Affidavit Subject:- Regarding communal riots took place in Bhavnagar District, pursuant to incident took place at Godhra on dated 27.2.2002. I, Rahul Sharma, I. P. S., D.C.P. Control room, Shahibaug, Office of Police Commissioner, Ahmedabad, do hereby declare my following fact on oath: That I am an officer of IPS Batch, 1992 and I have been allotted in the Gujarat cadre. I have performed my duties at difference places in Gujarat. I was performing my duties as District Superintendent of Police, Bhavnagar District for the period from dated 16.2.2002 to 26.3.2002 in Bhavnagar District. Total 23 police stations were situated in my area as District Superintendent of Police, Bhavnagar District, the list of those police stations is kept herewith vide Statement-A.

On dated 27.2.2002, I was on casual leave at Vadodara, at that time, in the noon, I was came to know about incident took place in train at Godhra. While I was preparing to come at Bhavnagar, at that time Special I. G. P. of Junagadh Range instructed me that, pursuant to the incident took place at Godhra on 27.2.2002, the call of "Gujarat Bandh" has been given by Vishwa Hindu Parishad on dated 28.2.2002, so you immediately resume duty, therefore, I immediately left to resume duty and left from Vadodara on 27.2.2002 at 17.30 P.M. and came at office of District Superintendent of Police, Bhavnagar at 21.45 P.M. and called meeting of Police Officers, Bhavnagar during period from 22.00 P.M. to 24.00 P.M. and from hours 00.00 A.M. to 2.00 A.M. on 28.2.2002 and given necessary instruction to them, and for the call of Gujarat Bandh given on 28.2.2002, I had given them necessary guidance to all officers regarding making systematic and proper distribution of bundobast. I made discussion with officers outside city i.e. Dy. S.Ps. of Mahuva Division, Botad Division, and Palitana Division through phone as to what arrangement regarding bundobast pursuant to call of Gujarat Bandh is made? How many persons in bundobast are allotted? Whether they require more persons or not? etc. wherein S. D. P. O. of Palitana demanded that as rally is to come out pursuant to call of "Gujarat Bandh" today at Palitana, therefore horse rider policemen are required, therefore, I informed in LIB Branch and asked them to make an arrangement and necessary arrangement was made as per my instructions. The wireless message which I sent to give additional police force, from outside except bundobast of local police at each place of the District, that message is enclosed herewith by 'Statement-B'. In the District, except Bhavnagar city, Mahuva, Shihor, Palitana were treated as sensitive centers and the detail of total bundobast on all sensitive places is enclosed herewith in Statement-B(1). And pursuant to call of "Gujarat Bandh" on dated 28.2.2002, I remained present in stand-to position at my office from hours 2.00 A.M. and I was supervising bundobast of District and city, through wireless set. During that, at late night at about 23.00 P.M. I came to know that, there is fire in the shop of a Muslim situated near Ghogha gate chowky, therefore I called officer of F. S. L. etc. there and stated to make an investigation/endeavour regarding that and visited place and on knowing fact by going there, I found that there is fire at shop named Good luck Electronics of Salim Ali Mohammed Lakhani, aged 40 years, Residing at Shishuvihar in undesirable manner, regarding that, I personally explained Police Inspector, C Division to make an investigation. On next day i.e. on 1.3.2002 by accompanying an officer of F.S.L., I personally visited place, so officer of F. S. L. after examination stated that reason of fire is short circuit. Date: 1.3.2002

On dt. 1.3.2002, due to call of "Bharat Bandh" today, I remained present at my office in stand-to bundobast and I was in contact of City and District on wireless set, during that as in the newspaper "Sandesh" of today the news which can instigate the people are published (Statement-C), and as I made talk with Shri Rajesh Joshi, Resident Editor (Editor) of Sandesh at Bhavnagar today, not to publish such news in daily newspaper by telephone, he stated that, "what is written is proper. Even I wanted to write more, but now if you are saying then I will not write so, hereafter." As he stated so, I kept an entry to inform superior officer regarding this. Thereafter I was present at my office and pursuant to call of "Bharat Bandh" I was keeping an eye on bundobast arranged through the wireless set. On this day, I was aware of the fact that a rally of "Sadhu Samaj" was to come out at Bhavnagar, and they were to give representation to the Collector, Bhavnagar. During this, I came to know from Control room at 17.10 P.M. that rally has been taken out by "Sadhu Samaj" in oppose of Godhra massacre took