    Legal Affairs, Office of the President of the Philippines to Hon. City Mayor Mauricio G.Domogan, requesting submission to their office on or before 17 April 2013 of His Honor'scomments and recommendation regarding the request of Onjon Ni Ivadoy Association Inc.;and

    [b] Letter dated 16 April 2013 of Regional Executive Director Clarence L. Baguilat,DENR-CAR, Baguio City to Hon. City Mayor Mauricio G. Domogan, requesting commentregarding the request of Onjon Ni Ivadoy Association Inc.

    The Committee on Tourism, Special Events, Parks and Playgrounds recommends to furnishthe Office of the President of the Philippines and the DENR-CAR the minutes of the meetingwhen Resolution No. 182, series of 2010 dated August 16, 2010 entitled, "DESIGNATINGTHAT PORTION OF BURNHAM PARK BETWEEN THE CHILDREN'S PLAYGROUNDAND THE CITY ORCHIDARIUM AS SITE FOR THE MATEO CARIO MONUMENTAND AS AN IBALOI HERITAGE GARDEN" was approved.

    The minutes of the meeting is clear as to the intent of the Council in approving the saidresolution. The intent is for the portion of Burnham Park between the Orchidarium andChildren's Park to be designated as Ibaloi Heritage Garden with a Mateo Cario Monument.It will be part of the Burnham Park Master Development Plan as conceived by the Universityof the Cordilleras. The construction and management of the garden and monument will bedone by the City Government of Baguio.

    May it be stated that the City Government of Baguio recognizes the indispensable contributionmade by the Ibalois and being the original and indigenous inhabitants of the City of Baguiohence the city government institutionalized the Ibaloi Day and made it a regular activity of thecity government.

    The application therefore of Onjon Ni Ivadoy Association, Inc. with the Office of the Presidentto delineate the Ibaloi Heritage at Burnham Park under their management and control maynot be in consonance to the approved resolution. The intent is clear that the designated areashall be to give honor and recognition to the Ibaloi through the installation of the MateoCario Monument and designating the same as Ibaloi Heritage Garden and the citygovernment is to maintain that area of Burnham Park.

    The committee suggest that the Onjon Ni Ivadoy Association, Inc. instead submit anapplication to adopt the park under the adopt-a-park program of the city subject to rules andregulations as implemented by the city government. (Item 3, 30 September 2013 Agenda)

    (NOTE: [a] Ordinance No. 09, s. 2013 institutionalized the Ibaloi Day and making it a regular activity of theCity of Baguio.[b] Resolution No. 182, s. 2010 designated that portion of Burnham Park between the Children's Playgroundand the City Orchidarium as site for the Mateo Cario Monument and as an Ibaloi Heritage Garden.[c] Resolution No. 395, s. 2009 declared February 23 of every year as Ibaloi Day in the City of Baguio, incommemoration of the recognition of the United States Supreme Court of Nati ve Title for Ibaloy Leader MateoCario.)[d] The following personalities were requested to be present in todays meeting to be one of the resourcepersons relative to the above request:

    4. Committee Report Nr. EGAP-2013-027Proposed Resolution Nr. PR 074-13 introduced by Hon. Leandro B. Yangot Jr. and Hon. Fred L.

    Bagbagen entitled, "Inviting the Human Resource Management Officer and the Local FinanceCommittee to explain and to give details on whether or not Executive Order No. 80 can apply toofficials and employees of the City Government of Baguio."

    The Committee on Ethics, Governmental Affairs and Personnel recommends APPROVAL ofthe foregoing resolution.(Item 4, 30 September 2013 Agenda)

    (NOTE: Executive Order No. 80 reads, "Directing the adoption of a Performance-Based Incentive System for

    government employees was signed by His Excellency President Benigno Simeon C. Aquino III on 20 July2012 which establishes and implements a Performance-Based System that will motivate higher performanceand greater accountability in the public sector and secure the accomplishment of commitments and targets".[b] The following personalities were requested to be present in todays meeting to be one of the resourcepersons relative to the above proposed resolution:

    5. Committee Report Nr. MARKET-2013-008Letter dated 04 October 2012 of Ms. Lourdes S. Santos, regarding Stall No. 75, Fish Extension, City

    Market, Baguio City.

