This booklet has been designed with you in mind. We hopeyou enjoy your driving experience with us. If you have anyquestions or concerns that you cannot discuss with yourinstructor then feel free to call us. Our team is here to supportyou from start to finish, between 8am-10pm, 7 days a week.

At we want you to pass your tests as quicklyas possible and we will do everything we can to help you achievethis. However, we also want to make sure that once you passyour test, you are confident to drive whenever and whereveryou want. So we’ll teach you how to drive, notjust how to pass your tests.

Your Track Record will guide you through the learningprocess. With helping you to understand exactlyhow you are progressing and identify when youhave acquired the skills you need to pass your driving test.You should take this booklet to all of your lessons.

Learner Driver Terms & ConditionsInterpretationIn these conditions (“Conditions”) “We”, “Us” or “Our” means PASS N GO UKLIMITED (The) (company registration number: 7522816---) and “You” or “Your”means the customer. You must read these Conditions in full as they set out tocomplete Terms upon which We have agreed to provide, and You have agreed toObtain, driving tuition from Us. We and Your Instructor reserve the right tocharge for any lessons Affected by Your failure to comply with any of theseConditions.

About Your InstructorYour Instructor is one of Our self-employed franchisees whose relationship withUs is governed by a franchise agreement, No contractual liability shall arise orsubsist between You and Us, However We will endeavour to assist You with Yourrequirements.Our instructors are licensed to carry on business as driving Instructors and haveobtained such licenses from the Department of Transport.

Driving TuitionDriving tuition is only available to persons:1. Aged 17 and over (16 and over if disabled);2. Who hold valid UK provisional driving licence (“licence”); and3. Who are legally entitled to drive in the UK.If You take driving lessons, it is Your responsibility to ensure that You have theappropriate licence and the licence must be presented to Your driving instructorprior to the commencement of Your tuition. Your Instructor reserves the right torefuse to provide You with tuition or to cancel any lessons You have agreed to orbooked, If You fail to provide him/her with the licence prior to Your first lesson.

Your tuition is governed by a contract between You and Your Instructor.Accordingly, You and Your Instructor are responsible for arranging the date, andtime, pick up location and duration of Your lesson.

Your Instructor will:1. Provide You with driving/theory tuition at the hourly rate communicated to

You from time to time;2. Recommend what are, in their opinion, the most appropriate training

methods and aids to help You study for Your theory and hazard perception test;

3. Design a course of lessons to match Your specific driving and learning needs from Your first lesson right through to Your practical test;

4. Provide You with driving/theory lessons which will last two hours or such other duration as You and Your Instructor will agree in advance;

5. Provide a presentable, modern, properly maintained and dual controlledPASS N GO branded car for each lesson;

6. Also recommend where appropriate, advanced courses to help You develop Your skills for: motorway driving, driving in extreme weather conditions and the Pass Plus:

7. Give You relevant feedback during Your lessons and record Your development in Your PASS N GO track record at the end of each lesson;

8. Monitor Your progress, advise and recommend what is, in their opinion, the appropriate time to book Your mock practical test and once it has been agreed between you both, Your instructor will apply for Your practical driving test and where required, they will advise whether it should be subsequently rescheduled;

9. Provide training on a one-to-one basis with no other learner in the car.10. Honour the full time booked for each lesson, which should include an

introduction, practical training and a debrief at the end of Your lesson;11. at all times conduct themselves in a professional manner including:

• being courteous and considerate to You• avoiding physical contact except in an emergency

• not smoking during Your lessons• restricting mobile phone use to emergencies or directly for Your benefit;

12. Reserve the right to cancel a lesson or finish a lesson early on the grounds of road safety;

13. Not discriminate against You and will always abide by the law;14. Endeavour to be on time at the agreed pick-up point and be available for the

full duration of the lesson booking, subject to any unforeseen circumstances beyond their control;

15. Endeavour to give You 48 hours notice should a lesson need to be rescheduled.

16. Respond professionally to any worries or issues that You may have and try to resolve them to Your satisfaction. If appropriate, they will give You the name of the PASS N GO manager to whom You can refer the matter.

If Your Instructor is for whatever reason unable to comply with their obligations toYou, both We and Your Instructor reserve the right to arrange for an alternativePASS N GO Instructor to provide You with some or all of Your driving/theorytuition.If We or Your Instructor are unable to arrange for an alternative Instructor toprovide Your driving tuition, or in the event of a mechanical breakdown of thevehicle in which You have been learning to drive, or for any other reason, theInstructor reserves the right to rearrange Your lessons for a time convenient toboth You and the Instructor.

