Hi Edgar,

If there is no plan to merge the right-of-way {through a subdivision) or to vacate the right-of-way at that location, then our office would not be involved in reviewing or approving your proposal.

I will note the following though:

For the triangular parcel, you will likely need to involve the City (General Services Department) as a property owner, as that is not public right-of-way but a City owned parcel (APN 5554-007-900).

A B..Pennit from BOE Central District {anp DOT review and approval, of cours·e) would be needed to modify the traffic lanes on Sunset Bl and Crescent Heights Bl as shown in your diagram.

Since you mentioned revocable permit, without knowing what you are proposing to install within the right-of-way, I would recommend consulting with BOE Central District on any necessary revocable permits for whatever is being proposed within the right of way. Shay Doong (copied here) is the supervisor of the public counter that issues revocable permits for Central District.

Thank you so much for meeting with me and Jim O'Sullivan to discuss the 8150 Sunset project. I took a few notes, but wanted to make sure I understood all of the points you made. So please feel free to correct anything that is not accurate.

On September 7, 2016, Edmond Yew met with Laura Lake and James O'Sullivan to discuss the closure/vacation of Cresc.ent Heights and the use of city-owned 8118 Sunset Boulevard for the project {for the so-called intersection "improvemenr and as a public plaza). Julia Duncan from CD 4 arranged the meeting and attended it.

Mr. Yew thought the meeting was about the LACMA expansion. He said his office was unfamiliar .with the project, and had never reviewed the proposal to close the Crescent Heights tum lane to traffic or to use 8118 Sunset for street purposes and a public plaza. He was not aware of a B or R permit being substituted for a street vacation.

He also stated that the EIR needed to be recirculated to address the closure of the street, vacation, etc. and that the vacation would be a condition of approval for the tract map.

Laura Lake explained that the EIR response stated that the street would be closed through a merger and re-subdivision under the Tract Map. But the property involved is not within the tract, so that is not an option. That merger would also have required findings from the City Engineer.

He explained that normally, closure of a street requires a street vacation or merger through a tract map. But no request had been submitted. Likewise, no B Permit or R Permit had been discussed as an alternative. And LADOT had never consulted the City Engineer regarding the intersection "improvement" to round-off the triangle for a new right-turn.

Mr. Yew explained· that normally, his office would ask neighbors how they feel about the closure, and would make required findings regarding current and future use. No such review has been conducted, including safety ·findings. He agreed that state law required the City Engineer to find that the street was not needed now or in the future. No such findings have been made.

He explained that when an application is received lo close a street or alley, his department canvasses the neighbors to detemiine whether or not they favor the closure. No such canvass has been conducted.

Mr. Yew raised two new points upon looking al the intersection plan provided by the applicant:

The attached Notice of Preparation of an Environmental Impact Report for the 8150 Sunset Boulevard Mixed-Use Project (Case ENV-20132552-EIR) does not specifically state whether the project would require dedication or vacation of public street rights of way. However, the Proposed Site Plan (Figure 5) appears to show elimination of a turning lane from east­bound Sunset Blvd to south-bound Crescent Heights Blvd. and conversion of the lane and traffic island into a plaza. Please clarify the project scope.· ·

The City of Los Angeles, Department of City Planning will be the Lead Agency and will require the preparation of an cnvfronmental impact report ("BIR'') fur the project identified herein.· The Department of City Planning requests your comments as to the scope and content of the Draft BIR. The Project description and potential environmental effects are included below. An initial study was prepared and is included in the environmental file. A copy of the environmental file is available for review, by appointtnent during office hours, at the Department of City Planning, 200 North Spring Street, Room 750, Los Angeles, CA 90012.

PROJECT DESCRIPTION: The Project Applicant proposes to redevelop the 2.56-acre property located at 8150 Sunset Boulevard with a mixed-use residential and retail project The property is located within the Hollywood community of the City of Los Angeles (City), and currently contains two commercial structures and other improvements, all of which would be demolished and removed from the site. The proposed project would consist of two buildings over a single podium structure with various elements ranging in height from two stories to 16 stories in height (approximately 42 feet above the ground elevation at the intersection of S\Ul.set and Crescent Heights Boulevards [the "North Building"], increasing to approximately 108 feet for the nin~story portion and approximately 191 feet for the .16-story portion of the building [the "South Building"J; the ovemll building height is approximately 216 feet as measured from the low point of the site along Havenhurst Drive to the top of the South Building). The North Building, which would be built along Sunset Boulevard, would include two levels with a rooftop terrace containing exclusively commercial uses. The South Building would contain commercial uses on the first two levels, residential uses on levels three through 15, and a rooftop restaurant/lounge on the top level. The project wouJd indude approximately 111,310 square feet of commercial retail and restaurant uses within three lower levels (one subterranean) and one

rooftop level. 249 awrtment units, including 28 affordable housing units, within the twelve upper levels representing approximately 222,560 gross square feet of residential space. The project would also provide a new central public plaz.a, new public space at the northeast comer of the site, public rooftop de.ck/garden areas along Sunset Boulevard, a private pool and pool deck area for residents, as well as other resident-only amenities totaling approximately 6,900 square feet that would include a residential lobby, resident recreation room, fitness center, changing rooms, business center, and library . . Parking for all proposed uses would be provided on-site via a seven-level (three subterranean and semi-subterranean levels) parking structure housed within the podium structure that indudes 849 total parking spaces (295 for residential uses and 554 for commercial uses). The total development would intlude approximaiely 333,870 square feet of commercial and residential ·spac.e with a maximum floor-area ratio (FAR) of approximarely 3: l. The Project Applicant anticip~tes commencing construction in 2015 with oc.cupancy occurring in 2017. ·

REQUESTED PERMITS/APPROVALS: The Project Applicant is requesting approvals for the proposed .Project that would· include, but may not be limited .to, the following: Affordable Housing Incentives, including Parking Option 1 and Off-Menu Incentives; Site Plan Review; Master Conditional Use Permit ·ror Alcohol (on- and off-site sales); Subdivision to create airspace lots and for condominium purposes; Variance for outdoor dining above the ground floor level and to allow a fitness studio, as not otherwise permitted in the C4 zone; demolition permits; construction permits, including building. grading, excavation. fuundation, and associated permits; haul route pennit, as may be required; street tree removal pennit; and other approvals as needed ·
