Motor vehicle collisions are the #1 cause of employee fatalities (OSHA) and distracted driving is

now one of the most significant contributing factor to these collisions.

Cost to Employers

The cost to employers of distracted driving crashes is high – not just in lives lost, healthcare costs, and vehicle repair costs, but in the millions of dollars paid out in liability cases. The annual cost of crashes caused by cell phone use is estimated at $43 billion or approximately $120 million every single day of the year (Harvard Center for Risk Analysis).

Employers can be held liable if a driver responsible for a crash was using an employer-owned

or personal cell phone.

In the past ten years, distracted driving crashes have resulted in companies paying millions in restitution, ranging from $1.5 to $24.7 million, to victims injured by negligent driving of an employee distracted by a cell phone.

It’s your legal responsibility and obligation to eliminate this needless, deadly risk!

II The Science of Distracted Driving

The focus of this program is on cognitive distractions.

It is common sense to know that taking your hands off the wheel or your eyes off the road is

dangerous, but it is just as important to understand how dangerous it is to take

your mind off the task of driving.

II The Science of Distracted DrivingRisk and FrequencyOur crash risk associated with distracted driving

depends on two factors:1. Attentional demands (visual, manual, cognitive)

of the distracting task2. Frequency of the task

Risk and FrequencyData on the increased risk of crashes for a given

distraction. Drivers know when they are visually and manually distracted and minimize the amount of time on the distraction. The same is not true for cognitive distractions. We are less aware of this type of distraction. As a result the distraction lasts longer.

II The Science of Distracted DrivingHands-Free vs. Handheld

The NSC has compiled more than 30 research studies and reports by scientists around the world that used a variety of research methods, to compare driver performance with handheld and hands-free phones.

All the studies show hands-free phones offer no safety benefit when driving because…Hands-free devices do not eliminate cognitive distraction.

II The Science of Distracted DrivingCell Phone Use vs. Under the Influence

Talking on a mobile device while driving is comparable to driving while intoxicated at

a blood alcohol concentration of .08 and has four times the crash risk.

II The Science of Distracted DrivingTexting While Driving

Texting on a mobile device while driving puts you at even greater risk, up to 23 times the crash risk; recent studies have shown that using voice-to-text is more distracting than texting by hand.Although texting is clearly riskier because it involves all three types of distraction - visual, manual and cognitive, NSC data shows that drivers talking on a cell phone are involved in many more crashes than drivers texting. In a recent study, NSC conservatively estimated 21% of crashes, or 1.2 million crashes, involved a driver talking on a cell phone as compared to 5% of crashes, or 281,000, involved a driver texting.

III Understanding the Distracted Driver

The central findings of extensive research and multiple scientific studies confirms

cognitive distraction due to mobile devices, handheld or hands-free, impairs driving ability.

The conversation, not the device, creates the distraction and the danger.

III Understanding the Distracted DriverCan the Brain Multitask?

By definition, multitasking is…the ability to perform two or more tasks simultaneously.

But is the human brain actually capable of multitasking?

Attempting to multitask two cognitive tasks can reduce productivity by approximately 40 percent.

III Understanding the Distracted DriverCommon Driver Errors Drivers make two common errors when they

are cognitively distracted:

1.Inattention blindness2.Slower response and reaction time

III Understanding the Distracted DriverDriver Confidence and Self-Awareness

Even though they recognize distracted driving is dangerous, many drivers mistakenly believe their own crash risk is lower than other drivers. Most drivers believe they are personally capable of driving safely while using their mobile device, even though they believe other drivers cannot drive safely while using a mobile device.

IV What’s at Risk? This session looks at the following:

Societal impact Corporate impactPersonal impact of distracted

driving

32

Page 33: October 29, 2015 Reduce Corporate Liability Risks and Costs with DDC Distracted Driving Online 1

IV What’s at Risk?Societal Impact: Financial Cost

A Harvard risk analysis study estimated the annual direct cost of crashes caused by cell phone use while driving to be $43 billion, which amounts to approximately $120 million every single day of the year! The direct costs of these crashes are just the tip of the iceberg. The indirect costs more than triple the financial impact on us as a society.

IV What’s at Risk?

Corporate impactBut beyond the safety issues and direct costs

associated with an employee crash, employers and employees are now being held responsible.

Lawsuits are becoming commonplace, resulting in multi-million dollar awards payable by employers

and their insurers when employees were involved in motor vehicle crashes while using cell phones.

.

IV What’s at Risk?Personal ImpactPersonal impact can involve loss of life,

injury, and financial and legal ramifications, but from all the accounts, the worse

consequence for a distracted driver who causes a crash where someone is injured or killed is being sentenced to a lifetime of guilt.

36

Page 37: October 29, 2015 Reduce Corporate Liability Risks and Costs with DDC Distracted Driving Online 1

Distracted Driving OnlineV What’s Being Done?

Societal ImpactEvery year in the United States, distracted driving

claims the lives of thousands and results in hundreds of thousands of injuries. The NSC conservatively estimates that 1 out of every 4 collisions is due to distracted driving this equals 1.3 million collisions resulting in more than 400,000 injuries and over 3,000 deaths each year.A distracted driving collision occurs every 24 seconds.

37

Page 38: October 29, 2015 Reduce Corporate Liability Risks and Costs with DDC Distracted Driving Online 1

Distracted Driving OnlineV What’s Being Done?

Addressing Distracted DrivingThe growth of cell phones and smart phones isn’t the

only cause for concern. In-car technologies, such as navigational displays, Internet browsers, and voice based features, present new challenges for drivers. Many of these technologies are proving to increase the cognitive load for the driver and create additional distraction.

38

Page 39: October 29, 2015 Reduce Corporate Liability Risks and Costs with DDC Distracted Driving Online 1

Distracted Driving Online

V What’s Being Done?As more and more people are killed and injured

by distracted driving, more and more advocates join the cause to create awareness and

influence our policies at every level:•Federal•State•Corporate•Most importantly, the policy of every

individual driver

39

Page 40: October 29, 2015 Reduce Corporate Liability Risks and Costs with DDC Distracted Driving Online 1

Distracted Driving OnlineV What’s Being Done?

Corporate PolicyIn addition to laws, many companies are instituting polices against cell phone use and driving. Employers can and have been held liable for actions of their employees, even though those actions are still allowed by federal regulation or state law. However, with the intense publicity surrounding cell phone and mobile device distracted driving, it would be difficult for employers to argue that they’re not aware of the dangers. Employers have a legal duty to provide a safe work environment to its employees.
