the enclosed resolution regarding the new municipal policing cost-recovery billing methodoloryfor O.P.P. services approved by the Treasury BoardlManagement Board of Cabinet in August of2014.

The Council of the Township of McKellar is calling on your government to initiate a moratoriumon the implementation of the new O.P.P. billing model until such time as the principles of a fairand equitable billing model can be addressed for all participating municipalities.

This is to advise you that at the regular meeting of Council of the Township of Carling,held on November 10,2014 the following resolution was enacted:

WHEREAS the Township of Carling is in receipt of the new OPP Billing Modelwhich will see invoices split between base costs and calls for service on anapproximate 60/40 split;

AND WHERAS all municipalities will pay the same base cost per property, whichis estimated at $203.00 per property;

AND WHEREAS the new model received Cabinet approval on August 13,2014and will commence on January 1,2015, to be phased in over five years;

AND WHEREAS the Province is currently responsible for policing costsassociated with unorganized townships;

AND WHEREAS the Town of Bancroft has passed a resolution requesting theProvince to implement a billing method for those properties located inunorganized townships;

NOW THEREFORE BE lT RESOLVED that Carling Township Council doeshereby endorse the resolution passed by the Town of Bancroft and request theProvince to implement a billing method for those properties in unorganizedtownships so those properties contribute to their fair share of policing costs;

RESOLUTION: "Buy American" Provisions in the American Recoveryand Reinvestment Act

WHEREAS cities and communities across Canada support free and fair tradebetween Ganada and the United States;

AND WHEREAS bilateraltrade between Canada and the United States amounts toover $600 billion per year in economic activity, significantly contributing to Canada'slong-term econom ic competitiveness;

AND WHEREAS many of the most important supply chains and industry linkagesthat fuel our respective economies are inexorably linked;

AND WHEREAS provisions, such as'Buy American' requirements, which serve toinhibit this important economic partnership directly affects the economic prosperity ofour country, our businesses and our communities;

AND WHEREAS Halton Hills and Halton Region showed leadership in 2009 bypassing resolutions calling on the Federal, Provincial and municipal governments ofCanada to push back against unfair U.S. legislation;

AND WHEREAS organizations like Canadian Manufacturers and Exporters estimatethat thousands of manufacturing jobs are continuously at risk from continued BuyAmerican provisions being proposed across the United States;

AND WHEREAS Halton companies were directly impacted as jobs were lost due tothe Buy American provisions being inserted into projects receiving federal andmunicipal funding;

AND WHEREAS Canadian cities and communities are committed to open and fairtrade with American governments and businesses;

AND WHEREAS recent agreements between Canada and the United States haverecognized the critical economic linkages between our two countries, fosteringsecure, predictable trade and investment environments;

THEREFORE BE lT RESOLVED THAT allmunicipalities be requested to expresssupport for free, fair and reciprocal trade between the United States and Canada andsupport the principle that any restrictive'Buy American' provisions in U.S. legislationare contrary to that spirit of free trade;

AND THAT the Region of Halton call on the Federation of Canadian Municipalities(FCM) to support and work with the Government of Canada, the CanadianManufacturers and Exporters and other stakeholders in their efforts to urge theUnited States Congress and state governments to abstain from the use of 'BuyAmerican' provisions;

AND THAT FCM be requested to write to the U.S. National League of Cities and theUnited States Conference of Mayors urging them to also support the spirit of thisresolution and the spirit of free trade, so that businesses and industries on bothsides of the border can compete for contracts in the fairest and most efficientmanner;

AND THAT the Regional Chair write to the Prime Minister, the leader of theOpposition and the leader of the Liberal Party advising them of Regional Council'sposition and enclosing a copy of Regional Council's resolution in this regard;

AND THAT the Regional Clerk forward a copy of Regional Council's resolution to allOntario municipalities requesting that they endorse and support Halton's positionand to Halton MP's, MPP's, FCM and the Canadian Manufacturers and Exporters fortheir information.