Intensive Driving CoursesYou must give Us a deposit when making a (Booking Date) for an intensive drivingcourse Your deposit is non refundable. You must pay the remaining balance to YourInstructor on the first lesson of Your driving course. You will then be fullycommitted to completing the course and You will not be able to receive a refund.Your Intensive driving course must be completed within four weeks from the dateof Your first lesson, the 48 Hour cancellation notice does not apply to any of OurIntensive driving courses, if You cancel any of Your lessons then these lessons willbe deducted from the lessons remaining. Intensive Driving Courses continued...under the influence of drink or drugs then Your Instructor reserves the right toterminate Your Intensive Driving Course with immediate effect and You will not beentitled to a refund. Any abusive, offensive or other such conduct will not betolerated and the course may be terminated. If You don’t make progress asexpected Your Instructor will advise You whether Your test should be rescheduled.If You are not test ready then Your Instructor holds the right to refuse the use ofthe vehicle in attempting the practical test and will instead recommend a morepractical length of course best suited for You. Due to driving test availability andany circumstances beyond Our control it may be necessary for Us to rescheduleYour test in order to fit in with other arrangements and Our booking process.Your test will be arranged for the end of Your course. Your test will be booked atour nominated test centre. You must not change or cancel the test withoutnotifying Us first.

Lesson Cancellation PolicyYou must give Your Instructor 48 hours notice if You wish to cancel or rearrangeYour lesson, other wise You will be liable for 100% of the lesson fee.Where You have pre-paid for any lesson but fail to attend or provide the MinimumNotice, You will still be liable for the Lesson fee.

InsuranceYour Instructor will carry the appropriate motor insurance should You be involvedin a collision as a learner driver whilst in control of driving the Instructor’s tuitionvehicle.

Price ChangesWe reserve the right to change the price of all Our learner driver productsincluding all tuition, at any time.

Non-Block Booked TuitionThe price of lessons that have not been pre-paid (as part of a block bookingconsisting of a minimum 10 hours worth of tuition time (“Block Booking”) may bechanged at any time. You will receive prior notice of any price increases.

Block Booked TuitionThe cost of Block Booked tuition is based on the lesson price in force at the timethat the booking is made and will be honoured for a period of 6 months from thedate of the booking. If You fail to use a minimum of 50% of Your Block Bookedtuition within the first 6 months of the booking date, We reserve the right toincrease the price of any unused tuition time.

Special OffersWe also reserve the right to introduce special offers from time to time in respectof both Our On the Road and Off the Road products together with any otherproducts that we may decide. Such offers will not affect the price of BlockBookings unless it is expressly stated within the offer.

PaymentYou must pay for Your good(s) and/or lesson(s) in advance using one of thefollowing methods:• payment via credit or debit card by telephoning Our Customer Service

Where You make any payments directly to Your Instructor or any of OurInstructors it is Your responsibility to ask for and obtain appropriate receipts orother proofs, in relation to all payments You make to Your Instructor or any of OurInstructors. Where We are able to, We will endeavour to assist with anydiscrepancies in payments You have made without ever accepting liability for thesame.

Learner Driver Tuition - Refund PolicyPLEASE NOTE: Due to the nature of Our Intensive DrivingCourses Your deposit will be non refundable When You have paidthe remaining balance for Your course You will Not be able toreceive a refund.No refund is payable where a period 12 months has elapsed since Your last lesson.Where it is possible to do so, where We agree to refund You any amounts, We willdo so using the same method You used when You made the payment. If for anyreason We are unable to refund You using the same method with which You paid,We reserve the right to refund You by any other method We deem appropriate.We may request additional information from You to confirm Your identity in orderto comply with the Money Laundering Regulations 2007; We will also use thisinformation to ensure adherence to Our Merchant Operating Instructions for cardcollection facilities.Please note: refunds may take up to 28 working days to reach You or Youraccount.

Learner Driver Products - Returns/Refund PolicyYou may cancel Your order for any goods that You purchase from Us withoutpenalty by returning the unused and undamaged goods within 10 days of yourpurchase. All goods that You wish to return must be in the same condition inwhich they were supplied to You and in their original packaging.If any of the goods You receive are damaged or faulty on receipt, You must informUs within 48 hours of receipt and where it is possible, We will provide You withreplacements of any goods which are faulty or damaged. If We are unable toreplace such goods, We will notify You and You will be entitled to a refund.

You will not be entitled to a refund or replacement of the goods if:1. any goods that You return to Us are in Our opinion used, damaged or not

within their original packaging; or2. You decide You no longer want the goods and do not return them within 10

days of Your purchase; or3. You fail to inform Us of any faulty or damaged goods within 48 hours of

receiving them.Postage and Packaging (P&P) is non-refundable.

