MORPAC is the voluntary, non-partisan Political Action Committee (PAC) of the
Mortgage Bankers Association (MBA). It is the only PAC that directly represents
the interests of the real estate finance industry in our nation’s political system.
MORPAC encourages participation in the political process by pooling
financial resources to help elect qualified federal candidates whose views
and voting records reflect the interests of MBA and its members.

Dear Industry Colleagues,
I am pleased to share our 2018 MORPAC Mid-Year Report that details our campaign’s
progress through June 30 in this 2017–2018 election cycle.
As a show of gratitude to our dedicated contributors, this report lists all of the individuals
and companies who have been a part of our 2017–2018 campaign. In addition, you’ll
find itemized information about the goals our political programs have been able to
achieve thus far and a comprehensive summary of the legislative and political priorities
MBA’s advocacy team has been working to achieve at this point.
In 2018 alone, MORPAC has already raised over $800,000 in individual donations,
putting us more than $1.7 million raised this cycle and getting us closer to our goal
of raising $2.25 million by end of 2018. MORPAC is funded entirely through voluntary
contributions from people like you. Every member of MORPAC has joined a team of
dedicated industry professionals that drive and support the real estate finance industry.
MORPAC is an essential advocacy tool that supports the election and re-election of
federal candidates who have an understanding of the real estate finance industry, but
the Mortgage Action Alliance (MAA) is our best way to educate policymakers at the
federal and state level on issues that impact our members. Under the leadership of
MAA Chairman Gene Lugat, MAA has increased its membership by over 76 percent
this cycle with over 27,000 industry-wide active members and counting.
We’ve had more than 2,900 downloads of the MAA mobile app since launch and saw
a 350 percent increase in communications to Congress compared to the 2015–2016
election cycle. In fact, our advocates sent over 46,000 letters and tweets to Congress
in the last year to 95 percent of Senate and House offices on key issues.
With our industry undergoing rapid growth and change driven by the legislative and
regulatory environment, it’s up to us to make our voices heard in the political arena. I
hope you will take time to review the report and continue to stay involved with MBA’s
Advocacy Programs and fight for our industry.

Since January 2017, MORPAC has raised more than

In 2018 alone, MORPAC so far has raised over

MORPAC hosted three individual fundraisers in 2018 MORPAC raised over $28,000 for Senate Banking Committee member Heidi Heitkamp (D-ND) at MBA’s Mid-Winter Conference, and (in a joint commercial/multifamily and residential IMB-driven effort) roughly $75,000 for House Ways and Means Committee member Mike Bishop (R-MI) in conjunction with MBA’s National Advocacy Conference (NAC) MORPAC also hosted a fundraiser for House Financial Services Committee member Jim Himes (D-CT) at MBA’s Secondary Conference and raised about $25,000 towards that effort

Over the past year-and-a-half, MBA has worked relentlessly on behalf of our
members and the industry at large. Importantly, MBA had major wins with the
Tax Cuts and Jobs Act (Public Law 115–97) and The Economic Growth, Regulatory
Relief and Consumer Protection Act, (Public Law 115-174) securing many important
provisions to MBA members (more details included in the Legislative & Political
Update that follows). Below are key highlights of our efforts, emphasizing
where we have made progress for you on Capitol Hill and in state capitals.
• Created exception for MSRs to maintain current deferred tax treatment within sweeping tax bill, H.R. 1 (now P.L. 115-97).
• Protected key tax provisions in package including: cap gains rollover on sale of principle residence, MRBs and credit certificates, business interest deductibility and 1031 like-kind exchanges.
• Advocated for IMB eligibility for pass-through deduction on qualified business income (implementation advocacy ongoing with Treasury and IRS).
• Testified on Capitol Hill on GSE reform, regulatory relief, protections for VA borrowers.
• Maintained primary thought-leader status on housing finance reforms with key members/staff of House Financial Services/Senate Banking Committees.
• Secured enactment of S. 2155 (now P.L. 115-174) with key mortgage-related regulatory relief provisions:
• SAFE Act amendments to provide 120 days of transitional authority for MLOs to originate when leaving a depository to join a sponsoring non-bank (or when crossing state lines);
+ Applying TILA consumer protections to PACE/energy efficiency mortgage products;
+ Added safeguards to protect veterans, surviving spouses and service members who utilize the VA Home Loan program’s IRRRL refinancing product;
+ An improved, more workable regulatory regime for the eligibility of High Volatility Commercial Real Estate (HVCRE) construction loans; and,
+ Partial TRID and HMDA relief.
• Prevented inclusion of FHA administrative fee and secured prohibition of funds used to seize mortgages via eminent domain in FY18 omnibus federal funding package. Efforts ongoing as part of FY19 debate.
• Achieved bipartisan House passage of bills to:
+ Allow for MLO transitional licensing (H.R. 3978);
+ Exempt small non-banks and depositories from HMDA reporting requirements (H.R. 2954);
+ Create a fair federal financial examination appeals process for both non-banks and depositories (H.R. 4545);
+ Adjust the TILA definition of “points and fees” under the ATR/QM rule (H.R. 1153);
+ Expand the required review of financial regulatory requirements and shorten the review period to at least every 7 years (H.R. 4607); and,
+ Favorably reform the National Flood Insurance Program (series of bills).
• Secured introduction of bipartisan legislation to:
+ Allow certain captive insurance companies to restore their FHLB membership (S. 2361);
+ Restructure the BCFP from a sole director to a bipartisan commission (H.R. 5266); and,
+ Ensure BCFP provides regular written guidance on key rules (H.R. 5534).
+ Developed model state legislation and organized industry campaign to adopt a common remote online notarization process.