place at Godhra, and after giving representation to the Collector, Bhavnagar, this rally was dispersed. During that period at 18.00 O'clock on set, I came to know that in some areas of Bhavnagar city, mobs are gathered. Immediately, I left from my office with my striking force (the statement of which is enclosed herewith in Annexure by Statement-D) and as the mobs were gathering in Navapara, I remained there in the work of dispersing the mob and after dispersing mob from there, I came at Ghogha ghat. So mob was gathered there and I dispersed this mob through striking force with me. I was present there in this action, during that on wireless set, I received an information that the goods in the shop at corner of Lokhand Bazar, Kanbiwad, has been set on fire. Therefore, I immediately left from there and as from Lokhand Bazaar mob was making casual stone pelting and one shop was burnt, I remained busy in dispersing them. During this, Collector also came there and I remained there in the action of dispersing mob of Kanbiwas for about two hours. During that I received news that opposite Lokhand Bazaar in Lati Bazaar in street one house is burnt, therefore, immediately I and Collector and persons of my striking force went there and made an endeavour to call fire brigade to extinguish fire there. At this place as there was doubt that more persons from nearby areas will again make an assault, therefore, I and Collector stayed there upto hours 20.15 P.M. During that, at this time, I made discussion with the Collector to call more fire fighters from Nirma, Alang, Botad and Palitana etc. places pursuant to incidents of fire. During this, I came to know that, there is also fire at White Rose and Apollo Hotel, therefore, I and Collector seated in only one vehicle and as situation was found more spoilt, we made discussion to impose curfew and came at White Rose Hotel. During this Collector made declaration of imposition of curfew and I informed all the officers of the bundobast by wire message to

make strict compliance of curfew and we came at White Rose Hotel. After coming there, we came to know that three persons are trapped inside White Rose. As White Rose hotel was totally burning from lower part, it was not possible to go inside it. For saving three persons, who were foreigners and trapped inside, I decided to enter in the building of White Rose from another building near White Rose. For that while I was going upstairs with my striking force, as in this building also by keeping rust and boxes on stairs hurdles were caused, I gave instruction to P. S. I. Shri Chavda and staff to remove the same and I came down with purpose that no mob is gathered. During this, P. S. I. Shri Chavda of my striking force, police staff and home guard persons went on terrace of another building and from there they jumped on terrace of White Rose building and by opening door of terrace of white rose building and by going down stairs they took out three foreign travellers and made them come down and shifted them at safe place from back door of hotel. As this work from there was completed, I left for controlling other affected areas of city from there. By making patrolling, I reached in Limbdiwali Sadak area. Near Limbdiwali Sadak the persons of two communities gathered and they were making stone pelting on each other and were burning some shops and also residential houses at this place. As I came at the above place with my striking force, as the mob of Muslim community was gathered, they were explained and removed. At other side i.e. mob of Hindu community towards Walket chowky was rioting and had burnt the shops and houses and as its flames were going very high, nobody could be clearly seen in the mob, so I had often given warning through mike of Government vehicle of striking force to this mob to disperse. During this City Dy. S. P. Shri M. D. Jani also reached with his staff, therefore, I had given him necessary instruction regarding situation. Thereafter Shri Jani got fired teargas shells and firing through persons/officers of his striking force and local police station and its detailed fact is enclosed by statement E (page 4). At this time, I had a talk with D. G. P. through my mobile phone and he had informed me that he is sending one company of S. R. P. with him for Bhavnagar. During that, I informed all officers of Bundobast through wireless set of my Government vehicle to take strict action to stop riot and to use necessary force and if required to make effective firing and at this place, during bundobast, I had taken out about fifteen families of minority community from dangerous house near burning houses and shifted them at safe place. During this, a phone call of a person named Professor Shaikh came that, mob is gathered near Sanchit Niwas and they are making stone pelting, so reach early, therefore by handing over the responsibility of safety of Limbdiwali Sadak to Shri Jani, I came towards Sanchit Niwas with my striking force. When I was coming in the way, near Ibrahim masjid, Nr. Municipal school

