Around 60 distinguished individuals from various walks of life have

issued a statement protesting against a recent order of the Meghalaya High Court, directing the Central

government to consider the use of Armed Forces (Special Powers) Act, 1958, in the Garo Hills area.

The statement signed by social activist Aruna Roy, Prashant Bhushan, Nikhil Dey, Teesta Setalvad

among others said: The said direction issued by the High Court of Meghalaya is in complete violation

of the Constitutional arrangement of separation of powers. The power to notify an area as disturbed

and extend application of the AFSPA lies exclusively with the executive, that is, the State or the Central

governmentIn fact, the point of view of the Court that the prevailing circumstances in Garo Hills

warrants imposition of the AFSPA is merely based on the lay impressions of the Bench a view whichis uninformed, extraneous and has no basis in law and betrays lack of application of mind. The

methodology and logic employed by the court in arriving at these conclusions is alien to established

contours of legal reasoning and judicial rigor.

According to the eminent citizens, The instant order severely damages the credibility of the High Court

of Meghalaya as an independent arbiter of citizens democratic rightsIn addition to

misunderstanding its role in a democracy, we are also concerned that the High Court has chosen to

advocate imposition of the AFSPA a law whose democratic credentials are in serious doubt. The

AFSPA is widely considered to be a legislative measure unique in its absolute disregard of the rights of

the residents against unlawful exercise of coercive power. The law exposes people to wanton and

reckless use of force by security forces as it grants them absolute power and authority to use force. Over

the years, a consensus has emerged on the AFSPA being a security measure of colonial origin in that it

is a distinctively regressive tool which sets up a military ecosystem where security forces act with

impunity and whip up an environment of fear and terror in the hearts and minds of people living in

these places. The use of the AFSPA as a substitute for routine policing and maintaining law and order isa dangerous development. It is one that a High Court should not condone, and certainly not

perpetuate.

They said: ...This blatant and unilateral order does not serve the democratic fibre of the region, rather

it appears to be bringing in questions on the courts commitment to the Constitutional ethos of the

Indian republic.

Bengal Chief Minister Mamata Banerjee said here on Thursday that actor Aamir Khan is within his

democratic rights to make any comments and no one has the right to ask him to leave the country.

Aamir is within his right to make the statement. His wife has said something and he has spoken about

it. Now he is being asked to leave the country as if the country is theirs, the country is for all. None has

a right to say that you leave the country, you go to Pakistan, Ms. Banerjee said.

Addressing a gathering organised by a prominent Minority leader Siddiqullah Chowdhury at Shahid

Minar ground here, the Chief Minister said that an atmosphere was being created where people were

not allowed to freely voice their opinion.

Referring to the controversy over actor Shah Rukh Khans comments, Ms. Banerjee said that there were

many who were threatened.

The Chief Minister read out excerpts from the Preamble of the Constitution on the day which was

observed as Constitution Day in the country said that the biggest debate raging in the country was on

intolerance.

We will pay lip service to Constitution day and try to distinguish between Hindus, Muslims Sikhs and

Christian, she said. Ms. Banerjee asked do one has the right to decide on the food choices of others. .

Thursday distanced itself from the Ludhiana unit of the party which announced Rs. 1 lakh cash reward

for slapping actor Aamir Khan as a protest over his remarks on intolerance in India.

The Shiv Sena party has nothing to do with a sporadic statement made in the context of Aamir Khan in

Ludhiana. The said statement is not the official view of the party or its leaders. The party does not

support or endorse such views, a statement from the Sena said.

The activists of Ludhiana unit of the Shiv Sena had on Wednesday staged a protest outside the MBC

Radisson Blu hotel in Ludhiana where the actor is staying for the duration of the shooting of his

forthcoming film. The activists allegedly used derogatory language against the actor and burnt his

photographs condemning his remarks.

During the protest, Rajeev Tandon, chief of Shiv Senas Punjab unit, had announced that any person

who will slap Aamir Khan will get Rs. 1 lakh for each slap from the Shiv Sena.

Praising the Jaish-e-Muhammads (JeM) three-member fidayeen

(suicide) group that tried to storm an Army camp on Wednesday in north Kashmir and got killed, the

Lashkar-e-Taiba (LeT) on Thursday warned of more such attacks in the State.

Quoting LeT commander Mehmood Shah, the outfits spokesman, Abdullah Ghaznavi, paid tribute to

the three Jaish militants killed in Tangdhar, Kupwara.

The LeT spokesman described Wednesdays attack as a warning to the Indian Army. It could face

such type of attacks in every nook and corner of the Kashmir Valley, Ghaznavi said in a statement to a

local news agency in Srinagar.

The spokesman said the Kashmir struggle is on the rise. Attacks on Indian security camps have been

intensified.

He said: The attack on a high-security zone makes it amply clear that militants can target places they

wish at their ease and will.

LeTs praise of the Jaish militants has come as surprise to the security agencies involved in counter-

insurgency operations. The statement seems to be aimed at providing moral support to the Jaish in the

State, said an officer of a counter-insurgency cell.

