c) No item and condition in addition to the above mentioned will be agreed to. The conditional offer/price bid which reflect/ affect the price of quoted item shall be liable for rejection outrightly without any reference.

General Term / Conditions of Contract

(A) These conditions should be read very carefully by the tenderer while filling in

their quotations.

01- Quotations must be enclosed properly sealed envelopes according to the

directions given in the tender notice:

02- The rate per unit must not under any circumstances be allowed and rates must be

entered in words as well in figures.

03- The tender should be given by those firms/ dealers, who are either registered,

approved supplies for these articles/goods equipments for which tender is being

given.

04- The approved suppliers shall be deemed to have carefully examined to the

conditions, specifications, size and drawing etc. of the goods to be supplied. If the

tenders have any doubt as to the meaning or of any portion of these conditions of

the specifications/drawing etc. He shall before assigning the contract refer it to the

Manager and get clarification in time.

05- The contractor shall not assign or sublet his contract or any substantial part

thereof to any other agency.

06- All the stores supplied shall be of the best quality to the specification trade mark

laid down by them and instruct accordance with the approved standard or

approved suppliers. The suppliers shall be of the very best quality and description

obtainable in India. The decision of the stores and shall be binding upon the

tenderer and in care any of the articles supplied not being approved, shall to be

rejected or to be replaced with consideration of the losses causes to suppliers as a

result or replacement of suppliers.

07- In purchasing officer or his authorized representative shall have at all reasonable

time assess to the suppliers promises and shall have power at all reasonable time

to inspect and examine the materials and workmanship of the goods.

08- In case goods other then the approved quality or size supplied the same shall be

rejected and will have to be replaced within a reasonable time the supplier without

extra cost.

09- The rejected articles must be removed by the tenderer from destination within 07

days from dispatch of letter or rejection. The officers concerned will take

reasonable care of such materials but in no case shall be responsible for any

losses, shortage or damage that may occur to it while it is on plant premises. If the

party fails to lift the material within above prescribed period an extra reasonable

charges will be recovered from the party.

10- The tenderer shall be responsible for the proper packing do as to damage under

normal conditions of transport by the Rail and Road or Air and delivery of the

material in good condition to the consignee at destination. In the event or any loss,

damage, breakage or leakage or any shortage the tenderer shall be liable to make

goods such loss and shortage found at the time of checking/inspection of material

by the materials by the consignee. No extra cost on such account shall be

admissible.

11- All rates quoted must be FOR destination and should include all taxes. In cash of

local supplier also the rates should include all taxes and no cartage or changes for

transportation will be given by Plant / Federation and the delivery of the goods

shall be given at the premises of CFP, Lambiyakalan.

12- The tenderer whose tender is accepted shall arrange supplies within a period of

minimum 07 days from the date of placing the order. Quantities shown in the

tenders are approximate. The suppliers will have to be arranged to the

requirement of Plant / Federation.

13- The contract of supply can be repudiated at any time if the supplies are not made

to the satisfaction of the Plant/Federation.

14- Tender should be filled in with ink, No tender filled in by pencil or otherwise

shall be considered. No additions.

15- The tenderer should sign the tender at each page and at the end in token of them

acceptance of all the term/conditions of the tender and the agreement.

16- Tender must be accompanied by earnest money required without which tenders

will not be considered. The amount should deposit in DD in favors of Cattle Feed

Plant, Lambiyakalan. The earnest money will be refunded to

unsuccessful tenderer within one month of the final acceptance of the tender

where as in case of successful tenderer I will be treated as a part of security. No

interest will be paid on such amount retained under such head.

17- Successful tenders will have to executed and agreement on prescribed form and

deposit security amount equal to earnest money of goods for the due performance

of the contract. The security money will be return after two months from the date

of complete of the agreed contract. No interest will be paid by the

Federation/Plant. The expenses of completion and stamping the agreement shall

be paid by the supplier and the purchasing officer shall be furnished free of charge

with the executed stamped counter-part on the agreement.

18- Remittance charges/Bank charges on payment made to the firm will be borne by

the Contractors.

19- If the approved suppliers fail either to supply goods of the prescribed

specifications or to deliver the goods within the specified period the purchasing

officer shall be liberty to arrange supply either through re-tender or otherwise if

necessary at cost risk of tenderer.

20- No advance payment will be made, payment shall be due and payable by the

Federation only when the whole quantity has been deliver and inspected and

accepted by the concerned authority and a certificate or having done so it

recorded. In case on disputed items 10 to 25% of the amount shall be withheld

and will be paid of settlement of the dispute.