LEGISLATIVE AND POLITICAL UPDATE
Once again, MBA hosted another successful National Advocacy Conference (NAC).
Nearly 400 industry advocates from over 40 states attended MBA’s NAC this past April.
The event played host to a slate of congressional and administration speakers including:
Senate Banking Committee (SBC) Chairman Mike Crapo (R-ID), HUD Deputy Secretary
Pamela Patenaude, senior SBC Democrat Bob Menendez (D-NJ) and House Financial
Services Committee (HFSC) members Reps. French Hill (R-AR), Denny Heck (D-WA) and
Trey Hollingsworth (R-IN). On Wednesday, April 25, over 360 attendees participated in
230 official constituent meetings with their Senators and Representatives on Capitol Hill.
The NAC Hill Day once again also included a tailored Commercial/Multifamily track. Our CREF members heard directly from speakers that included Senate HUD Appropriations Subcommittee and SBC member Jack Reed (D-RI), House Ways and Means Committee member Rep. Mike Bishop (R-MI), and HFSC members Reps. Nydia Velazquez (D-NY) and Tom Emmer (R-MN), along with key staff from the offices of Senators Tom Cotton (R-AR), Mike Lee (R-UT) and Doug Jones (D-AL) and David Scott (D-GA).
Just this May, President Trump signed S. 2155, the Economic Growth, Regulatory Relief, and Consumer Protection Act, into public law. This package was the result of several years of legislative advocacy by MBA and contains a number of provisions that will improve the regulatory landscape for both residential and commercial/multifamily mortgage lenders.
Regulatory ReliefThe Economic Growth, Regulatory Relief, and Consumer Protection Act (S. 2155), signed into public law (P.L. 115-174) by President Trump on May 24, 2018, contains many MBA priorities, including: SAFE Act transitional authority to originate; additional consumer protections for VA Interest Rate Reduction Refinance Loans; the application of TILA consumer protections to PACE loans; improvements to the HVCRE regulatory regime; and, partial TRID and HMDA reporting relief. A detailed summary of provisions impacting mortgage lending follows:
Section 106, SAFE Act Transitional Authority to Originate: After nearly a decade of advocacy by MBA, states must now provide temporary authority for mortgage loan officers (MLOs) to originate while transitioning between federally- insured depositories and non-depositories, as well as across state lines. The bill requires states to grant this 120-day transitional authority to individuals who are already employed by a financial institution and are a registered loan originator, while retaining the important consumer
safeguards contained within the current SAFE Act statute. States now have 18 months to implement the transitional authority provision.
Section 309, VA “Loan Churning:” The law contains a provision, based on legislation (S. 2304) first introduced by Senators Thom Tillis (R-NC) and Elizabeth Warren (D-MA), requiring a net tangible benefit test for all VA IRRRLs. IRRRLs would no longer be eligible for the VA guaranty unless they meet requirements such as a maximum fee recoupment period, a net tangible benefit test for the borrower, and a minimum loan seasoning period. Importantly, these reforms are targeted at recent instances of churning in the marketplace, while preserving beneficial refinancing opportunities for appropriate VA borrowers.

