Building Act 1975

NOTIFICATION OF DECLARATION OF A TRANSPORT NOISE CORRIDOR

Notice is hereby given under section 246Z (1) of the Building Act 1975 that the area adjacent to railways as described in the Schedule is

declared as a Transport Noise Corridor.

THE SCHEDULE

That on and from 29 January 2020, land adjacent to the railways as per the Rail Network of Queensland, is designated as a Transport Noise

Corridor, consistent with section 246Z of the Building Act 1975 and for the purposes of implementing the relevant building legislation

applicable to Transport Noise Corridors.

The land designated as a Transport Noise Corridor comprises land within a corridor up to 250 metres on both sides of the railways which are

significantly affected by noise. This includes railways that carry at least 15 trains per day. The corridor is measured from the boundary of

the railway with adjacent land, and then continuing the distance of up to 250 metres, depending on the noise contours mapped as a result of

rail traffic noise.

The declaration is for the purposes of implementing the relevant building legislation relating to mitigating rail traffic noise impacting on

residential buildings located within Transport Noise Corridors. The declaration supersedes previous notices declaring Transport Noise

Corridors for the rail network.

As per section 246Z (3)(b) of the Building Act 1975, documents identifying land within Transport Noise Corridors are in the register held by

the Director-General of the Department of Transport and Main Roads and available for inspection at the Department of Transport and Main

Roads’ office located at 313 Adelaide Street, Brisbane, or alternatively on the Department of State Development, Manufacturing,

Infrastructure and Planning State Planning Policy Interactive Mapping System – Transport Noise Corridors for the purposes of

implementing the Transport Noise Code.

The Department of State Development, Manufacturing, Infrastructure and Planning State Planning Policy Interactive Mapping System can

also be used to identify:

� the railway network;

� land designated a Transport Noise Corridor; and

� individual properties located in a Transport Noise Corridor.

in the Schedule is designated as a Transport Noise Corridor.

That on and from 29 January 2020, land adjacent to the State-controlled road network as per the State-controlled road network of

Queensland, is designated as a Transport Noise Corridor, consistent with section 246Z of the Building Act 1975 and for the purposes of

implementing the relevant building legislation applying to Transport Noise Corridors.

The land designated as a Transport Noise Corridor comprises land up to 100 metres or 250 metres on both sides of State-controlled roads

which are significantly affected by noise. This includes State-controlled roads:

� where the speed environment is 100 kilometres per hour or greater and the Annual Average Daily Traffic volume exceeds 1000

vehicles

� where the speed environment is 80 kilometres per hour or greater and the Annual Average Daily Traffic volume exceeds 2000

vehicles

� where the speed environment is 60 kilometres per hour or greater and the Annual Average Daily Traffic volume exceeds 3000

vehicles

� where the road pavement type is concrete or chip seal and/or the percentage of heavy vehicles is greater than 20 percent.

The corridor is measured from the boundary of the State-controlled road with adjacent land, and then continuing the distance of up to 100 or

250 metres, depending on the noise contours mapped as a result of road traffic noise.

The declaration is for the purposes of implementing the relevant building legislation relating to mitigating road traffic noise impacting on

residential buildings located within Transport Noise Corridors. The declaration supersedes previous notices designating Transport Noise

Corridors for the State-controlled road network.

As per section 246Z (3)(b) of the Building Act 1975, documents identifying land within Transport Noise Corridors are in the register held by

PUBLIC NOTICEAMENDMENTS TO THE BUNDABERG REGIONAL COUNCILPLANNING SCHEME AND PLANNING SCHEME POLICIES

(AND ASSOCIATED REPEAL OF TLPI AND PLANNING SCHEME POLICY)

Notice is given that on 21 January 2020, Bundaberg RegionalCouncil adopted amendments to the Bundaberg RegionalCouncil Planning Scheme 2015 and Planning Scheme Policies(the planning scheme). The amendments will commence asversion 5.0 of the planning scheme on 10 February 2020.

The purpose and general effect of the amendments are asfollows –

Amendment No 5 (Major Amendment)This amendment makes ongoing improvements to the planningscheme, including:• minor changes to codes and levels of assessment to reflect

desired intent and community expectations, including forSecondary dwellings and Dual occupancy development;

• zoning changes to recognise current land use, futuredevelopment intent and correct errors;

• local planning for the Burnett Heads town centre, the Kalkie-Ashfield local development area, and part of Bargara (betweenHughes and Seaview Roads);

• changes to address State interests, including regulatedrequirements and the Bundaberg State Development Area;

• changes to overlays, and the inclusion of additional localheritage places, including associated changes to SC6.2Planning Scheme Policy for the Heritage and NeighbourhoodCharacter Overlay Code;

• other changes to improve the operation and efficiency ofthe planning scheme.

Amendment No 6 (Mon Repos/Sea Turtle Amendment)This amendment seeks to provide a greater level of protection forthe Mon Repos Conservation Park and sea turtles from the effects ofurban development and responds to the ministerial direction noticegiven to Council on 19 February 2017. This amendment includes:• a Sea turtle sensitive area overlay code to ensure assessable

development in coastal areas avoids adverse impacts on seaturtles, including impacts from artificial lighting;

• zoning changes to include land at Shelley Street, BurnettHeads (currently included in the Emerging community zone) inthe Rural residential zone – Precinct RRZ1 (2000m² minimumlot size area);

• changes to other parts of the planning scheme, includingthe Advertising devices code and Nuisance code.

Repeal of TLPI and Planning Scheme PolicyNotice is also given that on 21 January 2020, Council resolved torepeal the following instruments, effective from 10 February 2020 –• SC6.6 Planning Scheme Policy for the Hughes and Seaview

Bargara Masterplan Area; and• Temporary Local Planning Instrument (TLPI) 1/2018 –

Protection of the Mon Repos Turtle Conservation Area.

The repeal of the above instruments recognises that –• Amendment No 5 incorporates planning undertaken for

the Hughes and Seaview Bargara masterplan area withinthe Central Coastal Urban Growth Area Local Plan Codeand other parts of the planning scheme; and

• Amendment No 6 provides a longer-term policy responseto the interim controls put in place through TLPI 1/2018,which was due to lapse on 16 March 2020.

I, Steven Miles MP, the Queensland Minister for Health andMinister for Ambulance Services, am satisfied there is apublic health emergency due to an outbreak of the coronavirus‘2019 n-CoV’ within China, its pandemic potential due to casesspreading to other countries and the public health implicationswithin Queensland resulting from recently arrived travellersfrom the epicentre of the outbreak.

To help control the threat and prevent or minimise serious adverseeffects on human health in Queensland additional emergencypowers will be required by the Queensland Government.Therefore, by this order, I declare a public health emergency underthe Public Health Act 2005 in all of Queensland.

This order is effective immediately and ends at midnight onThursday, 6 February 2020.
