    LETTER FROM THE PRESIDENT

    Winter warriors,

    The 2014 Board is seated and diving into the business

    of our community by planning an excing summer

    around the common grounds. The 2014 Board you

    elected consists of:

    Jean Sorenno, an original homeowner who is giving

    us another year of her careful deliberaons; Brad

    Gimbert, who grew up in his current home and jumps

    in to help anyone in need, is the co-chair of Facilies

    Commi!ee with Ron Paul Buehler, our long me swim

    team advocate; Jack Keang, our professional capital

    improvements project manager, has agreed to serve

    as our Vice President for another year; Tim Jacobs, the

    voice of reason from Crestmont Lane, connues to

    serve his newly adopted community; Lillian Fazio, an-

    other original homeowner, donates her bookkeeping

    excellence and hones her skills in Quick Books as our

    Treasurer and Tennis Commi!ee chairman; Tricia Dou-

    ville, who grew up within sight of the pool, returns as

    our decision making conscience, Board Secretary, and

    party planning Social Chairman; and last but not least,

    Richard Mason, the Security and Trac Commi!ee

    Chairman extraordinaire, blasts into another year of

    watching our streets and linking us so carefully to not

    only the Prince Georges County Police but County

    Councilwoman, Mary Lehman.

    Thanks to all of them for their reless service year

    a7er year.

    Our goal this year is to provide something for every-

    one; we want to get every last neighbor to the com-

    mon grounds for at least one funcon. Last year, we

    had the First Annual 5K Run/Walk and Kids Fun Run

    and I met someone who has lived here for a number of

    years, but had never been to the common grounds.

    She gured the pool was just too crowded and pre-

    ferred running. How nice that Felipe Arzayus 5K &

    Fun Run added a new dimension to our oerings. This

    year will be even bigger and be!er.

    You know the saying use it or lose it? Well, would-

    nt it be nice if our community promoted our own 30-

    minute acvity challenge? We have opportunies to

    challenge anyone in our community and to connue to

    bring our families together, we are planning acvies

    that will appeal to a wide variety of interests. Your

    Assessment, and a host of volunteers, bring us:

    We are so lucky to live in such a great community

    where our neighbors step forward to keep our homes

    a!racve and compevely priced. The Architectural

    Control & Compliance Commi!ee (ACCC) had two new

    members sign up, Michael Flowe (2013) and Lawrence

    Taylor (2014) which is GREAT news since our form of

    self government can only survive if we have interested

    neighbors. Thank you so much to both of them.

    We also enjoyed the revitalizaon of the Welcome

    Commi!ee and their Saturday visits to newcomers to

    Adavits and Assessment Noces were mailed to all

    Montpelier homeowners in late January. The Assess-

    ment is $295 and due March 1, 2014. All members

    paying the assessment on me receive one free pool

    passgood for 5 free entries during the 2014 season.

    If you havent paid the assessment and lled out the

    adavit, dont delay. Payment of the assessment is

    due March 1 and late a7er March 31, 2014. Payments

    a7er March 31 must include an addional $50 admin-

    istrave fee and $2.95 interest per month.

    Montpelier. Rilla Po2er and her volunteers get the

    names of our new residents from Mary Hughes, our

    reless Administrave Assistant, and send newcomers

    a post card asking for a good me to stop by. Their

    welcome includes some informaon about Montpel-

    ier, Laurel and the County and a box of cookies or

    some other goodie. Who doesnt like giving or geUng

    cookies? Unfortunately, Rilla must step down (very

    reluctantly) from organizing the visits and is asking for

    someone to replace her. What a be!er way to stay

    involved, at your own pace, with the community.

    Come help us welcome all those newcomers!

    Lastly, we are considering adding solar panels to our

    pool buildings to generate some addional revenue,

    plan to add a new feature or two to the open-year-

    round playground, and plan to re-whitecoat the pools

    (once the season is over). There is something for eve-

    ryone this year with the Montpelier Community!

    clean up the leaves and debris

    along the curbs surrounding

    your yard.

