5:00 P.M. – PUBLIC HEARING – PUBLIC INPUT ON AN APPLICATION ON A LOT LINE VACATION APPLICATION TO VACATE THE LOT LINE BETWEEN LOTS 3 AND 4 MORNING GLORY ADDITION SUBMITTED BY KATHLEEN JOHNSON (LEAH DESPOSATO).

Dusty Demerson opened the public hearing and stated the reason for it. Staff acknowledged that the public hearing has been properly noticed. There were no commissioner disclosures. Written comment from Mary Barrett was acknowledged. Leah Desposato introduced the project. David Leinsdorf explained that the plat can’t be recorded until Kathleen Johnson acquires and closes on the purchase of Lot 4. He recommended having a condition to approve the plat upon purchase. There is interest in expanding the current home, but not to the maximum allowed. The lot line vacation is mainly for protection of space and view corridors.

There was no public comment. There was one written letter in the packet on page 12. The public hearing closed at 5:09 p.m.

5:09 P.M. – PUBLIC HEARING – PUBLIC INPUT ON A VARIANCE APPLICATION REQUESTING A SOUTH SIDE SETBACK OF 10’ FROM A REQUIRED 17’ 11” FOR 19 ANTHRACITE DR, LOT 17 BLOCK K, CHALET VILLAGE ADDITION 7, SUBMITTED BY JOSH AND LAURA EGEDY ON BEHALF OF SOUTHERN KANSAS TELEPHONE CO. (TODD CARROLL)

Dusty Demerson opened the public hearing and stated the reason for it. Staff acknowledged that the public hearing has been properly noticed. There were no commissioner disclosures. Written comment from Martin Purser was acknowledged. Todd Carroll introduced the project. Josh and Laura Egedy proposed the garage this specific garage location because it’s difficult to build elsewhere due to the topography of the property. They plan to live at the house full time long term and it will help with storage.

Petra Marks, whose lived at 24 Anthracite for 25 years, said it will be a good-looking addition to the area and won’t impede views.

There was one written letter in the packet on page 21. The public hearing closed at 5:13 p.m.

Present Mt. Crested Butte staff included Carlos Velado, Todd Carroll, Leah Desposato, and Town Manager Joe Fitzpatrick. David Leinsdorf, Josh Egedy, Laura Egedy, Curtis Vaughn, Michael Kolesar, Jenna Svoboda, Ben Heppe, and Petra Marks were also present.

ITEM 1 APPROVAL OF THE AUGUST 22, 2018 REGULAR PLANNING COMMISSION MEETING MINUTES (LEAH DESPOSATO).

Sara Morgan made a motion to approve the August 22, 2018 regular planning commission meeting minutes. Mary Kasala seconded the motion. There was no discussion, and the motion passed unanimously.

ITEM 2 DISCUSSION AND POSSIBLE RECCOMENDATION TO THE TOWN COUNCIL ON A LOT LONE VACATION FOR LOTS 3 AND 4 MORNING GLORY ADDITION SUBMITTED BY KATHLEEN JOHNSON (LEAH DESPOSATO).

Leah Desposato said the first public notice in the paper had the correct legal description but the incorrect address, therefore the public notice was published again in the following paper with the correction. There was discussion on how the plat must be recorded 10 business days after the Town Council’s approval. If the sale of Lot 4 doesn’t go through, then the lot line vacation will not be applicable and will not be recorded.

Sara Morgan made a motion to recommend that the Town Council approve the Lot Line Vacation application of Lots 3 & 4 Morning Glory Addition submitted by Kathleen Johnson based on the compliance with the criteria set forth in Sec. 18-331 of the Town Code and the findings of fact as stated in this report with the following conditions:

1. The plat is recorded upon ownership of Lot 4 by Kathleen Johnson2. The plat is void if it is not recorded within the 10 business days after the Town Council’s

approvalBobby Jarvis seconded the motion, and the motion passed unanimously.

There was discussion on: • If it were built within the setback requirements it’d be more of a view issue compared to

the proposed garage with the variance• Josh and Laura are presenting the variance because they will be purchasing the property

from Southern Kansas Telephone.• The finding required in Sec.21-407 (b) and if the application is the minimum variance

that will make possible the reasonable use of the parcel.

Cynthia Peatross made a motion to recommend that the Town Council approve the proposed variance application submitted by Josh and Laura Egedy on the demonstration of compliance with the criteria and findings of fact as stated in the Mt. Crested Butte Town Code. Reed Meredith seconded the motion, and the motion passed unanimously.

OTHER BUISNESS • Next meeting is Wednesday, September 19, 2018 at 5:00 P.M.• Recap of the Town Council meeting and worksession Tuesday, September 4, 2018.

