ASSESSMENT MANAGER CONDITIONS

1. Carry out the approved development generally in accordance with the approved drawing(s) and/or document(s), and in accordance with:

a. The specifications, facts and circumstances as set out in the application submitted to Council, including recommendations and findings confirmed within technical reports.

2. Existing vegetation on the subject land, except that detailed in the Approved Plans and Documents under Appendix 1 and Appendix 2 must be retained.Any further clearing requires an Operational Works Approval.

3. Existing vegetation within the Road Reserve must be retained.

4. An approval under the Nature Conservation Act 1992 for the relocation of all specimens of Ant Plants (Myrmecodia beccari) is to be obtained prior to the removal of any Host Tree to this Vulnerable epiphytic plant.

5. Trees that contain nesting native birds, dens or roosting sites of native animals are not to be removed while the nests, dens or roosting sites are in use as per the requirements of Section 352 of the Nature Conservation (Wildlife Management) Regulation 2006 without the necessary approval from the Department of Environment and Heritage Protection.

6. Council’s Development Assessment Branch must be notified two (2) business days prior to the proposed date of commencement of any approved tree removal.

ADVICE

1. This approval, granted under the provisions of the Sustainable Planning Act 2009, shall lapse two (2) years from the day the approval takes effect in accordance with the provisions of Section 339 and Section 341 of the Sustainable Planning Act 2009.

2. This approval does not negate the requirement for compliance with all other relevant Local Laws and other statutory requirements.

EXECUTIVE SUMMARY

Council is in receipt of a Development Application for Operational Work (Clearing Native Vegetation). The small size of the lots generally from 530m2 – 798m² results in the removal of trees at the building approval stage which has placed significant cost on the end purchaser. The Developer, Multiplex Bluewater Pty Ltd has applied for the removal of existing trees from eleven (11) lots so as to avoid the cost of tree removal being borne by the purchaser of the lots.

Approval is recommended subject to conditions.

BACKGROUND

Council approved an application for a Reconfiguration of a Lot (1 Lot into 92 Lots) in February 2006 (8/13/882). This approval was Stage 2 of the Bluewater Views Estate. To date, a single part stage of the approval has been completed with a plan of survey being registered in 2008 and a number of lots having been built on.

The original Reconfiguration of a Lot (1 Lot into 92 Lots) was approved based on the condition that vegetation was retained as far as practically possible. In particular the approval conditioned that:

8. The applicant/owner is to submit a plan(s) that clearly identifies all vegetation on the subject site (as located in the Vegetation Survey Plans numbered 71058-31, 71058-32, 71058-33 and 7108-34 drawn by C&B Group dated 28 February 2005) with a minimum diameter of 500 millimetres. The plan(s) shall provide details of the expected locations of traffic carriageways, footpaths, service lines and other on-street works as to retain all vegetation with a minimum diameter of 500 millimetres unless otherwise approved by the Chief Executive Officer. The plan is to be submitted to Council and approved prior to the issue of a Development Permit for Operational Works

Landscaping Plan

9. The applicant/owner must landscape the subject land and street frontage in accordance with FNQROC Development Manual, Part 4 -Landscaping and in accordance with a landscape plan submitted to and endorsed by the Chief Executive Officer prior to the issue of a Development Permit for Operational Works. In particular, the plan must show:

a. The location and species (local name) of all existing trees with a trunk diameter of 500mm or greater, with an indication as to whether each tree is to be retained or removed, and natural and finished ground levels if filling is to occur in the vicinity of any tree;

b. The retention of as many existing trees and shrubs as possible and further planting of trees and shrubs;

c. Planting of the footpath with trees;

d. The provision of shade trees, especially in parks;

e. Inclusion of all requirements as detailed in other relevant conditions included in this Approval, with a copy of this Development Approval to be given to the applicant’s Landscape Architect/Designer.

The Landscaping Plan must include the principles of landscaping and built form envisioned for the development as outlined in the Bluewater Views Stage 2 Vision Concepts prepared on behalf of Multiplex Living, and the Bluewater Views Stage 2 Road Sections, Vivo Design plans numbered 71398_L_CD_ST2_01, 71398_L_CD_ST2_02,71398_L_CD_ST2_03, 71398_L_CD_ST2_06 and 71398_L_CD_ST2_07, and Cardno Drawing numbered 739543.12 SK1.

Existing native and mature vegetation must be retained in accordance with the Vegetation Retention and Infrastructure Services Plan as required by Condition 8 of this approval. Council’s City Assessment Branch is to be notified of the proposed date of commencement of any approved tree clearing.

Any common boundaries with Council esplanade parkland, general parkland or drainage reserves must be temporarily delineated and fenced off to restrict building access for the duration of construction activity.

Two (2) A1 copies and one (1) A3 copy of the landscape plan must be submitted to and endorsed by the Chief Executive Officer prior to the issue of a Development Permit for Operational Works.

Areas to be landscaped must be established prior to the endorsement of the Plan of Survey and must be maintained at all times, both to the satisfaction of the Chief Executive Officer.

Officers are of the view that under the original Reconfiguration of a Lot approval (8/13/882) the retention of mature vegetation conditions were focused primarily over parcels throughout the estate reserved for parkland, drainage road reserve and conservation as well as areas protected under statutory covenants. However, the developer at the time, for unknown reasons, did not clear the smaller residential lots (circa 700m2) of mature vegetation. This has resulted in significant vegetation clearing costs being borne by the end purchaser.

