The individual company providing the access service willhereinafter be referred to as the Telephone Company. Thiscatalog also contains Access Ordering regulations andcharges that are applicable when these services areordered or modified by the customer.

1.3 The provisions of this catalog apply to intrastateintraLATA and interLATA access service. The regulations,rates and charges contained herein are in addition to theapplicable regulations, rates and charges specified inother rate lists and/or catalogs of the Telephone Company.

(A) Certification Requirements- Special Access

When the customer orders Special AccessService, and the customer certifies to theTelephone Company in writing that less thanten percent of the traffic is interstate, theservice is considered to be intrastate and isprovided under this catalog.

Following initial certification, should thejurisdictional nature of the customer'sSpecial Access Service change, the customershould inform the Telephone Company in writingof the change. The effective date of thechange will be the date the Telephone Companyreceives the customer's notice of change. Nocharge applies for the jurisdictional change.

(B) Disputes Involving JurisdictionalCertification- Special Access

If a dispute arises concerning thecertification of projectedinterstate/intrastate traffic as described in(A) above or a regulatory commission questionsthe customer-provided interstate percentage,the Telephone Company will ask the customer toprovide the data the customer used todetermine the traffic split. The customershall supply the data within thirty (30) daysof the Telephone Company request. Thecustomer shall keep records of system designand functions from which the percentage ofinterstate and intrastate use can beascertained and, upon request of the TelephoneCompany, make the records available forinspection as reasonably necessary forpurposes of verification of the percentages.If the reply results in a jurisdictionalchange of a Special Access Service, theeffective date of the change will be the date

the Telephone Company receives the customer'sreply. There is no charge when the customer'sreply results in a jurisdictional change inthe Special Access Service.

(C) Jurisdictional Reports - Switched Access

For Switched Access Service, the TelephoneCompany cannot in all cases determine thejurisdictional nature of customer traffic andits related access minutes. In such cases thecustomer may be called upon to provide aprojected estimate of the division of itstraffic between the interstate and intrastatejurisdictions. The following regulationsgovern such jurisdictional estimates.

(1) General

A call that originates in Nebraska andterminates in Nebraska is an intrastatecall, regardless of the path the calltakes in the interexchange carrier'snetwork.

The percentage of interstate use (PIU)factors described in NECA TARIFF F.C.C.NO. 5, Section 2.3.11 (C) (2)-(4) areapplied to usage rated Carrier CommonLine, Information Surcharge, LocalSwitching, and Local Transport charges.Separate PIUs are required for flat ratedDirect Trunked Transport and Multiplexers.

Except where the Telephone Companymeasured access minutes are used as setforth following, the customer shall reportthe percentage of interstate use as setforth in Section 2.3.11 (C) (2) or (3) ofNECA TARIFF F.C.C. Effective on the first of January, April,July and October of each year the customershall update the interstate and intrastatejurisdictional report. The customer shallforward to the Telephone Company, to bereceived no later than fifteen (15) daysafter the first of each such month, arevised report showing the interstate andintrastate percentage of use for the pastthree months ending the last day ofDecember, March, June and September,respectively, for each service arrangedfor interstate and intrastate use.

Except where the Telephone Company isbilling according to actual usage byjurisdiction, the revised report willserve as the basis for the next threemonths billing and will be effective onthe bill date for that service. Noprorating or back billing will be donebased on the report.

If after review of the information, it isdetermined that a billing dispute exists,the Telephone Company will continue to usethe derived interstate percentage, untilthe Telephone Company and the customerreview documentation and agree toestablish a revised interstate percentage.The Telephone Company will use the revisedpercentage with the next billing period.

When the quarterly reports are notsupplied by the customer, the followingsteps, as set forth in (a) through (d)following, will be taken by the TelephoneCompany.

(a) If the customer does not supply thereports, the Telephone Company willassume the percentages to be the sameas those provided in the lastquarterly report. For those cases inwhich a quarterly report has neverbeen received from the customer, theTelephone Company will assume thepercentages to be the same as thoseprovided in the order for service asset forth in NECA TARIFF F.C.C. (b) If no report is received by thefifteenth day of each quarter, theTelephone Company will send a letterto the customer (by certified U. (1) All bills dated as set forth in (B) (2) precedingfor service provided to the customer by theTelephone Company are due 31 days (payment date)after the bill day or by the next bill date(i.e., same date in the following month as thebill date), whichever is the shortest interval,except as provided herein, and are payable inimmediately available funds. If the customerdoes not receive a bill at least 20 days priorto the 31 day payment due date, then the billshall be considered delayed. When the bill hasbeen delayed, upon request of the customer thedue date will be extended by the number of daysthe bill was delayed. Such request of thecustomer must be accompanied with proof of latebill receipt.

If such payment date would cause payment to bedue on a Saturday, Sunday or Legal Holiday,payment for such bills will be due from thecustomer as follows:

5. Access Ordering

5.1 General

This section sets forth the regulations and orderrelated charges for services set forth in other sectionsof this catalog. Order related charges are in additionto other applicable charges for the services provided.

An Access Order is an order to provide the customer withSwitched and Special Access or Access Related Service orto provide changes to existing services.

The regulations, rates and charges for specialconstruction are set forth in Section 8 of this catalogand are in addition to the regulations, rates andcharges specified in this section.

A customer may order any number of services of the sametype and within the same premises on a single AccessOrder. All details for services for a particular ordermust be identical except those for multipoint service.

The customer shall provide to the Telephone Company theorder information required in Section 5.2 and inaddition the customer must also provide:

-Customer name and premises address(es).

-Billing name and address (when different from customername and address).

-Customer contact name(s) and telephone number(s) forthe following provisioning activities: ordernegotiation, order confirmation, interactive design,installation and billing.

5.1.2 Expedited Orders

When placing an Access Order, a customer mayrequest a service date that is prior to theapplicable service date. A customer may alsorequest an earlier service date on a pendingAccess Order. In either case, an access ordermodification as set forth in Section 5.4 of NECATARIFF F.C.C. NO. 5 is required. If the

Telephone Company determines that the service can beprovided on the requested date and that additionallabor cost or extraordinary costs are required tomeet the requested service date, the customer willbe notified and will be provided with an estimate ofthe additional charges involved. Charges will bebilled at actual cost, not to exceed ten percentover estimated charges. Such additional chargeswill be determined and billed to the customer asexplained following.

To calculate the additional labor charges, theTelephone Company will, upon authorization from thecustomer to incur the additional labor charges, keeptrack of the additional labor hours used to meet therequest of the customer and will bill the customerat the applicable Additional Labor charges as setforth in 17.4.3(A) following.

