Permit Descriptions CAFRA - A Coastal Area Facility Act permit is required to construct residential, commercial, public, transportation, utility and energy-related facilities in the coastal area as defined by the Act. Federal Consistency Activity: Certain federal permits, not limited to the U.S. Army Corps of Engineers Dredge and Fill Permits, require certification by the DEP prior to the issuance of the permit by the federal agency. Freshwater Wetlands: A Permit (Letters of Exemption, Letters of Interpretation, Statewide General Permit, Open Water Fill, Individual, Transition Area Waiver, Water Quality Certificate) is needed prior to engaging in a regulated activity in or around freshwater wetlands and associated transition areas. A Stream Encroachment Permit, an U.S. Army Corps of Engineers Dredge and Fill Permit, and a Water Quality Certification may also be required. General Groundwater Petroleum Products Cleanup: This general permit authorizes the surface water discharge of treated groundwater previously contaminated with petroleum products. NJPDES permits: A permit is required for the discharge of pollutants to surface and groundwater, a discharge from an indirect user or the land application of municipal and/or industrial residuals. (A more comprehensive definition of activities, which require a permit, may be found at N.J.A.C. 7:14A-2.4) Solid Waste Facility: A permit is required to conduct or operate any solid waste facility as defined under the Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq., and N.J.A.C. 7:26-1 et seq. Stream Encroachment: Under the Flood Control Act DEP is empowered to require a permit to control construction within and proximate to flood hazard areas to reduce flood damage to and from new development and to protect the flood storage capacity and ecology of flood plains. Tidal Wetlands: A Coastal Wetlands Permit is needed to excavate, dredge, fill or erect structures on coastal wetlands. Treatment Works Approval: A TWA permit is required for the construction, modification or operation of a treatment works, including sanitary/industrial sewage pretreatment or treatment systems, sewage conveyance systems, sewer extensions and subsurface sewage disposal systems. Waterfront Development: A permit is required for any project involving the development of waterfront near or upon any tidal or navigable waterway in the State.

General Information

The DEP Bulletin is an information service provided by the New Jersey Department of Environmental Protection. In compliance with the Rules and Regulations Governing 90 Day Construction Permits (NJAC 7:1C-1.1 et seq.) this semi-monthly publication contains a list of construction permit applications recently filed or acted upon by the DEP. Using the Application Milestone Codes located on the inside front cover, interested persons can determine the status of Coastal Area Facility Review Act (CAFRA) permits, Federal Consistency Activity permits, Freshwater Wetlands Individual and Statewide General permits, General Groundwater Petroleum Products Cleanup permits, Open Water Fill permits, Solid Waste Facility permits (SWF), Stream Encroachment (SE) permits, Tidal Wetlands permits, Waterfront Development permits and Treatment Works Approvals (TWA). In addition, a calendar of Events of Interest and a Schedule of Public Hearings is provided. The public hearings listed do not, however, constitute an official notice. Environmental Impact Statements acted upon during the period are also shown. Additional information concerning the permit applications can be obtained by calling the project manager at the appropriate office listed on the inside back cover. Public Hearings are held for the purpose of obtaining input and reaction to a proposed rule, regulation, or new program. Some hearings may be mandated by law. Generally their scope of impact is statewide or of broad general interest and open to the public. Contested Case Hearings are held between the State and a particular party involving an application, enforcement violation or an appeal. Interest in these hearings is generally limited to those directly involved. DEP Events of Public Interest include public hearings, council meetings, workshops, public information meetings, and exams.

Notice of Treatment Works Approval Program FY 2008 Fee Report and Fee Schedule

Take notice that the Department of Environmental Protection (Department) has issued the Fiscal Year

(FY) 2008 Fee Report and Fee Schedule for the Treatment Works Approval (TWA) program. The Department is responsible for administering the TWA program, which establishes and implements

minimum standards for the approval of the design, construction and operation of treatment works to ensure that wastes are properly collected, conveyed and treated before discharge to the waters of the State. A TWA is a permit that authorizes the construction and/or operation of a wastewater treatment, storage and/or conveyance facility. These facilities include, but are not limited to, municipal or privately owned sewage treatment plants, sewer extensions, pumping stations, force mains, holding tanks and equalization tanks.

