I hope that t he reader wi l l bear over wi t h me for invent ing the word

t he i r s t o r y , but i f h ist ory is wr i t t en by those who are v ic tor i ous and

powerful enough to posit ion them selves and their narrat ives about

hist or ical event s int o acceptance by mainst ream histor i ans and media,

t hen, w hat el se should one cal l t he narrat ives of t hose who have

suf f ered defeat . Palestinians have for decades suf f ered f rom being in

t he posi t ion of the defeat ed. Their h ist ory is t he i r s t o r y , t he one tha t

does not m ake i t in t o t he text books of h ist ory . When deal ing wi t h human beings and their em ot ional as

wel l as in te l l ec tual f ra i l t ies however , the f act t hat t hose who wr i t e h ist ory are the one that arev ic tor ious, and t hose who w r i t e t he i rst ory are those who have suf f ered defeat does nei t her va l idate

hist ory nor t heirst ory. Both usual ly are "a" st ory, a narrat i ve about a discourse, as seen f orm a part icular

perspect ive.

The language of pol i t ical discourse is general ly speaking, and by vir t ue of t he nature of pol i t ics,

dominated by at t empt s t o posi t ion one sel f and others. From perceived posi t ions der ive perceived

rights and privileges as well as perceived duties and obligations for one self and others. Scapegoating is

but one of t he many tact i cs t hat are appl ied in t he pol i t ica l game of posi t ion ing one sel f and ones

int erest s in t he most f avorable manner, whi le posit ioning ones adversary much less favorably. Spin

Doctors or Propaganda Experts are playing a crucial role; so do lobbies, economy, geopolit ical

considerat ions and a cohort of ot her f actors one can easi ly i dent i f y. Sadly, t he abuse of t he language of

t he pol i t ica l d iscourse has cont r ibut ed considerably t o pro longing t he d ispute betw een Palestine and

Israel . Decades of conf l ict , and unimaginable human suf fer ing of both Palest inian and Israel i indiv iduals,

fami l ies, comm uni t ies would not have been possib le w i t hout e l ic i t ing a wor ld w ide demand t o br ing an

end to t he suf fer ing; That i s, i f on ly the conf l ic t would have been presented in a f actual manner ; That

is, i f medi a and entert ainment indust ry would not have been playing a crucial role in dehumanizing one

side of t he conf l ic t , whi l e e l ic i t ing the suf f er ing of t he other . A very wel l researched and documented

movi e produced by The Media Educat ion Foundat ion, REAL BAD ARABS, demonst rates how badly

Hollywood has contr ibut ed to posit ioning the Arab people as uncivi l i zed, brut al v i l l a ins, t error i st s, and

r ight out inhumane, or sub human (1).

In the m ovie, feat ur ing Dr. Jack Shaheen, Dr. Shaheen document s t hat Arabs are being posit ioned as

t he most mali gn group in t he hist ory of Hol lyw ood. Right f ul ly Dr. Shaheen is drawi ng the comparison

bet ween t he way Hollyw ood has been and is posit ioning Arabs as sub-human, w it h that of t he Germ an

National Socialists posit ioning of Jews as Untermenschen. ( ib id . ) In bot h cases, in t hat of t he

posi t ion ing of Jews and t he inhuman suf f er ing that has been in f l ic t ed on European Jews dur ing the

National Socialist Era in Germany, and the ongoing posit ioning of Arabs as sub-human, and the suffering

of Palest inians, the ef fect of t he posit ioning is a signif i cant incr ease in general populat ions accept of

pol i t ical ly m ot i vated violence as legit i mat e means t o solve pol i t ical conf l ict s. This includes pol i t ic ians

who grew up w i t h t he ste reo typ ing med ia and en te r t a inment .

In his book "REAL BAD ARABS, How Hollywood Vilifies a People " (2), Dr. Jack G. Shaheen looked at

more t han one t housand movies, f rom t he oldest archives of Hol lyw ood movies t o the great est"Blockbuster" movies up t o 2001. Shaheen el ic i t s t he st ereot ypes t hat r ob a whole peopl e of t heir

humanity. One could say that Dr. Shaheen is demonstrat ing on Hollywood product ions, that what the

renown Palestinian scholar Edward W. Said has described as "Orientalism" (3). Whil e Said analyzed t he

stereotyping of all people of Asia Minor to East and South East Asia, Shaheen part icularly analyzes the

posit ion Hollywood determines for Arabs. In the movie "REAL BAD ARABS", Dr. Jack Shaheen elicits that

the Disney Classic "Aladdin" that has been and is being seen by mil l ions of peopl e wor l d w ide, is

recycl ing al l t he old st ereot ypes. The song at t he beginning of t he movie is set t ing the scene. "Where

wi de, and part icular ly chi ldren, are coached int o bel ieving t hat Arabland is a place where i nnocent

wom en have thei r hands amput ated f or forget t ing to pay at t he bazaar. In ot her movies Arab men are

descr ibed as imb eci l ic super-r ich, as sex addict ed t yrants who mi st reat t heir w oman, and m ost

imp ort ant l y, Ameri can women. Women are kidnapped and sold of t o sleazy Arabs in auct i ons. Dr.

