  • Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:

    A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

    As of 2014/03/05, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property.

    As of 2014/03/05, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses.

    I am a qualified person and have the qualifications required by section 5 of the regulation.

    I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

    I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.

    PHASE ONE CSM NOTES

    SUPPORTING INFORMATION TO SATISFY TABLE 1, SCHEDULE D, PART VI OF THE RSC REGULATION

    1. Based on the findings of the Phase I ESA, no potential contaminating activities [“PCA”] were identified on the Phase One ESA property or within the Phase One ESA Study Area and no area of potential environmental concern [“APEC”] was identified on the RSC property.

    2. There are no water bodies in whole or in part on the RSC Property. A tributary of the West Humber River is located roughly 175 metres east of the eastern limit of the Phase One ESA property and roughly 30 metres west of the western limit of the Phase One ESA property. Both tributaries flow from the northwest to the southeast toward Lake Ontario. Salt Creek is also located roughly 520 metres west of the western limit of the Phase One ESA property and flows from a northwest to southeast direction. The local and Regional groundwater flow direction is inferred to the southeast toward Lake Ontario.

    3. There are no areas of natural significance located in whole or in part on the RSC Property. There are two [2] tributaries of the Humber River located within the Phase One ESA Study Area.

    4. There are no groundwater drinking wells located on the RSC Property. Eight [8] groundwater drink wells and two [2] groundwater monitoring wells are located within a 250 metre radius of the boundaries of the RSC Property [as illustrated on the attached CSM Drawing].

    5. The proposed development on the RSC Property will be serviced with buried utilities, including storm and sanitary sewers, a municipal water supply, hydro and other soft services. The depth and location of these service trenches are not anticipated to affect, direct or alter the migration of potential off-site contaminants. There are currently no services present on the RSC property.

    6. SOIL-MAT ENGINEERS & CONSULTANTS LTD. did not undertake a site specific geotechnical investigation on the RSC Property. A review of the Ministry of Northern Development and Mine’s “Pleistocene Geology of the Bolton Area, Southern Ontario Sheet Map P0477” and the “Paleozoic Geology of the Bolton Area, Southern Ontario Sheet Map M2338”, revealed the Site to be underlain by a lacustrine complex of stratified or non-stratified clay to silty clay loam or silty clay to silty clay loam till with the western edge of the Site being underlain by modern alluvium of silt, sand and gravel, in turn, underlain by Upper Ordovician Georgian Bay Formation shale bedrock. Depth to bedrock is anticipated to be approximately 4.5 metres below the existing ground surface elevation based on information ferreted out from water well records for wells located within the Phase One ESA Study Area and the Pleistocene Geology of the Bolton Area, Southern Ontario Sheet Map P0477.

    7. The validity of the CSM may be affected if the future use of the RSC Property diverts from the current understanding of the proposed development to include the installation of multi-level basements or deep groundwater wells that may artificially alter or redirect local groundwater toward the RSC Property. However, as the Phase One ESA Study did not reveal any PCAs within the Phase One ESA Study Area it is recommended that intrusive soil and/or groundwater sampling and monitoring would not be required in this scenario.
