Comments:

A hazardous waste investigation was performed at the Dumont Borough Dept. of Public Work. The inspection was initiated from a water pollution citationissued by NJDEP-Water Enforcement in October 2002 for the unpermitted discharges from leaking drums and other materials discharging into thebrook. Upon arrival at the September 24, 2003 inspection, NJDEP officials noted 13 55-gallon drums and a few smaller containers were stored outsideunder a blue tarp. When the tarp was removed, DEP inspectors determined the drums to be of poor integrity, severely rusted, bulging tops and one drumhad a large hole in the side. The drums did not have any markings to identify their contents. Photographs were taken to document the condition of thesecontainers. We spoke with Borough Chief of Staff Jack Eckel who stated that these drums contain purge waters from when a gasoline undergroundstorage tank was removed a few years ago. NJDEP recommended the drums be properly identified and removed from the site for disposal. A RCRA fieldNOV was issued for failing to determine if the waste was hazardous. A copy of the NOV letter is NJEMS and NFO file for review.

Compliance Status - An indication for a single requirement of the result of the complianceevaluation. Compliance Statuses include Out of Compliance (OC), In Compliance (IC), Not Determined(ND), etc.

Compliance Status Types:

Compliance Not Determined - Compliance could not be determined fromobservation or based on available evidence. The status implies intent and aneffort to make such determination. Usually indicates the situation preventeddetermination or made the requirement itself irrelevant such as with projectsnot yet begun or equipment not in operation.

Data Collection - The requirement is strictly a checklist item being used tocollect data about the PI, not to record compliance. For example, Potable Waterchecklists were developed to collect data that will eventually be stored in otherNJEMS screens once developed.

Heading - The requirement is a checklist heading, not a true regulatoryrequirement. There is no compliance determination made for Headings.

In Compliance - The requirement is found to be in compliance.

No - The requirement is strictly a checklist item not being used to recordcompliance. The checklist item is being used to gather information about thePI, not compliance with a true regulatory requirement. Marking a requirementas No will not create a violation.

No Obvious Concern - The requirement is in compliance, but is enforced byanother Enforcement program (i.e. a Screening Checklist requirement) andtherefore should not be definitively marked with In Compliance.

Not Applicable - The requirement does not apply to the PI or that particularinspection, and therefore a compliance status is not recorded.

Not Inspected - There was no intention to evaluate compliance with thisrequirement and/or no effort was expended to evaluate compliance with it.

Out of Compliance - The requirement is out of compliance and becomes aviolation when the inspection is finalized.
