AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERSOF PALM BEACH COUNTY, FLORIDA, PERTAINING TO POSTINGOF UNDERAGEDRINKING SIGNS;PROVIDING FOR DEF.INITIONS;

PROVIDING FOR GENERAL REQUIREMENTS; PROVIDING FORENFORCEMENT; PROVIDING FOR SEVERABILITY; PROVIDINGFOR REPEAL OF LAWS IN CONFLICT; PROVIDING FORINCLUSION IN THE CODE OF LAWS AND ORDINANCES;PROVIDING FOR CAPTIONS; PROVIDING F.ORAPPLICABILITY;AND PROVIDING F'ORAN EFFECTIVE DATE.

WHEREAS, the Board of County Commissionersof Palm Beach County, Florida,

finds that underagedrinking and service of alcoholic beverages o minors is an increasing

problem in Palm BeachCounty; and:

WHEREAS, medical studies and highway statistics note serious health risks and

adverseeffectsassociatedwith consumptionof alcoholic beverages y minors; and

WHEREAS, the general public should be informed regarding the law prohibiting

serviceof alcoholicbeverageso minors;and

WHEREAS, the generalpublic should be informed regarding the penaltiesassociated

with the saleor provision of alcoholic beverageso minors; and

WHERAS, the posting of signs with such information by vendors and certain other

dispensers of alcoholic beverages warning of the prohibition against and the penalties

associatedwith the sale or provision of alcoholic beverages o minors will make the public

awareof the possibleconsequencesf providing alcoholic beverageso underageminors; and

WHEREAS, the Palm Beach County Substance Abuse Awareness Coalition has

endorsedposting of these types of signs as an effective measure o generateawarenessand

deterrenceof theprovision of alcoholic beverageso underageminors; and

WHEREAS, the Board of County Commissioners inds that it will serve the public

health, safety and welfare of the citizens of Palm Beach County to inform the public as to

penaltiesassociated ith sellingalcohol o minors.

NOW' THEREFORE' BE IT ORDAINED BY THE PALM BEACH COUNTY

BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, FI,ORIDA,

that:

Section1. Definitions

The following words, phrases,or terms when used in this Ordinanceshall, unless he

contentotherwise indicates,havethe meaningsprovided below. No attempt is made to define

ordinary words which are used n accordancewith their establisheddictionary meaningexcept

whennecessaryo avoid misunderstanding.

a) Alcoholic Beveruge means alcohol, spirits, liquor, wine or beer, regardlessof

amount,containingmore than one percent(1%) alcohol by weight.

b) BusinessEstabtishment includes,but is not limited to, any place of businessor any

club, organization,person, irm, corporationor partnership,suchas: a golf club; country

club; veteran's fraternal or benevolent organization; grocery store; drug store; night

club; bottle club; bar; tavem; restaurant;grill; filling station; conveniencestore;or any

other building, structureor location or portion thereof wherein one person directly or

indirectly pays another or the purchaseor dispensingof an alcoholic beverage.

c) Conspicaously posted means clearly visible, easily readable and immediateiy

apparentupon viewing.

d) Dispensemeans he storing,handling, apportionment,preparation,gift, distribution,

or serving, directly or indirectly, of any amount of an alcoholic beverage o or for any

personby any officer, owner, operator, essee,or employeeof a businessestablishment.

For purposesof this definition, permitting or allowing any person to carry alcoholic

beverageson the premisesof any businessestablishment o be consumed hereonshall

constitute he "dispensing"of suchbeverages.

e) Minor meansany individual under the legal drinking age as set forth by Florida

Statutes s.562.1 and562.11 ,as may be amended r replaced.

f) Person meansan individual, person, firm, joint venture, partnership,corporation,

estate, trust, business rust, syndicate,fiduciary, association,and all other groups or

combinations,

g) Sale meansany transferof an alcoholic beverage or consideration,or any gift of an

alcoholic beverage in connection with or as a part of a transfer of any property or

product for consideration.

Vendorof AlcoholicBeveragesmeans nypersonwho ownsor operates business

establishment hich sellsor dispensesny alcoholicbeveragesor consumption n or

off thepremises.

Section . GeneralRequirements

All personswho own or operate business stablishmentn PalmBeachCountvwhich

age; nless xempt ursuanto Sections 62.11 r 562.13, loridaStatutes.

3. The penaltiesassociated ith the sale or dispensing f alcoholic

beverageso persons nder2l years f age ncludemprisonmentn county

jail for aperiodof up o 60daysa fine up to $500,or both.

Section .Enforcement

It is unlawful to violate any provisionsof this Ordinance. Such violationsmay be

enforcedby all meansavailableat law includingbut not limited to enforcement roceedings

beforePalmBeachCountyCodeEnforcement pecialMasters,heprosecution f violationsn

the nameof the Stateof Floridapursuanto the authoritygrantedby Sec. 125.69,Florida

Statutes,smaybeamended,r anyother awful actionsasarenecessaryo preventor remedy

anyviolationof thisOrdinance.

Section5. Severability

If any section,paragraph,sentence, lause,phrase,or word of this Ordinance s for any

reasonheld by a Court of competent urisdiction to be unconstitutional, inoperative,or void,

suchholding shall not affect the remainderof this ordinance.

Section . Repealof Laws n Conflict

All local laws and ordinancesn conflict with any provisionsof this Ordinance re

hereby epealedo theextentof suchconflict.

Section7. Inclusion in the Code of [,aws and Ordinances

The provisions of this Ordinanceshall becomeand be made a part of the Palm Beach

County Code. The sectionsof this Ordinancemay be renumberedor re-lettered o accomplish

such, and the word "ordinance may be changed o "section," "article," or other appropriate

word.

Section8. Captions

The captions,sectionheadings,and sectiondesignationsused n this Ordinanceare for

convenienceonly and shall have no effect on the interpretation of the provisions of this

Ordinance.

Section9. Anplicability

All provisions of this Ordinanceshall apply to the unincorporatedareasof Palm Beach

County, Florida, and to all municipalities within Palm Beach County that elect to have the

provisions of this ordinance apply within their respectiveurisdictions.

Section10. Effective Date

The provisions of this Ordinanceshall becomeeffective on 2012.
