Before working with a TexasREALTOR®, you should knowthat their duties depend onwhom the they represent.
The REALTOR® who liststhe property for sale representsthe owner. Your REALTOR®’ssole duty is to ensure that yourhome sells quickly, easily, andat a suitable price.
All brokers must treat youhonestly and fairly regardlessof whom they represent.
If you choose to have aREALTOR® represent you,you should enter into a writtencontract that clearly establishesthe obligation of both partiesand specifies how your REAL-TOR® will be compensated.SStteepp 22:: SSeettttiinngg aa pprriiccee

Regardless of what you orig-inally paid for your home andthe cost of improvements youhave made, the only price thatmatters is what the market willbear at the time you decide tosell. Whether or not you get anappraisal, your REALTOR®
can develop a comparativemarket analysis. Once you’ve decided on aprice range, the REALTOR®can help you calculate an esti-mated amount you might netfrom the sale.
If you have owned yourhome for several years, youmay have built up sizable equi-ty. Equity is the differencebetween the value of yourhome and the balance on yourmortgage. After subtractingwhat you owe on your mort-gage, ask your REALTOR®what costs you will incur inclosing.
These may include title fees,taxes, a penalty for prepayingyour mortgage, brokeragecommission, attorney fees, andcharges for preparing andrecording documents. It’s possible that a REAL-TOR® from another companywill find a buyer for your home.In that case, your broker is thelisting broker, and the secondagent is the cooperating broker.Many times the listing brokerwill agree to pay the cooperat-ing broker a fee from theamount you pay the listing bro-ker. The listing agreement willspecify how long you agree tolist your house with a company.You want a period that’s long

Remember that the listingagreement is a contract. Youshould get a copy for yourrecords. Your REALTOR® isbound to the terms just as youare. Preparing your homeIn preparing your home forviewing by prospective buyers,remember that people buy onemotions. Your home has tofeel right, or buyers will lookelsewhere. Ask your REAL-TOR® and some honest friendsto look at your home objective-ly and suggest ways to makeyour home more inviting andsellable. Consider both theexterior and interior. Since youwill be appealing to buyers’feelings, you need to pay atten-tion to detail. An extra $50 youspend on red geraniums or newbath towels might mean a sig-nificant increase in a buyer’soffer.
Clean your home thoroughlyand make minor repairs such
as tightening towel racks andgluing wallpaper edges. Forlarger repairs, consult yourREALTOR® as to whetherrepairing the item will generatea good return on the sale.Repainting the woodwork maybe worth it, but replacing thecarpet may not. If your home has a majorproblem you don’t intend tocorrect, be candid about it.Don’t paint over the watermarks on the ceiling to hide aleaky roof. In anage when lawsuits are as com-mon as family sit-down din-ners, it pays to be open abouteverything.
You should consider includ-ing a one-year residential serv-ice contract with the sale ofyour home. This buyer perk is acommon practice and helpsease concerns. The offer may be contingenton the buyer selling a homefirst or obtaining an inspection.Ask your REALTOR® howthese terms affect you andwhether the offer is in line withthe market. The range of containers in
which to grow vegetables has
expanded, too. From classical
glazed and footed urns and
upside-down tomato and pep-
per baskets to $5 party tubs
drilled with drainage holes,
mixed containers that supply
food as well as ornamentation

container gardening, Pamela
Crawford, recently published a
colorful how-to manual that
addresses the questions of
beginners as well as longtime
gardeners intrigued by the idea
of combo containers whose
"thrillers" are vegetable plants.

Adjustable rate mortgages(ARMS) have interest rates ormonthly payments that can goup or down over time. Thesemortgages typically start outwith a lower interest rate,lower monthly payments, andlower fees and points thanfixed rate mortgages and oftenappeal to first-time homebuy-ers, younger couples whoexpect their incomes to growin the coming years, and peo-ple who might not have muchcash for down payment andclosing costs.
If you consider an adjustablerate mortgage, ask the lenderto explain the terms fully. Askabout the interest-rate cap (themaximum rate you will becharged no matter how highrates go in the market), theindex that will be used to cal-
culate future interest rates, andhow index charges will affectyour mortgage.

From the lender’s viewpoint,approving the loan, based onyour financial standing, is onlypart of the risk; the other partis the property itself. Thelender may require an apprais-al to verify that the home isworth the loan as well as aphysical survey to discover anyencroachments on the proper-ty. Repairs may be required.Insurance must be purchased.Verifications of employment,
deposits, and other mattersmust be obtained. Loan docu-mentation and conveyanceinstruments must be drawnand approved. In addition, thetitle company must researchthe title and arrange for payingoff any liens, taxes, and othercosts. All these conditions andothers must be satisfied beforea transaction can close. weeks or even months ofresearch and decision making.The closing could last less thanan hour but may take longer,depending on the complexityof the transaction. If buying a home were stict-ly a cash transaction, youwould simply hand over themoney and receive the deed.More than likely, however, youare borrowing money for thehome, which means that youare actually making two trans-actions—acquiring the loanand buying the home.
As a borrower, you will signa note promising to repay theloan and a deed of trust (alsoknown as the mortgage) pledg-ing the house (or other collat-eral) as security for the note.You will also sign numerousother papers includingacknowledgments, disclosures,surveys, certificates, etc. Besure to read each documentcarefully. Imaging audits are a powerful way to
diagnose your home’s energy efficien-
cy. The auditor uses a thermal imaging
camera to quickly identify thermal

ples of flaws are: improper wall insula-
tion, open areas in the attic that may
disturb loose fill insulation, uncon-
