Buying or selling a property can be a stressful process, with many issues having the potential to delay completion and, in some cases, to threaten the transaction itself. Valuations can come in below expectations; survey reports can reveal defects requiring costly remedial works; a transaction further down the chain can collapse. Not until the Friday afternoon Royal Court session, when the contract is passed, can a transacting party know that the deal is definitively done.

NOT ALL IS DOOM AND GLOOM

The conveyancing process itself can reveal issues which can threaten or delay a transaction. 

Boundary irregularities are a commonly occurring issue. Sometimes it may be that part of a building or enclosure has been built on the wrong side of, or too close to, the boundary with the neighbour’s property. Or a window or other opening has been established less than the required 2 feet 9 inches from the boundary. Or a boundary wall has been built along the wrong alignment. 

Another common issue is the lack of properly established contractual rights, whether in relation to required rights of way over third party property or in relation to the right to run mains services across third party property. Such rights can only be created by way of contract passed before the Royal Court. So, for example, the fact that the owners of a property have been accessing that property by means of a neighbour’s roadway for many years will not have created any legal right for such access, and the owner of the roadway could choose to withdraw permission at any time. 

Planning and building control non-compliance is also a frequently encountered

problem. It may be that works have been carried out at a property without the necessary permission or that there has been an unauthorised change of use. A relatively common occurrence is the situation where works have been carried out with the necessary permissions in place but without the works having had a final inspection by a building control inspector for the purpose of issuing a certificate of completion.

Inheritance anomalies can also come to light, casting doubt on the vendor’s ownership of the property. Or there may have been a failure to comply with the necessary formalities when the property was conveyed at an earlier stage. 

Not all is doom and gloom Indeed, rare is the property that does not have some title irregularity, however minor. But what is absolutely necessary, when acting in a property purchase, is to be able to spot any such issues, examine them on a prudent and yet commercially sensible basis (not making mountains out of molehills), and advise on appropriate remedial measures.

This can in some cases involve insisting on the vendor’s lawyers approaching neighbours to request their participation in the contract to ratify the encroachment or other breach or to grant missing rights. In some cases it may be appropriate to approach the authorities,

for example to arrange for a building control inspector to inspect works which have not previously been ‘signed off’. In some cases, the best approach will be to obtain defective title insurance.

Experience and sound judgement is crucial in ensuring that title issues do not scupper transactions and that if any delay is caused while they are addressed, that delay is kept to a minimum. The road to completion can at times be a rocky one but a good property lawyer should be adept in spotting and circumventing obstacles.

The 2015 Jersey Architecture Biennale commenced on Monday 14 September and runs until Friday 18 September.

The architects Presentations happen on evening of Thursday 17 September, when Principals of local Jersey Architects practices will present their “Practices Choice Projects”, each Principal talking for maximum 10 minutes about their favourite topic and giving a flavour of projects they have undertaken. These short quick-fire presentations will be wide ranging and the free evening promises to be a fascinating evening revealing what interest and excites Jersey Architects.

On Friday 18 September Jersey will be hosting a world-first event, with six internationally acclaimed architects shortlisted to win the biggest UK Award in the profession, the 2015 RIBA Stirling Award, presenting their designs at a free event in Jersey. This day-long event curated

by Stephen Hodder MBE, recent President of the Royal Institute of British Architects, is a real coup for Jersey happening before a similar evening London event some 10 days later. The “RIBA Stirling Award Day” is completely free to attend including complimentary buffet lunch and

refreshments by prior booking. This is followed that evening with a Gala Dinner celebrating local Jersey Architects who

have won a 2015 Jersey Design Award or Commendation, when the independent judging panel citations will be announced and their awards presented. 

Derek Mason, President of the Association of Jersey Architects, said: “This really is a big deal for Jersey and puts the Island, not only on the national map, but very much in the international spotlight. There has been even more interest since it was confirmed that RIBA President Stephen Hodder would be curator for the day.”