Section 214, High Volatility Commercial Real Estate (HVCRE) Legislation: S. 2155 addresses several specific issues in the regulations governing what is an HVCRE loan. The law permits withdrawal of HVCRE classification when a project meets underwriting requirements for permanent financing; permits withdrawal of contributed capital when a project meets underwriting requirements for permanent financing, permits withdrawal of internally generated capital; permits banks to count the value of appreciated property
toward the borrower’s required 15 percent capital contribution; and exempts loans originated prior to January 1, 2015.
Effective immediately, Section 214 supersedes contrary provisions of the current HVCRE rule and any successor rule, limiting the banking agencies’ authority to assign a heightened risk weight to a credit facility that finances or has financed the acquisition, development or construction of real property, to credit facilities that fall within the scope of the definition of “HVCRE ADC Loan” specified in Section 214. Notably, Section 214 would not eliminate the higher, 150 percent risk weight for HVCRE ADC loans or incentives for banks to mitigate ADC lending risk.
Section 307, PACE Consumer Protections: The law creates disclosure and ability to repay requirements for Property Assessed Clean Energy (PACE) loans to finance energy improvements. MBA secured introduction of similar, standalone, language in both the House and Senate in 2017. The provision requires a loan originator to determine that the borrower has a reasonable ability to repay the loan being offered. In this regard, Section 307 is an important first step toward appropriately regulating PACE lending and ensuring that PACE borrowers are fully informed and protected from predatory lending practices, i.e., establishing a national consumer protection standard for PACE loans.
Section 104, HMDA Relief: Section 104 amends the Home Mortgage Disclosure Act (HMDA) to expand exemptions on itemized disclosures to HMDA added by the Dodd-Frank Act. The law exempts from these disclosures closed- end mortgages and open-end lines of credit for those banks and credit unions who originate fewer than 500 closed-end mortgages or 500 open-end lines of credit in the last two years, respectively. MBA continues to advocate for an extension of the exemption to include all small mortgage originators, including small independent mortgage banks. Such an exemption would reduce the regulatory burden placed upon all smaller community lenders by increased HMDA reporting requirements. As it relates to multifamily lending and servicing, we continue to support a complete exemption from the HMDA reporting requirements for these loans, as these business purpose loans were never intended to be captured by HMDA.
Section 109, TRID Relief: The law includes an MBA-supported “Sense of Congress” in Section 109(b) in favor of needed clarity for the TILA- RESPA integrated disclosures (TRID). This subsection asks the Bureau of Consumer Financial Protection (BCFP) to provide clearer, authoritative guidance on several components of the TRID Rule. Specifically, the statement requests clarity on the Rule’s applicability to mortgage assumption transactions and construction-to- permanent home loans. Finally, the request seeks clarity on the extent to which lenders can rely on model disclosures published by the BCFP, without liability, if recent changes to regulations are not reflected in those disclosures.

MBA also supports the intent behind the “No Wait for Lower Rates” section of the new law. However, as currently structured, this section only impacts “high cost mortgages” rather than providing broader relief.
Section 310, Credit Score Competition: Section 310 of the law encourages competition in the development and usage of credit scoring models for residential mortgages. Heightened competition should produce more accurate modeling, which in turn provides a variety of benefits for consumers, lenders, and investors.
Section 101, QM Portfolio Relief for Small Banks: Section 101 extends “Qualified Mortgage” status to loans originated by, and retained in the portfolios of, banks and credit unions with less than $10 billion in consolidated assets. This expansion of QM status does not apply to loans with interest-only or negative- amortization features, points and fees above the existing cap of 3 percent of the loan amount, or prepayment penalties that are in violation of existing QM requirements. MBA continues to advocate for an expansion of QM status to loans originated by any lender, provided that they are transferred to, and subsequently held in the portfolio of, a community bank or credit union within 90 days of their origination.
GSE ReformMBA remains a pivotal player (and technical advisor) to key principals and staff in both the House and Senate. Despite the hearings held by both congressional authorizing com-mittees on the topic last year — including detailed scrutiny of the MBA preferred model — momentum for action on comprehensive legislation has stalled. While continuing to meet with targeted leadership offices (and Executive Branch players) to push for appropriate action — either administrative or legislative — we are also urging appropri-ate Hill oversight regarding a series of actions by the GSEs (and FHFA) that we believe have allowed the agencies to encroach upon the boundaries of their respective charters.
GUIDE ActMBA was instrumental in securing the April introduction of H.R. 5534, also known as the GUIDE Act, by Representatives Sean Duffy (R-WI) and Ed Perlmutter (D-CO). The proposal, which was conceptualized by RESBOG and MBA staff roughly three years ago, seeks to provide transparency to BCFP’s process of providing rules and guidance to provide
lenders with more certainty — and better protect consum-ers by addressing the current “regulation by enforcement” regime. More specifically, the bill:
• Mandates that the Director issue “guidance” that is necessary or appropriate to carry out the purpose of the laws it is responsible for including facilitating compliance;
• Defines “guidance” to include a range of written issuances from interpretative and legislative rules, to bulletins and frequently asked questions;
• Requires the Bureau to publish in the Federal Register within one year of enactment the definitions, criteria, timelines and process for issuing each type of guidance the Bureau shall provide, with a final rule required within 18 months of enactment;
• Prohibits liability for reliance in good faith on guidance from the Bureau or any predecessor agency that was in effect at the time of such act or omission;
• Requires the Bureau to establish a process and timeframes for requests for guidance, including time limits to provide answers in response to requests for guidance;
• Requires the Bureau to create a process for amending or revoking guidance, including a process for public notice and comment;
• Requires the Bureau to develop guidelines for determining the size of any civil money penalties and publish these guidelines in the Federal Register within 18 months of enactment.

