SUBJECT: DELIBERATION AND POSSIBLE ACTION IN REGARD TO A REQUEST FOR A CERTIFICATE OF DESIGN COMPLIANCE FOR A FREESTANDING SIGN LOCATED AT 100 NORTH AUSTIN STREET. 1. BACKGROUND/HISTORY

This is the regular agenda item (action item) for a Certificate of Design Compliance (CDC) application for a demolition at 100 North Austin Street. The City of Buda Unified Development Code requires that work in the Historic District or Central Business District triggering a site development permit shall have CDC approval prior to issuance of the permit.

2. CURRENT STATUS The applicant is proposing to demolish and replace two fences on the site. Due to these fence being of different design, a CDC is required as it is beyond ordinary maintenance and repair. The applicant requests an 8’ fence. In Section 6.5(1)e of the Unified Development Code, residential fences are limited to six feet in height unless the fence is not opaque, with at least ¼ of the fence’s vertical area open or transparent. In such cases that at least ¼ of the fence is transparent, the fence may be up to 8 feet in height. The proposed fence would not meet the required transparency in order to allow the fence to be taller than six feet. It should also be noted that in order to build the fence 8 feet in height without the required transparency, an applicant must receive a zoning variance from the Board of Adjustment. The Historic Preservation Commission could not grant this variance. The horizontal fence design is an acceptable alternative to vertical privacy fence, and is an approach used with increased popularity in historic neighborhoods. The existing privacy fence is not historic and is utilitarian in nature, whereas the proposed fence introduces a level of aesthetic design.

4. ACTION OPTIONS/RECOMMENDATION Staff recommends the Commission consider approval of the request to build the proposed cedar fence with horizontal slats, with condition limiting the height to six feet.

SUBJECT: DELIBERATION AND POSSIBLE ACTION IN REGARD TO A REQUEST FOR A CERTIFICATE OF DESIGN COMPLIANCE FOR DEMOLITIONS LOCATED AT 300 WEST GOFORTH STREET. 1. BACKGROUND/HISTORY

This is the regular agenda item (action item) for a Certificate of Design Compliance (CDC) application for a demolition at 300 W. Goforth Street.

2. CURRENT STATUS The applicant is proposing to demolish two accessory structures on the site. One structure is a garage which is to the right rear of the house, facing the property from the street. The other structure is a small accessory house structure that is at the rear of the property to the left of the main house. The applicant proposes the demolition in order to simplify the site. The applicant has also inquired regarding subdividing the site.

The accessory house structure is set back over 100 feet from West Goforth Street. This structure is a two-room structure that has been used as a rental house. This structure is included in the 1992 Buda Historic Resources Inventory, and is assigned a Medium priority. The accessory house had a wood exterior of vertical board & batten siding, and is estimated to date from 1915. Review from distance seems to indicate it is in reasonably good condition—no bowing was apparent in the roof, and doors/windows appear to be aligned indicating foundation stability. At the same time, the limited visibility of the structure from the street limits the public interest in preservation. Staff did not have full permission for property access, as the applicant has the property under contract. Staff has requested inspection reports or a letter of permission through the Realtor to grant access and more closely inspect the accessory house structure. The garage structure is visible from Goforth Street, as it is adjacent to the rear left corner of the main house. This structure is visibly worn down and appears to have most recently been used as a shed. However, the structure has numbering near the door showing an address of “300C,” indicating the structure may have been occupied in the past. This structure was not included in the 1992 Buda Historic Resources Inventory, nor any subsequent listing of historic properties. It appears to have no historic significance and actually degrades the significance of the primary structure.

4. ACTION OPTIONS/RECOMMENDATION

Staff recommends approval of the request to demolish the garage/shed, as it does not contribute to the historic relevance of the site and is accessory to the primary structure. Staff is not prepared to provide a recommendation for the 2-room accessory house towards the rear of the property without first obtaining additional information regarding condition.