    And while sprucing up the yard, re-

    member that the County will not pick

    up YARD WASTE IN PLASTIC BAGS. Yard trim must be placed in heavy-duty paper

    bags or re-usable trash cans with lids. Limbs

    collected curbside must not exceed four (4) feet

    in length and three (3) inches in diameter and

    must be securely ed in bundles.

    Community Members Present: Laszlo Boesze, Mary

    Derrick, and Mary Hughes.

    President Bob Derrick called the meeng to order at

    7:02 PM. There was a quorum to conduct business.

    Secretarys Report: Tricia Douville

    The minutes of the November 2013 board meeng were

    reviewed. Trustee Fazio made a moon to accept the

    minutes. Trustee Keang seconded the moon and it

    passed unanimously.

    Treasurers Report: Lillian Fazio

    Trustee Fazio prepared the monthly statements

    which were distributed.

    Trustee Fazio reported that the accountant started

    the compilaon. He also proposed an annual fee for

    accounng services ($4,000). The board would like

    to see what services are covered in the proposal be-

    fore making a decision.

    Trustee Fazio recommended an increase in the year-

    ly assessment to build up the reserve fund again and

    to fund the upcoming capital expenditures of white

    coang and repairs. Trustee Buehler expects the

    capital expenditures will be low and Trustee Jacobs

    quesoned why the assessment needs to be in-

    creased if we are in the black. Trustee Keang re-

    minded the trustees that in addion to the white

    coang, the pool building will need a new roof, new

    pool furniture will be needed and new sun shades

    have been proposed. Trustee Mason said our assess-

    ment is low and cost of living is increasing. The in-

    crease is limited to 5% per the governing documents.

    Trustee Douville made a moon to increase the as-

    sessment to $295 for 2014. Trustee Keang second-

    ed the moon and it passed unanimously.

    The proposed annual budget was reviewed. Com-

    munity member, Mr. Boesze, suggested an increase

    for electric. Maintenance and repair for the pool was

    also increased. Trustee Keang made a moon to

    accept the amended budget. Trustee Fazio seconded

    the moon and it passed unanimously. A copy will

    be printed in the next newsle!er.

    ACCC: Michael Boddie, Chairperson (absent)

    Trustee Keang reported that a new neighbor has a

    camping trailer in the driveway. A call will be made

    to explain that it must be in storage between Novem-

    ber 1 and March 31.

    A ne was held in abeyance unl February 1 for a

    homeowner to nish repairs to his house.

    Communicaons Commi2ee: Tony Fleming, Chairper-

    son (absent)

    No report.

    Facilies Commi2ee:

    A chairperson is sll needed. Trustee Buehler will dis-

    cuss the posion with Trustee Gimbert.

    Pool Commi2ee: Mary Derrick, Chairperson

    The pool is winterized and the cover is in place.

    Social Commi2ee: Patricia Douville, Chairperson

    Trustee Douville has not been able to get a date for

    visit of the Santa on the retruck. Trustee Buehler

    will also try to get the date so that it can be an-

    nounced to the neighborhood.

    The holiday lights judging will be Sunday, December

    22. The winners will be announced on the website,

    facebook, newsle!er and email.

    Security Commi2ee: Richard Mason, Chairperson

    Trustee Mason distributed his report and said there

    were no crimes reported in Montpelier in the last

    two months.

    A gi7 card for guns will be held in Laurel on De-

    cember 14.

    The Cops Coee topic was on safety in the home.

    The Senior Appreciaon Breakfast featured presen-

    taons by Councilwoman Mary Lehman and the Di-

    rector of Laurel Hospital.

    Trac Commi2ee: Richard Mason, Chairperson

    Pepco announced that only Mr. Pleasant, not Cedar-

    brook, was geUng new trees to replace those cut down.

    Trustee Mason will speak to them and Mary Lehman to

    be sure that Cedarbrook also gets new trees.

    Tennis Commi2ee: Lillian Fazio, Chairperson

    Trustee Fazio reported that our a!orney sent a le!er to

    the company concerning our guarantee on the courts.

    They have said that they sll intend to x the cracks.