False Claims ActIn early July, House Financial Services Committee members Josh Gottheimer (D-NJ) and Lee Zeldin (R-NY) intro-duced MBA-supported legislation to repair the FHA false claims process (H.R. 5993). The Fixing Housing Access Act, addresses the legal and operational risks associated with originating FHA-insured loans and potential claims brought by the Department of Justice (DOJ) under the False Claims Act and the Financial Institutions Reform, Recovery, and Enforcement Act (FIRREA). The legislation does not hamper the DOJ’s ability to pursue bad actors; instead, it clarifies and improves the timing associated with potential violations and relevant statutes of limitations, as well as the calculation of damages for originating FHA-insured loans. The legislation also specifies that essential elements of a claim be proven for each individual claim rather than through the problematic use of statistical sampling.
Tax ImplementationAlthough sweeping tax legislation was signed into law (P.L. 115-97) last December, many provisions of the Tax Cut and Jobs Act (TCJA) still require additional clarity and guidance. MBA has been working extensively with policymakers to obtain guidance in areas important to our industry, in par-ticular the provision that creates a new section of the tax code (199A) permitting a deduction of up to 20 percent for qualified business income of pass- through organizations. In particular, the scope of the pass-through deduction within this new section requires clarification from Treasury and the IRS to ensure that independent mortgage companies structured as pass-throughs are eligible for this important deduction. MBA has recruited the help of Ways and Means Committee member Mike Bishop (R-MI) on this issue, and we continue to work with members and staff of the Joint Committee on Taxation and the Senate Finance Committee to press our case with the administration — and thereby work to ensure that mortgage companies are eligible for the deduction.
Budget and AppropriationsCongress has begun the Appropriations process for Fiscal Year (FY) 2019. The House Appropriations Committee marked up its FY 2019 Transportation and HUD (T-HUD) funding bill on May 23, and the Senate Appropriations Committee marked up its counterpart version on June 7. On August 1, the Senate passed a package of appropriations bills, including the Fiscal Year (FY) 2019 Transportation, Housing and Urban Development (THUD) and Financial Services and General Government (FSGG) Appropriations bills. The House and Senate must now reconcile differing funding levels and legislative provisions in the bills in a con-ference meeting. For example, the Senate THUD provisions included $900 million more than the House legislation and
$12.8 billion more than President Trump’s budget request. Of note, neither THUD bill contains language supporting a lender fee for FHA technology. However, the Senate bill directs $20 million for modernizing FHA’s IT systems, including improving single-family processing underwriting and delivery, claims systems, and program compliance. The Senate FSGG bill did not include financial services riders such as the Mortgage Choice Act and the TRID Improvement Act. The House bill included both along with governance changes to the Bureau of Consumer Financial Protection. MBA continues to press for our priorities within these bills as they progress towards floor consideration.
In March, Congress passed, and President Trump signed, a $1.3 trillion omnibus spending bill which funds the govern-ment through the end of the current fiscal year (September 30). The package contains several of MBA’s priorities, and notably did not include authority for an FHA administrative fee for IT upgrades and quality assurance. Other specific highlights for MBA members include:
HUD Funding: HUD would receive a net total of $42.7 billion, an increase of $3.9 billion, or 10 percent, over the fiscal year 2017 enacted level. That figure is also over $11 billion more than what the Trump administration sought in net discretionary funding. Additional HUD highlights include:
• No authority for an FHA administrative fee for purposes of IT upgrades and quality assurance;
• $130 million for FHA administrative contract expenses ($30 million below HUD’s request);
• $55 million to HUD for housing counseling assistance ($8 million above HUD’s request);
• $30 billion in FHA multifamily and health care commitment authority;
• $27 million in administrative contract expenses for Ginnie Mae ($1.6 million above HUD’s request);
• $33.5 billion for Project- and Tenant-Based Section 8 Rental Assistance (roughly $3.5 billion more than the FY2017 enacted level), $3.365 billion for Community Development Block Grants ($305 million more than FY2017), and $1.36 billion for HOME Investment Partnerships ($412 million more than FY 2017);