Provincial Funding Announcements -2015 OMPF and Public Transit

A. 2015 OMPF Allocations Announced

Today the Ministry of Finance issued 2015 allocation notices from the Ontario Municipal Partnership Fund (OMPF). Letters

to heads of council and treasurers are being mailed at this time.

Allocation notices may also be viewed on the Ministrv's website. Below are key aspects of the funding announcement for201 5 and issues on the funding horizon for 2016 and beyond. This will be of importance to current and new councils.

A reduced envelope province-wide

The total envelope continues to decrease. A $35 million cut will occur in 2015 dropping the total Fund to $515 million. Itwas $550 million llr,2014 and $575 million in20l3. If the government continues with its fiscal plan, an additional cut of $15

million should be expected lrr-2016. The2014 Provincial Budget profiled a commitment of a $500 million envelope by 2016

AMO advocated for a deferral of the expected cut of $25 million for 2015. AMO was extremely disappointed when the 2014

provincial budget included a cut of $35 million. AMO and municipal treasurers who were consulted on the Fund's 2015

design noted the Ministry's competing goals of stability for all recipient municipalities and targeting assistance formunicipalities in greatest need within a declining overall funding envelope.

Impact on recipient municipalities

Of the 388 municipalities which receive OMPF dollars, 245 will experience a decrease while 143 will either have stable orincreased funding. Individual municipal reductions for the coming year will be primarily determined as a percentage of 2014allocations and for northern and rural municipalities, will be scaled based on the relative fiscal health of those municipalities.

Generally, northern municipalities experienced a cut of up to l0%o of their total 2013 OMPF allocation. This year they willexperience the same cut of up to l0%o for 2015. Generally, southern municipalities experienced a cut of up to l5o/o of theirtotal2}l3 OMPF allocation. This year they will experience a cut of up to 20Yo for 2015. These changes are very significantfor many communities.

How does OMPF structure for 2015 compare to 2014?

For 2014 and20l5, the grant structure within the OMPF remain the same. They are: Assessment Equalization, NorthernCommunities, Rural Communities, Fiscal Circumstances and Transitional. The Transitional Assistance grant component for2015 has been reduced by $40 million while the Fiscal Circumstances grant component has been enhanced by $5 million. Nochanges were made to the other three components.

The Municipal Fiscal Circumstances Index (l\ßCD measures such factors as weighted assessment per household, medianhousehold income and employment rates among others, on a relative basis, for northern and rural municipalities that havebeen receiving OMPF. As noted above, the degree of cuts for the majorþ of recipient municipalities will be determined inpart by the use of this measure. This approach demonstrates some sensitivity to the fiscal condition of municipalities and thelimited capacity of some to shoulder any cuts.

The 2008 upload agreement of social assistance and court secwity costs affected different municipalities in different ways.Despite the merits of the uploads, mariy communities continue to face limited or declining fiscal health and face fundamentaloperating budget challenges. AMO is concerned about the cumulative fiscal impact of a variety of provincial governmentinitiatives. These include the 20ll-2014 OPP wage increase, social assistance benefit adjustments, OPP billing changes, andspecial dam payment cuts to name just a few program cost changes that have occurred dwing the ensuing years.

Through a discussion with AMO, Premier Kathleen Wynne, Ted McMeekin, Minister of Municipal Affairs and Housing, andDeb Matthews, President of the Treasury Board, have agreed to the need to examine this provincial multi-ministerialcumulative impact on municipal governments' fiscal health. Discussions are underway with the government on how this canoccw.

B. Ontario Delivers Permanent Funding for Transit

The Honourable Steven Del Duca, Minister of Transportation, today announced that the Province is providing $321.5 millionthis year to support municipal public transit systems through the Ontario Gas Tax for Transit program (link to attachment).

Municipalities are managing an infrastructure funding gap estimated in 2008 to be $60 billion over ten years. To helpcommunities manage this funding crunch and continue to deliver transit for our residents, AMO called on the Province tomake the Ontario Gas Tax permanent for municipalities who have transit systems and to create a permanent fund formunicipal roads and bridges in small, rural and northern communities.