Shaheen el ic i t s t hat over t hree hundred m ovies, near ly 25 % of al l Hol lywood m ovies in one w ay or t he

other demean Arabs. ( ibid.)

With respect to demeaning an ent ire people, the same could be said about the count less movies

produced dur i ng and subsequent t o World War Two, w ho depict t he Germ an people as beast s,

inhumane m onst ers, and genocidal maniacs. Count less Hollywood pr oduct i ons el ic i t t he legit im ate

suff er ing of t he Jewish people dur ing wor l d war t wo. As far as I am aw are t here has not ever been a

Hol lyw ood product i on t hat e l ic i t s the suf fer i ng of the at least 25.000 Germans t hat w ere burned t o

death dur ing t he bombing and t ota l dest ruct i on of Dresden (4), or t he at l east 17.600 Germans t hat

wer e burned to death af t er a 20 minut es bombi ng raid over Pforzheim (5). The aut hor of thi s ar t ic le has

lost almost al l of hi s fami ly dur ing t he bombing of Dresden and grew up wi t hout ever having a

grandfat her or grandmot her, a great grandfather or great grandmot her, uncles, or aunt s f r om his fat hers

side of t he fam ily. Is t hat suf fer i ng not legit im ate? Is t he suf f er ing of t hose who per i shed in Hiroshim a

and Nagasaki, and that of t hose lef t behind not l egit im ate human suf f er ing. The fact is, that human

beings are k ind hear t ed by nature, and we do not wish to in f l ic t pa in and suf fer i ng on fe l l ow human

beings, as long as t hose f el low human bei ngs are granted t heir d ignit y as human bei ngs, and not being

syst emat i cal ly dehumanized and st r ipped f or al l human value.

Dr. Jack G. Shaheen el ic i t s in bot h t he movie and t he book "REAL BAD ARABS", t hat Hol lywood and

poli t ics go hand in hand in dehumanizing Arabs. Further, he documents that the dehumanizat ion of

Arabs began subsequent t o World War Tw o. The Palest inian Israel i conf l i ct , in w hich t he USA

unequivocal ly support ed Israel, t he Arab Oil Embargo in t he sevent i es, and t he revolut ion in I ran have

been the m ain dr iv ing and m ot ivat ing factors behind t he dehumanizat ion in Hol lywood product ions.

( ibid) Ever since t he foundi ng of t he st ate of Israel, every single US-Administ rat ion has unequivocal ly

declared t hat i t is comm it t ed to w hat is of t en cal led "The Ameri can Israel i Fr iendship", or by other

euphemisms for t he unwaver ing suppor t o f Israel , no m at t er w hat , and no mat t er w hat v io la t i ons of

int ernat ional law i t comm it s. On the ot her hand, t he USSR was known f or i t 's unequivocal support of

t he Palest inian course, m ore or less regardless what v iolat ions of int ernat i onal law t here wer ecommit ted by the mi l i t ant member organizat i ons of the PLO. In t oday's Russia, t his suppor t is more

cr i t ical, but i t is mainl y dr iven by geopoli t ical rat her t han human r ight s considerat ions. The people of

Israel and Palestine, Arabs, Christ ians and Jews alike have been, and are st i l l the pawns in superpowers

geopoli t ical st ratagems.

Polic ies impact consensus real i t y by means of m edia and the ent ert ainment indust ry.

Consensus real i t y det ermi nes i f a people i s perceived as human beings, wi t h al l t he legal,

ethi cal, and m oral consequences i t im plies, or i f a people is perceived as sub-human, whose suf f er ing

can be t o lerated or condoned; i f a people can be murdered wi t h impuni t y . In REAL BAD ARABS( ib id . )

Dr . Shaheen is drawing at t ent ion t o t he many Hol lyw ood movies t hat are produced wi t h t he help of t he

US-Depart ment of Defense, r eferr ing to num erous movies where t he murder of Arabs is glor i f ied. But i t

does not st op t here. The Pent agon, as wel l as ot her defense depar tm ents wor ld wi de, i nvest in Media

Corporat i ons, inf i l t rate m edia wit h so cal led "expert s and analyst s" wi t h t i es t o civ i l ian and mil i t ary

int el l i gence services and armed f orces. Even t he book market is t o a large degree contr ol led by

government and mil i t ary censorship, as demonstrat ed by t he case of Lt . Col. Ant hony Schaeff er , whose

book "Operat ion Dark Heart "( 6) the Pentagon t r i ed to prevent f rom ent er ing the market . (7)