• A policy rider that would prohibit HUD financing of properties that have been subject to eminent domain;
• A policy rider that would prohibit HUD funds be used to either require or enforce a Physical Needs Assessment (PNA); and,
• A policy rider that would prohibit HUD from directing a grantee to undertake a zoning law change as part of the Affirmatively Furthering Fair Housing Rule.
Expands Low-Income Housing Tax Credits: Importantly, the omnibus includes legislation largely based on the Cantwell-Hatch Affordable Housing Credit Improvement Act (S. 548), which expands availability of the low-income housing tax credit program for the next four years (2018-2021). Specifically, it expands the tax credit allocation by 12.5 percent each year, resulting in an estimated additional 35,000 affordable housing units.
Tax Reform Implementation: The IRS received $11.4 billion in total, of which $320 million must be used towards the implementation of tax reform. No tax extenders (e.g., LIHTC, mortgage debt forgiveness and/or MI premium deductibility) for calendar year 2018 were included in the package.
The package also includes a general provision calling on the Office of Management and Budget (OMB) to “submit a report to the Committees on Appropriations of the House of Representatives and the Senate on the costs of implementing the Dodd-Frank Wall Street Reform and Consumer Protection Act.”
Flood Insurance: An important facet of the FY18 omnibus package was the decoupling of the National Flood Insurance Program (NFIP) from government funding, meaning pro-gram authority would expire on July 31, 2018 rather than at the end of the fiscal year. In July, MBA joined 21 other stakeholders in a letter urging Congress to reauthorize the NFIP ahead of the July 31, 2018 expiration deadline. Congress has yet to pass a long-term reauthorization of the program which has already resulted in a series of six stop-gap extensions and two brief lapses in 2017 and 2018. While the House passed a series of bills to extend and reform the NFIP, the Senate has yet to coalesce around an agreement.
Also in July, Sen. Bill Cassidy (R-LA) offered a motion to instruct Senate conferees named to reach consensus with the House on an FY19 Energy and Water measure to include a 6 month NFIP extension within that bill. The motion was agreed to by an overwhelming vote of 95-4, demonstrating that such a provision has support sufficient to ultimately prevail. The vote follows the inclusion of a straight NFIP extension of six months within the Senate’s Farm Bill reauthorization proposal (that still needs to be reconciled with the House’s version).
HFSC Chairman Jeb Hensarling continues to insist on certain NFIP-related program reforms (e.g., an expansion of acceptable private flood insurance alternatives) before he will yet agree to any long-term reauthorization. MAA members have been engaged on this issue throughout the year to ensure that NFIP authority does not lapse, thereby putting closings and home sales potentially at risk. MBA staff continues to advocate for a long-term reauthorization (five years), with reforms that will exempt commercial and multifamily properties from mandatory NFIP purchase requirements, along with changes that will foster further development of the private flood insurance market.
On Tuesday, July 31, the Senate passed a four-month exten-sion of the NFIP. President Trump signed the legislation just hours before the program was scheduled to lapse. The House of Representatives overwhelmingly passed the extension the week before. MBA sent a letter of support and the Mortgage Action Alliance issued a Call to Action urging Members of Congress to reauthorize the program. MBA President and CEO David H. Stevens, CMB, issued a statement praising Congress for the extension. MBA continues to call for a long-term extension of the program (preferably for five years), an exemption for commercial/multifamily properties from NFIP mandatory purchase requirements, and the development of meaningful private flood insurance alternatives.
FHLB MembershipMBA has also secured bipartisan, bicameral introduction of legislation to reinstate FHLB membership eligibility for captive insurance subsidiaries of Mortgage REITs and other affected parent companies (H.R.2890 and S.2361). We continue to work to find a suitable House or Senate vehicle to advance these companion proposals.
