A proposed bill may soon help speed upthe approval process for homeowners sell-ing their home through short sale by re-quiring subordinate lien holders to reviewand respond to short sale requests within45 days.

The legislation, “The Fast Help forHomeowners Act,” was offered in Con-gress today by U.S. Rep. Jerry McNerney(D-Calif.) and is strongly supported by theNational Association of Realtors.

“As the leading advocate for homeown-ership, Realtors know that issues and delayswith secondary lien holder remain an ob-stacle to streamlining the short saleprocess,” said NAR President Moe Veissi,broker-owner of Veissi & Associates Inc.,in Miami. “Short sale negotiations aremuch more difficult for borrowers whohave multiple servicers involved and ongo-ing delays continue to severely limit thenumber of homeowners who are approvedfor short sales, forcing many homeownersinto foreclosure.”

The proposed legislation would estab-lish guidelines requiring the primary lienholder to inform secondary and any sub-sequent lien holders of a request for shortsale. The bill would also impose a deadlinefor subsequent lien holders to respond toboth the primary lender and the consumerfollowing a short sale request.

NAR has been actively pushing themortgage servicing industry for years to

improve the short sale review and approvalprocess, especially in cases where secondliens are involved. Veissi praised Rep. Mc-Nerney for his efforts on the bill and urgedCongress to pass it quickly.

“Second mortgage lien holders fre-quently hold up and cancel the short saletransaction while trying to collect thelargest possible payout in exchange for re-leasing the homeowner's lien, eventhough the secondary lien holder oftengets nothing if the home ends up goinginto foreclosure,” said Veissi. “While ef-forts have been made to improve primarylien holders' response times, issues stillabound with second and subsequent lienholders, and this legislation is a step in theright direction.”

Realtors continue to report that shortsale transactions are being held up due to alack of response regarding acceptance ofshort sale requests. NAR wants mortgageservicers to approve reasonable short saleoffers so that homeowners can avoid fore-closure, and minimize the negative impacton families, home values and neighbor-hoods.

NAR believes that streamlining theshort sale approval process for both pri-mary and secondary lien holders will helpclose more short sale transactions. “We ap-plaud any effort to help improve the shortsale process and give distressed homeown-ers alternatives to foreclosure,” said Veissi.

Existing-home prices continued toshow gains but sales fell in June with tightsupplies of affordable homes limiting first-time buyers, according to the National As-sociation of Realtors.

Total existing-home sales declined 5.4percent to a seasonally adjusted annualrate of 4.37 million in June from an up-wardly revised 4.62 million in May, but are4.5 percent higher than the 4.18 million-unit level in June 2011.

Lawrence Yun, NAR chief economist,said the bigger story is lower inventory andthe recovery in home prices.

“Despite the frictions related to obtain-ing mortgages, buyer interest remainssolid. But inventory continues to shrinkand that is limiting buying opportunities.This, in turn, is pushing up home prices inmany markets,” he said. “The price im-provement also results from fewer dis-tressed homes in the sales mix.”

According to Freddie Mac, the nationalaverage commitment rate for a 30-year,conventional, fixed-rate mortgage fell to arecord low 3.68 percent in June from 3.80percent in May; the rate was 4.51 percentin June 2011; recordkeeping began in1971.

The national median existing-homeprice for all housing types was $189,400 inJune, up 7.9 percent from a year ago. Thismarks four back-to-back monthly priceincreases from a year earlier, which last oc-

curred in February to May of 2006. June'sgain was the strongest since February 2006when the median price rose 8.7 percentfrom a year prior.

Distressed homes – foreclosures andshort sales sold at deep discounts – ac-counted for 25 percent of June sales (13percent were foreclosures and 12 percentwere short sales), unchanged from Maybut down from 30 percent in June 2011.Foreclosures sold for an average discountof 18 percent below market value in June,while short sales were discounted 15 per-cent. “The distressed portion of the marketwill further diminish because the numberof seriously delinquent mortgages hasbeen falling,” said Yun.

Total housing inventory at the end Junefell another 3.2 percent to 2.39 million ex-isting homes available for sale, which rep-resents a 6.6-month supply at the currentsales pace, up from a 6.4-month supply inMay. Listed inventory is 24.4 percentbelow a year ago when there was a 9.1-month supply.

First-time buyers accounted for 32 per-cent of purchasers in June, compared with34 percent in May and 31 percent in June2011. “A healthy market share of first-timebuyers would be about 40 percent, so thesefigures show that tight inventory in thelower price ranges, along with unnecessar-ily tight credit standards, are holding backentry level activity,” Yun said.