The 2013 Budget delivered on our ask. Municipal governments can count on permanent support for transit through thisprogram. Ontario's Gas Tax Fund delivers two cents for every litre of gasoline sold in the province to support transitproviding $3.1 billion for municipal transit since its creation.

In20l4 the Ontario Budget responded to AMO's call for permanent funding for roads and bridges in small, rwal andnorthern communities by creating the Ontario Communþ Infrastructure Fund (OCIF) for municipalities with under 100,000

OverviewThe Ontario Municipal Paftnership Fund (OMPF) is the Province's main transfer paymentto municipalities.

In 2015, the Province will provide a total of $515 míllion in unconditional fundíng to388 municipalities through the OMPF. This funding, combined with the municipal benefitresulting from the provincial uploads, will total over $2.2 billion in 2015 - more thanthree and a half times the level of funding provided in 2004.

Provincial Uploads and OMPF Phase-DownIn 2012, the government announced the review of the OMPF and the phase-down of theprogram to $500 million by 2016. The phase-down of the OMPF was part of the 2008Provincial-Municipal Fiscal and Service Delivery Review (PMFSDR) agreement to uploadsocial assistance benefit programs and couft security and prisoner transpoftation costsoff the propefty tax base.

Despite the adjustment to the program, overall support provided to municipalities willcontinue to increase, with the provincial uploads more than offsetting the reduction tothe program.

OMPF Review and RedesignThe redesigned OMPF was introduced tn 2OL4 following consultations with the

Association of Municipalities of Ontario (AMO) and mun¡cipal representatives from across

the province. The program is comprised of four core grant components that reflect the

following objectives:

. cont¡nuing to support areas with limited propefty assessment;o cont¡nuing to recognize the challenges of nofthern and rural municipalities, while

targeting funding to those with more challenglng fiscal circumstances; and. assisting municipalities as they transition to the redesigned program.

A new grant component was announced as part of the redesigned program - the

Nofthern and Rural Fiscal Circumstances Grant. This grant component was introduced in

recognition that not all nofthern and rural municipalities are the same. The differences in

the fiscal circumstances of these municipalities are recognized through this grant, which

provides additional, targeted support to eligible municipalities based on their northern

and rural Municipal Fiscal Circumstances Index (MFCI).

2OL5 OMPF

Over the past year, the Ministry of Finance has continued to consult with AMO and other

municipal representatives on how to best support municipalities through the program as

the OMPF phases down. These discussions have informed the design of the 2015

program.

In the province's discussions with municipalities, two key recommendations emerged

with respect to the Program design:

1. Funding should be fufthertargeted to municipalities with the greatest needs; and

Z. The design of the program should ensure a manageable pace of change.Page 15 of 66

Funding provided through the Northern and Rural Fiscal Circumstances Grant will begin

to increase in order to further target suppoft to those municipalities with the mostchallenging fiscal circumstances. Compared to 2Ot4, these municipalities will receive an

increase of more than 30 per cent in per household funding allocated through this grant.

In addition, the significant amount of Transitíonal Assistance will provide municipalitieswith stability as they adjust to the redesigned program, This funding will ensure thatmunicipalities receive a guaranteed level of support based on their 2OL4 OMPF

allocation. Municipalities in the nofth will receive at least 90 per cent of their 20L4 OMPF

allocation, while municipalities in other regions of the province will receive at least B0

per cent.

These minimum levels of support will be enhanced, up to 100 per cent, for eligiblenofthern and rural municipalities with more challenging fiscal circumstances, as

measured by the MFCI.

2OL5 Provincial UploadsThe Provincial-Municipal Fiscal and Service Delivery Review (PMFSDR) was completed in2008. This review set out a new approach to the funding and delivery of services inOntario and represents a significant milestone in the provincial-municipal paftnership.

In 2015, the Province will continue to deliver on its commitment in accordance with the

timetable agreed to through the PMFSDR by:

. continuing the phased upload of Ontario Works (OW) benefits; and

. continuing the phased upload of court security and prisoner transpoftation costs (up to

$125 million annually at maturity).