To develop, determine and bill the customer theextraordinary costs which may be involved, theSpecial Construction terms and conditions as setforth in Section 8 of this catalog will be used bythe Telephone Company. Authorization to incur thecosts and to bill the customer will be according tothe terms and conditions of Section 8 of thiscatalog.

When the request for expediting occurs after theissuance of the Access Order, a Service Date ChangeCharge, as set forth in 17.4.l(B) following alsoapplies.

less than ten percent interstate traffic.

All part-time Program Audio services are subject toa service inquiry. A service inquiry is a requestto the Telephone Company to determine if facilitiesexist to provide the service ordered and todetermine the service date on which service can beprovided to the customer.

When ordering bridging and/or multiplexing thecustomer must specify the Telephone Company hub(s)from which they desire service. The customer mustspecify only those hubs that provide the type ofservice ordered and interconnect with the wirecenter(s) from which the customer requires service.The Wire Center section of NECA TARIFF F.C.C. NO. 4identifies hub types and multiplexing functions aswell as hub levels (i.e., hub, terminus hub, etc.).Additionally, the Subtending section of NECA TARIFFF.C.C. NO. 4 identifies wire centers and theintermediate and/or super-intermediate hubs withwhich they interconnect.

When ordering Term Discount Rate plans or upgradesto the plans, discontinuance charges, as specifiedin 7.2.8 of NECA TARIFF F.C.C. NO. 5, will not applyif the conditions set forth therein are met and thecustomer provides the following orderinginformation:

Term Discounts/Upgrades in Capacity (DDS to DSl orDSl to DS3)- The customer1s order for the disconnect of the

existing service and the installation of the newupgraded service must be received simultaneouslyand specifically reference the application ofupgrade in capacity.

- The customer's disconnect order for the existingservice must reference the upgraded serviceinstallation order.

Customer orders to install and disconnect servicesprovided under a Term Discount plan, where thenumber of circuits remains constant and the customerwishes to maintain the existing Term Discount periodand minimum service period, must be receivedsimultaneously and reference continuation of theexisting term discount period and the minimumservice period on both the installation anddisconnect orders.

DS3 Capacity Discounts/Upgrades- The customer's order for the disconnect of the

current DS3 Capacity Interface and order for theinstallation of the upgraded DS3 CapacityInterface must be received by the TelephoneCompany simultaneously and specificallyreference the application of upgrade incapacity.

- The customer's disconnect order for the existingDS3 service must reference the installationorder.

The Local Transport rate category establishesthe charges related to the transmission andtandem switching facilities between the customerdesignated premises and the end officeswitch(es) which may be a Remote SwitchingModule(s) or WATS Serving Office, where thecustomer's traffic is switched to originate orterminate the customer's communications.Mileage measurement rules are set forth in NECATARIFF F.C.C. NO. 5, Section 6.4.6 and in thissection.

Local Transport is a two-way voice frequencytransmission path composed of facilitiesdetermined by the Telephone Company. The two­way voice frequency transmission path permitsthe transport of calls in the originatingdirection (from the end user end office switchto the customer designated premises) and in theterminating direction (from the customerdesignated premises to the end office switch),but not simultaneously. The voice frequencytransmission path may be comprised of any formor configuration of plant capable of andtypically used in the telecommunicationsindustry for the transmission of voice andassociated telephone signals within thefrequency bandwidth of approximately 300-3000Hz. The customer must specify the choice offacilities (i.e., Voice Grade 2 or 4 wire orHigh Capacity DSl or DS3) to be used in theprovision of the Direct Trunked Transport orEntrance Facility.

The customer must specify when ordering (1)whether the service is to be directly routed toan end office switch or through an access tandemswitch, (2) the type of Direct TrunkedTransport, and whether it will overflow toTandem Switched Transport when service isdirectly routed to an end office, (3) the

When the customer has both Tandem SwitchedTransport and Direct Trunked Transport at thesame end office, the customer will be providedAlternate Traffic Routing as set forth in NECATARIFF F.C.C. NO. 5, Section 6.4.6.

Direct Trunked Transport is available at alltandems and at all end offices except those endoffices identified in NECA TARIFF F.C.C. NO. 4.as not having the capability to provide DirectTrunked Transport. Direct Trunked Transport isnot available from end offices that lackrecording or measurement capability.

Direct Trunked Transport of originating 800series calls from an end office is availableonly from certain equipped end offices,identified in NECA TARIFF F.C.C. NO. 4.

Local Transport is provided at the rates andcharges set forth in 17.2.2 following. Theapplication of these rates with respect toindividual Feature Groups is as set forth in6.4.l(C) following. When more than oneTelephone Company is involved in providing theSwitched Access Service, the Local Transportrates are applied as set forth in NECA TARIFFF.C.C. NO. 5, Section 2.4.7.

The Local Transport rate category includes fourclassifications of rate elements: (1) DirectTrunked Transport, (2) Tandem SwitchedTransport, (3) Transport Interconnection Charge,and (4) Multiplexing.

(1) Direct Trunked Transport

The Direct Trunked Transport rate elementsrecover a portion of the costs associatedwith a communications path between a servingwire center and an end office or servingwire center and a tandem on circuitsdedicated to the use of a single customer.

Three types of Direct Trunked Transport areavailable: ( 1) Voice Grade, 2 or 4-wire,(2) High Capacity DSl, and (3) High CapacityDS3. The minimum period for which a HighCapacity DS3 Direct Trunked Transport isprovided is twelve months.

High Capacity DS3 Direct Trunked Transportcan only be terminated at end offices thatare identified as hub offices that provideDS3 to DSl multiplexing. Additionally, DSlDirect Trunked Transport can only beterminated at end offices that are

Whenthe Direct Trunked Facility mileage is zero,neither the Direct Trunked Facility rate northe Direct Trunked Termination rate willapply.

The Direct Trunked Facility rate recovers aportion of the costs of transmissionfacilities, including intermediatetransmission circuit equipment, between theend points of the interoffice circuits.

DS3 to DSl Multiplexing charges specified in17.2.2 following apply when a High CapacityDS3 Entrance Facility or High Capacity DS3Direct Trunked Facility is connected withHigh Capacity DSl Direct Trunked Transport.The DS3 to DSl multiplexer will convert a44.736 Mbps channel to 28 DSl channels usingdigital time division multiplexing.

DSl to Voice Grade Multiplexing chargesapply when a High Capacity DSl EntranceFacility or High Capacity DSl Direct TrunkedFacility is connected with Voice GradeDirect Trunked Transport. However, a DSl toVoice Grade Multiplexing charge does notapply when a High Capacity DSl DirectTrunked Transport is terminated at anelectronic end office and only SwitchedAccess Service is provided over the DSlfacility (i.e., Voice Grade Special Accesschannels are not derived). The DSl to VoiceGrade multiplexer will convert a 1.544 Mbpschannel to 24 Voice Grade channels.

