The Regular Meeting of the West Baton Rouge Par-ish Council was held on Thursday, June 13, 2019 and called to order at 5:30pm. Council Chairman Gary Spillman asked that all electronic devices be placed on silent and recognized Councilman Phil Porto, who led everyone in the Pledge of Allegiance.

ATTENDANCEThe following members were recorded as being pres-ent: Messrs. Barry Hugghins, Ricky Loupe, Kirk Allain, Gary Spillman, Edward “Bob” Robertson, Chris “Fish” Kershaw, Phil Porto, and Ms. Charlene Gordon.Absent: Ms. Naomi Fair.

Also present were, Mr. Riley Berthelot Jr, Parish President, Mr. Phillip Bourgoyne, Director of Fi-nance, Mr. Kevin Durbin, Director of Public Works, and Mrs. Michelle Tullier, Council Clerk.

MINUTE APPROVAL

A motion was made by Mr. Barry Hugghins, second-ed by Ms. Charlene Gordon to approve the minutes of the May 23, 2019 regular meeting.

PARISH PRESIDENT’S REPORT

Parish President Riley Berthelot was recognized and covered the following items:Pre-Construction meeting on rehab of LA415 to US 190;Recent rain event update and issues;HB578 passage, pending Governor Signature, Thanked everyone for help and support with this project starting with Planning Commission in 1972;Introduced Senator Rick Ward, Representative Ed-mond Jordan and Representative Jeremy Lacombe who all spoke briefly on this project;Mayor meeting regarding drainage cleanup;There were a few questions for the Parish President.

Councilwoman Naomi Fair entered the meeting at 5:45pm.

RESOLUTION TO ADOPT THE MILLAGE RATES FOR TAX YEAR 2019

Mr. Phillip Bourgoyne was recognized and explained the millages being presented are the same as the past year, the rates have not changed. There were no ques-tions at this time.

A motion was made by Mr. Ricky Loupe, second-ed by Ms. Charlene Gordon to approve the Millage Rates for the Tax Year 2019 as presented.

CONSIDER PAY INCREASE FOR PARISH

EMPLOYEESMr. Phillip Bourgoyne, was again recognized and explained that the administration is recommending a 2% - one step increase this year due to the current 12 month CPI.

A motion was made by Mr. Chris Kershaw, second-ed by Mr. Barry Hugghins to approve the 2%- one step increase for all classified full-time, semi full-time, permanent part-time employees, including all appointed directors, which includes the following named departments: Council Clerk, Coroner, Regis-trar of Voters, Administration, Information Technolo-gies, Planning/Zoning, Building Maintenance, Emer-gency Management, Engineering, Animal Control, Recreation, Roads, Health Unit, Drainage, Commu-nity Center, Community Action, E-911, Judges, Dis-trict Attorney/Legal Counsel, Public Utilities, Sales Tax, Detention Center, Justice of the Peace and Con-stable with an effective pay period beginning July 1, 2019. Chairman Spillman questioned the fireman longevity increases and what hire dates we are actually going by.

COMMUNICATIONS WITH COUNCIL MEM-BERS AND/OR ELECTED OR APPOINTED OFFICIALS

Mr. Phillip Bourgoyne explained the paperwork giv-en to the Council regarding a new requirement of Community Action and asked that the Council may-be help with providing the requested information. Councilwoman Charlene Gordon thanked everyone who helped with Family Day in the Park and not-ed the Council on Aging Fan Drive currently going on. Councilman Porto notified everyone about a re-cent job he may be taking which may require him to miss a few meetings. Councilman Kershaw noted that Brusly Softball pitcher Mary Cathryn Comeaux recently being named Gatorade Player of the Year, the Councilman also noted the amount of calls that he has received recently regarding garbage pickup and asked that this be kept in mind when our contract comes up for renewal.

PUBLIC HEARING ON PREVIOUSLY INTRO-DUCED ORDINANCES

An Ordinance To Amend Article III, Section 3-02 By Adding Paragraph (B) To Section 3-02 (Exec-utive Branch) Of The West Baton Rouge Parish Home Rule Charter To Impose Term Limit Provi-sion For The Office Of Parish President

Chairman Spillman explained before opening the Public Hearing that this Ordinance is not asking for the Council to vote on term limits, it is simply asking to give the people a chance to vote on this subject.