No.2/2 many people were gathered and strong stone pelting was going on, and some shops and residential houses were set on fire and an attempt was also being made to burn other houses also, therefore, by getting down there, I gave warning to the mob to disperse, but as mob was not dispersed, I used force through my striking force and dispersed the mob, the detail of which is mentioned in the Statement-E (page No.3). At that time, a resident named Maulvi Ullah @ Rangila Mohammed Nazir resident of Flat Sana Apartment, situated in Prabhudas Talao Tekri chowk came there and informed me that about eleven persons are trapped in his flat and mob of Hindus are burning the house, therefore, I took Maulvi Ullah with me and came towards Prabhudas Talao Tekri chowk with my striking force, and I had seen mob of about 1000 people burning that flat and in Prabhudas chowk, one Armada jeep and one motor cycle were burning. Here at all four sides mobs gathered and were rioting, therefore, by reaching there, I gave instruction to mob to disperse, through mike of vehicle of my striking force, however as mob was not dispersed, by using the force, I dispersed the mob. Its detailed fact has been mentioned in Statement-E(page no.3). After mob was dispersed, Maulvi Ullah shouted and called about 11 people from terrace to come down stairs, wherein including 7 men, 1 woman and 3 children total 11 persons were safely brought downstairs and shifted at safe place. During that, I came to know that rioting mobs are gathered near corner of Arabwad and are rioting and Collector and District Home guard Commandant are also trapped between mobs. So immediately I went there with staff and gave instructions through mike of vehicle of striking force to this mob to disperse, however mob was not dispersed, so by using force, I dispersed the mob, the detailed fact of which is mentioned in Statement E (Page No.19). Thereafter I was in patrolling, during that, I came to know that some persons are admitted in hospital due to sustaining injuries, due to firing and due to making assault on police persons, they are injured, so I visited Government hospital to ask about their health. Earlier, I came to know that in Kumbharwada area, by giving blows with sharp edged weapon to one shepherd person some unknown persons caused his death, therefore, I went at said place of incident with staff and knew fact from P. I. Shri Patel present there and at local place motor cycle of deceased shepherd was lying in burnt position, which I had seen. Thereafter, by moving in patrolling from there, an attempt was being made to burn some cabins in this area, but as I came, the mob ran away and only few shops were burnt and started to burn. During this, I and my staff personally came and extinguished such four to five shops while they were burning. Thereafter, as I felt that riots become lighter, I came at my office. At this time there was time of about Five thirty A.M. in the morning. As my mobile phone

was discharged, due to coming of constant phone calls, therefore, I kept mobile phone for recharging. Thereafter, from hours 07/00, I went out for patrolling and as incidents of setting on fire started taking place again, I gave instructions to all officers through set of my Govt. vehicle to take effective action to strictly control the riots and I had given instruction to all mobile directly through wireless set of my vehicle, to all officers to control riots strictly and to take effective action and if any officer will not use arms with him to stop riots then strict penal action will be taken against him. During this period, one company of S. R. P. came so I made allotment of persons of S. R. P. in city area and made bundobast more strong. And while I was in patrolling, during that at 8.30 A.M. I came to know that rioting mobs are setting shops on fire in Kumudwadi, therefore immediately I went at Kumudwadi with my striking force. In this area the mob had burnt the houses, shops and cabins and they were making an attempt to set on fire more houses and shops that I had seen myself, and looking there as mobs were coming from three sides and committing riots and setting shops on fire, I kept halt of P. S. I. Chavda of striking force with me in Sitaram chowk and I personally went towards eastern side to disperse the rioting mob, and gave warning to the mob to disperse through mike of my government vehicle, however by using necessary force I dispersed the mob, the detailed fact of which is mentioned in Statement E (page No.6), and while returning