800 Data Base Access Service is provided toall customers in conjunction with FGC andFGD Switched Access Service. A Basic orVertical Feature Query charge, as set forthin 17.2.2(B) following, is applied for eachquery launched to the 800 data base. TheBasic Query provides the identification ofthe customer to whom the call will bedelivered and includes area of servicerouting which allows routing of 800 seriescalls by telephone companies to differentinterexchange carriers based on the LATA inwhich the call originates. The VerticalFeature Query provides this same customeridentification function in addition tovertical features which may include (1) callvalidation, ensuring that calls originatefrom subscribed service areas; (2) POTStranslation of 800 series numbers, which isgenerally necessary for the routing of 800series calls; ( 3) alternate POTStranslation, which allows subscribers tovary the routing of 800 series calls basedon factors such as time of day, place ororigination of call, etc.; and (4) multiplecarrier routing, which allows subscribers toroute to different carriers based on factorssimilar to those in (3).

The End Office rate category establishes thecharges related to the local end officeswitching and end user line terminationfunctions necessary to complete the transmissionof Switched Access communications to and fromthe end users served by the local end office.The End Office rate category includes the LocalSwitching and Information Surcharge rateelements. Directory Assistance Service is setforth in Section 9 following.

(1) Local Switching

The Local Switching rate element establishesthe charges related to the use of end officeswitching equipment, the terminations in theend office of end user lines, theterminations of calls at Telephone CompanyIntercept Operators or recordings, the STPcosts, and the ss7 signaling functionbetween the end office and the STP.

Local Switching does not apply to FGB andFGD services associated with WirelessSwitching Centers (WSCs) directlyinterconnected to a Telephone Company accesstandem office.

Where end offices are appropriatelyequipped, international dialing may beprovided as a capability associated withLocal Switching for FGC and FGD services.International dialing provides thecapability of switching international callswith service prefix and address codes havingmore digits than are capable of beingswitched through a standard FGC or FGDequipped end office.

Rates for Local Switching are set forth in17.2.3 following. The application of theserates with respect to individual FeatureGroups is as set forth in 6.4.l(C)following.

There are four types of functions includedin the Local Switching rate element: CommonSwitching, Transport Termination, LineTermination and Intercept. These functionsare described in (a) through (d) following.

Line termination provides for theterminations of end user lines in thelocal end office. There are two typesof Line Terminations, i.e., Common LineTerminations and Special Access ServiceTerminations, used in the provision ofWATS or WATS-type services at TelephoneCompany designated WATS Serving Offices.

Special Access Service Terminations aredifferentiated by line side versus trunkside terminations. In addition, thereare various types of originating andterminating line side terminations,depending on the type of Special AccessService signaling. Line sideterminations are available with eitherdial pulse or dual tone multifrequencyaddress signaling.

(d) Intercept

The Intercept function provides for thetermination of a call at a TelephoneCompany Intercept operator or recording.The operator or recording tells a callerwhy a call, as dialed, could not becompleted, and if possible, provides thecorrect number.

(2) Information Surcharge

Information Surcharge rates are assessed toa customer based on the total number ofaccess minutes. Rates for InformationSurcharge are as set forth in 17.2.3(B)following. The application of these rateswith respect to individual Feature Groups isas set forth in 6.4.l(C) following.

Two types of rates and charges apply to SwitchedAccess Service: recurring (usage and flat rates)and nonrecurring charges. These rates and chargesare applied to the various rate elements as setforth in (C) following.

(A) Recurring Rates

(1) Usage rates for Switched Access Service arerates which apply on a per access minute orper call basis. These charges areaccumulated over a monthly period.

(2) Flat rates for Switched Access Service arerates which apply on a per rate elementbasis per month.

For Direct Trunked Transport ordered to theend office, a Local Transport nonrecurringtrunk activation charge, as set forth in17.2.l(E) following, will be applied at theend office on a per order basis for eachgroup of 24 Direct Trunked Transport trunksor fraction thereof that is activated at theend office.

For Direct Trunked Transport ordered to theaccess tandem a Local Transport nonrecurringtrunk activation charge, as set forth in17.2.l(E) following, will be applied at theaccess tandem on a per order basis for eachgroup of 24 Direct Trunked Transport trunksor fraction thereof that is activated at theaccess tandem.

For Tandem Switched Transport, a LocalTransport nonrecurring trunk activationcharge, as set forth in 17.2.l(E) following,will be applied at the access tandem on aper order basis for each group of 24dedicated trunks or fraction thereof that isactivated at the access tandem.

A maximum of 24 trunks can be activated on aDS1 facility and a maximum of 672 trunks canbe activated on a DS3 facility.

(2) Interim NXX Translation Optional Feature

This nonrecurring charge applies to theinitial order for the installation of theInterim NXX Translation optional featurewith FGC or FGD service and for eachsubsequent order received to add or changeNXX translation codes. The charge appliesif this optional feature is installedcoincident with or at any time subsequent tothe installation of Switched AccessServices. The charge is applied per order,per LATA or Market Area by the TelephoneCompany. When multiple telephone companiesprovide the translation function, thenonrecurring charge is assessed only by theTelephone Company providing the finaltranslation function, which identifies thecustomer's traffic. This traffic is thendelivered to the customer's point oftermination without further translation.

(3) Service Rearrangements

All changes to existing services, other thanchanges involving administrative activitiesand FGA off-hook supervisory signaling, willbe treated as a discontinuance of theexisting service and an installation of anew service. The nonrecurring chargedescribed in (1) preceding applies for thiswork activity. Moves that change the

For additions, changes or modifications tooptional features which do not have theirown specific nonrecurring charges, an AccessOrder Charge, as set forth in 17.4.l(A)following will apply, with the exception ofthe addition of 64 Clear Channel Capabilityto an existing service. When an optionalfeature is not required on each transmissionpath, but rather for an entire transmissionpath group, an end office or an accesstandem switch, only one such charge willapply.

When the 64 Clear Channel Capabilityoptional feature is installed on an existingfacility, the addition will be treated as adiscontinuance and start of service and allassociated non-recurring charges will apply.

For conversion of FGC and FGD trunks frommultifrequency address signaling to SS7signaling or from SS7 signaling to MFaddress signaling, nonrecurring charges willapply as set forth in 17.2.l(D).