    Trustee Mason reported that 8 post cards have been

    sent out to new neighbors to set up a welcome visit,

    but no visits are scheduled.

    OLD BUSINESS:

    Whitecoang will be considered in the spring as too

    many unanswered quesons arose during the bid pro-

    cess. Three bids, all around $100,000, were secured,

    but there were many caveats included which could

    raise the price. At this point it is best to work on the

    Scope of Work, redo the bids and prepare for white

    coang next fall as soon as the pool closes.

    The next board meeng will be held on Tuesday, Janu-

    ary 14, 2014 at 7:00 PM at Deereld Recreaon Center,

    preschool room. The moon was made and seconded

    to adjourn at 8:22 pm. The moon passed unanimous-

    ly.

    The meeng was called to order at 7:03 PM by M. Bod-

    die. The minutes of the December meeng were not

    available.

    OLD BUSINESS:

    12704 Silverbirch Lane Fine held in abeyance unl Feb-

    ruary 1 pending compleon of repairs.

    12234 Shadetree Lane Large mobile home is gone. No

    violaon exists at present.

    New Business:

    12203 Shadetree Lane A fence (over 4 7 tall) was in-

    stalled without prior approval. A le!er will be sent

    giving the owner 30 days to request approval for

    the fence and an excepon to the 4 7. require-

    ment or remove the fence.

    8803 Gramercy Lane Homeowner requested approval

    for a 10x12 shed. J. Keang made a moon to

    approve the shed pending receipt of the nal di-

    mensions for height (not to exceed 10 7.) The

    moon was seconded and passed unanimously.

    12505 Ivory Pass - C. Grillo, Vivint Solar, presented a re-

    quest for approval to install solar panels on the

    roof. M. Flowe made a moon to approve the

    request. C. Hebert seconded the moon and it

    passed unanimously.

    12613 Mt. Pleasant - C. Grillo, Vivint Solar, presented a

    request for approval to install solar panels on the

    roof. M. Flowe made a moon to approve the

    The ACCC Guidelines, as revised at the December 3, 2013

    meeng, were approved and signed by all commi!ee

    members. They will be given to the Board of Trustees at

    the January 14, 2014 meeng.

    The next meeng of the ACCC will be Thursday, February

    6, 2014 at 7:00 PM at Deereld Community Center. The

    meeng adjourned at 7:35 pm.

    Montpelier Community Association, Inc. Board of Trustees Meeting Minutes

    January 14, 2014

    Trustees in A2endance: Paul Buehler, Bob Derrick,

    Patricia Douville, Lillian Fazio, Brad Gimbert, Tim Ja-

    cobs, Jack Keang, Richard Mason and Jean Sorrenno.

    Community Members Present: Mary Derrick and

    Mary Hughes.

    President Bob Derrick called the meeng to order at

    7:02 PM. There was a quorum to conduct business.

    Secretarys Report: Tricia Douville

    The minutes of the December 2013 board meeng

    were reviewed. Trustee Keang made a moon to ac-

    cept the minutes. Trustee Douville seconded the mo-

    on and it passed unanimously.

    Treasurers Report: Lillian Fazio

    Trustee Fazio prepared the monthly statements

    which were distributed.

    Trustee Fazio reported $63,353 net income for the

    associaon for 2013. She put $50,000 into reserve,

    which brings the reserve accounts to $128,000.

    Trustee Fazio recommended a yearly contract for

    accounng services with A. Simmons. The Basics

    package covers a compilaon, tax preparaon,

    1099s, and support including Quick Books instruc-

    on and the cost ($3,788) is in line with our current

    charges for accounng. Trustee Douville made a

    moon to enter into the Basics annual package

    ($947/quarterly). Trustee Sorrenno seconded the

    moon and it passed with Trustee Keang opposed.

    Trustee Keang raised the queson whether three

    bids for the annual contract are required by the gov-

    erning documents. There have been problems in the

    past nding accountants willing to take on this ser-

    vice and Mr. Simmons is local and has provided good

    service at a reasonable price. Trustee Keang will

    see if there are accountants interested in providing

    the service that the associaon needs for the future.