Af t er growing up and being indoct r inat ed to t he degree that Arabs ut t er ly have lost t he i r humani ty ,

af t er growing up and dai ly bei ng inf luenced by medi a report s t hat are designed to depr i ve Arabs of

t heir value and dignity as human beings, and af t er growing up wi t h a const ant stream of so cal led

enter t a inment t hat v i l i f ies Arabs whi l e i t g lor i f ies t he murder ing of t hem wi thout the sl ightest concern

about t he i r humani ty , is i t surpr ising, t hat t he populat ions of t he West si lent ly and compl ic i t y accept

t he dai ly v iolence t hat i s comm it t ed against t he people of Palest ine, or t he recent massacres of t ens of

t housands of Lib yans. Af t er al l, Libya has suppor t ed t he PLO and Palesti nians for decades, so Libyans

must be heart less t error ists, w hom West ern m il i t ary forces and hired m ercenar ies can massacre wi t himpuni t y in t he tens of thousands. Af t er a l l , what t hose people in t he West have learned f rom ear ly

chi ldhood via Disney cart oons such as Aladdin, and count less ot her dehum anizing product ions is, t hat

t he Arabs, and for most West erners Libyans are perceived as an Arab country, can be m urdered and

The reason why t he suf f er ing of t he People of Palest ine is not p erceived as legit im ate suf fer ing, on an

equal scale wi t h t he suf f er ing of t he Jewish people in Europe dur ing World War Two, and t he suf f er ing

of Israel is who are murder ed by Palest inians is, t hat t he government s of West ern count r ies

syst emat ical ly have depr ived t he people of Palest ine f rom t heir humanit y.

I t i s a fact t hat hum an being has an innate resist ance against t aking another human beings l i f e. As long

as we are not speaking in t erm s of psycho-pathology, i t t akes mont hs of r i gorous mi l i t ary t r aining,

befor e a person can overcome t his innat e human tr ait . I t does not m att er i f one analyzes t his aversion

against t aking another human beings l i f e f r om a purel y moral or et hical perspect i ve, or i f one analyzes i t

f r om an evolut ionary perspect i ve. Our innate unw il l ingness against t aking another human beings l i f e is

meaningful, and has t he f unct i on t o preserve ourselves as a species and hum an civ i l i zat ion.

We can est abl ish as fact , t hat t here is hist ory and thei rst ory. Both are equally i nval id. Whil e hist ory is a

funct ion of po l i t ica l cont ro l f or t hose who are in posi t ions of re lat ive power , w hich can be inst rument a l

for dehumanizing others, and for providing apparent legit imacy for the oppression of others, theirstory

is of t en inst rument a l in recru i t i ng resist ance against t he dominant powers whi le dehumanizing the

oppressor. Neit her t he decades long conf l ict in Palest ine or Israel nor any other conf l ict can be t rul y

underst ood, l et alone be solved, by a rhet or ic approach t o t he language of t he discourse. Language is a

power fu l inst rument t hat cont r i butes t o a great degree in determ in ing our t h ink ing and our act i ons.

Problems in conf l ict s are only t ruly com prehended and solved by a l anguage t hat is f ree f rom

posi t ion ing, scapegoat ing, and dehumaniz ing one, whi le prov id ing leg i t im acy to t he other . Without t he

foundat ion of a pure and fact ual language to t he discourse, even i f one is aimi ng for peace, i t is alm ost

im possibl e t o discern whi ch argument s in t he Palest inian - Israel i discourse are legit im ate and val id, and

which are not .

The Necessit y of a Teleological Approach t o the Language of the Discourse.

The Palest inian Israeli confl ict has last ed f or decades, wi t h unim aginable

human suf f er ing involved on bot h sides. This suf f er ing w as

predominant l y on the side of t he Palestinians and Arab Israelis, bu t

legit imate suf fer ing has been and is present on both sides. I t must, with

al l r ecognit ion of Israel i suf fer i ng, be underst ood t hat Israel is not only

t he one that i l legal ly occupies Palest inian ter r i t ory; i t also has one of the

worl ds most wel l equipped mi l i t ary forces t hat are largely used to cont rolt he civ i l ian populat i on that i s l iv ing under i l legal occupat i on. The conf l ict has been dominated by

decades of bot h low int ensit y and high intensit y conf l i ct . Both sides have used and are making use of

what could be general ly descr ibed as " t e r r o r i sm " .

The problem s wi t h comm only used approaches t o the l anguage of t he discourse wi t h regards t o the

Palest ine Israel conf l ict as wel l as pol i t i cal ly m ot i vated violence i n general becom es obvious when one

analyzes t he dif fer ent p hi losophical and scient i f ic approaches t hat are used for under st anding

t error ism. Before est abl ishing a teleological approach, l et us br ief ly analyze some of t he other

approaches t hat are comm only used.

The const ruct ionist and social const ruct ionist approach. Wit h regards t o so cal led t error i sm, t he

constructionist approach is among other represented by Rom Harr. In his contribution to

"Underst anding Terror ism" (8), Harr not only emphasizes that the genesis of many psychological

phenomena lie in the language and other symbolic systems. Harr is also correctly drawing attention to

the fact that social construct ionism does not suf f ic ient ly deal with problems such as posit ioning,

scapegoating and labeling. Harr is giving the example of the British Member of Parliament Peter

Mandelst am, who said:

" I t h ink t he d ist inct i on we have t o make is not bet ween good and bad t er r or is ts. I t is betw een

t hose t er ror ist s who have pol i t ica l obj ect ives, and are prepared t o negot iat e t hese object ives at

t he end of t he day and engage in some ki nd of pol i t ical or peace process. "(9).