Test FeesThe Driving Standards Agency (DSA) determines the Theory and Practical testfees.If You would like Us to book Your test on Your behalf, We will be happy to do soand will charge a non-refundable booking fee for doing so. The booking fee willcover any administrative costs that We may incur.If You wish to cancel or rearrange a test that We have booked with the DSA onYour behalf, We will follow the DSA cancellation procedure as set out on the DSAwebsite at http://www.dsa.gov.uk.Currently the DSA cancellation procedure states that You can cancel or rearrangeYour test providing You give at least three clear working days’ notice. If Yourequire Us to arrange a cancellation or rearrange any driving or theory test onYour behalf, We will require a minimum of 5 working days’ notice in order to doso. If You fail to provide Us with a minimum of 5 days notice You may remain liablefor all or some of the test fee and any late cancellation fees. In any event Weaccept no liability to You for any payments or expenses that You may incur inrelation to Your driving and/or theory tests.

Other ProvisionsBy taking bookings, providing certain information and documentation, and inprocessing payments, We and the Agent act on behalf of Your Instructor. Nocontractual liability arises between You and Us or the Agent under the agreementbetween You and Your Instructor.Neither the Agent nor We have and shall have any liability to You in relation to anyinjury, loss or damage arising from the use of the tuition vehicle or from the factsor omissions of Your Instructor or any other one of Our Instructors. Further, Wewill not in any event be liable for any losses relating to any business interests thatYou may have including but not limited to loss of profits, business, loss ofopportunity or any business interruptions or delays that You may incur. This doesnot apply to any claim You may have for personal injury or death and nothing inthese Conditions will affect Your statutory rights.We do not guarantee to provide or procure the provision of any of the servicesreferred to in these Conditions if We are prevented from doing so incircumstances beyond Our reasonable control, including without limitations, theactivities of civil government authorities, third party industrial disputes, internalindustrial disputes where We have taken the reasonable steps to prevent theeffects of such action on any of the services set out in these Conditions but havebeen unable to do so; acts of God, or severe weather conditions.We reserve the right to make reasonable changes to the services referred to inthese Conditions and to these Conditions for any reason We deem necessary.Where We do make any such changes, We will give You reasonable notice of thechanges. If as a direct result of such changes the services We provide to You aresubstantially varied to Your detriment, and where We are satisfied of the same, Youmay cancel Your agreement with Us by giving not less than 30 days’ notice inwriting to Our address below. Any refunds that You may be entitled to will bedealt with in accordance with Our Refund Policy set out above.If any provision of these Conditions is found by any court, tribunal oradministrative body of competent jurisdiction to be wholly or partly illegal invalid,void, voidable, unenforcable or unreasonable it shall to the extent of such illegality,invalidity, voidness, voidability, unenforceability or unreasonableness, be deemedseverable and the remaining provisions of these Conditions shall continue in fullforce and effect.

Informing You about Products and ServicesIf You have indicated Your agreement We may contact You by mail, telephone, fax, e-mail or SMS/MMS to inform You of any goods, services or promotions that You mayof interest to You. If You decide You do not wish to receive such information,please inform Us, but be aware that this will prevent You from receiving Ourspecial offers and/or promotions.

How to use Your Track Record

Your Track Record is a tool for you and your Instructor tokeep a record of your theory and driving progress. It will helpyour Instructor to individually tailor your programme of lessonsto suit you. So please make sure you bring it to every lesson.

You can also use it as your driving lesson planner (see yourAppointment Card on page 32) to make sure you never miss alesson. But first of all, please make sure you complete your own andyour Instructor’s details on page 2 & 3.

The most important part of Your Track Record is theInstructor Assessment section. There are 50 driving skills you willneed to master, each with five assessment levels. As you progressyour Instructor will fill in the date and level reached for eachindividual skill. But remember levels can go down as well as up!When you’re both confident that you’ve mastered all of therequired skills, your Instructor will arrange your Mock Test.

So just who is that person sitting next to you?Over the course of your lessons you’ll find out quitea lot about them, and it’s their job to find out aboutyou and what helps you learn.

Our Instructors come from all walks of life, but whatever theirbackground they’ve all got one thing in common - a passion forhelping people pass their test.

Instructors have a friendly, patient approach toteaching. They believe the more you relax, the more you can learn.And if you enjoy your lessons, the chances are you’ll build up yourconfidence and your driving skills more quickly.

To make sure your road to becoming a driver is as smoothas possible, we try to match you up with someone you’rereally going to click with.

