Minutes The Physical Therapy Committee of the Board of Medical Licensure and Supervision met on December 7, 2018 in accordance with the Open Meeting Act. Having noted a quorum, Ms. Ball called the meeting to order at 9:03 a.m.

Following Committee review, Ms. Berry moved to approve the minutes of the September

28, 2018 meeting as written. Ms. Hinkle seconded the motion and the vote was unanimous in the affirmative.

MADISON SUSMILCH, applicant for Physical Therapist licensure, appeared in support of her request to sit for the Federation of State Boards of Physical Therapy ("FSBPT") licensure examination a third time. Ms. Susmilch stated she is currently participating in an online live lecture two days a week as part of her study plan, as well as also obtaining information and advice from professors and friends regarding successfully passing the examination. Ms. Susmilch also indicated she has changed her study pattern. She is currently working as a physical therapy tech with a skilled nursing facility. The Committee reminded her that in Oklahoma three is the maximum times an applicant may sit for the exam. LISA BURCH appeared in support of her application for Physical Therapist licensure. She previously appeared before the Committee in December of 2016 and was approved pending

completion of the file at that time. She is appearing today to ask the Committee to consider reducing or terminating its previously imposed requirement as it pertained to supervision. For Committee review, Ms. Burch provided passing scores in all areas on the Federation of State Boards of Physical Therapy Practice and Assessment Tool ("PEAT") and 111 continuing education hours, with the Committee having recommended that she obtain only 80 hours. Letters from her supervising physical therapists in support of terminating her supervision were reviewed by the Committee. Following review of the materials presented and discussion, Ms. Hinkle moved to recommend that the requirement of 12 months of direct onsite supervision previously recommended for LISA BURCH be terminated. Ms. Berry seconded the motion and the vote was unanimous in the affirmative.

ERICA THOMAS appeared in support of her application for re-entry of her Physical Therapist licensure. She last practiced as a physical therapist in January of 2018, and her Oklahoma license lapsed in January of 2018. Her license lapsed due to childbirth and the subsequent surgery and hospitalization of her infant. Ms. Thomas stated that she did not intend to let her license lapse and she wishes to return to the practice of Physical Therapy. Ms. Thomas further stated she believes that she is current for the 2016-2017 continuing education ("CEU") compliance period. She has completed one CEU for the 2018-2019 compliance period. Ms. Berry moved to approve the application of ERICA THOMAS for re-entry of Physical Therapist licensure pending verification of required continuing education hours for the 2016-2017 compliance period. Ms. Hinkle seconded the motion and the vote was unanimous in the affirmative.

The Committee then reviewed applications for licensure. Ms. Hinkle moved to recommend approval of the following incomplete applications for Physical Therapist licensure pending completion of the files. Mr. Ward seconded the motion and the vote was unanimous in the affirmative.

Next, the Committee considered continuing education units/courses ("CEUs"). A

discussion ensued and Rachel Herbert reported that the box of CEUs which was previously missing had been found and that box was now ready for review. Kelly Berry stated she would take that box with her after the meeting and advised that she also has another box of CEUs that is only partially reviewed. Ms. Berry and Ms. Hinkle both stated they will make completing the review of the CEUs a priority. David Haynes does not currently have a box for review.

Jennifer Ball advised Rachel Herbert that Peggy Newman has called several times asking about an ethics course she did in Tulsa a few months ago. Ms. Newman is receiving calls asking when it will be approved. Kelly Berry further advised that she and Rachel Herbert have been discussing some standardized language for the subcommittee to use on the document cover page.

Next, the Committee considered the pre-reviewed continuing education units ("CEUs").

Ms. Hinkle moved to approve the pre-reviewed continuing education units as recommended by the review subcommittee. Mr. Ward seconded the motion and the vote was unanimous in the affirmative. (See Attachment #1)

Ms. Hinkle moved to deny the pre-reviewed continuing education units as recommended by the review subcommittee. Ms. Berry seconded the motion and the vote was unanimous in the affirmative. (See Attachment #3)

Barbara Smith, Executive Secretary, asked if Committee Chair would consider reordering

the agenda to hear the report from Robert Nisbet, MD. The Committee then heard from Robert Nisbet, MD, Coordinator, Oklahoma Allied Professional Peer Assistance Program (“APPA”). Dr. Nisbet explained that APPA is a voluntary program. APPA serves allied health professionals who have had substance abuse and/or behavioral issues and seek assistance. Dr. Nisbet stated that he has received no referrals from committee members and wanted to remind the committee that the APPA program is available. Members of the Committee were each provided an APPA brochure and Dr. Nisbet’s business card. Dr. Nisbet answered questions of the Committee and the Committee expressed its appreciation for the information.