(C) Application of Rates

The application of these rates is dependentupon the Feature Group, type of transport(e.g. direct trunked, tandem switched, type ofmultiplexing) and the availability of equalaccess capabilities in the end office to whichthe service is provided.

The following rules provide the basis forapplication of rates and charges:

Switched Access rates apply to all FGCaccess minutes provided to customers tofurnish MTS/WATS, to all terminating accessminutes, to all access minutes originatingat end offices equipped with equal accesscapabilities (i.e.,FGD), and to DirectoryTransport Service. Switched access ratesalso apply to FGB and FGD access minutesoriginating or terminating in a WirelessSwitching Center (WSC), which is directlyconnected to a Telephone Company accesstandem office. In addition, rates apply toFGA and FGB access minutes used in theprovision of MTS/WATS service.

Switched access rates always apply to thefollowing Local Transport rate elements:

(7) Common Channel Signaling/Signaling System 7(CCS/SS7) Network Configuration

The CCS/SS7 Network Connection is comprisedof a Signaling Mileage Facility charge, aSignaling Mileage Termination charge, aSignaling Entrance Facility charge, and aSignaling Transfer Point (STP) Port charge.

The Signaling Mileage Facility charge isassessed on a per facility per mile basis.The Signaling Mileage Termination charge isassessed on a per termination basis, at eachend of the facility. When the SignalingMileage Facility mileage measurement iszero, Signaling Mileage Termination chargeswill not apply.

The STP port charge is assessed on a perport basis for each termination of aSignaling Mileage Facility at an STP.

(8) 800 Data Base Access Service

A basic Query or Vertical Feature Querycharge applies for each completed query thatis returned from the 800 data baseidentifying the customer to whom the call isdelivered, whether or not the actual call isdelivered to the customer. The query isconsidered completed when the appropriatecall routing information is returned to theService Switching Point (SSP) that launchedthe query. Charges will be applied only bythose companies whose wire centers areidentified as assessing query charges inNECA TARIFF F.C.C. NO. 4, WIRE CENTERINFORMATION.

When FGC or FGD service is used for theprovision of 800 Data Base Access serviceand the total minutes of use (MOU) and/orcount of queries can be determined for eachcustomer at a tandem or SSP but cannot bedetermined by individual end office, anallocation method will be utilized todetermine MOU and/or queries by end officeand customer. For each end office, a ratiowill be developed and applied against thetotal MOU and/or count of queries for agiven customer as determined by the SSP ortandem. These ratios will be developed bydividing the unidentified originating 800series MOU at an end office by the totalunidentified originating MOU in all endoffices subtending the tandem or SSP.

6.9 IntraLATA Dialing Parity Surcharge

The Telephone Company may include a surcharge on allintraLATA originating access minutes subject topresubscription to recover costs associated with theimplementation of intraLATA dialing parity, in accordancewith its intraLATA dialing parity plan as filed with theNebraska Public Service Commission (NPSC). The surchargewill recover incremental costs associated with hardwareand software upgrades, customer notification, and anyother costs approved by the NPSC in the TelephoneCompany's Dialing Parity Plan.

7.1 General

7.1.1 Channel Types

Following is a brief description of each type ofchannel:

Voice Grade- a channel for the transmission ofanalog signals within an approximate bandwidth of300 to 3000 Hz.

Program Audio- a channel for the transmission ofaudio signals. The nominal frequency bandwidths arefrom 200 to 3500 Hz, from 100-5000 Hz, from 50-8000Hz, or from 50-15000 Hz.

Digital Data- a channel for the digital transmissionof synchronous serial data at rates of 2.4, 4.8,9.6, 19.2, 56.0 or 64.0 Kbps.

High Capacity- a channel for the transmission ofisochronous serial digital data at rates of 1.544,3.152, 6.312, 44.736 or 274.176 Mbps.

Detailed descriptions of each of the channel typesare provided in 7.4 through 7.11 of NECA TARIFFF.C.C. NO. 5.

The customer also has the option of ordering VoiceGrade and High Capacity facilities to TelephoneCompany hubs for multiplexing to individual channelsof a lower capacity or bandwidth. Descriptions ofthe types of multiplexing available at the hubs, aswell as the number of individual channels which maybe derived from each type of facility are set forthin 7.6 and 7.10 of NECA TARIFF F.C.C. NO. 5.Additionally, the customer may specify optionalfeatures for the individual channels of the facilityto further customize the channel to meet specificcommunications requirements. Optional features andfunctions are described in 7.2.1 of NECA TARIFFF.C.C. NO. 5.

Each service consists of a basic channel to which atechnical specifications package (customized orpredefined), channel interface(s) and, when desired,optional features and functions are added toconstruct the service desired by the customer.Technical specifications packages and channelinterfaces are described in NECA TARIFF F.C.C. NO.5, Section 15. This information indicates thetransmission parameters that are available with eachpackage. Optional features and functions aredescribed in Section 7, NECA TARIFF F.C.C. NO. 5.

Customized technical specifications packages will beprovided where technically feasible. If theTelephone Company determines that the requestedparameter specifications are not compatible, thecustomer will be advised and allowed to change theorder.

When a customized channel is ordered, the customerwill be notified whether Additional EngineeringCharges apply. In such cases, the customer will beadvised and allowed to change the order.

(A) Channel interfaces at each Point of Terminationon a two-point service may be symmetrical orasymmetrical. On a multipoint service they mayalso be symmetrical or asymmetrical, butcommunications can only be provided betweencompatible channel interfaces. Only certainchannel interfaces are compatible, as set forthin NECA TARIFF F.C.C. NO. 5, Section 15.

7.2 Rate Regulations

This section contains the specific regulations governingthe rates and charges that apply for Special Access.

7.2.1 Rate Categories

There are three basic rate categories which apply toSpecial Access Service:

- Channel Terminations, described in 7.2.l(A)following;

- Channel Mileage, described in 7.2.l(B) following;- and Optional Features and Functions, described in

7.2.l(C) following.

(A) Channel Termination

The Channel Termination rate category recoversthe costs associated with the communicationspath between a customer designated premises(CDP) and the serving wire center (SWC) of thatpremises. Included as part of the ChannelTermination is a standard channel interfacearrangement which defines the technicalcharacteristics associated with the type offacilities to which the access service is to beconnected at the Point of Termination (POT) andthe type of signaling capability, if any. Thesignaling capability is provided as an optionalfeature as set forth in (C) following. OneChannel Termination charge applies per CDP atwhich the channel is terminated. This chargewill apply even if the CDP and the SWC arecollocated in a Telephone Company building. Ifthe CDP is considered by the Telephone Companyto be located an extraordinary distance from theSWC, Special Construction charges will apply.