The full programme includes guided walks, building tours, presentations, a Vin d’Honneur at the Town Hall and the 2015 Jersey Architecture Design Awards exhibition at CCA Galleries International in Hill Street. This exhibition showcases the record 79 entries received for a 2015 Jersey Design Award and is open for everyone to visit between 10.00am and 5.00pm until Friday 18 September. The general public can also cast their votes for their favourite project, which will receive the 2015 People’s Choice Award at the Gala Dinner.

IntroductionA seller’s agent is instructed by a seller to market and sell a property.

A buyer’s agent is retained by a buyer to find a property and to negotiate its price.

An “estate agent” can serve in either role depending on the client’s needs, but they tend to specialise in working either with sellers or with buyers.

So, what role does each have and how do they differ?

Seller’s AgentWhen an agent acts as seller’s agent, he or she generally undertakes the following tasks:

• Valuing the property for sale. To sell your property for the best price in the shortest time with the least inconvenience, you must accurately and competitively price your home. It is important therefore to have an agent who understands how to strike the proper balance and sell your home for a price you want.

• Recommending any necessary repairs and improvements. A seller’s agent will give a seller advice on how best to present their property to the market so it is seen in the best possible light by potential buyers.

• Marketing a seller’s property. A seller’s agent will do things like put up a “for sale” sign, host open house viewings, and advertise in local magazines, newspapers and websites.

• Presenting a seller with offers made by a buyer and negotiate a deal with the buyer or the buyer’s agent (if any). A seller’s agent sorts

out the difference between low-ball offers and genuine compromise offers, and he or she will advise the seller whether the offer is a good one in the current market or not.

• Supporting the seller and the agreed deal through to completion.

The seller’s agent is retained by the seller but this can be on a variety of basis:1. sole agency - this is where a single firm of estate agents only is instructed to act for the seller and is paid an agreed remuneration (invariably based on a percentage of the sales price) by the seller when the sale completes.

2. joint agency - a seller may choose to instruct two or more firms of estate agents on a joint agency basis. All the firms instructed will seek to market the property and find a buyer and will share the commission (on an agreed split) by the seller from the sale proceeds on completion

3. multi agency - here a seller instructs multiple estate agency firms but only the firm which finds the buyer who proceeds to completion is paid a commission from the proceeds by the seller.

Buyer’s agentA buyers' agent is retained by a buyer not the seller. In contrast to the seller’s agent, the buyer’s agent is ordinarily paid by the buyer when the property transaction completes. That remuneration is usually on a fixed fee basis or calculated as a percentage of the saving made on the actual agreed purchase price as compared to the asking price, or a combination of the two.

During a transaction a buyer’s agent generally undertakes the following tasks:• Assisting a buyer to find a suitable property. A buyers' agent searches for homes that meet a buyer’s criteria.Advising and assisting a buyer to determine which property best meets the buyer’s needs. The buyer’s agent will often compile a shortlist of appropriate properties before arranging for viewings of those felt best suited to the buyer’s requirements.

• Making and negotiating offers on a buyer’s behalf with the seller’s agent. A buyer’s agent will help a buyer to make an offer that is fair, not too generous or insulting.

• Supporting the buyer and the agreed deal through to completion.

Impact on the Jersey Property MarketThe role of a buyer’s agent is an emerging proposition for Jersey although it has been commonplace in other larger jurisdictions for many years. It is perhaps a reflection of the increasing interest in Jersey from those relocating from further afield, whose busy lifestyles necessitate professional assistance to minimise the time investment needed to identify a home to buy, and to see that purchase through to completion.

As can be seen from the above, the roles of the two types of agents differ, reflecting the essentially different stances of their respective clients. Sellers, in particular, should pay attention to the content of their seller’s agency agreements to ensure they understand how and when fees are payable and to whom, especially where a buyer’s agent is also involved.

JERSEY LENDING MARKET

Interest rates on some products keep on falling! This situation can’t go on forever, although it does cause a bit of extra excitement for applicants finding that they can in fact access an even lower rate of interest than we had previously told them!

The best rates are where a deposit of up to 40% can be put down, although even 90% mortgages can still access rates as low as 2.48%. Catch these while you can and remember that these exceptionally low cost mortgages are also available for anybody wishing to remortgage from one lender to another.