Next, Ms. Smith then provided an update regarding the proposed rule revisions to Okla. Admin. Code 435:20-9. She reported that Ms. Ball appeared at Medical Board meeting on November 8, 2018 to present the proposed rules and answer any questions the Board might have. The Board did not indicate any immediate issues with the amended language at that time. Ms. Smith thanked Ms. Ball for her very knowledgeable and professional presentation to the Board.

Regarding the amended rules, Jennifer Ball, Committee Chair, reported that at the

Federation of State Boards of Physical Therapy ("FSBPT") Annual Meeting, the Federation advised that it is considering changing the name of "Continuing Education and Competence" to "Continual Professional Development." Thomas Schneider, AAG and Committee Advisor, indicated he might have some issues with the proposed name change because "professional development" is not stated in statute, as continuing education and competence are. Mr. Schneider further advised that if "continual professional development" is to be highlighted, then it will need to be put in the rules as a definition. The Committee agreed that they would like to look into deleting "competence" and adding "professional development" in its place. Ms. Schneider requested the definition of "continual professional development" as stated by FSBPT. Ms. Ball will work on the new draft of the proposed rules with this change and get the language to Barbara Smith no later than January 10th.

Ms. Ball then reported that she attended the FSBPT Annual Meeting in October of 2018

where strategic planning was discussed. Some of the topics covered were testing accommodations for breast feeding mothers, a six-time lifetime limit of attempts at successfully passing the exam, no additional attempts allowed after receiving two very low scores (400s), developing a workforce data set and encouraging all states to collect that data upon licensure renewal. Reji Varghese, Deputy Director, indicated he could make a workforce data survey part of the renewal process. If FSBPTT will provide Ms. Ball with the elements to incorporate into the survey, he will incorporate that into the renewal process and that information will be made available to anyone upon request. The Committee thought the workplace data would be very helpful to Oklahoma employers as well as licensees.

Ms. Ball then advised that Oklahoma will host the FSBPT Annual Meeting next year. This is a great opportunity to showcase our state. Additionally, Oklahoma earned four stars indicating that our exam and licensure statistics are reported timely.

She also reported that the American Physical Therapy Association is looking at the PT and PTA exams to identify emerging and obsolete areas of practice. The subjects of paraffin, thermotherapy and hydrotherapy contact baths have been removed from the PT exam. Omitted subjects for the PTA exam include ultraviolet intermittent pneumatic compression and selective debridement. Dry needling and diathermia are on the watch list.

Next, Kelly Berry reported on the Physical Therapy Licensure Compact. Oregon, North

Dakota, Missouri, Mississippi, Tennessee and Utah are actively issuing compact licenses (a/k/a privileges). To date, 39 privileges (licenses) have been issued. There are 15 states that have enacted legislation for compact licensure but not issued privileges, and one state has legislation pending. There are additional states predicted to launch compact licensure in January and March of 2019. The strategy is to begin to educate states earlier regarding compact licensure and to also market the compact directly to PTs and PTAs.

The compact agency is funded by an $800,000 loan from the FSBPT and they are also sharing some of their administrative fees with the FSBPT. At the current rate, the agency is being loaned about $200,000 per year. At this point in time, the compact agency is not currently planning on charging a member fee to the states.

Reji Varghese, Deputy Director, reported that what is preventing Oklahoma from launching is the background check through the FBI. There have been several holdups due to staffing, etc., to get that piece of the process up and running. Further, it is not required that the Medical Board charge a fee, but if the Board chooses to do so, it will need legislative approval to do so, and he and Mr. Kelsey are looking into that.

Also, Mr. Varghese stated he has been trying to get a meeting set up with the Oklahoma State Bureau of Investigation. Once the Medical Board is issued an ORI number, it can then request background checks from the FBI and can begin fingerprinting new applicants. There was much discussion regarding fingerprinting and background checks being required to obtain a compact license in every state. Mr. Varghese stated that it appears each state will require applicants to have multiple fingerprints, but if the compact has your fingerprint on file, then each state should not have to go through that process.

A licensee's host or home state is where the licensee's mailing address is. Ms. Berry stated she has issues with the proposed fees. She would prefer to pay one fee

that covers all costs rather than being "nickled and dimed." Ms. Berry requested that "Committee Newsletter" be added as an item to the January

2019 agenda. There being no further business, Mr. Ward moved to adjourn the meeting. Ms. Hinkle

seconded the motion and the vote was unanimous in the affirmative. The time was 10:52 a.m.