For a Digital Data Service 56.0 or 64.0 Kbps orfor a 1.544 Mbps or 44.736 Mbps High CapacityService connecting a CDP to a Public Packet DataNetwork Service as described in NECA TARIFFF.C.C. NO. 5, Section 16, there will be a chargefor only one Channel Termination.

For DS3 High Capacity Service, the ChannelTermination rates are made up of the DS3Capacity Interface rate and the DS3 ChannelInstalled rate. The Capacity Interface rate isdependent upon the capacity ordered (i.e.,Capacity Interface of 1, 3, 6 or 12) and isapplicable at each CDP. The capacity ordered isthe maximum number of DS3 services that can beterminated on a given service at the CDP (e.g.,a capacity of 3 can terminate 1, 2 or 3 DS3services). One DS3 Channel Installed rateapplies per CDP at which the channel isterminated for each DS3 channel ordered. The Channel Mileage rate category recovers thecosts associated with the end office equipmentand the transmission facilities between theserving wire center (SWC) associated with twocustomer designated premises (CDP), between aSWC associated with a CDP and a TelephoneCompany hub, or between two Telephone Companyhubs. Channel Mileage rates are comprised ofthe Channel Mileage Facility rate and theChannel Mileage Termination rate.

(1) Channel Mileage Facility

The Channel Mileage Facility rate recoversthe per mile cost for the transmission pathwhich extends between the Telephone CompanySWCs and/or hub(s).

(2) Channel Mileage Termination

The Channel Mileage Termination raterecovers the cost for end office equipmentassociated with terminating the facility(i.e., basic circuit equipment andterminations at SWCs and hubs). The ChannelMileage Termination rate will apply at theSWC(s) for each CDP and Telephone Companyhub where the channel is terminated. If theChannel Mileage is between Telephone Companybridging hubs, the Channel MileageTermination rate will apply per TelephoneCompany designated hub. If the ChannelMileage is between the SWC for a CDP and aWATS Serving Office, the Channel MileageTermination rate will apply at both the SWCassociated with the CDP and the WATS ServingOffice. When the Channel Mileage Facilityis zero (i.e., collocated SWCs), neither theChannel Mileage Facility rate nor theChannel Mileage Termination rate will apply.

(C) Optional Features and Functions

The Optional Features and Functions ratecategory recovers the costs associated withoptional features and functions which may beadded to a Special Access Service to improve itsquality or utility to meet specificcommunications requirements. These are notnecessarily identifiable with specificequipment, but rather represent the end resultin terms of performance characteristics whichmay be obtained. These characteristics may beobtained by using various combinations ofequipment. Although the equipment necessary toperform a specified function may be installed atvarious locations along the path of the service,they will be charged for as a single rateelement.

Examples of Optional Features and Functions thatare available include, but are not limited to,the following:

- Signaling Capability- Hubbing Functions- Conditioning- Transfer Arrangements

performed. The bridging functions performed areto connect three or more CDPs in a multipointarrangement. The multiplexing functions are tochannelize analog or digital facilities toindividual services requiring a lower capacityor bandwidth.

NECA TARIFF F.C.C. NO. 4 identifies SWCs, hublocations, hub level (i.e., hub, terminus hub,intermediate hub, or super-intermediate hub) andthe type of bridging or multiplexing functionsavailable. Additionally, subtending wirecenters are identified for intermediate andsuper-intermediate hubs.

7.2.2 Types of Rates and Charges

There are three types of rates and charges. Theseare monthly rates, daily rates and nonrecurringcharges. The rates and charges are described asfollows:

(A) Monthly Rates

Monthly rates are recurring rates that applyeach month or fraction thereof that a SpecialAccess Service is provided. For billingpurposes, each month is considered to have 30days.

(B) Daily Rates

Daily rates are recurring rates that apply toeach 24 hour period or fraction thereof that aProgram Audio Special Access Service is providedfor part-time use. For purposes of applyingdaily rates, the 24 hour period is not limitedto a calendar day.

a consecutive 30 day period will be charged thedaily rate, not to exceed the monthly rate.

(C) Nonrecurring Charges

Nonrecurring charges are one-time charges thatapply for specific work activity (i.e.,installation or change to an existing service).The types of nonrecurring charges that apply forSpecial Access Service are installation ofservice, installation of optional features andfunctions, and service rearrangements. Thesecharges are in addition to the Access OrderCharge, as specified in 17.4.1 following.

(1) Installation of Service

Nonrecurring charges apply to each serviceinstalled. The nonrecurring charges for theinstallation of service are set for eachchannel type as a nonrecurring charge forthe Channel Termination and, in some cases,the Channel Mileage Termination.

(2) Installation of Optional Features andFunctions

When optional features and functions areinstalled coincident with the initialinstallation of service, no separatenonrecurring charge is applicable. Whenoptional features and functions areinstalled or changed after the installationof service, an Access Order Charge asspecified in 17.4.1 following will apply perorder.

(3) Service Rearrangements

Service rearrangements are changes toexisting (installed) services. Such servicerearrangements may be administrative innature or may involve an actual physicalchange to the service. Changes to pendingorders are set forth in 5.4 of NECA TARIFFF.C.C. NO. 5.

Changes in the physical location of thepoint of termination or customer designatedpremises are moves as set forth in 7.2.3 ofNECA TARIFF F.C.C. NO. 5.

Changes in the type of Service or ChannelTermination which result in a change of theminimum period requirement will be treatedas a discontinuance of the service and aninstallation of a new service.

Changes in ownership or transfer ofresponsibility from one customer to anotherwill be treated as a discontinuance of theservice and an installation of new service.In the event the change in ownership ortransfer of responsibility does notinterrupt use of or relocate facilities orarrangements, the change will be treated asan administrative change.

Administrative changes will be made withoutcharge(s) to the customer. Administrativechanges are as follows:

- Change of customer name,- Change of customer or customer's end user

premises address when the change ofaddress is not a result of physicalrelocation of equipment,

7.7 Program Audio Service

Program Audio Service is not currently offered by TheTelephone Company.

7.12 Internet Service to K-12 Schools

The Internet is a public service offering whichprovides access to a network of computers. Rates, asset forth in 17.3.11 following, will apply to one 56kbps Digital Data Service circuit per local callingarea for connection to the Internet. Theseconnections, provided as a public service to K-12schools in the State of Nebraska, may be used foreducational access to the Internet to the nearestEducational Service Unit (ESU) or frame relay point.Schools may not allow Internet access to third parties,other than teachers, administrators, or students,through this service.