    Trustee Fazio reported that the sale of a vacant

    house on Oxwell Lane has fallen through. The associ-

    aon has a money judgment for past due assess-

    ments which should be paid when the house is sold.

    ACCC: Michael Boddie, Chairperson (absent)

    Trustee Keang reported that the trailer on

    Shadetree is gone.

    Four approvals were granted for solar panels and one

    approval for a new shed.

    A le!er was sent for a 6 foot fence installed without

    prior approval.

    Facilies Commi2ee:

    Trustee Derrick made a moon to accept Trustee

    Gimbert and Trustee Buehler as co-chairs of the Facili-

    es Commi!ee. Trustee Keang seconded the moon

    and it passed unanimously.

    Pool Commi2ee: Mary Derrick, Chairperson

    The pool is closed.

    Social Commi2ee: Patricia Douville, Chairperson

    The holiday lights judging went well. The winners

    were announced on the website, facebook, news-

    le!er and email.

    The next event will be the Easter Egg Hunt on Satur-

    day, April 12 and a cake walk may be added to the

    event.

    Security Commi2ee: Richard Mason, Chairperson

    Trustee Mason distributed his report. The re de-

    partment said it is okay to burn leaves at present, but

    if condions get dry it will not be allowed.

    District VI has a new commander, Major Cara Lloyd.

    Solicitors connue to be a problem. The County re-

    quires a permit for solicitors and the associaon nev-

    er gives permission for solicing. Call 911 if a solici-

    tor will not leave the premises when told to do so.

    Vehicles without current, valid tags are not allowed

    to be stored in your driveway or on the street.

    Trac Commi2ee: Richard Mason, Chairperson

    Pepco planted 44 trees near the power lines along

    Cedarbrook and Mt. Pleasant. They are red buds and

    dogwoods.

    The Cops ocers received many comments on

    lighng needs in the neighborhood.

    Trustee Mason has made three calls to the county

    regarding the dead tree on the corner of Briardale

    and Cedarbrook. He was told it can take up to a year

    for a response.

    Trustee Mason was told that all Bradford pear trees

    will eventually be removed by the county. As this

    will change the appearance of Montpelier, Trustee

    Mason was asked to get addional informaon. He

    will nd out if this can be delayed, staggered or if

    people can opt out of the program.

    Tennis Commi2ee: Lillian Fazio, Chairperson

    There has been no acon from Mid Atlanc on the

    cracks in the tennis court surface. Trustee Fazio will

    There were no reported crimes in our community since

    our last report in Montpelier Today. Residents have ex-

    perienced nuisances of solicitaon and suspicious knock-

    ing on doors and windows. Please read the Police and

    Security Commi!ee recommendaons for immediate

    acon to reduce and stop door to door solicitaon. With

    both types of personal invasion, please call 911 so the

    local County patrolmen can invesgate. The 911 dis-

    patchers are not the police. The dispatchers encourage

    you to provide as much informaon as possible. Our

    police department encourages you to call 911 if in

    doubt. As the police say, "Please don't complain if you

    haven't called the police." The police remind me it is

    every resident's responsibility to report suspicious and

    illegal acvity to 911. District VI (Beltsville) command

    has changed and we now have Major Kara Lloyd, Com-

    mander, and Capt. Tony Mills as Assistant Command-

    er. Major Lloyd, who spoke at our last MCA Annual

    Meeng, supports our community and appreciates all

    that our residents do to prevent crime in our neighbor-

    hood.

    RECOMMENDATIONS TO REDUCE DOOR TO DOOR SOLICITATION

    1. The Security Commi!ee recommends you

    place a sign next to doorbell that says:

    Unless you are family, a friend, or you

    have an appointment, please do not disturb.

    2. You do NOT have to open door. If you do,

    kindly tell solicitor that it is against Prince

    Georges County law and Montpelier Commu-

    nity policy to allow solicing unless they have

    a county permit and badge.

    3. Keep a picture of the no solicing sign near

    your front door. There are signs posted at all

    entrances to Montpelier.

