Bidders should review Document 00210 – Supplementary Instructions to Bidders - to determine whether the contract will be a City Street and Bridge Construction or Improve-ment Contract which requires a current Certificate of Responsibility filed with the Director of Public Works and Engineering no later than three business days prior to Project Bid Date. A Certificate of Responsibility is a valid Prequalification Approval Letter issued by TxDOT stating that a Bidder is qualified to bid on State Highway improvement contracts pursuant to 43 Texas Administrative Code, Section 9.12, as it may be amended from time-to-time, and Chapter 15, Article IV of the Code of Ordinances, Houston, Texas.

For Project WBS No. R-000266-0219-4 this Contract is expected to be funded in part by a loan from the Texas Water Development Board an agency of the State of Texas. Neither the State of Texas nor any of its departments, agencies, or employees is or will be a party to this Contract. Low Bidder(s) will be required to comply with the federal wage and payroll requirements issued by the U.S. Department of Labor under the Davis-Bacon and related Acts, as further described in Document 00806. This contract is subject to the Environmental Protection Agency’s (EPA) “fair share policy”, which includes EPA-approved “fair share goals” for Minority Business Enterprise (MBE) and Women Business Enterprise (WBE) firms. EPA’s policy requires that contractors make a good faith effort to award a fair share of subcontracts to Minority Business Enterprise and Women-Owned Business Enterprise firms. Although EPA’s policy does not mandate that the fair share goals be achieved, it does require prime contractors to demonstrate use of the six affirmative steps. The current fair share goals for the State of Texas are as follows: MBE 12.94% and WBE 8.72%.

Bidders shall comply with City Ordinance 2013-0428, Chapter 15, Article V, City of Houston Code of Ordinances, as amended, and City of Houston Office of Business Oppor-tunity Minority, Women, and Small Business Enterprise (MWSBE) Procedures.