though P. S. I. Chavda of striking force had given warning to the mob to disperse ahead of Kumudwadi and towards western side, and though gas was fired as mob was not dispersed, and started stone pelting on persons of my striking force, P. S. I. Shri Chavda of striking force, had after obtaining permission of the Executive Magistrate present there fired one round from Three knot three rifle and home guard Vijay Mansukhlal, after obtaining permission of Executive Magistrate present on site fired on round from his Three Knot Three rifle on the mob towards western side, so two persons were injured and after sending both persons at government hospital for treatment, the detailed fact of firing and teargas shell is mentioned in Statement-E (page no.6). I went out in city for patrolling, during that while I came on Vitthaleshwar road, the mob was gathered and rioting, so warning was given to it through mike of my government vehicle, however as mob was not dispersed, by using necessary force, the mob was dispersed the detailed fact of which is mentioned in Statement-E(page No.20). On going ahead from there, near corner of Arabwad, mob again gathered and made stone pelting on us, therefore after obtaining permission of Executive Magistrate to disperse them, I got fired two round from three knot three rifle of homeguard Hitesh B. on the mob towards Kansara Sheri and got fired one round from three knot three rifle of homne guard Vijay Mandlia through police constable P. P. Rana of striking force, and one round firing from three knot three rifle of police constable Dinesh Sivabhai, and dispersed the mob. Thereafter, I was in patrolling in the city, during that I came to know that mob of people is making an assault at Akwada Madressa, and there is need of more police force, as it was stated so by officer present there, I sent Police Inspector Bhati of B Division police station there and I was also going there by moving and patrolling. During this a phone call of a person named Arifbhai came on my mobile phone that, mob of people will burn Akwada Madressa, so you immediately help, therefore I was going at Akwana. During that, Police Inspector Shri Bhati of B Division Police Station reached at Akwada Madressa and I heard that on wireless set. On the road towards Akwada Madressa, mob was gathered near workshop of Gujarat Travels, and they had set on fire buses and trucks of Gujarat Travels. So after dispersing mob, and by leaving 2 police constables and 2 home guards with me there for bundobast, and I went ahead, so near Limbda motors rioting mob was setting on fire cabins, so I stood there and I gave instruction to the mob through mike of my government vehicle to disperse. During this one person made an attempt to set on fire one cabin through burning torch, and as I challenged him, he made an assault through burning torch on me, so I fired one round from government Pistol with me at lower part from waist on him, so he sustained injury at leg and he ran away in mob and mob was dispersed. Thereafter I reached at Akwada, where mob of about ten thousand people gathered and rioting and by throwing stones and burning torches on Madressa, they were trying to set on fire Madressa. Many persons of mob had lethal arms like scythes, swords, pipes, axes etc. with them. At this time Dy. S. P., Bhavnagar city Shri M. D. Jani also came there, and though warning was given to this mob through mike of government vehicles to disperse, it was not dispersed, and made stone pelting towards us, therefore by using force, we had dispersed the mob, the detailed fact of which has been mentioned in Statement-E (Pate No.13). Thereafter, I sent Police Inspector Shri Bhati of Bhavnagar City B Division Police station to call the Sarpanch of Akwada village. At this time, the sarpanch of village was not present, therefore Shri Bhati called Aniruddhasinh Gohil, a leader of village. I explained him to explain the rioting persons of village not to commit riot and not to make stone pelting on police and not to throw burning torches on Madressa, otherwise police will take strict action. Thereafter, I explained Police Inspector Bhati to remain present at Akwada Madressa in the bundobast, and I came in Bhavnagar city and I remained present in the meeting of Peace Committee held at Collector office. Thereafter I made patrolling till hours 24.00 in the city. Thereafter, after meeting I had discussion with Shri Jani, and I decided to shift about 400 students studying at Akwada Madressa and teachers and