    The Committee on Market, Trade and Commerce recommends to adopt the recommendationsof the Hon. Mayor Mauricio G. Domogan, Chairperson of the Baguio City Market (BCMA) ascontained in his letter dated November 9, 2012 denying all the herein letters of requests forreconsideration. The Committee further recommends to UPHOLD the validity of the awardof the subject stalls at the City Market, Baguio to the respective winning bidders and thelatter's right to peacefully occupy the same.

    Hon. Peter C. Fianza, Member of the Committee signified, "To file a corrective proposedordinance."(Item 4, 23 September 2013 Agenda)

    (NOTE: The above matter is related to the following:[a]Letter dated 18 September 2012 of the heirs of Agustina Dizon represented by Ms. Remedios Dizon-Castillo,praying that a resolution be rendered granting their appeal for the declaration as null and void the award of Stall No.

    13, Entrails Section, Baguio City Market to the winning bidder and ordering the lease rights be reverted back to them.[b] Letter dated 02 July 2012 of Ms. Remedios Castillo, requesting action on her appeal for the awarding of Stall 13,Entrails Section, Baguio City Public Market. This was forwarded to the Committee on Market, Trade and Commerce

    on 04 July 2012.[c] Letter dated 29 May 2012 of Ms. Corazon S. Gonzales, Atty-In-Fact/daughter of Ms. Teresita Santos-Gonzales,following up their appeal that the lease right over Stall No. 74, Fish Extension Section, City Market be reverted back toher mother. This was forwarded to the Committee on Market, Trade and Commerce on 30 May 2012.[d] Letter dated 12 April 2012 of Ms. Remedios Dizon Castillo and Ms. Corazon Gonzales, reiterating their letter datedMay 24, 2011 regarding their appeal for the awarding of different stalls at Fish and Entrails Sections, Baguio PublicMarket. This was forwarded to the Committee on Market, Trade and Commerce on 16 April 2012.[e] Letter dated 11 April 2012 of Ms. Remedios Dizon Castillo and Ms. Corazon Gonzales requesting clarificationregarding the 3rd Indorsement dated 08 June 2011 of the Sangguniang Panlungsod ng Baguio forwarding to theBaguio City Market Authority (BCMA) for comment the following:

    a. Letter dated 24 May 2011 of Ms. Lourdes Santos to Mr. Policarpio Tamayo, Baguio City Market Authority:

    1. appealing reconsideration on the implementation of Resolution 001-09 of the Baguio City Market Authority[cancellation of lease contract of Lourdes Santos for stall numbered 75 Fish Extension]; and

    2. praying that the award of Stall No. 75, Fish Extension, City Market, Baguio City be declared null and void andthe lease rights be reverted back to her.

    b. Letter dated 24 May 2011 of Ms. Corazon S. Gonzales, Atty-in-Fact of Teresita Santos Baltazar to Mr.Policarpio Tamayo, Baguio City Market Authority:1. appealing reconsideration for the awarding of Stall 74, Fish Extension Section, Baguio City Public Market; and

    Committee Report Nr. EMPLOY-2013-010Proposed Resolution Nr. PR 046-09 of Hon. Nicasio M. Aliping Jr. Establishing livelihood andtraining program in the City of Baguio.

    The Committee on Employment, Livelihood, Cooperatives and Persons With Disabilities(PWD) recommends APPROVAL of the above proposed resolution.

    Further, the members of the committee adopt to be the authors of the said resolutionconsidering that the proponent is no longer a member of the City Council. (Item 5, 30 September 2013 Agenda)

    8. Committee Report Nr. EMPLOY-2013-011Proposed Resolution Nr. PR 183-09 of Hon. Vice Mayor Daniel T. Farias Temporarily convertingthe Irisan dumpsite to a livelihood facility for the constituents of Irisan Barangay.

    The Committee on Employment, Livelihood, Cooperatives and Persons With Disabilities(PWD) recommends APPROVAL of the above proposed resolution.

    12. Committee Report Nr. PWORKS-2013-018Resolution No. 87-13 of Hillside Barangay, Baguio City, "A Resolution approving the realignmentof a barangay project entitled, 'Rehabilitation and repair of damaged flood control located along the

    creek of Puroks 3 & 5 between Miras and Flores families' into 'Purchase and installation of CloseCircuit Television (CCTV) for Hillside Barangay' in the amount of Two Hundred Thousand Pesos

    (Php200,000.00)."

    The Committee on Public Works regretfully DENIES the above request realignment for thefollowing reasons, to wit:

    Under Item No. 3.0 of Joint Memorandum Circular No. 2011-1, of DILG-DBM dated April 13,2011, provides specifically the programs and projects to which the 20% development fundshall be utilized. Purchase of Close Circuit Television (CCTV) does not fall to any of theprojects mentioned.