21- The validity period and delivery period can be extended up to three month by the

Manager, Cattle Feed Plant, Lambiyakalan Direct or indirect conversing on the

part of tenderer or their representative will disqualify their tenders.

22- The Manager reserve the right accept any tender necessary the lowest tender and

reject any tender without assigning any reasons there of orders can be placed for

the whole or and articles tendered for at the direction of the Manager.

23- Tenderer will have to submit an Income Tax Clearance Certificate from the

Income Tax Officer of the circle concerned and a Sales Tax registration

Certificate from the Sales Tax/ Commercial Tax officer concerned ward along

with the tender without which tender may not be consideration.

24- All legal proceeding if necessity arises to institute by any of parties

Federation/Plant or contractor shall have to be lodged in the court situated in

Bhilwara and not elsewhere.

25- In case of any dispute matter shall be refers to Arbitrator Managing Director,

R.C.D.F. or his authorized person shall be as sole arbitrator. His decision shall be

final and binding to both the parties.

26- No other conditions except those mentioned above will entertained in the tender.

27- As the goods shall be supplied on FOR basis no freight payment shall be made

from Cattle Feed Plant, Lambiyakalan.

28- Successful tendrere must deposit security money Rs. 10000/-. The amount should be deposited in demand draft in favour of Cattle Feed Plant, Lambiyakalan.

SPECIAL TERMS AND CONDITION

Payment Terms :

1) For all the motors rewinding below 10 HP the payment shall be made within 15 days from the date of receipt of bills.

2) For motors above 10 HP the payment shall be made within 30 days.

Work Schedule :

1) All motors up 0,5 HP within 5 days. 2) Motors between 0.5 HP to 15 HP 10 days. 3) Motors higher than 15 HP 15 days.

Testing :

1) All the motors up to 10 HP initial testing shall be carried out on test bench under no load condition . 2) The motor above 10 HP shall be tested after placing the motor at site and un load / full load condition.

Guarantee :

3 Months from the date of putting the motor on load , incase of repeat failure (more than one ) of rewinding the CFP shall be free to get the job done elsewhere at the cost of original contractor.

Motor Accessories:

The motor given for the rewinding having connection plate / cover plate, shall be returned to CFP with these item properly fitted on Motor after rewinding.

Inspection :

1) All the motors shall be sent to the contractor works by the plant for the rewinding Work. The final Inspection of winded motor shall be done at Cattle Feed Plant.




GENERAL TERMS AND CONDITIONS.

1. Good quality /ISI mark material should be used and balancing of phases should be ensured at no load and full load current.

2. Motor up to 05 HP should be rewinded within 5 days .05 to 15 HP within 10 days and above 15 HP in 15 days incase of emergency motor shall have to be rewinded within 48 hrs.

3. The payment for rewinding shall only be released after satisfactory performance of motor for 10 days.

4. Earnest money of Rs. 10000/-( Rs. Ten thousand only) should be deposited in cash or in the form of Demand Draft Payable to the Cattle Feed Plant, Lambiyakalan with completed tender forms No. interest shall be payable for the same (cheque will not be accepted).

5. Tenderer must give his permanent place of work where he can be contacted at any hours of the day (Preferably phone No. also).

6. Penalty of Rs. 10/ - per day shall be imposed on the rewinded for any delay beyond time specified for rewinding.

7. The old wire of the burnt motor may be retained by winder and rates may be quoted accordingly.

8. Motors which burns out shows any defect due to rewinding fault will have to be rewinded / repaired without any charges on urgent basis.

9. Every page of the tender should be signed in token of the acceptance of the terms and condition.

10. There should be no cutting / over writings in the tender documents. If at all must be duly signed by the tenderer .

11. In case of discontinuation of contract in violation of the tender terms. Security money shall be forfeited.

12. The contract period shall be for one year effective from placing the work order. Which can be extend to another one year based on mutual consent and performance however the Cattle Feed Plant reserve the right to extend for 3 month after completion of one year on the same terns and condition. Contractor shall submit the agreement as director by the Cattle Feed Plant. 13. Rate’s can be approved for one and/or more than one party for different motor’s.


14. The Manager, Cattle Feed Plant, Lambiyakalan reserves the right to reject any or all offers without assigned any reason thereof.

15 Incase contractor fails to fulfill the condition of the contract Cattle Feed Plant may get the motors rewinded from any other place at his (contractor 's) risk and cost.

16. Tenderer must quote his past experience of the mentioned job.

17. Statutory deduction shall be made as per rules .

18. The burnt / defective motors shall be given by the Cattle Feed Plant at there place of work and shall be lifted back by the Cattle Feed Plant with Cattle Feed Plant conveyance after rewinding within stipulated time.