other residents at safe place at night time, and I made discussion regarding necessary bundobast regarding this, pursuant to that, from hours 23.00 at night till hours 2.00 A.M. on next day, we shifted all residents residing at Madressa at Ibrahim Masjid, Bhavnagar situated at Shishuvihar. During all this action, the road towards Madressa was closed through burning tyres, big stones, wooden hurdles etc. due to which very much hardship was caused to police in reaching to Madressa and returning from there. While taking residents of Madressa and coming back in the way stone pelting was made on buses and other government vehicles. In shifting the residents of Madressa Dy. S. P. Shri M. D. Jani and Police Inspector Shri Bhati and M. T. P. S. I. Shri Chauhan were together. Whereas I remained present at Akwada Madress with my striking force to keep it as alternative safe place till above residents can reach at Ibrahim Masjid. On next day, in the morning, I kept necessary bundobast and patrolling with a view to see that peace is not spoilt due to many roumers and false complaints and atmosphere. Thereafter during patrolling of city at about 14.00 P.M. in the noon, when I came near Kopra press road, the mob was gathered to break shops and to rob the same, so I got fired gas shell through A. S. I. Pravinsinh with me and dispersed the mob. At this time P. S. I. Shri Zala of C Division came there, so I went in patrolling from there. At noon time, Special I. G. P. Shri H. P. Sing of Junagadh Range came, so by making him conversant with the situation of city, and with him I visited the affected areas. Thereafter at Akwada Madressa the rioting mob gathered so to remove them from rioting, I sent Police Inspector Bhati and P.S.I. Chavda and persons with him to make help to persons of bundobast. Thereafter I instructed Police Inspector Shri N. B. Jadeja of L.C.B. that, if the bus managers of private travles wants to keep their vehicles at police head quarter for safety of their vehicles then I give permission to keep the same, and I instructed him to inform Managers of all travels regarding that, as a result of which, many managers of travels, kept their luxury buses and trucks and other vehicles at police head quarters. At about 20.00 P.M. at evening, one company of B. S. F. came at Bhavnagar city, through whom flag march was made immediately in whole city and especially in the sensitive areas. Thereafter, at about 22.00 P.M. at night, one column of army came so flag march was got done through them immediately in the sensitive areas. At late night another column of army also came. Considering the safety of the Madressa situated at Akwana, the head quarter

of both columns of army was kept at Akwada Madressa. On dated 4.3.2002 in the early morning, one company of border wing also came at Bhavnagar city. The detail of the bundobast made through above all para-military forces is enclosed as per Statement F. Thereafter on dated 4.3.2002, Central Home Minister Shri L. K. Advani, and Chief Minister of Gujarat State Shri Narendra Modi were to come together and as other V. I. P. persons were to arrive, I remained busy in the work of preparing scheme of bundobast till dated 3.4.2002 till hours 24.00. Thereafter on dated 4.3.2002 from hours 00/00 to 4/00 A.M. I prepared the scheme of bundobast regarding visit of Hon‟ble Central Home Minister Shri Advani of Bhavnagar and pursuant to V. I. P. bundobast I inspected route and site inspection from hours 8.00 to 14.00 P.M. and gave proper instruction and guidance to the concerned officers of the bundobast. Thereafter, as Central Home Minister came, I remained with him in bundobast and remained in meeting at Collector office and remained in patrolling in the city. As constant improvement was being made in the situation in the city, therefore relaxation in curfew was given day after day. The detail of curfew imposed during communal riots in Bhavnagar city is enclosed in Statement-G. Though there was improvement in the situation, however no relaxation was kept by police. The information showing daily bundobast is enclosed in Statement H. Thereafter as and when any V. I. P. came to visit the riot affected areas, at that time, I remained with them and gave necessary information to them and obtained instructions and guidance given by them. On dated 13.3.2002, a crime conference of officers of all police stations of district, C. I. P., S.D.P.O. and local police officers and police officers of local branches was held, and in that Crime Conference, instruction was given to the police to do work impartially, clearly and fairly during communal riots. In this meeting, instruction was also given to take precautionary measures and vigil pursuant to Shiladan to be held at Ayodhaya on dated 15.3.2002. The minutes of meeting are enclosed herewith in Statement-I. Thereafter on dated 23.3.2002 from hours 11.00 I was in patrolling, during that, I knew by wireless message that, rioting mob gathered near Chavdi gate near Imamwada‟s masjid and is rioting, and though persons of police and B. S. F. remained in bundobast there gave warning through mike to this mob to disperse, and attempt was made to disperse mob by firing teargas shell, as this mob was not dispersed, and started stone pelting on police and B. S. F., therefore B. S. F. used necessary force and dispersed the mob, the detail of which is enclosed in Statement-E(page no.29), and as I came to know about that fact through wireless message, I, Immediately reached there and became

