Wang earned his undergraduate degree at the University of Texas at Austin. After graduation, he pursued his jurisprudence degree at the University of Pennsylvania Law School and his medical degree at the University of Texas Southwestern Medical School at Dallas. He continued his education at Harvard School of Public Health where he graduated with a Master’s of Public Health. He then completed an internship and residency in internal medicine at Duke University Medical Center followed by a fellowship in cardiology at University of North Carolina Hospitals. Endocarditis Prophylaxis for Dental Procedures…Revisited

The Medical Letter (v54, Sept. 17, 2012) publisheda review of recommendations for endocarditis

prophylaxis for dental procedures. Since 2007, antimicrobialprophylaxishasbeenrecommendedonlyforpatientsathighestriskof severeconsequences frominfectiveendocarditis. Thereis no indication that more limited use of dental prophylaxissince thenhas led toan increase in the incidenceof infectiveendocarditis. Theriskofsevereconsequencesofendocarditisishighestinpatientswithpreviousinfectiveendocarditis,prostheticheartvalves, or unrepaired congenital heart disease, including thosewithsurgicallyconstructedpalliativeshuntsorconduits.Patientsarealsoconsideredathighestriskduringthefirst6monthsafterrepair of congenital heart defects with prosthetic material, orwhentheydevelopcardiacvalvulopathyafteracardiactransplant.Thereisnoevidencetosupporttheuseofantibioticprophylaxisbeforedentalproceduresforpatientswithprostheticjoints.

beginning to a busy holiday seasonrapidly approaches, we are all findingourselvesextremelybusy.However,weshouldnotforgettostopandgivethanks

forallthatwehave.Formyself,Iamverythankfulformyfamily,friends,profession,andthiscountrythatIlivein. I feelthatweshouldallbethankfulforourchosenprofession.Ithelpsustohelpthosewhoaresufferingwhileallowingustohaveagoodlife.Weshouldnottakethisforgranted.Organizeddentistryhelpsus tomaintainwhatwehaveworkedsohardtoachieve.OurlocalsocietyprovidestimelyCEcourses,fellowship,advocacy,andpeerreview,tonameafew. Onthestatelevel,theTDAdoesatremendousjob.AsanyonewhohasbeentotheannualsessioninSanAntoniocouldtellyou,theopportunityforCEdoesn’tgetanybetter.Finally,letusnotforgetwhattheADAdoesforallofus.Theyhelpfundtheresearchthatkeepsourprofessionmovingforward.Theyfightforusonthenationallevelsothatwecanmaintainourpractices.Theyareourvoice. Buttheycannotdoallof thisalone. Onthe locallevel,theSocietyandBoardhelpstofightforyourrightssothatthecitydoesnotdictatehowwepractice.OntheState level, DENPAC, the political action committee oftheTDA,isourvoiceinstategovernment.IfyoulookontheDENPACwebsite,theyhavetheirmissionstatementoutlined“DENPAC,thegeneralpurposeactioncommitteeoftheTexasDentalAssociation,isavoluntary,non-profit,unincorporatedgroupofdentistswhosegoalistoinfluence

the nomination or election of state candidates whohave demonstrated their concern for the preservation ofdentistryasanindependentprofession,andforthedentalhealthofthepeopleofTexas.”ItisvitalthatallmemberssupportDENPAC,especiallynow.Ifwearetokeeplawsandregulationsfromimpedingourcareofpatients,wemusthaveavoice. Doyouwantsomeonemakingregulationsregardingthepracticeofdentistrywhohasnotrainingorscientificknowledgeofdentistry? Finally,onthenationallevel,theADAhasADPAC.According to the ADPAC website, of the 535 members

ofCongresswhoaredecidingonbillsthatdirectlyinfluencethepracticeofdentistry, there are only two dentistsserving in the House and Senate.ADPACsupportscandidateswhoarestrong advocates for dentists and thepatientstheyserve.

When I first joined organized dentistry, I didnot appreciate the full impact of all that DENPACand ADPAC do for us. I felt that this was just anotheryearlyduesthatwehadtopay.ButasIhavebeenintheprofession,Icanseethemanyfacetsthatwefacethataretryingtounderminedentistry. Weface issues fromthirdpartyproviders,MedicareandMedicaidissues,andissuesthatstemfrom“junk”scientificresearchthatunfortunatelyswayspublicopinion. Consider supporting organized dentistry today, sothatnextyearatthistime,wecanallstillbethankfulfortheblessingsthatdentistryhasbroughtus.