19. Rewinder should submit delivery challan / bill to the Cattle Feed Plant while delivering motor The party shall raise the bill within one month of delivery of motor.

20. Good workmanship and timely deliver of rewinded motors is the essence of this contract and rewinded must ensure it through out the contract period.

21. Servicing of the Ceiling Fan / Cooler Fan / Cooler Pump / Pedestal Fan shall be done on labour rate per pieces basis the material required shall be given by us old material shall be returned back by the party.

TERMS & CONDITIONS FOR TRANSPORTATION OF FURNACE OIL 1. The tenders should be filled up clearly with no cuttings. 2. The tenders should be sealed and the name of tenderer & bidder should be

mentioned of the separate envelope for part “A”& ”B”. 3. The tenderer should not be a member of staff, Board of Directors or their

relatives. 4. The tenderer should not be black listed party. 5. Experience in the field would be given priority. Necessary certificate may be

attached along with tender. 6. The offer of the tenderer should remain valid for one year. 7. The party would observe rules of the sangh for material in and out. 8. The offer would be of one year. After expiry of one year it can be extended for

another 01Year on the same terms & conditions. On the satisfactory work by transporter. In case of any Delay in tender Three Month extended by sangh This would be acceptable to the party.

9. Incase it is felt that the quoted rate in on higher side, the Cattle Feed Plant, Lambiyakalan reserves the right to negotiate the rates with the bidders. The right to take the final decision would lie with the Cattle Feed Plant, Lambiyakalan.

10. Furnace Oil / L.D.O. would be transported from Indian Oil Corporation/ Depot Kandla.

11. The rate quoted would be on per MT basis, F.O.R. Cattle Feed Plant, Lambiyakalan.

12. The tender may be cancelled without assigning any reason by the Manager Cattle Feed Plant, Lambiyakalan. The decision of Manager Cattle Feed Plant, Lambiyakalan. Would be final and binding in all the cases.

13. At the time of receiving furnace oil each compartment would be checked by stick. The certification for dip stick would have to be produced by the party. It would be counterchecked by weighing the tanker on Dharmkanta.

14. The bill for transportation would be submitted with individual consignments. The payment for transportation bill would be made within 15 days.

15. Incase of shortage of furnace oil / L.D.O. Cattle Feed Plant, Lambiyakalan reserves the right to deduct & recover equivalent amount from the transportation bill / security amount.

16. Only the parties authorized by Indian Oil Corporation/Bharat Petroleum, can submit the tender form. It is essential to enclose copy of license `certificate with the tender.

17. (A) In case of any increase/decrease in the rate by Govt. of India / (Govt. of Rajasthan) basic rate per kilometer will be increase / decrease reckoning 04 KM in one litter of diesel. Price will be entertained proportionately in transportation charge tacking standard /Lit. Average quarterly basis and will be payable for next quarter.

(B) Per MT Rate revision on (+ -) = Diesel rate difference increase/decrease/total MT weight X std. KM. ( If rate is an per KM basis)

18. The successful bidder earnest money will be deposited is sangh as security money for the period of contract awarded. No interest will be paid on it .

19. The security amount would be forfeited in the event of bracking the contract before the contract period by the party / refusal of the party to do the job for Cattle Feed Plant, Lambiyakalan.

20. The furnace Oil / L.D.O. would have to be transported immediately on receipt of the same from respective Depot. The Cattle Feed Plant, Lambiyakalan would give bank draft favoring the company and also a authority letter on the basis of which furnace oil can be obtained from the Depot and the same would have to be brought to the Cattle Feed Plant, Lambiyakalan.

21. Any octroi and Toll Tex paid on furnace oil would be given by Cattle Feed Plant, Lambiyakalan. Union. Upon production of receipt of the same.

22. The transit insurance for furnace oil would be arranged by the transporter and transporter must submit the attested copies of insurance document.

23. The bidders would have to attach Demand Draft of Earnest Money of Rs. 20,000=00 along with the bid, for want of which the bid would not be entertained.

24. Income –Tax, service Tax would be deducted from the bill as per rules. 25. The successful bidder would have to enter in to an agreement with Cattle Feed Plant,

Lambiyakalan on a no judicial stamp paper for Rs. 500=00 at his cost. 26. It would be the responsibility of the successful bidder to inform the revision of rate of

furnace oil as declared by the companies from time to time to Cattle Feed Plant, Lambiyakalan subsequent to allotment of transportation contract.

27. All dispute are subject to Bhilwara jurisdiction only. 28. Rate for transportation of Furnace Oil / L.D.O. (Inclusive of all Tax including