conversant with the situation. After reaching there, I came to know that, B.S.F., police and S. R. P. persons have arrested total 21 persons out of rioting mob and brought them in “A” Division police station, and Police Inspector T.K. Patel of A Division police station, has lodged a complaint against these persons, which has been registered as “A” Division Police station‟s I C. R. No. 174/02 for offences punishable under section 143, 146, 147, 148, 149, 189, 295, 336 of I.P.C. and u/s. 135 of Bombay Police Act, the copy of which is enclosed vide Statement-E (page No.29), and regarding this incident, I made report to Hon‟ble D. G. P. and I. G. P. Gujarat State on dated 24.3.2002, a copy of which is enclosed herewith vide Statement „J‟. Thereafter till dated 25.3.2002, I performed my duties at Superintendent of Police, Bhavnagar. I gave instructions to the concerned police officers to register offence committed during riots, and I had also given instruction to take action immediately regarding that. Thereafter, as more S. R. P., B.S.F., Border Wing and Army personal were received from government, the same were used till required and I did not let any riot take place and by giving relaxation in curfew step by step, made proposal to Collector to lift the curfew from Bhavnagar and accordingly lifted the curfew. Thus, the riots took place in Bhavnagar District after incident of Godhra massacre were mainly incidents of burning goods and properties by mobs and during Gujarat Bandh there was peace in the whole district, but on the next day i.e. on dated 1.3.2002 after late night the riots were spread. During whole communal riots, each officer and person of Bhavnagar police performed his duties very impartially and fairly and could save lives of many persons and many properties due to their ability. If all necessary action and sufficient use would not have been used by me and police bundobast then figure of loss of lives would be such huge which cannot be imagined, and innocent people would have lost their lives. The list of persons died during communal incidents and list of persons died and injured in police firing is enclosed in Statement-K. The report of firing made by police which was sent to District Magistrate, Bhavnagar, its whole fact has been enclosed in Statement-E. The information or suggestion which were made by wireless set by police officers and police persons in Bhavnagar police city control room, the entry thereof was made in the register of city control room and its fact is enclosed in Statement L. The information received by telephone or information of fact of incidents took place received in Bhavnagar District police control room, the entry

regarding that has been made in the register of District control room, its fact is enclosed in Statement „M‟. The complaints of offences pursuant to each incident took place during communal riot are registered. Till dated 26.3.2002 total 278 complaints are registered. Except Bhavnagar city, in other areas of the district also casual incidents took place, wherein, incidents took place at Ghogha, Shihor, Gariyadhar, Vallabhipur and Gadhda, but at no place loss of life has been caused. But small damage to properties have been caused, and its complaint has been lodged as per rules and regulations. The other place except Bhavnagar city where incidents took place, its short fact has been closed in Statement „N‟. During all this period of communal riots (From dated 1.3.2002 to 5.3.2002) innumerable phone calls relating to incidents came on mobile phone of me-District Superintendent of Police, Bhavnagar, and I received all of them and immediately taken counter effective actions, and statement of bill of all calls of mobile phone is enclosed by statement „O‟. Looking to population of the Bhavnagar city, it is about nine lakhs. The Bhavnagar city has been distributed in „A‟ Division and „C‟ Division police station, out of which in A Division police station in Muslim areas Vadva, Padar Devki, Vadva Talavdi, Bapesara Kuva, Amipara, Navapara etc. areas are situated. Looking to Muslim areas in „B‟ Division police station, the said Muslim areas are situated at Shishu Vihar, Bharatnagar, Memon colony, bank of Kansara 14 nala, Madressa Akwada and looking it in „C‟ Division police station area, the same are situated at Amba chowk, Sandhiyawad, Limdiwali Sadak, Vorawad, Prabhudas