The Texas Medical Privacy Act,alsoknownasHB300,becameeffectiveonSeptember1,2012.TheTexaslegislaturefeltthatthefederalprivacyact,HIPAA,waslackinginseveralareasofprotectionandenforcementofsecurityandprivacyofprotected health information(PHI).Theactalsograntsenforcementauthoritytoavarietyofstateagencies.

CoveredentitiesaremandatedtotrainallemployeesonHB-300.

Protected Health Information

Dental practices are “Covered Entities”under the Health Insurance Portability and

Accountability Act of 1996 (HIPAA) Privacy andSecurityRules.Assuch,theyarerequiredtohavepoliciesandprocedurestosafeguardtheprivacyandsecurityoftheirpatients’ProtectedHealthInformation(PHI).ThePrivacyRulegivesindividualsrightsovertheirPHIandsetsrulesandlimitsonwhocanlookatandreceivethathealthinformation.TheSecurityRuleprotectsPHIinelectronicformbyrequiringentitiescoveredby HIPAA to use physical, technical, andadministrative safeguards to ensure thatelectronicPHIremainsprivateandsecure.In 2009, a new reporting requirement forHIPAAbreacheswasaddedbytheHealthInformation Technology for Economicand Clinical Health (HITECH) Act andrule.UnderHITECH,ifthereisabreachof unsecured PHI, there are notificationrequirements to the patients, to the Secretary of theU.S.DepartmentofHealth&HumanServices(HHS),andforcertainbreaches,tothemedia.ThenotificationrequirementsapplytoelectronicandnonelectronicPHI. The penalties for HIPAA violations can be verysubstantial, including high civil monetary penalties

and in some cases, criminal penalties. The Office ofCivilRights(OCR)ofHHShaspursuedsomeCoveredEntities after they filed a breach notification underHITECH. Thus far, in2012,OCRhas settledwithatleast three Covered Entities after they filed requiredbreachnotifications. Theseinclude(1)insuranceplansettlingtopay$1.5millionaftertheftof57unencryptedcomputerharddrives,(2)statehealthandsocialservicesdepartmentsettlingtopay$1.7millionaftertheftofUSB

President Elect’s Report: Dr. Witcheta reported for Dr. James. Reviewed upcoming General Meeting CE.

Editor’s Report: Dr. Tom Wicheta reported for Dr. Kelp. Reminded the Board that Dr. Kelp will be leaving the Editor position in May 2013 and encouraged the Board to begin the process of replacing him.

Committee Reports: •Capital Area Dental Foundation: Dr. Stan LaCroix reported on Foundation

activities. Foundation is a member of the CTDC, 14 member organizations dedicated to access to care. Dr. Kelly Keith reported that the Gala is Feb. 16, 2013 at the Four Seasons Hotel. Sponsorship activity has started with an emphasis on young dentist participation.

•Judicial: Dr. Don Taylor announced 8 new member applications. The Doctors are: Ketan Amin, Seth Briggs, Brittney Espinoza, William Hughes, Ross Maddox, Vincent Morales, Gabriela Rosas and Kendra Sandoval. Motion was made to accept the new members. Motion#120911BM Rouch/Cronin—Passed

•New Dentist: Dr. Annalisa Heck reported on ongoing activities.•Sponsorship Committee: Dr. Wayne Radwanski mentioned some sponsors

are not renewing due to lack of member interest at the general meetings. He emphasized the necessity for the Board to recognize them as much as possible at the meeting. Discussion about ways to add value to the Sponsor experience at the general meeting. At September General Meeting, sponsors will be allowed to speak to group for one minute.

•DenPac: Dr. Kelly Keith reported contributions are slightly below average. Discussed the importance of DenPac in light of the record legislative turnover and the necessity of making our positions clear to the incoming elected individuals. Reminded all in attendance of Legislative Day on February 20, 2013.

•Dental Hygiene Advisory Committee: Dr. Jerry Katz discussed plans for a CE event with Dr. Sam Lowe.

•Peer Review: No new Peer Review cases.

President’s Report: Discussion around the importance of selecting a proper replacement for Editor.

Old Business: Discussion of reported City of Austin inspections for hazardous waste disposal.

Conclusion and Adjournment: The gavel was passed, and the meeting was adjourned at 7:24 p.m.