It’s your callWe can’t make any promises, but we’ll do our best to meet yourneeds. Here are some of the things we can take into account whenselecting your Instructor:

• A different Instructor - if you’d like to try someone else,no problem. And no questions asked either.

• Language - you might prefer to be taught in a languageother than English.

• Female Instructor - shouldn’t be a problem, we havefemale Instructors available.

• Automatics - Instructors with automatic vehicles are available.

Learner Charter

At our goal is to provide you with the higheststandard of training, so you start your motoring independenceas a competent and confident driver. You’re gaining a skill for life, notjust being trained to pass.

Your Instructor will:

1. Recommend the very latest training methods and aids tohelp you study for your Theory and Hazard Perception Test.

2. Design a course of practical training to match your specificneeds from your first lesson through to your Practical Test,moving on to motorway training, Pass Plus and advancedcourses.

3. Provide relevant feedback during your lesson and, at theconclusion of each, record your development in YourTrack Record.

4. Monitor your progress, advise and recommend the appropriatetime to apply for your Practical Driving Test or, if necessary,reschedule a Practical Driving Test appointment.

The main cause of global warming is the greenhouse gases,particularly carbon dioxide (CO2) which we produce by burningfossil fuels - by driving cars. We at DrivingSchool can do our bit to protect the environment, and help youdo yours, by promoting eco-safe driving.

Shrinking your carbon footprint- and passing your test

The amount of carbon you produce in your car is mainly downto two factors: what you drive and the way you drive it.

We can’t tell you which car to drive but one way we can helpyou to reduce your ‘carbon footprint’ when you’re driving isby developing your hazard perception skills.

These skills, and the principles behind them, are now alsoan important part of your Driving Test. The Theory Test will oftencontain questions to check your knowledge. And the PracticalTest now includes assessment of your ability to usethe controls in a way that reduces your impact on theenvironment in your car.

Behind the wheel

• Always look out for potential hazards well beforehand,so that you avoid harsh braking, or acceleration andunnecessary stopping.

• Use the accelerator smoothly and, when appropriate, takeyour foot off the accelerator altogether to allow the momentumof the car to take you forward.

• Stay within the speed limit. Driving at 70mph uses about15% more fuel than at 50mph.

• Use your gears selectively - you can sometimes even block change- and use the highest possible gear without making theengine struggle.

• Use engine braking - with your foot fully off the accelerator theengine needs very little fuel, and will help slow the car down.

• Use cruise control (if you have it) - keeping a steady speedconsumes less fuel.

• Avoid revving the engine when starting and if you’re stationaryfor more than a couple of minutes, like when stuck in traffic,switch it off. Five minutes of engine idling can use as much fuelas driving half a mile.

• In hot weather try to use your air vents and windows ratherthan air conditioning, and park in the shade.

• Always try to reverse into a parking space so that you candrive out of it easily. Lots of manoeuvring with a cold enginereally guzzles fuel.

Before you head off

• Try to avoid journeys by car, walk, cycle or use publictransport instead.

• Try car sharing, avoid rush hours and use park and ride schemes.

• Plan your routes to avoid notorious hold-ups and roadworks. Sat Nav can stop you getting lost and driving furtherthan you need.

• Don’t carry any unnecessary weight - only travel with thethings you need for your journey, not with a boot full of stuffyou don’t.

• Avoid heavy accessories and wide tyres that increase rollingresistance and use more fuel.

• Remove roof racks and boxes if they’re not being used- they create more drag.

• Have your car serviced regularly - so that it’s running atmaximum efficiency.

• Keep your tyres pumped up, as under-inflated tyres increasefuel consumption. Check them frequently and always before along journey, and do it when they’re cold.

You’ll learn more about the principles of eco-safedriving through the course of your lessons. And theywon’t just help you to protect the environment,they’ll also help you to be a better, safer driver.

Your examiner will ask you two questions regarding vehicle safety. There will be one ‘show me’ question and one ‘tell me’ question.For health and safety reasons, you won’t be required to demonstrate any of the under-the-bonnet checks in the test, just tell the examinerwhat needs to be done. These are the questions, along with our answers.

There are two easy ways to test the power steering isworking. Firstly, start the engine and turn the steering wheelvery slightly; if the power steering is working correctly, a smallbut noticeable movement will be felt. The second way is toturn the steering wheel just after moving off; the wheelsshould move with ease. If the steering feels heavy, then it’s not working properly.

Show me how you would check that the power-assistedsteering is working before starting a journey.1

Press the footbrake pedal, make use of reflections inwindows, garage doors or elsewhere, asking someone tohelp if necessary. As this is a ‘show me’ question, the examinermay check the brake lights for you. You may need to switchthe ignition on; however, you should not start the engine.