    Further, under Item No. 4.6 of the said Joint Memorandum Circular, which mentions theexpenditure items not covered by the 20% Development Fund, Close Circuit Television(CCTV) falls under administrative office equipment, thus, realignment for the purchase of thesame is not allowed.(Item 10, 30 September 2013 Agenda)

Aquino III, President, Republic of the Philippines, to order theDepartment of Environment and Natural Resources, Cordillera Administrative Region (DENR-

    CAR) to stop and hold in abeyance the processing and issuance of titles under RA 10023 (FreePatent Law) and the National Commission on Indigenous Peoples (NCIP) as regards the issuance of

    certificates of ancestral land title under RA 8371 (IPRA Law of 1997) pending request of MayorMauricio G. Domogan for investigation by the Baguio and Boracay Redevelopment Committee-Technical Working Group over the titling of critical government reserves and other related issues."

    The Committee on Urban Planning, Lands and Housing recommends the following:

    1. With respect to the issue on Free Patent, that the resolution be addressed to the DENRSecretary Ramon Paje instead of the Office of the President considering that it was the DENRCentral Office which acted on the denial of the city's request for free patent special guidelinesfor the City of Baguio.

    2. As to the second request addressed to His Excellency President Benigno S. Aquino III tostop and hold in abeyance the processing and issuance of titles under RA 10023 (Free PatentLaw) and the NCIP pending request of Mayor Mauricio G. Domogan for investigation by theBaguio Boracay Redevelopment Committee - Technical Working Group (TWG) over thetitling of critical government reserves and other related issues, the committee recommends

    Proposed Resolution Nr. PR 086-13 introduced by Hon. Fred L. Bagbagen entitled, "Requesting

    the Department of Environment and Natural Resources, Cordillera Administrative Region(DENR-CAR) to stop and hold in abeyance the processing and issuance of titles under RA 10023(Free Patent Law) pending request of the City of Baguio for the legal opinion of the Office of theSolicitor General as to whether or not RA 10023 is applicable in the city considering that it isgoverned by its own charter."

    The Committee on Urban Planning, Lands and Housing recommends APPROVAL of theabove proposed resolution.(Item 16, 30 September 2013 Agenda)

    19. Committee Report Nr. UPLH-2013-028Proposed Resolution Nr. PR 080-13 introduced by Hon. Leandro B. Yangot Jr. and Hon. KarminnCheryl Dinney D. Yangot entitled, "Respectfully appealing to His Excellency President Benigno S.

    Aquino III, President of the Republic of the Philippines to intercede and intervene in resolving themost serious problem of the City of Baguio which is the indiscriminate and unscrupulous titling byway of Certificates of Ancestral Land Titles (CALTS) by the National Commission on IndigenousPeoples (NCIP) of our remaining government parks, playgrounds, roads, reservations, forest andlands owned by the Government."

    Considering the urgency of the matter and in order to space the city's remaining parks,playgrounds, roads, reservation, forests as well as other government owned lands within theCity of Baguio from being titled in favor of private applicants, the Committee on UrbanPlanning, Lands and Housing recommends APPROVAL of the above proposed resolution.

    Let copy of this resolution be immediately forwarded to His Excellency President Benigno S.Aquino III for his information and consideration.(Item 17, 30 September 2013 Agenda)

    20. Committee Report Nr. WAYSC-2013-059Letter dated 08 July 2013 of Punong Barangay Bonifacio A. Bustos, Padre Burgos Barangay,

    submitting their Ordinance No. 01, series of 2013 entitled, An Ordinance enacting a comprehensivebarangay tax ordinance imposing taxes on retailers or entrepreneurs engaged in business within thebarangay, Baguio City, Philippines and for other purposes.

    In view of the foregoing compliance with Sections 186 and 187 of the Local Government Codemandating that ordinances levying taxes, fees, or charges shall be the subject of a publichearing prior to its enactment, as could be evidenced by the hereto attached minutes ofmeeting and attendance to the general assemblies, the Committee on Ways and Means andFinance, Cluster C, recommends FAVORABLE REVIEW of the subject barangay taxordinance.(Item 18, 30 September 2013 Agenda)

    The Committee on Ethics, Governmental Affairs and Personnel recommends APPROVAL ofthe foregoing proposed resolution.