The two groups have in the past, sources said, competed for supremacy in Kashmir. Jaish, believed to

be behind the Parliament attack in 2001, was banned by Pakistan in 2002 during the Pervez Musharraf

regime. The Red Mosque stand-off, involving Jaish supporters, pitted the militant group against the

Pakistani establishment.

Comeback bid

Sources said the Jaishs primary focus since 2008 remained Afghanistan but it has now decided to

return to Kashmir, where it remained almost absent post-2006. The groups lone commander and

handler, Qari Yasir, who was in direct touch with other commanders across the border, was killed in

June 2013.

The group was wiped out from the Kashmir Valley in 2015 when the security agencies killed four

militants in Sopore and Awantipora, mainly foreigners.

discussion on the Constitution of India and its framer, Dr. B. R. Ambedkar, became an unlikely

occasion for a debate on the Aryan invasion theory in Indian history, between Congress Parliamentary

Party (CPP) leader Mallikarjuna Kharge and Dattatreya Hosabele, Rashtriya Swayamsewak Sangh

(RSS)Sar Sah Karyavahor joint general secretary on Thursday.

The trigger was Union Home Minister Rajnath Singhs introductory speech on the Constitution and Dr.

Ambedkar, in the Lok Sabha. However much Dr. Ambedkar may have felt discriminated against by the

social system of the country, he never thought of abandoning the country, he said in an obvious

reference to actor Aamir Khans apprehensions about rising intolerance in the country. The actor had

said his wife, film maker Kiran Rao, had considered leaving the country after such incidents.

As soon as the Home Minister had made this remark, Mr. Kharge was on his feet and said, The

Minister should not speak of this kind of controversial things. Running away? Dr. Ambedkar was a

mool niwasi(original inhabitant) of this country. We (Dalits) are the original inhabitants of this

country, we are not the ones who will run away; we are the ones who defend this country. For over

5,000 years we have been facing violence and discrimination and have stayed put.

Not mentioning the word Aryan, the statement by Mr. Kharge, a Dalit, more or less conforms to the

Aryan invasion theory, whereby the Aryan race came and settled in India, establishing the Varna

system and keeping Dalits and Dravidians at the lowest rung of the caste hierarchyThe matter was

soothed within the Lok Sabha by the intervention of Speaker Sumitra Mahajan. Outside, however, it

evoked a strong response from Mr. Hosabele, who said, Mr. Kharge says Aryans came from outside.

This is against Dr. Ambedkars view. He (Dr. Ambedkar) said Aryans were never a race, were not

outsiders. Read his book Who Were the Shudhras.

Union Minister Thawar Chand Gehlot on Thursday pushed for the

construction of a Ram temple in Ayodhya, repeal of Article 370, which gives special status to Jammu

and Kashmir, and implementation of a Uniform Civil Code in the country.

Ayodhya mein Ram Mandir tha, hai aur banega(there was a Ram Temple in Ayodhya, it is there and

will be rebuilt), he said in the Lok Sabha. He termed Article 370 a measure that was meant to be a

temporary provision in the Constitution.

Uniform civil code

Favouring a Uniform Civil Code, he asked, Why we should have different laws for differentcommunities? Every country follows a uniform law.

President Barack Obama spared two turkeys named for one of the nations most admired presidents,

continuing a White House tradition that provides a sense of amusement and cheer no matter how

troubled the times.

Obama pardoned Abe, the 2015 national Thanksgiving turkey, during a ceremony on Wednesday in

the Rose Garden. Abe gobbled right on cue as Obama finished his absolution.

Dont fret for Honest, though, the second bird which was nearby. Both turkeys will spend their

remaining days living it up on a Virginia farm. They were named for Abraham Lincoln, often

nicknamed Honest Abe.

The birds hail from California, are 18 weeks old and weigh in at about 19 kilograms each. The names of

the turkeys were chosen from submissions entered by school children in California.

American families traditionally gather each year for turkey feasts on the last Thursday of November, a

holiday commonly traced to a 1621 celebration in Plymouth, Massachusetts, where the first American

colonists, the Pilgrims, invited Native Americans to join them in a feast.

George H.W. Bush was the first president to formally pardon a Thanksgiving turkey in 1989, though

stories of spared turkeys date back to Lincolns presidency. Obama was accompanied at the event by

The victory of Mauricio Macri, the Mayor of Buenos Aires, in Argentinas

presidential election over the ruling Peronist partys Daniel Scioli, marks an end to the so-called

Kirchner era, at least for now. Over the past 12 years, the outgoing President, Cristina Fernandez, and

her late husband Nestor Kirchner dominated the countrys polity, reshaping the character of the

Argentine state into a welfare institution from being a free-market facilitator. Mr. Scioli had promised

to follow the policies of Ms. Fernandez. But Mr. Macris offer to build 21st century development as

opposed to 21st century socialism resonated better with a majority of the voters at a time when the

Argentine economy was going through a tough phase. The late President Kirchner inherited a much

worse economy in May 2003 when he assumed office. It is widely accepted that Argentinas market-

driven policies of the 1990s, a period of blind deregulation of the economy, triggered the financial

meltdown of 2001-2002. The power couple offered a new social contract; they raised public spending

heavily on programmes for the poor; increased tariffs to protect local economies; nationalised privatecorporations and passed several progressive laws, including the legalisation of gay marriage in 2010.