Show me how you would check that the brake lights areworking on this car. (I can assist you.) If you need to switchthe ignition on, please don’t start the engine.

Turn on the ignition. Switch on the left, then right indicators.A warning light on the instrument panel will flash, and thereshould be a ticking sound. Switch them off after the check.

Checking to see if the horn works is simple. You willbe able to hear it when you press down on the control.You may need to switch the ignition on; however, youshould not start the engine.

Show me how you would check that the horn is working(off road only).4

Press the footbrake pedal firmly. Demonstrate by applying theparking brake (handbrake) so that when it is fully applied itsecures itself, and is not at the end of the working travel. Youcan tell it’s working correctly as it should hold the car securely.

Show me how you would check the parking brake(handbrake) for excessive wear; make sure you keep safecontrol of the vehicle.

Operate the control to wash and wipe the windscreen.You may need to switch the ignition on; however, youshould not start the engine.

Show me how you would clean the windscreen using thewindscreen washer and wipers.6

Check all the relevant dashboard controls, including fan,temperature, air direction/source and heated screen to clearwindscreen and windows. The engine does not have to bestarted for this demonstration.

Identify the oil dipstick. To check the level, the dipstick needs tobe removed and wiped clean with a dry cloth. The dipstickshould then be reinserted fully and removed again to see howmuch oil there is. It should be between the maximum andminimum marks.

Open the bonnet, identify where you would check the engineoil level and tell me how you would check that the enginehas sufficient oil.

Identify the coolant reservoir tank. It should be filledbetween the maximum and minimum markers. To addcoolant, unscrew the radiator cap and top it up. This shouldonly be done when the engine and radiator have cooled toavoid danger of scalding.

Tell me how you would check the tyres to ensure that theyhave sufficient tread depth and that their general condition issafe for use on the road.

Press your foot down on the brake pedal. The brakes shouldfeel firm and not spongy or slack. It’s a good idea to test thebrakes just after moving off. They should adequately stop thecar without pulling to one side. If they don’t feel firm, havethem checked by a qualified mechanic.

Tell me how you would check that the brakes are workingbefore starting a journey.7

Operate the headlight switch (turn on ignition if necessary),then walk round the vehicle. (Because this is a ‘tell me’ question,there is no need to physically check these lights.)

Hazard Routine – MSPSL

Mirrors: Check position/speed of following traffic. Act sensibly onwhat you see!Signal: Ask yourself “Will a signal help others?” If you need a signal,give it in good time.Position: If necessary, steer to a new road position in good time sothat others can anticipate what you intend to do.Speed: Slowing down, ease off the accelerator or brake. If you need tospeed up, accelerate smoothly. If needed, change gear for greater control.Look: Look well ahead. Assess the situation. Decide on what you needto do. Act promptly on your decision to wait or proceed.

You know this routine as Mirrors – Signal – Manoeuvre!A manoeuvre is any change in position or speed so M-S-M becomes:

Emerging at T-junctionsAs you come to the end of aroad ask yourself: Is the junctionopen or closed?Who has priority?Use MSPSL on approach. Scanleft and right as you approach thejunction to build up a picture ofthe traffic flow and other hazardsin the main road.Your zone of vision willget wider as you approachthe end of the road.The diagram on the rightshows that you will not beable to decide if it is safe toemerge until your eye line islevel with any obstructions.Where your line of sight isrestricted:Edge forwards by using clutchcontrol (peep and creep). Leanforwards in your seat so thefront of the car doesn’t need tostick out so far.Beware of emerging leftwhilst looking right!

Emergency Stop

Keep a firm grip on the steering wheel.Brake firmly and promptly. Steer if needed to avoid collision!Clutch down just before stopping.Once stopped, apply parking brake, select neutral.When clear, take a good look round before moving off again.If you cause a skid by breaking too harshly:Ease the pressure on the brake pedal.Steer to straighten the car.

Crossroads

Early identification is important, look out for signs andcrossing traffic.Use MSPSL on approach. Assess priority and approachaccordingly.Unless road layout or markings dictate otherwise, followthe normal rules for positioning.Remember that traffic approaching from your right or leftmay not realise the junction is a crossroads.

If you and an approachingdriver are turning right,turning offside to offsideis safer becauseyou have abetter view.

When conditions dictate(e.g. spac is limited) turnnearside to nearside.Take care yourview will berestricted.