JERSEY PROPERTY MARKET

The Mortgage Shop last saw this amount of footfall coming through our doors in Broad Street in the first half of 2008, at a time when property prices peaked. This is quite unusual for this time of the year, with estate agents, lawyers, surveyors and lenders all telling us just how busy they are. Don’t expect property prices to start going up just yet – there is a lot of stock available from all agents and it may still be possible to negotiate a modest reduction on many purchase prices. Do remember to find out how much you can borrow before you start looking at property too closely – there is nothing more disappointing than finding that the property you have mentally moved in to is beyond your means!

Because of the low interest rates available currently, it is indeed a great time for people to be securing loans and mortgages. The same cannot be said for those who hold large amounts of money in cash deposits. With interest rates so low, inflation is eroding the real value of their money over time.

Savers are always keen to try and get their money to work harder for them and most want to try and keep pace, if not beat inflation. A really important part of choosing a suitable investment is obtaining and understanding your choices.

Deciding to invest some of your money is a big decision and it is important to do so with an adviser and a plan that you trust. Have you ever admired the effortless chic in vintage films with dapper gents decanting Canadian Club out of their liquor cabinet? Or perhaps you’ve dreamt of having a sparkling home bar to win friends and influence people? 

With a few practical tips and some sober guidance from the experts we can help you create a home bar to be the ultimate feature for your designer home. 

Let’s get the first round in. You’re going to need to install a work surface for your mixing. You can opt for a wooden bar or a stone-worked one. The standard bar height is roughly one metre in height, with a 20 cm overhang for knee room. You should consult the professionals who will fit your dream bar top with a drip-lip to stop drinks from spilling over. Bar molds on the rim will provide a comfy armrest while adding barstools will create a social atmosphere.

No half measures, you can install a draught system with bar-taps so that beer flows from kegs kept chilled in your fridge with pressure from CO2. You’ll need to have the lines and pipes insulated so speak to a contractor for advice on how this is best done. 

Is it going to be a dry or wet bar with a sink? If you go for the latter you’ll need a drainage system and water lines to the mains so some plumbing advice would be wise in advance of a trip to showrooms. You’ll also need separate refrigeration units to store bottled wine and canned beer. 

No doubt you will want to showcase the best of your collection which probably needs a drinks rail overhead for the jewels of your stock. PROBLEMS WITH CONDENSATION, DAMP AND MOULD?

One of the realities of living on a beautiful island is dealing with dampness in the air. However we can greatly reduce the effects of dampness with a basic knowledge of ensuring good ventilation throughout our home.

What is condensation? Condensation occurs when moist air hits a cold surface. This moist air condenses on cool surfaces such as walls, mirrors, tiles, windows and clothes. It can often be found behind wardrobes, inside cupboards, around windows and on the ceiling or places where there is a poor circulation of air. 

What causes condensation?Bathing without ventilation – bathrooms should have a working extractor fan or even better, a  window for ventilation.

Even people breathing causes condensation 

Condensation usually occurs at night when the temperature falls.

What does condensation and mould look like?  A build up of condensation can lead to damp which then turns into mould growth on walls and ceilings and can also lead to damp patches around the home. Condensation manifests itself as water droplets which can be found on walls, glass windows, window frames and in the corners of rooms and cupboards.

How to prevent condensation

Do…Dry washing outdoors whenever possible 

If drying clothes indoors, dry them in a bathroom with the door closed and window open

Ventilate your kitchen when in use by opening the window (if any) or using the extractor fan and keeping the door closed where possible

Ventilate your bathroom when in use by opening the window (if any) or using the extractor fan and keeping the door closed

Wipe down any mould immediately in order to prevent it from spreading by using diluted bleach rather than washing up liquid 

Do Not…Dry wet clothes on the radiator 

Put too many clothes in the wardrobe or cupboard as this stops the air from circulating

Use washing up liquid to wipe down mould 

Paint over mould.  It must be properly cleaned and painted over with special paint that can be purchased from a local DIY store 

With a basic knowledge of condensation, we can greatly reduce the effects of dampness. Ventilation is by far the best prevention.
