2015 marks the 50th anniversary of the introduction of a comprehensive planning and building law here in Jersey. So what exactly does this entail and has it been a success?  I catch up with Michael Stein, Director at MS Planning to learn more about what he believes to be a groundbreaking improvement. 

Aside from proving an excellent tool to protect the countryside and coastline from excessive development, a new appeals system (that will make it easier for Islanders to challenge planning decisions) has been introduced in this anniversary year. This radical overhaul allows islanders to contest decisions made by the Planning Department, Planning Applications Panel or Environment Minister and which, at long last, will result in proper checks and balances being in place. ‘The most exciting new development is the introduction of a new planning appeals system, which will be a much fairer and less costly process for applicants who wish to challenge refusals and other grievances, and they will now have a much improved chance of winning appeals by using planning professionals and without having to go to the Royal Court’.

 In the past, when islanders have wanted to challenge a planning decision - either because they objected to a project’s approval

or were against its refusal – they had to go through the Royal Court, which meant embarking on a costly, complex and lengthy journey, and required the engagement of lawyers. On top of this, winning appeals was rare, especially as the fi nal decision was based on a test of reasonableness which was very di� cult to prove against. With this in mind, few people were willing to challenge refusals, meaning many questionable decisions went unchallenged. This new appeals system is the result of both hard work and a good relationship between States departments. Environment Minister Steve Luce is delighted about the introduction of this law as it now allows for a truly accessible and transparent appeals system. 

This is the fi rst of many initiatives – all of which have been designed to help Islanders become more engaged with decisions about planning and building in the community. Other proposals include o� ering islanders access to a 3D programme that will enable them to virtually ‘fl y’ around the island, viewing various building plans, allowing them an insight into how certain planning proposals will a� ect our surroundings. Other events to take place in the coming months will include free public drop-in centres for planning and building advice, improved energy performance targets, a Town and Country Planning Association climate change event and social media question sessions to name but a few. Since 1965, the planning law has allowed our island’s idyllic coastline, countryside and heritage to stay intact. Despite this, there’s always room for improvement, which is what the 50 years of planning and building anniversary is all about. The Planning Department propose to use this occasion to fi nd out more about what islanders want to see take place in the next 50 years and use this information to make this happen!

FIXED RATE OR TRACKER RATE?

Now this really is a subject for debate! Your decision, taken in conjunction with your professional mortgage adviser, will depend very much on a number of matters, such as: your appetite for risk, your career and salary position and whether you see yourselves moving home again within the short term. During the past two years we have been recommending that borrowers should consider locking in to a fi xed rate. For those borrowers on increasing incomes, and with mortgages of 60% of property value or less, then with the prospect of rates remaining low in the medium term, a tracker or a discounted rate could be a good choice for the next two or three years.

JERSEY MARKETActivity in the property market, mortgage enquiries and applications are all up substantially year on year. We anticipate transactions back to 2007 levels by the end of the fi rst quarter.

What is really positive is that prices are marginally lower than in 2007/2008, (despite some statistics suggesting price rises!) and wages have started to improve, so better value can be obtained. The gap between incomes and prices is perhaps the closest it’s been for 10 years. Of course with the continuing low mortgage rates, a� ordability is much better than it was back in 2008.

The local economy seems to be surging forward. Construction companies in particular are reporting full order books. Whilst demand for property has increased and mortgages are available at low rates, there is still a surplus stock of property in the Island, so we wouldn’t expect prices to start rising until this stock has been absorbed.

PEACEFUL PLACESPerched on a cushion like a Zen master basking in quietude, you fi nd solace in your inner sanctum. The premise is simple – no TV’s or devices, no harsh lighting and ample space to stretch out and relax.

Bed down the fl oors with bamboo mats and buy in small tabletop water fountains for background ambience.   

Think big - you could bring in a padded massage table along with scented lights and dimmer lights in the ceiling to create the right mood.  You will want a professional to wire in the electrics, as a stray elbow in the dark could cause hours of needless physiotherapy. 

If you plan to use your meditation room for yoga you will need wall-to-wall mats and good ventilation for workouts, so you might want to install an air conditioning unit or simply circulate fresh air. If you really want to unwind you could install an indoor hot tub complete with in-built speakers and up-lighters for atmosphere. 

Working with an interior designer you can bring in Japanese elements to help with symmetry and give the room ‘omoshiroi’.  They will help with colour scheme, layout and inspiration to create an oriental style tea-room.

CASH BUYER – YES OR NO?

One of the most contentious issues when selling a property is whether the purchaser is a cash buyer or not.  If this issue is not picked up at an early stage, a sale can take longer than expected or even be lost!

This is generally due to miscommunication or a misunderstanding and can be easily resolved by gaining the correct information from the outset. 

A buyer is only a cash buyer if he / she has real cash assets (funds) available at the time of completion. This would include a buyer who has secured an “in principal” notifi cation from a mortgage lender.

Other types of buyer might include:

A buyer re-mortgaging a property to purchase another property – who would only become a cash buyer once the transaction had been completed and equity released;

A buyer awaiting a divorce settlement – who would only become a cash buyer once the divorce had been completed and funds released;

A buyer with a property to sell and a potential purchaser in place – who would only become a cash buyer once the property had been sold and funds released. Sadly it can be the case that a purchaser pulls out at the last minute.

It is therefore vital that all parties concerned are fully aware of all the facts from the outset, such as what the fi nancial position of the potential purchaser is and the subsequent timescale for achieving cash buyer status.

Armed with all this information the property transaction can proceed through the necessary channels and result in success for all concerned.
