BE I FURTHER RESOLVED: that in order to enhance the protection of the Oneidagami g enterprise, the Oneida Tribe does hereby authorize joining the Nation.alIndian Gaming Association (NIGA) and shall appoint a delegate fram the membersof e Oneida Business Carnndttee, along with an alte~ate, to represent theOnei a Tribe of Indians of Wisconsin on the NIGA Board of Directors, and that aTri 1 Atto~ey shall serve as a technical advisor of the Oneida Tribe ofIndians of Wisconsin for any future NlGA meetings.

Nowt THEREFORE BE IT RESOLVED: that the Oneida Business Committee of the OneidaTri e of Indians of Wisconsin, in consideration for receiving Wisconsin FundAss stance for Private Sewage System Replacement or Rehabilitation, herebycer ifies that:

The Oneida Business Committee is authorized to apply for grants under s.144.245, Wis. stats., and NR 124, Wis. Adm. Code, and to accept grant awardsfram the state of Wisconsin on behal f of the Oneida Tribe of Indians of

Wisconsin;

state grant funds received by the Oneida Tribe of Indians of Wisconsin unders. 144.245, Wis. stats., and NR 124, Wis. Adm. Code, will be used torehabilitate or replace failing private sewage systems which serve principalresidences or small commercial establishments owned by persons or businesseswhich are eligible under s. 144.245(6), Wis. stats.;

state grant funds will be used as provided under s. 144.245(6), Wis. stats.;

4. The state grant share for each principal residence or small commercialI establishment will not exceed the amount permitted under s. 144.245(7), Wis.stats.;

WHEREAS, Resolution #8-10-90-F authorized the Oneida utilities Commission tomanage and be financially accountable for both a water and sewer system, and

, the Oneida utilities Commission authorized the issuance of a$ Water and Sewer System Revenue Bond and the sal e of the bond to theUnit States of America, Farmers Harne ~nistration for the purpose offin cing a portion of the cost of such system, and

WHEREAS, the Oneida Business c~ttee agrees to guarantee to facilitate themakihg of the loan and to guarantee the payment of, and interest on the loan andband!. as approved and adopted by the Oneida utilities C~ssion, and

~ ' an amended Oneida Tribal Sanitary District Ordinance is required tocarr out all financial and operational functions of a utility that a~nistersa se er and water system, and~ ' said amended ordinance shall incl ude rates and charges that areest' ted to be sufficient to pay all costs of operation and maintenance of thesyst and to produce net revenues equal to the maximum amount of principal andinterest on all obligations payable fram revenues of the system in anysubsequent fiscal year, and

~ ' the Oneida Tribe has authorized the Oneida utilities Commission to bethe entity to operate and construct a water and sanitary sewer facility of theOnei Tribal Sanitary District by Resolution #8-10-90-F, and~ ' Farmers Home Administration agrees to make a loan to the Oneidautil" ties Commission, which loan is evidenced by a Water and Sewage SystemRev ue Bond, series 1991, (the Bond) issued by the Commission and delivered tothe Farmers Harne ~nistration (FMHA), and

WHERfAs, as a condition of making the loan, the F1-1HA has required that theOneitla Tribe execute and deliver this Guaranty, and

WHEREAS, the issuance of the Band by the Commission, and the acceptance thereofby the FMHA, will give rise to substantial benefits to the Tribe including theenhahcement of the heal th and wel fare of economics of Oneida tribal government,its ~rs, as well as the public, by providing a water and sanitary sewerservice wi thin the Oneida Tribal Sanitary District.

NGl tHEREFORE BE IT RESOLVED: that in consideration of the making of the loanand the acceptance of the Bond by the FMHA, the Oneida Tribe hereby agrees toexec~te and deliver the attached Guaranty.