But Ms. Fernandez faced a serious economic challenge in 2011 when commodity prices fell globally.

This derailed her governments expenditure-driven development model. The economy slipped into

stagnation, while inflation jumped, setting the stage for the comeback of the opposition party. Ms.

Fernandezs combative style of governance was also criticised both inside and outside the country for

its authoritarian tendencies. Mr. Macri built his campaign on these concerns of the general public,

and reaped benefit.

However, it does not mean that Mr. Macri has got a free hand to take the welfare Argentine state back

to the hands of the free market. To begin with, his margin over Mr. Scioli is less than three percentage

points. The Peronists are strong both inside and outside Parliament. They have the backing of

Argentinas strong trade unions. Memories of the instability of the 1990s and the financial crisis of

2000-02 are still fresh. Besides, Mr. Macri would like to remember that outside the dictatorship era no

President has ever completed a full term of office without the support of the Peronist political force. If

he cuts down public expenditure and ends programmes for the poor steps that business-friendlyleaders usually take to fine-tune finances a backlash could follow in Congress and on the streets. But

the election also provides Mr. Macri an opportunity to offer better-quality governance that would

continue the progressive policies of the Kirchner era while taking steps to rejuvenate the sagging

economy and strengthen the democratic institutions of the South American country. The choice he

would make will shape not just his legacy, but also his countrys future.

There is a worrying turn of events in Jammu and Kashmir that must be

of serious concern to the State and Central governments. The changing character of the insurgency is a

warning signal that an urgent course correction is required in Kashmir to prevent the clock being set

back by a decade. The election of a federal government with a decisive majority last summer, coupled

with the installation of a BJP-PDP government in Jammu and Kashmir, had fuelled expectations that a

firm political process would be initiated in the State. Its time for New Delhi to get a grip on the

situation. Of course, the current spurt in violence can be seen as a last-ditch effort by militants to cross

to the Indian side of the Line of Control before winter snow shuts passes along the higher reaches. The

intense appetite of news TV and social media also keeps insurgency-related incidents in sharper focus.

However, these explanations should not mask the emerging challenge in the Kashmir Valley. Over the

last two years, militancy has been on the increase along all parameters. Of most concern is the recent

increase in the number of young people being drawn to militancy amid indications of a fresh wave ofreligious radicalisation. In addition, there is good reason to heed the caution that not all of what is seen

in Kashmir may be what it appears to be. Of late, a flourishing industry of spies, informants and

insurgents has muddied the waters.

Indias engagement with domestic insurgencies has been uneven, ranging from successful incorporation

into the democratic fold of former warriors against the state, to seemingly unending wars of attrition

and containment. Kashmir has been on the burn for more than 25 years, and tens of thousands of

people, from young children to heroic soldiers, have lost their lives. It is time for a holistic political

process to kick in, drawing from past efforts and adopting best practices from around the world on

resolving such disputes. Financial packages, such as the one announced by Prime Minister Narendra

Modi during his visit early this month to the Valley, alone cannot assuage the historical grievances of

the Valley. It would play no major role in finding a lasting solution to the Kashmir dispute. In this

context, care also needs to be taken to ensure that money pumped in by the government does not

continue to feed the well-oiled corruption machinery and middlemen that violence has created. New

Delhi needs to approach the issue keeping in sight the fact that Indias strategic interests areintertwined with the goodwill of the Valleys ordinary people. Recent killings of army officers, the

sudden increase in infiltration attempts and growing indications of radicalisation are all warnings that

the fog of war is thickening in Kashmir. Before violence yet again gets out of hand, New Delhi needs to

take charge, and deal with the dispute with a grand vision.

Two Palestinians were shot and killed in separate incidents on Thursday

in the West Bank as Israel announced plans to build a new fence near the flashpoint city of Hebron in

an effort to contain a two-month spate of violence.

In the first incident, the Israeli military said a violent riot erupted when troops raided the village of

Qattana overnight to search for ammunition and arrest suspected assailants. The Palestinians hurled

firebombs and stones at troops, according to the army.

Troops shot 21-year-old Yehya Taha in the head, according to Palestinian health ministry spokesman

Mohammed Awawdeh, and the youth later died of his wounds in a Ramallah hospital. Later on

Thursday, Israeli border guards shot and killed a Palestinian attacker wielding a knife near the West

Bank city of Nablus. Police spokeswoman Luba Samri said the man got out of a taxi near a military post

and began running toward officers, brandishing a knife.

No Israelis were hurt in that attack, Ms. Samri added. The Palestinian Health Ministry identified the

assailant as 51-year-old Samir Seresi. AP