This builds on the government's previous uploads of:

. Ontario Drug Benefit (ODB) costs Ín 2008;

. Ontario Disability Support Program (ODSP) administration costs in 2009; and

. ODSP benefits, completed in 2011.

Fufthermore, the Province will provide more than $230 million in additional suppoft of

municipal OW administration costs.

As a result of the uploads, 380 municipalities will see an estimated benefit of over

$1.7 billion in 2015.

NVCA suppofts Ontario's effolts to combat invasivespec¡es

Utopia, Ontario, November 10, 2Ol4 - The Nottawasaga ValleyConservation Authority (NVCA) commends the Ontario Ministry of NaturalResources and Forestry's re-¡ntroduction of the Invasive Species Act.

The proposed act would be Canada's first standalone legíslation designedto address the problem of ¡nvasive species. It would give the provincepowers to intervene earlier with a wide range of potentially dangerousplants and wildlife. It also provides new regulations and penalties to helpdeter the introduction and spread of these species.

"If successful, the proposed legislation should help to prevent and slowthe spread of those invasive spec¡es that pose the highest risk to ourlocal environment and economy," said NVCA's Interim CAO, D. GayleWood.

Once passed, this legislation will give the provinc¡al government newtools and authority to ban activities such as possessing and transportingcertain high risk invasive species. It will put in place mechan¡sms tosupport preventative measures and address urgent threats. Measurescould include "rapid response" actions like preventing the movement ofcontaminated firewood, bans on possessing and transporting certaininvasive species, and modernized inspection systems.

Invasive species pose a significant threat to the Nottawasaga Valleywatershed, displacing native wildlife and plants.

"Phragmites is becoming a significant issue in our wetlands while garlicmustard is threatening our upland forests," explained DavidFeatherstone, manager of NVCA watershed monitoring. "Our forestedswamps and upland forests are being threatened by emerald ashborer. Zebra and quagga mussels have impacted the Georgian Bayecosystem and round goby has colonized our shoreline and larger riversystems."

Along with partners such as the Ontario Federation of Anglers andHunters, the Nature Conservancy, the County of Simcoe and the Town ofCollingwood among others, NVCA has worked to monitor and controlinvasive species for about a decade. Projects have included monitoringand/or removing garlic mustard at the Tiffin and Petun ConservationAreas and along the Bruce Trail, As well, NVCA and partners have been

sector; introduce a Patient Ombudsman with oversight of hospitals and long-term care homes; make changes to the record-keepingrequirements inthe Municipal Freedom of Information and Privacy Protection Act; and provide for additional transparency and

accountability rules for the province's own political and public service.

AMO supports accountability and transparency in local govemment and the broader public sector. In terms of Bill 8, the same steps

are being followed when any other laws are tabled that affect municipal government - is its legal language clear, practical, effectiveand, is it efficient, would it create unintended consequences and if so, are there ways to mitigate them. Policy changes need to achieve

the results that they are intended to achieve in a manner that is accountable and respectful to all.

AMO has a group of municipal lawyers and senior administrators looking at the proposed legislation and amendments that should be

presented. Transparency and accountabilþ are positive principles, but implementation will determine success or failure of this or any

other legislation. We believe that the Ontario Government shares our commitment to working together on improvements to this Bill.

However, it is clear through media reports and social media that the Ontario Ombudsman appears to think that it is wrong for AMO ormunicipal governments to have any opinion on this Bill or how to improve it. AMO will continue to do this work no matter who tries

to demean us or municipal governments. Groups or individuals with their own ideas should not be discredited. In this province, allvoices are encouraged to be heard, even when creating new systems ofaccountability.

We expect the Standing Committee will hear deputations and read written submissions and that it "4,ill

similarly share the basic goal -to achieve the intended results, earn public confidence, strive for systems that are efficient and practical, and make sure that arry are

cost effective.