7.13 Other High Speed Access to Internet Service for Schools

Charges for 64 kbps Digital Data Services and HighCapacity Services will be discounted when sold to theState of Nebraska, any Nebraska Public School District,any Educational Service Unit or any accredited NebraskaPost Secondary School for provision of access to theInternet. Discounts will be determined on anindividual case basis. This service is subject to thesame restrictions as set forth in 7.12 above for 56kbps service.

9. Directory Assistance Service

9.1 General Description

9.1.3 Rate Categories

There are two rate categories which apply toDirectory Assistance Service:

-Directory Assistance Service Call-Directory Transport Service

(A) Directory Assistance Service Call

The Directory Assistance Service Call ratecategory provides for the use of generalDirectory Assistance (DA) Services, such asoperators and DA access equipment necessary toprovide DA Service to a customer.

(B) Directory Transport Service

Directory Transport Service provides thetransmission facilities and transporttermination between the premises of theordering customer and the DA location. Forpurposes of determining Directory TransportMileage, distance will be measured from thewire center that normally serves the customerpremises to the DA location(s).

Directory Transport is a two-way voicefrequency transmission path composed ofSwitched Access Local Transport facilities asset forth in 6.1.3 preceding. The two-wayvoice frequency path transports calls in theterminating direction (from the premises of theordering customer to the DA location). Thefollowing rate elements, which are more fullydescribed in 6.l.3(A) preceding, areapplicable:

-Entrance Facility for the transport of the DAcall from the customer's premises to theserving wire center (SWC) of that premises.

- Tandem Switched Transport (i.e., TandemSwitched Facility, Tandem Switched Termination,and Tandem Switching) for the transport of theDA call from the customer's SWC to the DAlocation with switching at a tandem, or fromthe tandem to the DA location.

- Interconnection Charge for the Local Transportcosts that are not recovered by the EntranceFacility, Direct Trunked Transport, TandemSwitched Transport, Multiplexing, or dedicatedsignaling (i.e., SS7) rates.

- Multiplexing. DS3 to DSl Multiplexing chargesapply when a High Capacity DS3 EntranceFacility or Direct Trunked Facility isconnected with High Capacity DSl Direct TrunkedTransport. The DS3 to DSl multiplexer willconvert a 44.736 Mbps channel to 28 DSlchannels using digital time divisionmultiplexing.

DSl to Voice Grade Multiplexing charges applywhen a High Capacity DSl Entrance Facility orDirect Trunked Facility is connected with VoiceGrade Direct Trunked Transport. A DSl to VoiceGrade Multiplexing charge does not apply when aHigh Capacity DSl Direct Trunked Facility isterminated at an electronic end office and onlySwitched Access Service is provided over theDSl facility. The DSl to voice multiplexerwill convert a 1.544 Mbps channel to 24 VoiceGrade channels.

Thecombination of FGB, FGC or FGD Switched AccessService with DA Service will only be providedat such available and appropriately equippedaccess tandem switches.

When Directory Transport is provided using aDirect Trunked Transport to the DA location, noaddress signaling is provided. When DirectoryTransport is provided with the use of an accesstandem switch, wink start-start pulsingsignaling is provided at the access tandemswitch.

(B) DA Service Arrangements

All changes to existing services other thanchanges involving administrative activitieswill be treated as a discontinuance of theexisting service and an installation of a newservice.

9.4.2 DA Service Call Charge

The DA service call charge, as set forth in17.2.5(A) following, applies for each call to DAService. (A "call" is defined as one which hasbeen answered by a DA operator.) The chargeapplies whether or not the DA operator provides therequested telephone number. The number of callsanswered by DA operators will be accumulated byTelephone Company measuring equipment. A creditfor the provision of an incorrect telephone numberwill be applied as set forth in 9.4.8 of NECATARIFF F.C.C. NO. 5.

9.4.3 Directory Transport Service

The Local Transport charges set forth in 17.2following are also applicable to DirectoryTransport Service and will be assessed on the samebasis as the Switched Access Local Transport rateelements set forth in 6.1.3(A) preceding: EntranceFacility, Direct Trunked Transport, Tandem SwitchedTransport, Multiplexing, and InterconnectionCharge.

10.1 General

This section contains a description of the regulations,rates, charges and liabilities applicable for the specialconstruction of facilities provided by the TelephoneCompany which are used to furnish intrastate accessservices.

Special Construction is required when a customer requestsservice and one or more of the following conditionsexist (s) :

The facilities to provide services are not availableand, at the request of the customer, the TelephoneCompany constructs facilities to provide the servicesfor the customer, and there is no other requirement forthe facilities so constructed.

- At the request of the customer, the Telephone Companyconstructs facilities of a type other than that whichthey would normally furnish in order to provideservices for the customer.

- In order to comply with requirements specified by thecustomer, construction by the Telephone Companyinvolves a routing of facilities other than that whichthey would normally utilize to provide services for thecustomer.

- At the request of the customer, the Telephone Companyconstructs a greater quantity of facilities than thatwhich they would otherwise construct in order tofulfill the customer's initial requirement forservices.

The facilities to provide services are not availableand, at the request of the customer, the TelephoneCompany expedites construction of the facilities atgreater expense than would otherwise be incurred.

- The facilities to provide services are not availableand, at the request of the customer, the TelephoneCompany constructs temporary facilities to provideservices for the period during which the permanentfacilities are under construction.

When special construction of facilities is required, thefollowing regulations shall apply.

10.2.1 Ownership of Facilities

The Telephone Company shall retain ownership of allspecially constructed facilities which it provides.

10.2.2 Interval to Provide Facilities

Based on available information and the type ofservice ordered, the Telephone Company willestablish a completion date for the speciallyconstructed facilities. If circumstances beyondthe Telephone Company's control force thecompletion date to be rescheduled, the TelephoneCompany will work with the customer to establish anew completion date.

10.2.3 Special Construction Involving Both Intrastate andInterstate Facilities

When special construction involves facilities to beused to provide both intrastate and interstateservices, charges for the portion of theconstruction used to provide intrastate serviceshall be in accordance with this catalog. Chargesfor the portion of the construction used to provideinterstate service shall be in accordance withterms and conditions as set forth in NECA TARIFFF.C.C. NO. 3.

10.2.4 Payments for Special Construction

(A) Payment of Charges

All bills are due 31 days after the bill dateand are payable in immediately available funds.

(B) Late Payment Penalties

If the entire amount billed, excluding anydisputed amount, is received by the TelephoneCompany later than 31 days after the bill date,a late factor shall apply. The late factorshall be the lesser of:

(1) the highest interest rate (in decimalvalue) which may be levied by law forcommercial transactions, compounded dailyfor the number of days from the paymentdate to and including the date that thecustomer actually makes the payment to theTelephone Company, or

(2) 0.000292 per day, compounded daily for thenumber of days from the payment date to andincluding the date that the customeractually makes the payment to the TelephoneCompany.