The Chairman opened a public hearing for the pur-pose of receiving comment regarding, item #11A) An Ordinance To Amend Article III, Section 3-02 By Adding Paragraph (B) To Section 3-02 (Execu-tive Branch) Of The West Baton Rouge Parish Home Rule Charter To Impose Term Limit Provision For The Office Of Parish President.

Mr. Clayton Hebert was recognized and stated he strongly believes the public should be given the right to vote on term limits.

No further public comments for or against said ordi-nance were presented. No written protests opposing the ordinance were received. The Council Chairman at this point declared the Public Hearing closed.

Ms. Naomi Fair made a motion to approve the Ordi-nance To Amend Article III, Section 3-02 By Adding Paragraph (B) To Section 3-02 (Executive Branch) Of The West Baton Rouge Parish Home Rule Charter To Impose Term Limit Provision For The Office Of Parish President, there was no second to the motion.

Councilman Kirk Allain explained he does support term limits, however he thinks that there should be 4 terms instead of 3 terms for the Parish President.

Parish President Berthelot gave multiple reasons that he was not in support of this ordinance. Councilman Kershaw gave multiple reasons that he did not sup-port this ordinance. Councilman Porto explained the reasons he was in support of this proposed ordinance. Councilman Loupe explained that he has always been in support of term limits for elected officials. Chair-man Spillman explained his reasons for bringing this ordinance to the Council.

After a long discussion involving various coun-cilmembers, and administration, a motion was made by Chairman Gary Spillman, seconded by Mr. Phil Porto to approve the Ordinance To Amend Article III, Section 3-02 By Adding Paragraph (B) To Section 3-02 (Executive Branch) Of The West Baton Rouge Parish Home Rule Charter To Impose Term Limit Provision For The Office Of Parish President as writ-ten.

A substitute motion was made by Mr. Kirk Allain, seconded by Mr. Phil Porto to approve the Ordinance To Amend Article III, Section 3-02 By Adding Para-graph (B) To Section 3-02 (Executive Branch) Of The West Baton Rouge Parish Home Rule Charter To Impose Term Limit Provision For The Office Of Par-ish President, with an amendment to Section 3-02(B) to change two and one –half terms to three and one-half terms.

The vote was recorded as follows:

YEAS: 5 (Spillman, Porto, Allain, Loupe, Fair)

NAYS: 4 (Kershaw, Hugghins, Gordon, Rob- ertson)

ABSENT: 0 (None)

ABSTAIN: 0 (None)

As a result of the votes the motion failed due to this item needing a two-thirds vote of the membership of the Council.

Chairman Spillman explained the Council would now vote on the original motion.

The vote was recorded as follows:

NAYS: 6 (Allain, Kershaw, Fair, Hugghins, Gordon, Robertson)

ABSENT: 0 (None)

ABSTAIN: 0 (None)

As a result of the votes the motion failed due to this item needing a two-thirds vote of the membership of the Council.

Before moving on the next item Chairman Spillman recognized Ms. Bernadette Moore a citizen on Buec-he Rd. who spoke on a ditch next to her house with sewage problems. Ms. Moore asked for help from someone to either put culverts in the ditch, or she would close it in, since this causes a nuisance due to the sewer smell from a ditch that does not even service her house. President Berthelot stated that he would check into our budget and see if we could close the parish ditch for Ms. Moore, clarifying that DHH has been out and inspected this ditch saying there were no violations at this time. Chairman Spill-man let Ms. Moore know that someone would be back with her in the next 2 weeks to let her know how this issue will be resolved.

CONSIDER STATUS REPORT, CHANGE OR-DERS AND/OR OTHER MATTERS AS RE-QUIRED ON CURRENT PROJECTS

Accept/Reject bid recommendation on South End Water Line Project

Mr. Jason Manola was recognized and asked that the Council approve the lowest responsive bidder on this project, which includes Alternate 1 and Alternate 2. Currently the lowest bidder is NCMC, LLC, however the engineers must review this bid to make sure that everything is included before proceeding, this will authorize administration to move forward once the lowest responsive bidder is established by the engi-neers. There were a few questions from the Coun-cilmembers for clarification.

A motion was made by Mr. Chris Kershaw, seconded by Ricky Loupe to accept the lowest responsive bid-der on the South End Water Line Project Transmis-sion main with Alternate 1 and Alternate2.
