NOTIFICATION

New Delhi, the 16th December, 2004

G.S.R813(E).-In exercise of powers conferred by sections 5 and 6 of the Oilfields(Regulation and Development) Act, 1948 (53 of 1948), the Central Government herebymakes the following rules to further amend the Petroleum and Natural Gas'Rules, 1959,namely:-

1. Short title and commencement.

(i)These rules may be called the Petroleum and Natural Gas (Amendment)Rules, 2004.

They shall come into force on the date of their publication in the OfficialGazette.

;( (ii)

2.In the Petroleum and Natural Gas Rules 1959,

(i) in rule 10, the word "two" shaHbe deleted;

(ii) in rule 22, for sub-rule (5), the following shall be substituted, namely:-

"(5) The licensee or lessee after determination, cancellation or relinquishment of his.license or lease shall immediately remove and dispose of any petroleum, all stores,equipment, tools, machinery from such area".

G.S.R814(E).- In exercise of the powers conferred by sub-section (4) of section

6A of the Oiltields (Regulation and Development) Act, 1948, the Central Government

hereby modifies the rates at which royalties shall be payable in respect of mineral oils,

namely, Crude Oil, Casing Head Condensate and Natural Gas and makes the following

further amendments in the said Act, namely:-

following shall be substituted and entries thereto shall be deemed to have been

3. NATURAL GAS: Ten per cent of the value of the natural gas obtained at well-~

head.

Notel: Well Head Price of Crude Oil and Casing Head Condensate for areas covered

under 1. (1) B. and 2. (l).B. above will be determined by deducting 7.5% and 10% of the

Crude Oil and Casing Head Condensate price considered for onland and offshore-production respectively.

Royalty will be calculated on Cum - royalty basis as under:;,

R 1 - Well Head Price x Royalty Rateoya ty amount - 100 + Royalty Rate

Note 2: Since consultations with the concerned State Governments took some time, it has

become necessary to revise the rate of royalty with retrospective effect. ~ The oil

producing States stand to benefit and other States are not likely to be advt1rselyaffected.