Subject: Setback Requirements

This worksession is to address the current town code building setback requirements in

Chapter 21 Article III. The Planning Commission is looking into this per staff request because

the current setback calculations are difficult to calculate and explain and are time consuming for

both the applicant and staff.

The current code has a base set of setbacks for each zoning district, as well as additional

requirements base on height similar to: “provided that one (1) foot of additional side and rear

setback shall be required for each two (2) feet of building height over fifteen (15) feet.” The

building height is “the vertical distance between the average grade or average finished grade of a

structure, whichever is lower, and the highest point of the structure, or to the coping of a flat

roof, to the deck line of a mansard roof, or to the highest ridge of a sloping roof.” The average

grade is “measured at the midpoint of each of the four (4) principal elevations.” Staff would like

to remove height as a factor in determining building setbacks.

Staff has provided the current town code, a chart displaying the average building heights

(mostly single family) over the past 5 years as well as setback requirements from other towns.

There are 3 different suggested options to update the code, all which remove the height as

a factor in the setback determination.

1. Current baseline requirements without additional requirements based on height.

2. Current requirements based off maximum allowable building heights excluding

additional allowance for roof pitch.

3. Compromise between options 1 and 2.

Other discussion points include:

• Review the “Distance Between Buildings” sections of LDMF, HDMF, and BD

• Account for lots smaller than 12,500 square feet

Current structures that would not meet the new setback requirements are protected by Chapter 21

the Code. Sec. 21-429 Nonconforming uses. The use of a lot or structure lawfully established prior to the effective date of the ordinance codified in this chapter which does not conform to the use regulations prescribed by this chapter for the district in which it is situated, may be continued, provided that no such nonconforming use shall be enlarged to occupy a greater lot area or building floor area than it occupied on the effective date of the ordinance codified in this chapter. Any subsequent reduction in lot area or floor area occupied by a nonconforming use shall be deemed a new limitation, and the use shall not thereafter be enlarged to occupy a greater lot area or floor area than such new limitation.

* In the Single-Family Residential District, the minimum front setback shall be twenty (20) feet, theminimum side setback shall be ten (10) feet, and the minimum rear setback shall be twenty (20) feet, orten (10) feet if one (1) side setback is at least twenty (20) feet, provided that one (1) foot of additionalside and rear setback shall be required for each two (2) feet of building height over fifteen (15) feet.

** In the High Density Multiple-Family District, the minimum front setback shall be ten (10) feet, the minimum side setback shall be ten (10) feet and the minimum rear setback shall be ten (10) feet, provided that one (1) foot of additional front, side and rear setback shall be required for each two (2) feet of building height over fifteen (15) feet.

***In the Business District, the minimum front setback shall be ten (10) feet, the minimum side setback shall be ten (10) feet and the minimum rear setback shall be ten (10) feet, provided that one (1) foot of additional front, side and rear setback shall be required for each three (3) feet of building height over twenty-five (25) feet. A ten (10) foot pedestrian accessway, at or near grade, shall be provided along all lot lines, but with a buffer provided between the accessway and any public street or road. These accessways may be covered. In no way shall a building or structure shed snow onto the required pedestrian accessway, a public right-of-way or an adjoining lot.

****In the Commercial District, the minimum front setback shall be ten (10) feet, the minimum side setback shall be ten (10) feet and the minimum rear setback shall be ten (10) feet.

***** In the Public Uses and Facilities District, the minimum front setback shall be ten (10) feet, the minimum side setback shall be ten (10) feet and the minimum rear setback shall be ten (10) feet, provided that one (1) foot additional, side and rear setback shall be required for each three (3) feet of building height over twenty-five (25) feet. Accessory facilities shall be located a minimum twenty-five (25) feet from all property lines that abut the Single-Family Residential District or the Low DensityMultiple-Family District.

Sec. 21-429 Nonconforming uses.

Chapter 21 ZONING ARTICLE I. IN GENERAL Sec. 21-1 Definitions. Height shall mean the vertical distance between the average grade or average finished grade of a structure, whichever is lower, and the highest point of the structure, or to the coping of a flat roof, to the deck line of a mansard roof, or to the highest ridge of a sloping roof. Grade or average grade shall mean the average of the topographic elevations of the existing (preconstruction) site, as indicated on the Official Topographic Map, and measured at the midpoint of each of the four (4) principal elevations. When the topographic elevation at the midpoint of a building elevation is questionable, the planning commission shall determine the topographic elevation.