Talao tekri, Bhilwada circle etc. Muslim areas are situated. In comparison to population of about 9 lakh of Bhavnagar city, on dated 28.2.2002 and dated 1.3.2002, by minimum police staff and minimum home guards and S.R.P., by making impartial and fair bundobast very effectively, the efforts are made honestly to save the human lives and properties, otherwise figure of damage to lives and properties of Bhavnagar District would have been very huge than this. In different cities of Gujarat, Hindu organizations made an assault on certain community and have completely recovered price of lives of Hindus, whereas Fattu Hindu organizations of Bhavnagar have only talks of culture and peace and have made failure to Gujarat Bandh. Moreover, people affiliated to strict Hindu ideology stated that, if persons of Hindu community would have committed such a massacre in the country of certain community then what situation they would have. But they are fattu, and people making big talks of Hinduism could not take any revenge of death of Hindus. So how such inhuman massacre of Hindus can be tolerated. But Hindu leaders of Bhavnagar were thinking about throwing one stone on closed shops of people of certain community. Whereas, in Godhra of Gujarat of India, the people of certain community had by setting on fire coach of train, had burnt alive number of Karsevaks, therefore it is better than call in the name of bandh that they should let normal life go on, such feeling has been expressed. As this was the first conference of Superintendent of Police Shri Rahul Sharma of this district, regarding making clarification about his system and policy to do work, he stated that:- During the visit of Ministers coming to visit this district, the police officers/police station officers of respective areas are remaining present with Minister constantly in his whole visit program. The piloting/guide car with P. S. I. is already being sent from here for performing duty of protocol which is sufficient. However, if any Minister calls police officer/police station officer of the concerned area for any work, at that time first my consent should be obtained and he only should go thereafter. Nobody should go directly, and all concerned are directed to take its note and comply with instruction. The day to day incidents taking place in police offices or police station and many times the personal matters or confidential matters are also being sent to reporters of newspapers, which are being published as one news in newspaper. This matter is not reasonable. The branches especially should close town such habits. If any such matter will be found to have been published hereafter, then by fixing responsibility of in charge of the concerned office/branch/post, the departmental action will be taken against him/them, and its understanding should be given to all employees under you. No officer/employee/police station officer should bring pressure of any kind from outside or recommendation before me regarding transfer. I will not make transfer by any such recommendation, and all should take its note, and all officers/employees under your control should be informed regarding this and its compliance be made. No profession of liquor, gambling or illegal profession of any kind or such clubs should be continued at any place or in any area of whole district. If the same are continued then the same should be closed down immediately, otherwise, strict action will be taken against concerned person which may be noted by all. The cases in which raid is carried out or vehicles are detailed otherwise, the panchnama of such vehicles detailed, copy of FIR and fact of vehicle should be sent to office of Superintendent of police on next day itself, which may be noted by all. Pursuant to communal incident took place recently on dated 27.2.2002 on Wednesday in the morning at Godhra in railway station, communal riots are spread in whole Gujarat, and due to which very much loss of lives and properties have been caused in other districts, in comparison thereto, in Bhavnagar city and rural area very less damage is caused and situation of law and order could be maintained, for which work of you all has become admirable, and for that, I congratulate all of you. Riots are of many nature like riots against policy of government, riots of students, riots on questions of labourers, due to such movements/riots