Vegetation Management Code Complies with A1.1 The vegetation damage occurs on a lot size equal to or less than 800m². The application does not comply with any other parts of this code.

COMPLIANCE DISCUSSION

Hillslopes Overlay CodeThe removal of the trees will not have any detrimental impact on slope stability as the lots are flat or have a moderately slope. The removal of the tree will have an adverse impact on the amenity and the biodiversity of the area as old mature tree provide hollows that are important nest sites to a wide range of native birds.

Vegetation Conservation & Waterways Significance Code:

The proposed removal of the trees does not comply with this code. The small size of the lots, large style of house being constructed in this area and the mature nature of many of the trees will however most likely result in the removal of almost every tree once houses are built on these lots. The cost of removal of these trees becomes increasingly expensive as houses are constructed on neighbouring lots. The small size of the lots makes it very difficult to design a house that will not require the removal of the tree due to its position or encroachment of the house into the Tree Protection Zone and/or Structural Root Zone. Some existing trees have become potentially unstable and due to excavation works on neighbouring lots that have intruded into the Structural Root Zone.

Vegetation Management Code:

Complies only with A1.1 of the code; The vegetation damage occurs on a lot size equal to or less than 800m².

Legislative Discussion:

Section 347 of the Sustainable Planning Act 2009 states that a condition must not be inconsistent with a condition of an earlier development approval still in effect. Council correspondence dated 17 December 2013 stated that the earlier Reconfiguration of a Lot Permit (8/13/882) continues to have effect due to delivery of the initial stages of the subdivision.

Condition 8 relates specifically to the retention of vegetation on traffic carriageways, footpaths, service lines and as a result of other on-street works. Officers are of the opinion that approval of the subject application to clear vegetation on freehold lots does not conflict with the earlier approval for the Reconfiguration of a Lot. A condition is proposed on the subject application which requires retention of vegetation within the Road Reserve.

The applicant submitted a Landscaping Plan with the Operational Works Application on 31 July 2006 in accordance with the requirements of Condition 9 of the original Decision Notice for the Reconfiguration of a Lot (8/13/882). Among other items, the Landscaping Plan detailed the location of existing vegetation to be retained as a result of the reconfiguration. Officers are of the opinion that Approval of the subject application does not conflict with the earlier approval for the Reconfiguration of a Lot as Condition 9 does not preclude a land owner making application for Operational Works (Native Vegetation Clearing). In the interest of public safety and locating a House on each of the lots Officers support the application for clearing vegetation.

APPENDIX 2: VEGETATION CLEARING SCHEDULE

A site inspection carried out by Bob Jago (Environmental Officer) on the 13th January 2014 confirmed that the following trees are to be removed.

Lot 101 on SP214833

This allotment has an area of 600m² and is covered by the Vegetation Conservation and the Hillslopes Overlay Codes. The applicant proposes to remove all five existing trees from this lot.

Tree No. 1 on the plan attached to the application is a specimen of Red Molloy Box (Eucalyptus leptophleba) approximately 13 metres tall with a stem of 47 centimetres at breast height (dbh). This tree has a pronounced lean towards the southwest but otherwise appears to be in good health.

Tree No. 2 on the plan attached to the application has been recently removed. This trees was a specimen of Clarkson’s Bloodwood (Corymbia clarksoniana) approximately 20 metres tall with as stem of 65 centimetres dbh. A stump and coppice shoots are all that remain of this tree.

Tree No. 3 on the plan attached to the application is a specimen of Forest Red Gum (Eucalyptus tereticornis) approximately 15 metres tall with a stem of 35 cm dbh. This tree appears to be situated on the adjacent Lot 930 on SP214833. The applicant wishes to remove this tree prior to a house being constructed on Lot 101 as this tree leans towards this allotment.

Tree No. 4a on the plan attached to the application is a specimen of Forest Red Gum (Eucalyptus tereticornis) approximately 20 metres tall with a stem of 65 cm dbh. This tree appears to be in very good condition.

Tree No. 4b on the plan attached to the application is a specimen of Blush Cudgerie (Euroschinus falcatus var. falcatus) approximately 15 metres tall with a stem of 35 cm dbh.

Tree No. 5 on the plan attached to the application is a specimen of Red Ash (Alphitonia excelsa) approximately 10 metres tall with a stem of 20 cm dbh. The stem has suffered damage and may possibly be hollow.

Lot 119 on SP214833

This allotment contains numerous trees; most are not indicated on the plan attached to the application. The 17 trees present on this allotment have been renumbered from left to right from the street frontage. This allotment has an area of 610m² and is covered by the Vegetation Conservation and the Hillslopes Overlay Codes. The applicant proposes to remove all 17 existing trees from this lot.

This tree is host to specimens of the Vulnerable Ant Plant (Myrmecodia beccarii). A permit to relocate these epiphytic plants will be required from the Department of Environment & Heritage Protection prior to the removal of this tree.

Lot 903 on SP214833 (Future Lot 122)

This section of Lot 903 forms the rear boundary with Lot 121. The 2 large trees adjacent to the rear boundary with lot will pose a danger to any house constructed on Lot 121.

Tree No. 1 is a specimen of Forest Red Gum (Eucalyptus tereticornis) approximately 30 metres tall with a stem diameter of 100 cm dbh. This tree has suffered extensive damage to both the Structural Root Zone and the Tree Protection Zone by the excavations necessary for the installation of the 150 mm sewer main and manhole. This tree leans towards the centre of Lot 121 and is structurally unstable.