    4. Keep a copy of the County Dept. of PermiUng,

    Inspecons, and Enforcement Ordinance an-

    nouncing no solicing unless solicitor is issued

    a permit and badge. Tel 301-883-3840 for

    more informaon.

    5. If they do not leave, get a good descripon of

    person and even take picture of them. Also

    get a car descripon, if available.

    6. If solicitor won't leave, tell the person that

    you are calling 911 for the police to come.

    Since we have No Solicing signs at all four

    entrances to our community, the violaon is

    also considered trespassing.

    County Dept. of Public Works to request pot holes be

    repaired on Montpelier Drive, Shadetree Lane, Radnor,

    and Royal Ridge. Thanks for all your reports.

    We are contacng Comcast Cable to request they repair

    all cable boxes in the community. You can assist by

    calling Comcast, too.

    The last phase for the county to remove mature Brad-

    ford Pear Trees on their right of way won't start for 1 to

    2 years. The Tree Managers will have a community

    meeng, and residents can request that trees in front of

    their house not be removed.

    Any person who intends to act in the capacity of a solicitor shall, prior to entering into or upon any residential dwelling ..., obtain a license therefor from the Director [of Permitting, Licenses and En-forcement], except those persons, partnerships, or corporations specifically exempted under Sections 5-207.06, .07 of this Division.

    Sec. 5-205. License: description; to be carried on

    person.

    (a) A license issued pursuant to this Division shall show the name and address of the solicitor, the name and address of the business to be represented, the date of issuance and expiration of the license, and one (1) of the photographs submitted by the licensee shall be attached to the license. (b) Every licensee shall carry his license with him at all times while engaged in soliciting and shall display said license to the prospective buyer prior to making any solicitation. Every licen-see shall permit any person, upon request, to per-sonally inspect his license, including any police officer or County inspector of licenses who makes such request. (c) It shall be within the discretion of the Director to allow a person, partnership or corpora-tion soliciting within the County to design its own badge to be worn by all its employees and agents located in the County; provided, that: (1) All such badges are first submitted to and approved by the Director. (2) One design is

    used for all such employees and agents. (3) The badge contains such information as required by the Director, including, but not limited to, the name of the licensee, the name of principal, expiration date, and a disclaimer stating that possession does not constitute endorsement by the County. (4) The said principal thereby immediately assumes responsibil-ity to secure proper distribution of the license and its return upon expiration. (5) Any unauthorized use thereof, or fraud or misrepresentation perpetuated by the use thereof in any unauthorized manner, is actionable against the person undertaking such dis-tribution. (d) No license shall be valid unless it bears the signature of the Director or his lawful designate and has his official seal affixed thereto. (CB-119-1974)

    Any person required to be licensed under this Divi-sion who acts in the capacity of a door-to-door so-licitor without first having obtained a license, or continues to act after a license has been denied, sus-pended, or revoked, shall be deemed guilty of a misdemeanor and, upon conviction, shall be subject to a fine not exceeding One Thousand Dollars ($1,000.00) or incarceration up to six (6) months in jail, or both such fine and imprisonment.     Does it seem that winter is here to stay? Cold weather condions; ice and snow, snow and more snow? Two

    hour school delays or be2er, no school!!! Coats, boots, gloves and hats replace the summer carefree look of

    shorts, bathing suits and ip ops? Dont fret, not yet good news is on the horizon that pesky Phil the

    groundhog predicts spring is scheduled to arrive in late March.

    Spring rewards us for surviving winter by giving us bold beauful colors and warm weather with promise of a

    great summer to follow! Summer in Montpelier rewards the community with the opening up the pool and the

    start of another great Marlins Swim Season. In fact, in just 3 short months the Montpelier Pool will be ring up

    in preparaon of the Marlins 47th season. The Marlin family looks forward to welcoming back return swimmers

    and especially looks forward to greeng new swimmers and their families.

    The Marlin Swim Team is a summer league that welcomes children from 6-18 with varied levels of swimming

    skills. This program has been one of the largest recreaonal programs in Montpelier for over 46 years. Swim-

    ming is a great sport!!! In addion, the Marlin Team really does bring out the best in our youth great team-

    work and camaraderie!!!!