society is not divided. At the time of such riot, first by giving warning, lathicharge may be made. If required after giving warning first firing be made in air, and firing only to extent be made that injury is caused on body. Whereas on taking place of incidents of communal riots, the society is directly divided into two divisions, and such society is divided. In such circumstances, the procedure seriatim as stated above is not required to be followed. But only direct effective firing is to be made and so far as possible the bullet can be shot on part below waist, but power till causing death has been given in the law, and accordingly immediately effective firing should be made within the limits of law. Only if effective firing is made then more damage being caused to the lives and properties of people can be prevented. Therefore firing becomes essential. As and when any incident of communal riot will take place, at that time the officer there should by becoming impartial and fair, by keeping away from caste and race and without being influenced by any big head or leaders or without keeping influence of anybody should performed his duty with daring without discrimination. If any such pressure is caused on you then immediately my attention should be drawn. No action under any direct pressure should be taken, and all are directed to take its note and comply with the same accordingly. At the time of any such communal riot, the police/police station officers of concerned area should not remain inactive, instead by using force immediately he should take effective detention action and prevent the damage to lives and properties being increased. Recently at the time of communal incidents being taken place in one area of Bhavnagar one officer was stating to control room from his wireless set that mob is increasing and has become uncontrolled. Therefore immediately send another one mobile at site, as he gave such instruction I heard from wireless. This matter is very improper. This officer by not calling other mobile or force ought to have taken effective steps himself, because reserved force has been sent on duty at other place from head quarter and very much time is passing in calling him and sending him at place where demand is made and at such time the damage to lives and properties is increasing, therefore in such circumstances the concerned officer should take effective steps like firing immediately and should disperse the mob. Now-here such matters should not be repeated, and all should take its note. Not only lathi but rifle should also be given to police persons going in the bundobast of communal riots. One lathi should be given with rifle between every two persons, so that it can be used as per requirement and control the riots. )As per provisions of the Section 129 of the Criminal Procedure Code, PSI and police officers of its above cadre can make firing without permission of the Executive Magistrate to disperse the rioting mob. (11)The persons of police should have teargas, ammunition and muskets in sufficient number to control the communal riots. The maximum use of

muskets should be made. The injured mob can be controlled. (12) After firing made pursuant to riots, the inquiry or magisterial inquiry are being conducted. In such inquiries, it becomes very important to give justification for purpose that the use of force or firing was necessary to control the riots. Therefore, the place where firing is made, the complaints/statements of victim residents of rioting mob of that place and complaints/statements of at least three/four residents/ businessman of the nearby areas should be obtained without fail. No negligence or delay or any kind should be made therein, which may be noted by all and there is instruction to comply with the same. After above discussion and consideration of work of law and order, the discussion/consideration of following work was also made:- The In charge officer PSI/PI of police station should make administration personally and they should not permit interference of others. The identification of police officers is not based on the matter as to how many offences are increased in his area and how much control is not there, but it is based on matter as to at how much pace the detection of offences is being made. It is natural that offences may take place, but effective detaining action should be taken against them and to do effective detection is only real identification and skill of concerned police officer, therefore it is very necessary to keep attention on effective detection which may be noted by all. If any offence takes place then immediately control room or I may be informed through phone. The discussion regarding police bundobast to be arranged at the time of code Puja/Shila Arpan Vishi to be taken placed on dated 15.3 at Ayodhaya, and examinations of SSC/HSC to be commenced from dated 18.3, and bundobast of Tajiya to be taken out on occasion of festival of Mahoram on dated 25.3, and festivals of goods Friday and Holi-Dhuleti on dated 29.3.2002, and elections of Gram Panchayat/Taluka Panchayat, was made. It was decided to continue the bundobast arrangement which is arranged at present stage.