(C) Billing Disputes Resolved in Favor of theTelephone Company

Late payment charges will apply to amountswithheld pending settlement of the dispute.Late payment charges are calculated as setforth in (B) preceding except that when thecustomer disputes the bill on or before thepayment date and pays the undisputed amount onor before the payment date, the penaltyinterest period shall not begin until 10 daysfollowing the payment date.

(D) Billing Disputes Resolved in Favor of theCustomer

If the customer pays the total billed amountand disputes all or part of the amount, theTelephone Company will refund any overpayment.In addition, the Telephone Company will pay tothe customer penalty interest on theoverpayment. When a claim is filed within 90days of the due date, the penalty interestperiod shall begin on the payment date. When aclaim is filed more than 90 days after the duedate, the penalty interest period shall beginfrom the date of the claim or the date ofoverpayment, whichever is later.

(E) Partial Payments

For special construction projects requiring aconstruction period longer than one month, theTelephone Company will require partialpayments. The partial payment amounts will bedetermined by dividing the estimated totalnonrecurring charge for the specialconstruction project by the number of monthsbetween the time when the special constructionbegins and the completion date. Partialpayments may not exceed the total nonrecurringcharge for the special construction project.Partial payments will be billed monthly, andpayment will be due 31 days after the billdate. If any partial payment is not receivedby the due date the Telephone Company willimmediately cease all work on the specialconstruction project, and cancellation chargeswill apply as set forth in 8.2.5(C) (3)following.

10.2.5 Liabilities and Charges for Special Construction

(A) General

This section describes the various charges andliabilities that may apply when the TelephoneCompany provides special construction offacilities in accordance with an order forservice. Written approval of all liabilitiesand charges must be provided to the TelephoneCompany prior to the start of construction.

(B) Development of Liabilities and Charges

Special construction charges and liabilitieswill be developed based on estimated costs.These estimates will be adjusted and anappropriate charge or credit determined uponproject completion, on an individual casebasis.

Depending on the specifics associated with eachindividual case, one or more of the followingspecial construction charges and/or liabilitiesmay be applicable:

(1) Nonrecurring Charge

A nonrecurring charge always applies andincludes one or more of the followingcomponents:

(a) Case Preparation Charge

A nonrecurring charge always includes acase preparation charge component tocover the administrative expensesassociated with preparing a specialconstruction case.

(b) Construction Charge

A construction charge will be appliedto recover all direct labor andmaterial costs required to complete thespecial construction project, alongwith overhead loadings which aredeveloped according to standardTelephone Company policies.

(c) Replacement Charge

If any portion of specially constructedfacilities requires replacementinvolving capital investment, areplacement charge will apply. Thischarge will be the installed cost ofthe replaced specially constructedfacilities. If any portion of thespecially constructed facilities fails,service will not be restored untilnotification is provided in writingthat replacement is required and suchreplacement is ordered.

(d) Rearrangement Charge

If the Telephone Company is requestedto rearrange existing speciallyconstructed facilities, a nonrecurringcharge equal to the cost of anyadditional special construction willapply.

(2) Lease Charge

A lease charge applies when the TelephoneCompany leases equipment in order to meetservice requirements. The amount of thecharge is equal to the net added cost tothe Telephone Company caused by the lease.

(3) Cancellation Charge

If a service order with which specialconstruction is associated is cancelledprior to the start of service, a

14.1 General.

14.1.a The following prospective Intercarrier Compensation("ICC") framework shall apply to Voice over InternetProtocol ("VoIP") - Public Switched Telephone Network("PSTN) traffic that would otherwise be subject to theTelephone Company's terminating intrastate toll accesscharges. This framework is being established solely as aresult of the Report and Order and Further Notice ofProposed Rulemaking, FCC 11-161, released November 18,2011 (the "Report and Order") by the FederalCommunications Commission ("FCC") and the FCC' s Order, (T)DA 12-147, released February 3, 2012. (T)

14.1.b The filing of this Section 14 by the TelephoneCompany is not and may not be used as an admission thatthe prior ICC frameworks applicable to the assessment ofaccess charges to intrastate traffic originated on orterminated to the Telephone Company's network do notapply.

14.3 Establishment of the Percent VoIP Usage Factor

14.3.a Should the customer desire to avail itselfof the provisions of this Section 14, thecustomer shall first provide to the TelephoneCompany a factor for Intrastate Toll VoIP-PSTNTraffic identified through the application ofSection 14.2, above (the "Percent VoIP Usage""PVU" factor) .

14.3.b No customer shall provide a PVU factorwithout, in good faith, the ability to promptlysupply traffic studies or other reasonableanalyses to demonstrate the accuracy of the PVUfactor.

14.3.c Timing of and procedures applicable to theupdate of a PVU factor by a customer shall begoverned by the provisions applicable to updatingof a Percent Interstate Usage as contained inthis Tariff or in the Telephone Company'sinterstate exchange access tariff.

14.3.e Provided that the customer has not already includedsuch traffic in its PVU factor calculation, in the eventthat the Telephone Company provides service to its endusers via Internet Protocol-capable customer premisesequipment, the Telephone Company shall report to thecustomer the percentage of its end users that utilizesuch an arrangement and shall apply such percentage tothe total Intrastate Toll traffic and rate such trafficin a manner consistent with Section 14.4, below.

14.4 Application of the PVU Factor.

14.4.a Although subject to the dispute provisions of thisTariff and treated as intrastate jurisdictional trafficby the Telephone Company, traffic delivered to thecustomer or received from the customer for termination onthe Telephone Company's network that is determined to beIntrastate Toll VoIP-PSTN Traffic by application of thePVU factor shall be subject to the lower of then (T)applicable interstate access rates and rate structureestablished by the Telephone Company or the Company's (T)corresponding then existing intrastate access rates. (T)

14.4.b Any dispute arising from the provisions of thisSection 14 shall be subject to the dispute provisions ofthis Tariff. Notwithstanding any provision to thecontrary, should a dispute arise under this Section 14regarding the level of the reported PVU factor, untilsuch time as such dispute is resolved, the customer shallpay the Telephone Company the applicable interstateaccess rate for the Intrastate Toll VoIP-PSTN Trafficthat is subject to the dispute based on the Customer'sreported PVU factor. True-ups of charges by theTelephone Company shall be based on the resolution of thedispute along with applicable interest as provided for inthe dispute provisions of this Tariff.