Pedestrian CrossingsThese can be uncontrolled (e.g. Zebra)or controlled (e.g. Puffin).Use MSPSL on approach: Look ahead and to the sidesof the crossing and anticipate the actions of pedestrians.You must give priority to pedestrians who have steppedon to a zebra crossing. At controlled crossings, obey thetraffic lights or signals given by the traffic controller(police or school crossing warden).What precautions should you take when stoppedat a crossing?

Pelican crossings have a flashing amberphase – what does this mean?How would you recognise a Toucancrossing/an equestrian crossing?How should you deal with crossingswhich have a central island?

Meeting Traffic

When a road is narrowed by an obstruction,a chicane or parked vehicles you will need todeal with approaching traffic safely.Use MSPSL as you approach the hazard.Assess the gap and ask yourself:Who has priority?How much clearance do you need?If you need to stop how far back shouldyou be?It is important to check mirrors:Following traffic needs warningif you are slowing or stopping.It is no good stopping if following trafficwill prevent the approaching drivercoming through.Plan ahead!

OvertakingThis can be a dangerous manoeuvre.Take note of road signs and markings.Ask yourself:Is it safe and legal to proceed?You will need to use the MPSL MSM routineseveral times before and during the manoeuvre:Position far enough behind the target vehicleto be able to see clearly ahead.How can you get a reserve of power?What should you do if a following vehiclestarts to overtake before you?Give a signal to advise following traffic, approachingtraffic, and the driver of the target vehicle.Don’t cut back in too soon!If in doubt, don’t overtake!

Parallel Parking

Use MSPSL on approach tospace. Stop parallel with andslightly ahead of target vehicle.

Select reverse gear, checkmirrors and look all round.Move slowly to point of turn(when the back of your car islevel with the beginning ofthe space).

Check mirrors and look allround before steering left,aiming for the middle of thespace. When you have a goodangle, straighten the wheels.

Approaching the kerb, check thefront of your car will clear thevehicle ahead then steer brisklyright to bring the front in.

Straighten the wheels as youget parallel to the kerb.

If necessary, pull forwards topark centrally in the gap.

Bay ParkingTake car in car parks – pedestrians are about. Find a suitable bay. You can reverse ineither to the right or the left. You can position at an angle to the bay. This will makeit easier to judge position, steer in and see between vehicles either side of the bay. Use mirrors and check all round for other traffic and pedestrians.Keep tight control of the clutch.Move slowly, steer briskly. Park centrally between themarked lines.

Learner Driver Terms & ConditionsInterpretationIn these conditions (“Conditions”) “We”, “Us” or “Our” means PASS N GO UK LIMITED (The)(company registration number: 7522816) and “You” or “Your” means the customer. You must readthese Conditions in full as they set out to complete Terms upon which We have agreed to provide,and You have agreed to Obtain, driving tuition from Us. We and Your Instructor reserve the right tocharge for any lessons Affected by Your failure to comply with any of these Conditions.

About Your InstructorYour Instructor is one of Our self-employed franchisees whose relationship with Us is governed by afranchise agreement, No contractual liability shall arise or subsist between You and Us, However Wewill endeavour to assist You with Your requirements.Our instructors are licensed to carry on business as driving Instructors and have obtained such licensesfrom the Department of Transport.

Driving TuitionDriving tuition is only available to persons:1. Aged 17 and over (16 and over if disabled);2. Who hold valid UK provisional driving licence (“licence”); and3. Who are legally entitled to drive in the UK.If You take driving lessons, it is Your responsibility to ensure that You have the appropriate licence andthe licence must be presented to Your driving instructor prior to the commencement of Your tuition.Your Instructor reserves the right to refuse to provide You with tuition or to cancel any lessons Youhave agreed to or booked, If You fail to provide him/her with the licence prior to Your first lesson.

Your tuition is governed by a contract between You and Your Instructor. Accordingly, You and YourInstructor are responsible for arranging the date, and time, pick up location and duration of Yourlesson.

Your Instructor will:1. Provide You with driving/theory tuition at the hourly rate communicated to

You from time to time;2. Recommend what are, in their opinion, the most appropriate training methods and aids to help

You study for Your theory and hazard perception test;3. Design a course of lessons to match Your specific driving and learning needs

from Your first lesson right through to Your practical test;4. Provide You with driving/theory lessons which will last two hours or such

other duration as You and Your Instructor will agree in advance;5. Provide a presentable, modern, properly maintained and dual controlled

PASS N GO branded car for each lesson;6. Also recommend where appropriate, advanced courses to help You develop

Your skills for: motorway driving, driving in extreme weather conditions and the Pass Plus:7. Give You relevant feedback during Your lessons and record Your development in your PASS