Harr realizes the problems with social constructionism. The example of Peter Mandelstam's definition

( ibid. ) also clear ly begs t he quest ion, i f so cal l ed t error i st s loose legit im acy because t heir opponent

oppresses t hem t o such a degree t hat t hey never get t o t he point where negot ia t ions are possib le. Are

they less legitimate. Harr draws attention to the fact that the one mans terrorist can be the other

ones freedom fighter. What Harr fails to deliver though, is a model that can help overcome the

problem s wi t h social const ruct ionism in pol i t ics and conf l ict s, and al l t hat i t includes.

There are numerous ot her approaches t o the di scourse of so cal led t error i sm. The inf l uence of t he

social self , t he dishonest cr im inal, and many other whi ch t o analyze is beyond the scope of t his ar t ic le.

The one most wi dely t aught in West ern Universit y Inst i t ut es is descr ib ing a st aircase, beginning wi t h

perceived in just ice, w here the ind iv idual w ho perceives apparent in j ust ice, and who is fee l ingdepr ived of leg i t imat e and suf f i c ient po l i t ica l in f luence, is slowly radical ized, and t hen dr iven in to t he

hands of "t e r r o r i s t " net works who slowl y recru i t and indoct r inate t he person in to becoming a ter r or ist .

This t heory w as developed by t he I ranian American Fat hal i M. Moghaddam (10).

Actually Moghaddam's theory is a bril l iant example for how problems can not be solved. It is also a

br i l l iant example of how so cal led t error ism t heory act i vely contr ibut es t o prolonging the Palest inian

Israel i conf l ict rat her t han solving i t . As long as t he point of depart ure is "perceived in j ust ice" ( ibid.)

be usefu l f or re inforc ing the v ic t ors, t he power fu l 's nar rat ive, t hat young people are indoct r inated by

radicals, w it hout ever analyzing why a group of people i s making use of pol i t ical ly m ot i vated violence

including t he st rat egy of t error i sm. Wit h respect t o the Palest ine Israel conf l ict , Moghaddam's t error i sm

theory ( ib id . ) is re inforc ing the Hol lyw ood nar rat i ve. The nar rat ive of t he v io lent Arab, the unc iv i l ized

barbar ian, w ho seduces mi sguided, i mbeci le young Arab people int o vic ious and incompet ent Arab

monsters who have not h ing bet t er t o do t han randomly murder ing innocent Israel i c i t izens for

thereaf t e r be ing murdered w i t h impun i t y .

I t is t r ue t hat t he genesis of m any psychological phenom ena is t o be found i n semant ics, i n language, in

words. Semant ics part ial ly pr edet erm ine social syntax. And thus, bef ore we ever arr ive at a st ate

where we can d iscuss legi t imat e suf f er ing, perceived in j ust ice versus in j ust ice perceived, and how t o

solve one of t he most complex conf l ic t s of t he Middle East and the w or ld, we should begin by

developing a tel eological appr oach to t he language of t he discourse.

A tel eology is any account t hat holds that f i nal causes exist in nat ure. A thing, a process, or an

act ion is teleological, w hen i t is for t he end of a f inal cause (11) . In other w ords, t e leo logy

analyzes the "inherent in t ent i onal i t y in a l l obj ect s, subj ect s and act iv i t ies". This includes polit icians,

mil i t ary and paramil i t ary forces, populat ions, nat ional i t ies, organizat ions, et cetera as well as f l owers

and bumblebees and the bumbl ebees and f lowers inherent in t ent ional i ty t hat par t ia l ly det ermines t he

course of t he i r in t eract ion. What t he author of t h is ar t ic l e suggest s is that t he language of t he

Palest inian Israel i discourse, and t hat of conf l i ct s in general, must be based on an understanding and

applicat ion of t eleology. The reason why t his approach is so crucial for conf l ict resolut ion is, t hat a

t eleological approach t o t he language of t he discourse makes i t im possibl e t o posit ion, scapegoat,

excuse, use euphem isms, and so for t h. Let us look at some exam ples.

Hiroshima. The second wor l d w ar had already cost t ens of m il l ions of l ives. The United St ates Air Force

is a nat ional mi l i t ary force. Terror i sm can be descr ibed as t he tact ic of inst i l l ing the emot ions of f ear,

t error , and perceived helplessness in a target populat ion, w it h the aim t o manipulat e a pol i t ical

agenda. The cit y of Hiroshim a was not of any direct mi l i t ary signif i cance in the sense t hat i t was not

heavi ly defended, and in t he sense t hat t he vast maj or i t y of i t 's inhabi tants were innocent c iv i l ians and

non combat ants. With a tel eological approach to t he language of t he discourse of pol i t ical ly m ot i vatedviolence, t he bombing of Hiroshim a was; " The cr imi nal , premedi t ated mass mur der of c iv i l ian non

combat ant s by means o f a na t iona l m i l i t a ry fo rce, w i t h t he in ten t i on to t e r ro r ize an ent i re peop le

and t he i r government i n to submission , and wi t h t he purpose t o in t im i da te and t e r ro r ize t hem so as

t o accept an uncondi t ional sur render ". Euphem isms li ke "we nuked them t o end war " are par t o f t he

problem, not par t o f t he so lut ion.