16 Public Packet Data NetworkThe Telephone Company concurs with Section 16 of NECA TARIFF F.C.C. NO. 5. Exceptions toSection 16 are as follows.

16.1 Frame Relay ServiceFrame Relay Service will be provided where facilities are available and on an ICB basis.

16.2 ATM ServiceATM Service will be provided where facilities are available and on an ICB basis.

16.3 Ethernet Transport Service

16.3.1 GeneralEthernet Transport Service (ETS) is a high speed data transport service that providesend-to-end transmission using Ethernet packet technology at transport speedsbeginning at 5Mbps and then ranging in 10Mbps increments following. ETS utilizes theTelephone Companies network to transport broadband multimedia traffic (i.e., voice,data and video). Ethernet packets generated by Ethernet-compatible customerpremises equipment (CPE) are transmitted using available capacity on sharedtransmission paths through the Telephone Company's ETS network to the pre­specified destination.

ETS may be utilized to 1) interconnect customer designated premises (CDPs) servedby the Telephone Company's ETS network, 2) interconnect with its local area network(LAN) to the Telephone Company's ETS network and /or 3) interconnect its CDPs to anEthernet network located outside of the Telephone Company's servicing territory.

ETS is provided using a combination of ETS Channel Termination (ETS CT), ETSPorts and Ethernet Virtual Connections. ETS may be utilized in conjunction withSpecial Access High Capacity services described in Section 7.

An ETS Port is required to provide the interface into the Telephone Company's ETSnetwork. ETS virtual connections establish a shared transmission path between twoports on the Telephone Company's network. ETS extended virtual connections arerequired to connect to adjacent or non-adjacent network providers as described belowin Section 16.3.3.

The transmission quality of ETS is not guaranteed and is offered to ETS customers at abest effort level. The Telephone Company will attempt to deliver all Ethernet packetsreceived; however, network congestion may result in a loss of Ethernet packets.Transmission speeds using copper facilities may be affected by distance from the

Services are provided where available and by the Telephone Companies providingrates in Section 17 following.

16.3.2 Obligation of the CustomerIn addition to other regulations described in other sections of this tariff, the followingprovisions apply to ETS:

A) ETS customers are responsible for providing the Telephone Company with thenecessary information to provision ETS as specified in the preceding Section 5.2Ordering Requirements.

B) Maintenance of required CPE is the responsibility of the customer.

16.3.3 Rate RegulationsA) Rate Categories

The various ETS rate elements are described below.1) ETS Channel Terminations (CTs)

An ETS CT provides transport facility between the CDP and an ETS Port at theTelephone Company's ETS switch.Monthly and nonrecurring charges apply for each ETS CT ordered. The monthlyrecurring rate and nonrecurring charge are based upon the bandwidth capacityordered.

2) ETS PortsETS Ports provide the interface at the Telephone Company's ETS switch for datatraffic to and from the CPE as well as for connecting the Telephone Company'sETS network with the Ethernet network of another network provider. The monthlyrecurring rate and nonrecurring charge are based on the bandwidth capacityordered.There are two types of ETS ports; ETS Basic Ports and ETS Interconnection Ports:a) ETS Basic Ports provide the interface to the Telephone Company's ETS

network and do not include transport. Each Basic Port must be associatedwith an Ethernet virtual connection. The bandwidth speed of the Port mustbe equal to or greater than the ETS CT.

b) ETS Interconnection Ports also provide the interface to the TelephoneCompany's ETS network and do not include transport. ETS InterconnectionPorts connect 1) a CDP served by an ETS or non-ETS switch to theTelephone Company's ETS network; 2) interconnect two ETS networks. Thebandwidth speed of the Port must be equal to or greater than the ETS CT.

4) ETS Interconnect Ethernet Virtual Connections (ETS I-EVCs)ETS I-EVCs are logical associations established across a shared transmissionpath that allow the ETS customer to transmit packets between Ports located in theTelephone Company's ETS network and a non-NITA Ethernet network. Themonthly recurring rate and nonrecurring charge are based on the bandwidthcapacity ordered.

C) Types of Rates and ChargesThere are two types of rates and charges; monthly and nonrecurring.1) Monthly Rates

Monthly rates are recurring rates that apply each month or fraction thereof whenan ETS service is provided.

2) Nonrecurring ChargesNonrecurring charges are one-time charges for specific work, like installation of aservice. There are four types of nonrecurring charges that apply to ETS; 1)installation, 2) service rearrangement, 3) moves and 4) design changes. Thesecharges are in addition to the Access Order Charge specified in Section 17.4.1.a) Installation of Service

Nonrecurring charges apply for installation of ETS CTs, ETS Ports and therespective ETS virtual connection.

b) Rearrangement of ServiceService rearrangements of existing services may be administrative only, orthey may also involve actual physical changes in the service.When an increase or decrease in bandwidth is requested a new minimumperiod requirement will be established and any remaining minimum periodcharges for the discontinued service will be due. The design change chargedescribed in (d) below will apply for changes in bandwidth.Charges will not apply for the following Administrative changes:

• Change of customer name• Change of address when it doesn't affect the location of the equipment• Change of billing information, such as contact name or telephone

A move involves a change in the physical location. Either at the point oftermination within the customer premise or to a new customer premise.

• Moves within the customer premise will be half of the installationcharge

• Moves to a new customer premise will establish a new minimumperiod requirement and any remaining minimum period charges for thediscontinued service will be due

d) ETS Design ChangesThe Design Change charged included in Section 17.4.1 will apply for physicalchanges in the ETS service.

16.3.4 ETS Term Discount PlanAn optional term discount plan is available for a customer subscribing to ETS services forat least 24 months. The rates for 24 months are included in the tariff and terms beyond 24months will be provided on an individual case basis (ICB). Rates effective at the time theterm discount is agreed to will remain in place for the term established when the servicesare ordered. Rates will not increase or decrease during the term.

Discontinuance charges will apply when a customer fails to satisfy their term commitmentperiod for ETS services. The discontinuance charge will be equal to 35% of the totalundiscounted monthly rate for each committed ETS Port included in the Term DiscountPlan for each month remaining in the unsatisfied term commitment period.

The following example illustrates how the Telephone Company will calculate the applicablediscontinuance charge.

Example:

A customer discontinues its existing ETS Term Discount Plan in its entirety in the 14"month of a 24 month term commitment period. Assuming the undiscounted monthly rate is$300 for three ports, the Telephone Company would bill the customer a term plandiscontinuance charge total of $3,150 ($300 x 35% x 3 ports x 10 months).

16.4 ISP Gateway ServiceISP Gateway Service will be provided where facilities are available on an ICB basis. (N)