N GO track record at the end of each lesson;8. Monitor Your progress, advise and recommend what is, in their opinion, the

appropriate time to book Your mock practical test and once it has been agreed between you both, Your instructor will apply for Your practical driving test and where required, they will advise whether it should be subsequently rescheduled;

9. Provide training on a one-to-one basis with no other learner in the car.10. Honour the full time booked for each lesson, which should include an

introduction, practical training and a debrief at the end of Your lesson;11. at all times conduct themselves in a professional manner including:

• being courteous and considerate to You• avoiding physical contact except in an emergency• not smoking during Your lessons• restricting mobile phone use to emergencies or directly for Your benefit;

12. Reserve the right to cancel a lesson or finish a lesson early on the grounds of road safety;

13. Not discriminate against You and will always abide by the law;14. Endeavour to be on time at the agreed pick-up point and be available for the

full duration of the lesson booking, subject to any unforeseen circumstances beyond their control;

15. Endeavour to give You 48 hours notice should a lesson need to be rescheduled;16. Respond professionally to any worries or issues that You may have and try to

resolve them to Your satisfaction. If appropriate, they will give You the name of the PASS N GO manager to whom You can refer the matter.

If Your Instructor is for whatever reason unable to comply with their obligations to You, both We andYour Instructor reserve the right to arrange for an alternative PASS N GO Instructor to provide Youwith some or all of Your driving/theory tuition.If We or Your Instructor are unable to arrange for an alternative Instructor to provide Your drivingtuition, or in the event of a mechanical breakdown of the vehicle in which You have been learning todrive, or for any other reason, the Instructor reserves the right to rearrange Your lessons for a timeconvenient to both You and the Instructor.

Intensive Driving CoursesYou must give Us a deposit when making a (Booking Date) for an intensive driving course Your depositis non refundable. You must pay the remaining balance to Your Instructor on the first lesson of Yourdriving course. You will then be fully committed to completing the course and You will not be able toreceive a refund. Your Intensive driving course must be completed within four weeks from the date of

Your first lesson, the 48 Hour cancellation notice does not apply to any of Our Intensive drivingcourses, if You cancel any of Your lessons then these lessons will be deducted from the lessonsremaining. If there is any evidence of You being under the influence of drink or drugs then YourInstructor reserves the right to terminate Your Intensive Driving Course with immediate effect andYou will not be entitled to a refund. Any abusive, offensive or other such conduct will not betolerated and the course may be terminated. If You don’t make progress as expected Your Instructorwill advise You whether Your test should be rescheduled. If You are not test ready then YourInstructor holds the right to refuse the use of the vehicle in attempting the practical test and willinstead recommend a more practical length of course best suited for You.Due to driving test availability and any circumstances beyond Our control it may be necessary for Usto reschedule Your test in order to fit in with other arrangements and Our booking process. Yourtest will be arranged for the end of Your course. Your test will be booked at our nominated testcentre. You must not change or cancel the test without notifying Us first.

Lesson Cancellation PolicyYou must give Your Instructor 48 hours notice if You wish to cancel or rearrange Your lesson, otherwise You will be liable for 100% of the lesson fee.Where You have pre-paid for any lesson but fail to attend or provide the Minimum Notice, You willstill be liable for the Lesson fee.

InsuranceYour Instructor will carry the appropriate motor insurance should You be involved in a collision as alearner driver whilst in control of driving the Instructor’s tuition vehicle.

Price ChangesWe reserve the right to change the price of all Our learner driver products including all tuition, at anytime.

Non-Block Booked TuitionThe price of lessons that have not been pre-paid (as part of a block booking consisting of a minimum10 hours worth of tuition time (“Block Booking”) may be changed at any time. You will receive priornotice of any price increases.

Block Booked TuitionThe cost of Block Booked tuition is based on the lesson price in force at the time that the booking ismade and will be honoured for a period of 6 months from the date of the booking. If You fail to use aminimum of 50% of Your Block Booked tuition within the first 6 months of the booking date, Wereserve the right to increase the price of any unused tuition time.

Special OffersWe also reserve the right to introduce special offers from time to time in respect of both Our On theRoad and Off the Road products together with any other products that we may decide. Such offerswill not affect the price of Block Bookings unless it is expressly stated within the offer.

PaymentYou must pay for Your good(s) and/or lesson(s) in advance using one of the following methods:• payment via credit or debit card by telephoning Our Customer Service

Where We are able to, We will endeavourto assist with any discrepancies in payments You have made without ever accepting liability for thesame.