The occupat ion of Palest ine is the i l legal occupat i on of a sovereign peoples countr y by m eans of

mil i t ary and paramil i t ary nat ional, occupying forces. The countermeasures against so cal led t error ism in

t he occupied West Bank, such as road bl ocks, would be ut t er ly unnecessary i f Palest ine w as not i l l egal l y

occupied, and are designed t o in t imi date and t er ror ize. They are i l legal ly establ ished populat ion

cont r o l uni t s est abl ished t o maint a in an i l l egal occupat ion.

The bombing of Gaza in 2004 was t he ter ror bombing of a c iv i l ian populat i on wi t h t he in tent ion t o

inst i l l t he emot ion of t er ror and help lessness, w i t h the in t ent ion t o in t im idate bot h the Palest in ian

people and t heir government in t o ceasing to cont inue t heir leg i t im ate f ight for l iberat i on and sel f

de te rmina t ion . I t w as t er ror bombing of non combatant c iv i l i ans and premedi t ated m ass mur der .

The PFLP-GC is a Palest inian paramil i t ary organizat ion t hat uses pol i t ical ly m ot i vated viol ence wi t h t he

intent ion to l iberate their country f rom i l legal occupat ion. The PFLP-GC has the declared intent ion to

l iberate t he i r count ry f rom i l l egal occupat ion and i t is thus a mi l i t ant l ibera t ion movement . I t also

makes use of t error bombi ng of c iv i l ians, as wel l as i t makes use of legit im ate m il i t ary act ion. The

euphemism "t arget ed assassinat ion" used by Israel and the United States of America, is a euphemism

f or pr em edi t a t ed m ur de r . The brut al v iolence used by Israel i m il i t ary forces against c iv i l ians in t he

occupied West Bank amount s t o in f l i c t ing bod i ly harm wi t h t he purpose to i n t i m ida te and inst i l l

t er ror , so as t o cont r o l t he populat ion of an i l legal l y occupied ter r i t ory . I t is pol i t ical l y mot i vat ed,i l legal v i o lence and t er ror ism w i t h t he purpose t o cont i nue and cont ro l an i l l egal occupat i on. The

Palest inian m an or w omen, who strap a bom b on t hem selves and explode t hem selves among non

Legitimate and Illegitimate Discourses on Palestine and Israel.

The Unique Suf f er i ng of t he Jewish People

Let t here be no doubt . Dur ing Wor ld w ar Two t he Jewish people of

Europe have suf f ered severe dehum anizat i on. In movies such as Der

Ewige Jude (12) an ent ire peopl e was in propaganda movies denounced

as rat s, as a pest , t hat needed t o be rem oved to safeguard a healthy

Germ an populat ion and a strong Germany. European Jews weresyst emat ica l ly depr ived of the i r humani t y . I t does not m at t er i f t he

number of six m il l ion murder ed Jews has been signif icant ly reduced af t er

lat er years research; t he fact remains that count l ess human beings suf f ered t he most appall i ng abuse.

An abuse t hat hardl y would have been possibl e i f t he Germ an populat ion had not b een manipulat ed

int o perceiving them as a pest .

Jewish lobbies of t en argue, t hat t he suf f er ing of t he Jewish people was unique, and t hat t hey

theref ore must be grant ed spec ia l r ights and pr iv i leges. I t i s an argument , t hat i s of t en used w i t h in t he

context of f inding j ust i f icat i on for Israel` s aggression in t he i l legal occupat ion of Palest ine. Wit h al l due

respect for t hose who suf f ered, but t he argument is inval id. Besides t he danger of t he indescr ibabl e

suf fer ing of the European Jews being wil l ingly or unwil l ingly abused to just i fy the inf l ict ion of suf fer ing

on others, Palestinians, there are many, l ike David E. Stannard ( 13) who r ight f ul ly argue, that declar ing

t he so cal led holocaust as a unique event, and the posit i oning of t he suf f er ing of t he Jewish people as

unique suf f er ing, be l i t t les t he many ot her genocides t hat have been t ak ing p lace, and t hose w hich may

come. Forced labor in t he for mer Belgian colony Congo has, even t hough t he exact num bers are

somewhat d isputed, cont r ibut ed t o t he death of approx imate ly 20 % of t he co lonies populat ion ( 14). I t

is c lear ly probl emat ic t hat t he claims of t he uniqueness of t he Jewish suf f er ing is not only f alse, but

that i t leads t o the very re lat i v ism i n t he evaluat ion of hum an l i fe t hat is one of t he root causes of t he

holocaust i t self , and of count less ot her massacres, act s of genocide, innocent ic ide, and ethni c

cleansing. I t is a root cause for the atrocit ies that those who survived the holocaust , and those who

t oday claim t o be the vict i ms representat ives, are claimi ng t o deplore. Wit h al l possible em pathy for

t he vict i ms of t he Nat i onal Social ists persecut ion, t he unique suf f er ing is not a val id argument for t he

establ ishment of a Jewish state or the state of Israel on the terr i tory of the Palest inian people.

