DESCRIPTION French contract law has finally been re-formed by way of an ordinance published on 11 February 2016 and entering into force on 1st October 2016. The objectives of the Reform are notably the simplifica-tion, modernisation and, ultimately, attrac-tiveness of French contract law.The Reform codifies a number of principles that have emerged in case law, thus stabi-lizing these solutions and improving legal certainty and does away with certain previ-ous concepts, whilst introducing new ones that are inspired from other legal systems.All these amendments have an impact on French M&A transactions and will compel practitioners to change the way they draft certain provisions of transaction docu-ments. The presentation aims to expose the main impacts of the Reform at each step of a corporate deal i.e. negotiation, signing and closing, and enforcement of the trans-action documents.

Data Protection Commissioner (Case C-362/14) is a ground-breaking case brought by Max Schrems before the Court of Justice of the European Union (“CJEU”). In its final ruling on October 6, 2015 the CJEU invalidated the

Safe Harbor arrangement, which governed data transfers between the EU and the US. This decision has thrown the cross-border sharing of personal information into doubt and marks a major change in international law. Mr. Schrems’ campaign continues with a private action in Austria and a second CJEU referral over model terms – an unprecedented case which sees the US Government seeking to be joined into EU court proceedings. Join noted compliance and privacy specialist Jonathan Armstrong as he chats with Mr. Schrems, the lead plaintiff and noted privacy activist, in a conversation about his involvement in the case, his background and what the future holds for EU-US relations.