AMO believes that accountability can and should be achieved in a manner that respects municipal government. We don'timprove Ontario by diminishing or belittling municipal government indiscriminately.AMO believes that good government is best achieved when municipal governments take on the difficult task of eaming thetrust and respect of the public that they serve. supported not vilified.

AMO will share with its members its submission to the Standing Committee as we hasten to meet the Legislature and StandingCommittees timelines. We will advise the memberships when this is posted.

I am pleased to be able to report that, in September, the new "Rural Commercial (RC)"zoning category that the Township had incorporated into our Zoning By-law as part of afive year review and up-date, has f,rnally been approved

We have been awaiting that approval before proceeding with your applications thatwould, if approved, permit certain developments and uses that are not currentlyconsidered legal or legal non-conforming, to be permitted and appropriately regulated bymeans of individual, site-specific amendments to the ZoningBy-law.

Given the timing of the municipal election, we did not want to commence the processingof new application under one Council only to have to complete the process under a newCouncil, so we have chosen to wait until the new Council has been installed beforeproceeding. I am also retiring as of December 72,2014, so a new planner will be

handling things from this point forward.

Because there are outstanding alleged zoning violations affecting your property, you willbe urged to make application for a zoning by-law amendment to seek approval tocontinue with those uses on your property. Lands zoned Rural Commercial are also

intended to be brought under site plan control, so an application for site plan approvalwill also be required to be made as directed by the new Council and/or planner.

It is respectfully suggested that you should contact the Township early in the new year toinitiatc the process of seeking approval for the uses that are occurring on your propertythat are not currently permitted in the zone you are in. I will suggest that this should be

done by the end of January at the latest for pre-consultation and that applications shouldbe received by the Township by the end of February, at the latest, to avoid actions beingtaken to otherwise enforce the Zoning By-law. This too, however, will need to be

determined by the new Council and Planner.

Altematively,you could cease operations (activities and uses) and remove, or convert the uses ofbuildings and structures for purposes permitted in the current zone for your lands.

I regret that I will not be here to see these matters through to completion, but I wish you

well and trust that you will cooperate with the new Planner and Council to resolve these

outstanding matters in a timely and appropriate manner.

zoÍLe, certain on-farm diversified uses and uses that produce value-added agriculturalproducts. More specifically, the proposed by-law would permit the establishment of afarm store, a small scale craft distillery and related, accessory developments and uses, as

well as agri-tourism uses, and related activities and developments.

It is proposed that the portion of the property where the distillery and farm store are to belocated and the activities involved with agri-tourism uses would be concentrated wouldbe placed into the Township's new 'Rural Commercial (RC)' zone. Under that zoning,the development of the site would be subject to site plan control. A revised and moredetailed site plan for the entire areato be re-zoned, has been submiued as part of aseparate application for site plan approval.

The proposedzorung by-law amendment would introduce def,rnitions for 'farm store' andfor a'craft distillery', as well as zoning regulations that will ensure that the uses are smallin scale and secondary to the principal agricultural uses of the property, set parkingstandards, lot coverage, landscaped open space standards and maximum building size andincorporate into the by-law such other requirements as deemed necessary by Council toappropriately regulate and control the uses. The specific rules that would apply would beincorporated into the by-law as exceptions.

The size ofbuildings has been reduced and caps have been added to ensure that they are

small in scale. The area which is proposed to be re-zoned has been reconfrgured slightlyto accommodate a development that is more compact and sensitive to the surroundingland uses, and so that less land that is currently being used for agricultural purposes isinvolved. The development has also been re-designed to address concerns expressed as a

result of public consultation and input to date.

Lands Affected

The Zoning By-law Amendment affects lands in the West Half of Lot 4, Concession 7EHS. These lands are shown on the Key Map attached to this notice.

On October 31,2014 Wayne Ferris retired from his position as equipment operator forthe Township of Mulmur. His departure created an opening for one fulltime employee in

the Public Works Department.

The opening was advertised in the 3 local papers as well on the Township web site.

After receiving 30 applications, the successful candidate was Mark MacArthur. Mark has

worked for the Township of Mulmur as a seasonal winter equipment operator for thepast 3 years.