Final ly, the insistence of some Jewish lobbies that the suf fer ing of the Jewish people is unique, while

shamelessly abusing the legit im ate suf f er ing of mi l l ions of Jews for an ext ort ion racket, whi ch the

Jewi sh Ameri can scholar Dr. Norm an G. Finkelstei n (15) document ed in h is book The Holocaust

Indust ry (16) is cont r ibut ing to st rong, w or ld w ide, ant i Jewish sent im ents. I t is re inforc ing many of

t he st ereotypes that have cont r ibut ed t o t he Jewish people being t argeted by Nat ional Soc ia l ist s in

the f i rst p lace.

The Hist or ica l Argument .

I f t he hist or ical argument , w hich is based on the f act t hat Jewi sh people wer e l iv ing in hist or ical Israel

in bibl i cal t i mes is t o be val idat ed as j ust i f icat i on for t he est abl ishment of t he modern st ate of Israel

t here ar ise a number of pr oblems t hat are inconsolable wit h modern int ernat i onal law. The author of

t his ar t ic le is German, born in t he region of Germany f rom w here Teutonic people once emigrated

nor thw ards t o the Danish t er r i t ory known t oday as Thy. Another r emnant of t hat per iod i s t hat Danes

call Germans Tysker. Those Germ an tr ibal peopl e had a dist inct cult ure and reli gion which is st i l l

migrat ion in t o Nor t hern Denmark. They could t hen, a l ter the dem ographics of t he area and i t would be

perfect ly legal t o provide a Thy-Passport t o anyone who could document West Germ an ancest ry. Final ly,

i f the Thy region was div ided between Germans and Danes, i t would be legit imate to occupy i t

ent i re ly , to ev ic t Danes f rom t heir houses, t o force them t o l ive in enc laves wi t h wal ls around them t o

protect t he occupier . The h ist or ica l argument is so problemat ic t hat i t would pr ovoke count l ess

conf l i ct s t hroughout t he wor l d. I t is an of t en used, but never t he less absolut ely inval id and a most

dangerous argument.

Legit im acy via t he Balf our Declarat ion.

According to todays legal standards,the Balfour Declaration (17) w ould be considered i l legal.

Even according t o t he st andards of t he per iod w hen i t was signed i t is i l l egal. The argument

t hat i t lends legit im acy t o the st ate of Israel is equivalent t o arguing, t hat any colonial power or nat ion

t hat i s v ict or ious in a war and an occupying power, has t he r ight t o signif i cant l y change the

demography of an occupied terr i t ory. I t i s absolut ely problem at i c, and created a precedence t hat since

has given rise to other conflicts and il legal practices, such as the ongoing establishment of a so called

independent Kosovo. Imagine for a m oment , t hat Denmark, w hich st i l l maint ains a semi colony on

Greenland, granted t he Jewish people a hom eland on Greenland. Would t he Inuit on Greenland have

t he r ight t o resist , and i f necessary by making use of pol i t ical ly m ot i vated violence. The argument i s

inval id, and the inher ent consequences of t his t ype of argument are most dangerous for t he peace.

Legi t imacy by Vir t ue of t he Uni t ed Nat i ons.

On 14 May 1948 the pr ovisional governm ent of t he self procl aim ed st ate of Israel, led by Ben Gurion,

inf ormed t he t hen US President Truman and t he wor l d t hat t he st ate of Israel w as est abl ished. Ben

Gurion asked Trum an t o recognize Israel on b ehalf of t he USA.(18) The US Admini st rat ion recognized

t he government of Israel as de fact o government wit h in the course of minutes. Af ter f a i led at t empt s,

i t was ful ly recognized as a mem ber of t he United Nat ions in 1949 (19). It is important to remember,

that the est abl ishment and recogni t ion of Israel happened wi t h in t he context o f a rapid ly developing

cold w ar, invol ving t he USSR and t he Warsaw Tr eat y nat ions on one hand and th e USA, t he UK, France,

and al l ied as wel l as occupied nat ions on the ot her. I t w as by no means clear w eather Israel w ould

become an a l ly t o the one or the ot her side of t he d iv ide. One must admit that t he Israel i po l i t ic iansplayed t heir hand w isely, gaining maxim um support f rom t he USA. A support t hat has since been so

extended t hat some hi st or ians perceive Israel as a part of t he American Republic.

The problem w i t h t he argument that t he recogni t ion of Israel by t he Uni t ed Nat ions prov ides leg i t im acy

for the state of Israel is that the United Nations, by recognizing Israel, contradicted main tenets of its

own charter. The right of Palestinians, Arab, Muslims, Christ ians, and Jews alike, was grossly neglected

by al low ing t he est abl ishment of a new st ate wi t h in the ter r i t ory of another , w i t hout at least a

refer endum. The argument t hat t he St ate of Israel has achieved legit im acy by being recognized by the

United Nations Security Counsel and the United Nations General Assembly is thus at least highly

problematic, and most l ikely legally invalid.