Learner Driver Tuition - Refund PolicyPLEASE NOTE: Due to the nature of Our Intensive Driving Courses Your depositwill be non refundable When You have paid the remaining balance for Your courseYou will Not be able to receive a refund.No refund is payable where a period 12 months has elapsed since Your last lesson. Where it ispossible to do so, where We agree to refund You any amounts, We will do so using the same methodYou used when You made the payment. If for any reason We are unable to refund You using the samemethod with which You paid, We reserve the right to refund You by any other method We deemappropriate.We may request additional information from You to confirm Your identity in order to comply with theMoney Laundering Regulations 2007; We will also use this information to ensure adherence to OurMerchant Operating Instructions for card collection facilities.Please note: refunds may take up to 28 working days to reach You or Your account.

Learner Driver Products - Returns/Refund PolicyYou may cancel Your order for any goods that You purchase from Us without penalty by returning theunused and undamaged goods within 10 days of Your purchase. All goods that You wish to returnmust be in the same condition in which they were supplied to You and in their original packaging.If any of the goods You receive are damaged or faulty on receipt, You must inform Us within 48 hoursof receipt and where it is possible, We will provide You with replacements of any goods which arefaulty or damaged. If We are unable to replace such goods, We will notify You and You will beentitled to a refund.

You will not be entitled to a refund or replacement of the goods if:1. any goods that You return to Us are in Our opinion used, damaged or not

within their original packaging; or2. You decide You no longer want the goods and do not return them within 10

days of Your purchase; or3. You fail to inform Us of any faulty or damaged goods within 48 hours of

receiving them.Postage and Packaging (P&P) is non-refundable.

Test FeesThe Driving Standards Agency (DSA) determines the Theory and Practical test fees.If You would like Us to book Your test on Your behalf, We will be happy to do so and will charge anon-refundable booking fee for doing so. The booking fee will cover any administrative costs that Wemay incur.If You wish to cancel or rearrange a test that We have booked with the DSA on Your behalf, We willfollow the DSA cancellation procedure as set out on the DSA website at http://www.dsa.gov.uk.Currently the DSA cancellation procedure states that You can cancel or rearrange Your test providingYou give at least three clear working days’ notice. If You require Us to arrange a cancellation orrearrange any driving or theory test on Your behalf, We will require a minimum of 5 working days’notice in order to do so. If You fail to provide Us with a minimum of 5 days notice You may remainliable for all or some of the test fee and any late cancellation fees. In any event We accept no liabilityto You for any payments or expenses that You may incur in relation to Your driving and/or theorytests.

Other ProvisionsBy taking bookings, providing certain information and documentation, and in processing payments, Weand the Agent act on behalf of Your Instructor. No contractual liability arises between You and Us orthe Agent under the agreement between You and Your Instructor.Neither the Agent nor We have and shall have any liability to You in relation to any injury, loss ordamage arising from the use of the tuition vehicle or from the facts or omissions of Your Instructor orany other one of Our Instructors. Further, We will not in any event be liable for any losses relating toany business interests that You may have including but not limited to loss of profits, business, loss ofopportunity or any business interruptions or delays that You may incur. This does not apply to anyclaim You may have for personal injury or death and nothing in these Conditions will affect Yourstatutory rights.We do not guarantee to provide or procure the provision of any of the services referred to in theseConditions if We are prevented from doing so in circumstances beyond Our reasonable control,including without limitations, the activities of civil government authorities, third party industrialdisputes, internal industrial disputes where We have taken the reasonable steps to prevent the effectsof such action on any of the services set out in these Conditions but have been unable to do so; acts ofGod, or severe weather conditions.We reserve the right to make reasonable changes to the services referred to in these Conditions andto these Conditions for any reason We deem necessary. Where We do make any such changes, Wewill give You reasonable notice of the changes. If as a direct result of such changes the services Weprovide to You are substantially varied to Your detriment, and where We are satisfied of the same,You may cancel Your agreement with Us by giving not less than 30 days’ notice in writing to Ouraddress below. Any refunds that You may be entitled to will be dealt with in accordance with OurRefund Policy set out above.If any provision of these Conditions is found by any court, tribunal or administrative body of competentjurisdiction to be wholly or partly illegal invalid, void, voidable, unenforcable or unreasonable it shall tothe extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness, bedeemed severable and the remaining provisions of these Conditions shall continue in full force andeffect.

Informing You about Products and ServicesIf You have indicated Your agreement We may contact You by mail, telephone, fax, e-mail orSMS/MMS to inform You of any goods, services or promotions that You may of interest to You. If Youdecide You do not wish to receive such information, please inform Us, but be aware that this willprevent You from receiving Our special offers and/or promotions.
