    Can you believe October is alreadyhere? It was just the other day whenwe welcomed 2013. Now Thanksgiv-ing and Christmas are just around thecorner. As for me, I'm so grateful for

    this month as I get ready to go toBrazil with my husband to visit myfamily. Our godchildren, twin girls,have been asking my sister and myparents daily when are we arriving. Iconfess that I don't know who ismore excited them or us.

    October will be a busy month for

    PAF. PAF is having the 2013 Fall

    Seminar hosted by the PAF PinellasChapter at St. Petersburg, FL on Oc-tober 5 at the Hilton St. PetersburgBayfront. The Seminar has been ap-proved by NALA for 7.0 hours ofCLE Credit, including 3.0 hours ofEthics. Following the Seminar, PAFwill be holding a Special Meeting for

    the purpose of adopting the pro-posed Amended and Restated Bylaws.Lastly, on Sunday, October 6, PAFwill be having a Board Meeting withthe Executive Committee and Chap-ter Presidents.

    I hope to see you at the Seminar andthe Special Meeting. I also hope tosee you at BPA's October Meeting atSuntree Country Club. This month

    The Board of Directors will be meeting onMonday, September 30,

    2013 at 6:00 p.m. at Perkins Restaurant, 8200 N. Wickham Road, Mel-bourne, FL 32940. Please feel free to attend if your schedule permits.

    Incentives for Members to Bring Guests: Our Chapters newincentive program is off to a huge success. In

    August we had five guests brought by 4 mem-bers and in September we had 17 guestsbrought by 7 members. The competition is

    growing among the members. Lets keep thosenumbers growing!!!!

    If you remember, the program offers a free raffle ticket for every guesta member brings to a meeting. The raffle ticket is for a chance to win aspecial basket that has been donated. Only those members bringing

    guests are eligible to participate in the raffle drawing. To kick off the newprogram we raffled a basket in August andJessica Pauleywas the grandwinner. The intent is to have a drawing at the end of every quarter fora basket. For every guest a member has brought to a meeting duringthe quarter, a ticket will be entered into the raffle.

    Plans for the PAF Fall Seminar 2014 Hosted by BrevardAt our next meeting, the Board of Directors will be working on com-

    mittee assignments for the seminar being hosted by our Chapter. Allthe site visits to the area hotels have been completed and the informa-tion has been forwarded to PAF. The next step is to formalize theSeminar Committee and develop a work plan. This seminar is a won-derful opportunity to showcase our Chapter and all that BrevardCounty has to offer.

    CALLING ALL MEMBERS: If you are new to our Chapter andare looking for away to get more involved and meet more people inthe organization, this is an excellent opportunity. If you have been amember for sometime but have not been active in any of the standing

    committees, this is an excellent opportunity to get involved and shareyour hidden expertise and experience. We will need people to helpwith seminar topics/speakers, recruitment of vendors, promotion ofthe seminar to our legal community, an evening reception, hospitalitysuite, items for gift bags, decorations, and volunteering at the seminar.

    E-Filing Questions and Answers(This Q & A was distributed at the September BPA Meeting in response to questions

    members had submitted in advance of the meeting)

    1. When will e-filing start for AP cases?

    We are in the process of updating the necessary codes to allow filing in AP cases at the local level(county to circuit). Filing with a DCA through the portal is being implemented incrementally. The2DCA is scheduled first. For updates, periodically check the News & Information section when youlog into the portal.

    2. Please list all the cases that will be on the e-filing system as of October 1, 2013.

    Brevard County will accept the following Case Categories as of October 1, 2013 CA, CC, SC, DR,CP, MH, GA, CF, MM, CT, TR, MO, CO, IN, CJ, and DP.

    3. Please explain the process of opening up a new civil case.

    We will be providing a demonstration.

    4. What about Orders that the Judges sign and give to the attorney's in court and tells the attorney tofile the order with the clerk's office. Can they be e-filed? Attorney doesn't want to go to the clerk'soffice and stand in line.

    Original orders signed by a judge need to be hand-delivered to the Clerks Office they cannot befiled through the portal.

    5. What about Default by the Clerk (can't e-file the envelopes) so do they have to be hand filed or canthey be e-filed and then when issued emailed back to requesting attorney and mailed out to all partiesfrom the attorney's office?

    Proposed Defaults cannot be filed through the portal. Upon receipt of a Motion for Default, theClerk will review the case and, if applicable, prepare a Default and mail it to the attorney.