Palestine Israel History and Theirstory: Part 1, Part 2 and Part 3.

The De Facto Argument.

One could argue that the state of Israel has gained legitimacy due to its

60 plus years of d e f acto exi st ence and funct ioning. The w eakness of

t his argument is that i t provides precedence for i l legal pract ices being

legi t im ized due to hav ing been pract iced for a suf f ic ient amount of

t i me. Sadly the de f act o leg i t imizat ion of i l legal pract ices, due t o t he

abi l i t y to back the i l legal pract i ces wi th m il i t ary force, is st i l l

comm onplace in 2011. The de f acto existence argument needs t he mostcareful considerat ion f or a numb er of reasons.

The most prom inent of t hose reasons are:

The fact t hat nat i ons are establ ished w i t h t he suppor t o f superpowers who apply economic, po l i t ica l

and mi l i t ary force to suppor t the establ ishment of nat ions t hat are f r i endly to t hem is h ighly

problem at i c. One of t hose incident s is Kosovo, w here t he Serbian populat ion has been, and st i l l is

subj ect t o oppression by pol i t ical ly m ot i vated vi olence via KFOR. Thus the Unit ed Nat ions has become

an inst rument for nat ion bui ld ing projects, that are opposed to its own charter and principles of

peoples r ight t o se l f det erminat ion.

The fact that the state of Israel is the first nation world wide, that owes its very existence and

legit i macy t o t he Unit ed Nat ions should obl i ge Israel t o st r ict ly uphold any UN General Assembl y and

UNSC resolut i on which is not in cont radic t ion t o t he char t er of the UN. The de facto r eal i ty meanwhi le

is, t hat Israel is condescending, and ref using to accept t he legit im acy of one UNSC resolut ion af t er t he

other that is critical of Israel, while at the same time using its influence within the USA and EU

mem ber st ates t o oppress t he natural and human r ight s of t he Palest inian people at t he Unit ed

Nat ions. An Israel t hat cont inues t his pract i ce can neit her legal ly nor m oral ly rely on being legit im ized

by the in t ernat ional body which i t re fuses t o adhere t o.

I t is a fact t hat Israel has for now 60 plus years comm it t ed and cont inues t o commi t cr im es whi ch are

t he ant i t hesis of t he pr inc ip les t hat are enshr ined in t he char t er of t he Uni t ed Nat ions, f rom w hich i t

claim s legit im acy. Princip all y t hose crim es are: The repeat ed invasions and aggressions against Lebanon

wi t h t ens of t housands of m urdered civ i l ians. The i l legal occupat ion and annexat ion of t he Golan Highs

and parts of Southern Lebanon. The occupation of Gaza, and after leaving Gaza, the il legal land and

mari t im e siege against Palest inians in Gaza. The il legal and crim inal depr ivat ion of Palest inians in Gaza

f rom basic food i t ems, and medic ines, f rom t he abi l i t y t o t rade f reely . The repeated dest r uct ion of

infr ast ruct ure such as elect r ic pow er pl ants and w ater suppl i es, government bui ld ings, schools, and

cult ural f aci l i t ies. The i l legal occupat ion of t he West Bank and the annexat ion of vast Palest inian

t err i t or ies, l eaving Palest inians in t he West Bank to l ive in de f acto enclaves t hat are separat ed f r om

each other by mi l i t ary inst al lat i ons, i l legal set t lement s, i l legal w al ls t hat isolate t he populat ions in t he

enclaves. The i l l egal t aking of pr i soners, i ncluding chi ldren. The t reatm ent of even uniformed

Palestinian liberation f ighters as criminals and t e r ro r is t s inst ead of g iv ing them t he st atus ofpr isoners of war. The syst emat ic t or t ure of pr isoners. Count less human r ights abuses. The use of

mil i t ary ammunit ions in civ i l ian areas. The regular use of disproport ionate m il i t ary force. Murder of

Palest inian pol i t ic ians as well as l iberat ion f i ght ers, pol icemen, and other under an i l l egal program of

what is euphemist ical l y cal led t arget ed assassinat i ons. Dai ly cruel, degrading and inhumane t reatm ent

of Palest inians. The control l ing every aspect of indiv idual, f amily, communit y and pol i t ical l i f e.

Deport at i ons t hat am ount t o ethni c cleansing. Refusing ref ugees t he r ight t o ret urn. A 60 year long

poli t ic of aggression, v i olence, m assacres, depor t at i ons and ethni c cleansing that amount t o genocide.

Just i f icat ions and Just ice.

The fact that Israel has the policy of justifying its 60 plus year long policy of aggression and genocide,

or rather innocenticide, does not lend justification to its inhumane treatment of Palestinians. Non of

its arguments, not the uniqueness of Jewish suffering; the historical argument; the argument of

legi t imacy by v i r tue of t he Bal four Declarat ion; t he argument of leg i t im acy by v i r tue of the Uni ted

Nat ions; nor t he de facto argument provide legit im acy for t he cruel, inhum ane and degrading

t reat ment of Palest ini ans and the syst emat ic genocide that is conduct ed on a dai ly basis. Apparent

j ust i f i cat i on i s n ot t o be conf used w i t h j ust i ce.