DIVISION 3. LOW DENSITY MULTIPLE-FAMILY DISTRICT Sec. 21-126 Setbacks. The minimum front setback in the Low Density Multiple-Family District shall be twenty (20) feet, the minimum side setback shall be ten (10) feet, and the minimum rear setback shall be twenty (20) feet, or ten (10) feet if one (1) side setback is at least twenty (20) feet; provided that one (1) foot of additional side and rear setback shall be required for each two (2) feet of building height over fifteen (15) feet. Sec. 21-127 Distance between buildings. In the Low Density Multiple-Family District, the minimum distance between buildings on the same lot shall be fifteen (15) feet, and the minimum distance between a building on a lot and a building on an adjoining lot shall be twenty (20) feet, provided that one (1) foot of additional separation between buildings shall be required for each two (2) feet of building height over fifteen (15) feet, calculated on the basis of the average height of the two (2) buildings. In all cases, however, a space of sufficient shape and size shall be provided to accommodate any snow shed from buildings. Sec. 21-128 Building height. The maximum height of buildings in the Low Density Multiple-Family District shall be thirty-five (35) feet.

A ten (10) foot pedestrian accessway, at or near grade, shall be provided along all lot lines, but with a buffer provided between the accessway and any public street or road. These accessways may be covered. In no way shall a building or structure shed snow onto the required pedestrian accessway, a public right-of-way or an adjoining lot. Sec. 21-202 Distance between buildings. In the Business District, the minimum distance between buildings on the same site shall be ten (10) feet, and the minimum distance between a building on a lot and a building on an adjoining lot shall be twenty (20) feet, provided that one (1) foot of additional separation between buildings not on the same lot shall be required for each three (3) feet of building height over twenty-five (25) feet, calculated on the basis of the average height of the two (2) buildings. In all cases, however, a space of sufficient shape and size shall be provided to accommodate any snow shed from buildings. Sec. 21-203 Building height. The maximum height of buildings in the Business District shall be fifty-five (55) feet. Roof heights shall be varied within the project, and multiple roof breaks shall be articulated to minimize the mass and scale of structures.

In the Public Uses and Facilities District, the minimum front setback shall be ten (10) feet, the minimum side setback shall be ten (10) feet and the minimum rear setback shall be ten (10) feet, provided that one (1) foot additional, side and rear setback shall be required for each three (3) feet of building height over twenty-five (25) feet. Accessory facilities shall be located a minimum twenty-five (25) feet from all property lines that abut the Single-Family Residential District or the Low Density Multiple-Family District. Sec. 21-240 Distance between buildings. In the Public Uses and Facilities District, the minimum distance between buildings on the same lot shall be ten (10) feet, and the minimum distance between a building on a lot and a building on an adjoining lot shall be twenty-five (25) feet. Sec. 21-241 Building height. The maximum height of buildings in the Public Uses and Facilities District shall be forty-five (45) feet.

DIVISION 8. RECREATION AND OPEN SPACE DISTRICT Sec. 21-252 Setbacks. In the Recreation and Open Space District, the minimum front setback shall be twenty (20) feet, the minimum side setback shall be fifteen (15) feet, and the minimum rear setback shall be fifteen (15) feet. Sec. 21-253 Distances between buildings. In the Recreation and Open Space District, the minimum distance between buildings on the same lot shall be fifteen (15) feet and the minimum distance between a building on one (1) lot and a building on an adjoining lot shall be twenty (20) feet, provided that the minimum distance between any building used for the housing or feeding of animals and any building used for dwelling purposes shall be fifty (50) feet. Sec. 21-254 Building height. The maximum height of buildings in the Recreation and Open Space District shall be thirty (30) feet, except for accessory farm and agricultural buildings which may not exceed forty-five (45) feet in height.

Subject: Parking Requirements

This worksession is to address the current town code parking requirements. The Planning

Commission has had a couple of worksessions prior to try and upgrade the code because the

current parking requirements may be inadequate.

The consensus at the last worksession was to include lock-offs for the Lodge at

Mountaineer Square calculations and address additional CRFA parking spaces for West Wall

Lodge and Grand Lodge. Dusty’s proposed formula for HDMF is 1 space per unit of 1-2

bedrooms, and an additional space for 3-4 bedrooms, or a lock off.

This has been added to the packet. Also included are the tables showing the current code

requirement, the 2 proposed code requirements, and the actual number of parking spaces for

Lodge at Mountaineer Square, West Wall Lodge, Grand Lodge, Eagles Nest, Homestead,

Mountain Sunrise, and Outrun Condos. Also attached is the parking design standards Table 21-

985(1) from Chapter 21 Section 21-895 of the Town Code, other jurisdictions’ parking

requirements, and a proposed table for updating the Mt. Crested Butte Code.