    6. What about sending in a Writ of Possession can that be e-filed and emailed back to attorney's officewhen issued or does that still need to be hand filed.

    Currently, the only proposed process that can be submitted through the portal is a Summons. Weare developing procedures to allow other processWrit of Possession, Notice of Action, Writ ofGarnishment, etc.

    7. When will we be able to serve opposing attorneys through e-filing portal?

    An e-service component is currently in the testing phase. The Florida Courts E-Filing Authority an-ticipates that this functionality will be available in the very near future.

    8. 5 Day Summons for Evictions-what about the envelope(s) we provide to the clerk's office for you tomail a copy of the complaint to the tenant(s)?

    The proposed Summons may be submitted through the portal. Additional copies of the complaint

    and envelopes for mailing must be submitted separately via mail or hand-delivery to the Clerks Of-fice. Please note that for Default purposes, the Clerk will use the latter of the date of service/postingof the Summons or the mailing of copies when calculating the 5 business days. Florida Statute 83.22(2)

    9. Can you e-file the mini versions of depositions instead of the full page longer ones?

    The Clerk will accept whichever version of a deposition that an attorney chooses to submit. How-ever, if the court, statute, or Rule of Procedure requires the full deposition, then the full depositionshould be submitted.

    10. When we file a caveat, there is no provision for payment. We wind up filing it and then get a letterfrom the Clerk asking for payment. What are we doing wrong?

    Most of these payment processed have been updated and are in production. The remaining issuesare being updated.

    11. Is it okay to file the mini-transcripts of depos? Otherwise, what do you suggest with large transcriptswhich need to be split up due to large data content?

    See #9. If a deposition or any other document exceeds 25m, the document may be submitted via aCD, thumb drive, or any other appropriate external media. If the filing attorney includes a return

    envelope, the media will be returned to the filer.

    12. Please explain the pending que.

    The Pending Queue is a holding queue for filings that cannot be accepted by the Clerk. Dependingon the reason the filing was moved to the Pending Queue, the filer may either correct the document(s) within the filing (wrong case number on pleading) and resubmit the filing or create a new filing(the filing fee submitted is incorrect). Filings in the Pending Queue for more than seven businessdays will be moved to the Judicial Review queue. AO 13-15

    13. What does Sending to Local System mean when listed as the Status?

    Sending to Local System means that there has been a transmission failure on the Clerks side. Weare manually correcting these. We cannot change the portal statusit will be updated by the portalstaff at some time in the future. If the event appears on the ROA and there is an image, the docu-ment is considered filed. Give us a filing number and we can confirm or correct.

    14. Document listed as Pending Filing since May, what does that mean?

    Sending to Local System means that there has been a transmission failure on the Clerks side. Weare manually correcting these. We cannot change the portal statusit will be updated by the portal

    staff at some time in the future. If the event appears on the ROA and there is an image, the docu-ment is considered filed. Give us a filing number and we can confirm or correct.

    15. Need ALL procedures explained on 5 day evictions/ default with envelopes/mailing the initial complaint/procedure for the writ of possess and the money order to the sheriff etc.

    We will provide an explanation during our presentation.

    16. When you have a problem with the actual portal function and you contact the FCCC, they do not

    respond to you at all, our office has both emailed and called with no returned call or e-mail. Thisis very frustrating especially when you are under a deadline. Is there any other way to contact the

    FCCC so that they get back to our attorney's?

    We understand their frustration as we have the same experience. If we are unable to assist you(we have figured out many of the technical portal problems), then the only option is to contactportal support. You may, however, follow up with them as often as you need to in order to getthem to respond. Always have the ticket number that they assign available when you contactthem. Also, the subject line of an email to them should contain URGENT CANNOT EFILE.

    17. When a file is placed in Pending Queue is there a way to delete the entire filing and restart? For

    example, you filed it under the wrong case number, is there a way to change the case number once

    it has been filed, or to delete the filing all together?

    Filings cannot be deleted. If it is moved to the Pending Queue and a new filing has to be created,

    the old filing will ultimately be moved to the Judicial Review queue.

    18. If you have a problem with the Portal and cannot resubmit a file that was placed in Pending Queue,

    are paper filings still accepted at any of the Clerk's offices?

    All filings should be submitted through the portal unless the filing exceeds 25m in which case itcan be submitted on external media (CD, flash drive).