Fees are assessed to cover the Department’s costs to review applications, issue permits, and manage the TWA program. The Department, through the issuance of a TWA Fee Report, can adjust the fee structure necessary to recover costs to administer the TWA program pursuant to N.J.A.C. 7:1C-1.5.

TWA fees are calculated based on project construction cost and a "P" coefficient. The Department has

updated the "P" coefficient using the estimated program budget in conjunction with actual data concerning the categories and number of projects submitted in the previous fiscal year. In FY2007 the "P" coefficient is 0.0040, which has remained unchanged since July 1, 2005. For FY2008, the "P" coefficient is 0.0044, which will result in an approximate increase of 7.4 percent over the FY2007 fee structure. The minimum fees for smaller projects will remain the same.

Because the projected fee increase does not exceed 10 percent, the Department is not required to hold a public hearing. The Department is providing this public notice, which contains the revised "P" coefficient and a synopsis of the Fee Report and Fee Schedule for the TWA program.

In accordance with N.J.A.C. 7:1C, all applicants for a Treatment Works Approval (TWA) shall pay

a fee based upon the construction cost category of the application.

Category 1 (construction costs greater than $1,000,000) fee = 4P ($250,000) + 2P($750,000) + P (construction cost - $1,000,000). Category 2 (construction costs greater than $250,000 but are less than or equal to $1,000,000) fee = 4P ($250,000) + 2P (construction cost - $250,000). Category 3 (construction costs less than or equal to $250,000) fee = 4P (construction cost).

The “P” coefficient in the above formula is derived from the following formula. P = EB/ (T1 + 2 (T2) + 4 (T3) + 1,500,000 (N1) + 500,000 (N2))

Where:

EB = estimated budget for the TWA Program; T1, T2, and T3 = the sum of the construction costs for all projects in categories 1, 2, and 3, respectively, from the prior fiscal year; N1 and N2 = the total number of projects in categories 1 and 2, respectively, from the prior fiscal year. The values from FY2007 were as follows: T1 = $156,320,360 T2 = $39,038,396 T3 = $37,383,697 N1 = 41 N2 = 81

EB = $2,139,930

Therefore, for FY2008, P = 2,139,930/ (156,320,360 + 2 (39,038,396) + 4 (37,383.697) + 1,500,000 (41) + 500,000 (81)) P = 0.0044

The following fees listed in the rules governing Ninety-Day Construction Permits, N.J.A.C. 7:1C-1.5 will remain the same in FY2008:

This is a renewal permit action for Kessler Institute, which is an existing 72-bed facility that provides outpatient and in-patient services for victims of multiple sclerosis. Therapy includes but is not limited to medication, physical therapy, and hydrotherapy. Sanitary wastewater generated from the facilitiy is collected and treated from an on-site wastewater treatment plant having a design capacity of 17,000 gallons per day (GPD). The wastewater is run through a series of clarifiers and settling tanks before being discharged to disposal beds #1 and #4. Disposal bed #1 is 5,044 square feet and disposal bed #4 is 14,000 square feet. Disposal beds #2 and #3 are no longer in use. The facility maintains five (5) downgradient monitoring wells, one (1) upgradient ground water monitoring well, and four (4) piezometers to ensure compliance with GWQS and the conditions of this permit. Residuals generated at this facility will be managed off-site at an approved residuals management operation. The Department is granting a reduction in the number of parameters that must be reported on the annual residuals “production” Waste Characterization Report (WCR) at monitoring location SL1A, pursuant to N.J.A.C. 7:14C-1.13(c). At the start of the calendar year after the effective date of the permit renewal, the residuals production WCR will reflect these changes.