The Right to Resist.

The people of Palest ine have every r ight t o resist . They have the r i ght t o peaceful resist ance, and t hey

have t he r ight t o use pol i t ical ly m ot i vated violence. They have however, as underst andable as t heir

desperat ion is, not t he r ight t o use t he same i l legal pract i ces t hat are used against t hem and w hich

t hey deplore. The murd er of innocent , non-combat ant Israel i c i t izens. The so cal led ki dnappings of

sold ier s, such as Gilat Shali t (20) are perfect l y legal, provided that pr isoners are granted t he ful l r ights

of pr isoners of w ar t o t he extend t hat secur i ty a l low s. The defamat ion of armed Palest i n ian l iberat ion

euphemi sms, only be d escr ibed as syst emat ic et hnic cleansing and genocide. Nothing short of genocide

embr aces t he ful l m onst rosit y of w hat has been happening in Palest ine f or over 60 years, and t he

monst rosit y of w hat is happening in Palest ine every single day.

The Right t o Exist .

I f t he st ate of Israel ever had t he r ight t o exist s, i t has now spent over 60 years on demonst rat ing that

the r ecogni t ion of Israel was one of t he most t ragic mi st akes t hat have been permit t ed and comm it ted

since t he end of t he second wor ld w ar. In t he eyes of m any scholars wor ld w ide t he consensus t hat

Israel has lost all l egit im acy, if it ever had any, is becoming increasingly prevalent . The m assive incr ease

of access to independent media and in format ion w i l l make i t exponent ia l ly more d i f f icu l t for Israel t o

maint ain the dehum anizat ion of Palest inians. Israel m ust be aware t hat t he support of West ern

governments for maintaining its criminal practice will only be possible as long as the populations of

these countries dont demand that their governments demand that Israel respects preconditions for

t heir support . Precondit ions whi ch West ern government s wi l l have to establ i sh as soon as t he number

of c i t izens t hat have had access t o fact ual inf ormat ion is reaching a pol i t i cal ly cr i t ical m ass.

A wel l meant word t o t he Jewish Communi t y .

You are a wonderf ul peopl e. The aut hor of t his ar t ic le has Jewi sh people am ong his good f r iends. I f you

are Jewish and you wish t o suppor t t he cause of t he Jewish people, do r ead th is ar t ic le t wi ce. The

best t hing that you can do for yourself , f or t he Jewish people, f or Israel, and for peace is t his:

occupied terr i tor ies of Palest ine. Support them. A slowly growing community of Jewish people speaks

out against t he Holocaust Indust ry. Support t hem. Bot h Arab and Jewi sh Israel i c i t izens prot est and

act ivel y resist i l l egal dem oli t ions of Palest inians homes. Join t heir cause and demonst rat e for t hose

who have suf f ered at t he hands of Jew ish people f or over 60 years. Underst and that i t is a cr im inal

mi nor i t y t hat bears responsibi l i t y f or bot h t he Palest inians and Israel is suf f er ing. Speak out againstpower . Show t hem t hat you have courage t o resist against being represented by cr i mi nals. Show

humani ty . Lobby against t hose lobbies who create hat red rather t han underst anding. Show t he

greatness of your people by showi ng your abi l i t y t o underst and suf f er ing. Your people have had a

genuine and f r ightening, t hough not unique suf f er ing brought upon you. Show t hat you understand

t hat t he suf f er ing of t he Jewish people was not unique, but t hat i t he lps you to be compassionate

t owards others who suf f er . Show t hat you are human, and protest t he dehumanizat ion of Arabs and of

al l hum an beings, everywhere. Your hum anit y is the best safeguard against ever being dehumanized

again.

The short answer is no. No tw o st ate solut ion wi l l ever br ing a de facto i ndependent ly exist ing Israel or

a de f acto independent l y ex ist ing Palest ine in t o ex ist ence. Af t er decades of Peace Pr ocess on t he

t r ack of a t wo st ate so lut ion i t must have become ev ident for a l l par t ies involved, t hat t he only v iab le

possibi l i t y f or t he est abl ishment of peace for Arabs, Chr ist ians and Jews al ike is one st ate. One secular

st ate w i t h t he l iber t y t o pract ice ones re l ig ion of choice. One st ate t hat em braces Palest in ians

inalienable right to return. One state that is seeking peace with its neighbors. One state that

embraces a pol icy of im mi grat ion, t hat is fair and balanced, and does not give r ise t o inter nal conf l ict s.

One state that adheres to international law and human rights while maintaining its uniquely rich and

fer t i le cult ural element s. Fai lure t o let reason and humanity prevai l may very well become one of t he

root causes for a conf l ict t hat ends civ i l izat ion as we know it . A st ate f or Jews, Musl im s, Chr ist ians,

Buddhists, At heist s and other s al ike is the only viabl e solut ion. And please do not l et t he choice of a

name come i n t he way of reason and peace. What about Peacerael.