    What do our swimmers do during the o season?

    Here are just a few:

    5th graders at Montpelier Elementary School, Kae

    Godshall and Allison DeMik along with a third student

    won a spot in the Final 4 in Prince Georges County

    Science Bowl. They will put their talents to the test

    on April 1, 2014.

    Amanda Hong, 8th grader, at Chesapeake Math It

    Academy (CMIT) took 3rd place in Chemistry at CMITs

    3rd Annual Stem Fair.

    Swim is not only limited to the summer. Ma2hew

    Collman nished his rst season with Eleanor Roose-

    velt Raiders Swim Team. Laurel High School Swim

    Team wins are up due to several of our older Marlins.

    Caroline Su2on, Mia Rutherford, Madison Tu2le along

    with Adam Gebhardt helped the Spartans to a 7-1 sea-

    son. South region Championships are next on their

    calendar. Go Spartans!

    On another good note, our former Voice of the Mar-

    lins, Michael Criscoli is on the road to recovery aRer a

    long illness. Keep the prayers coming and of course

    cards are welcome.

    Anymore news on our Marlins, please dont hesitate

    to forward it o to me. I will include it in the Marlin

    Highlight Secon.

    As chairperson of the Welcoming Commi!ee, I have

    enjoyed vising our new neighbors, along with several

    other long term residents of Montpelier. Unfortunate-

    ly, family health issues have made it necessary for me to

    vacate this pleasant task, and I would like to nd some

    Montpelier residents willing to lead and parcipate in

    the Welcoming Commi!ee. I can brief you on the usual

    things we have been doing, and perhaps you can create

    new ways to welcome our new residents. It is not a

    dicult task and we have always delighted in meeng

    the new people. I can provide names of people willing

    Hi Neighbor !

    Well Spring is nally here and I for one can't wait to get

    back to the garden.

    As many of you may be aware the state and our county is

    involved in the Watershed Protecon and Restoraon

    Program. The literature states that every day, trash, oil,

    sediment, chemicals and other pollutants collect on our

    roofs, roads, parking lots and driveways. When it rains,

    the pollutants travel over these surfaces, ow into the

    storm drains and in great volume end up in our creeks,

    rivers, lakes and streams. Prince Georges County has a

    "Rebate Program" which will reimburse you for buying

    and using rain barrels, green roofs, permeable pavement

    and planng rain gardens. You can contact them for the

    details at [email protected]. Besides

    the rain barrel, the rain gardens seem to be the most

    praccal.

    Recently, I spent a week in the country club secon of

    North Arlington, Virginia, caring for my grandchildren

    while their parents were vacaoning in the West. I had

    the usual tasks of picking up and driving children to voice

    lessons, library etc. and I began to be more aware of the

    landscaping of the properes as I drove around the com-

    munity. Many of these homes were built in the 7ies

    and are sll owned by the original families, but others

    have been purchased by families with young children., so

    there is a good mix. Sounds like Montpelier.

    One major dierence with our community is the land-

    scaping in the front of the properes. In Montpelier, the

    homes sport great expanses of lawn. That grass must be

    cut, ferlized, re-seeded and watered. All that ferlizer

    runs into the sewer system and adds to the polluon of

    the Bay. In the Arlington community, the homes have

    very li!le lawn. There are evergreen bushes, dogwood

    trees, spirea bushes and grass-

    es or just ground cover. The

    homes seem much more ele-

    gant and estate like.

    Why not secon out a percent-

    age of your lawn, check for

    ulity placement, then decide

    what plants or trees you could

    purchase. There are so many

    books, magazines and infor-

    maon to help you as well as

    the local nurseries. Maybe the

    rst year, you would just plant

    the foundaon shrubs. If you get pre-approval from the

    county, they will reimburse you up to $2,500.00. We as

    a community can make Montpelier have that elegant

    estate look, improve the desirability and really help the

    environment.

    Many of you have admired the Limelight panicle hydran-

    gea that are planted in front of the fence inside the pool.

    These large ower clusters last the enre summer,

    change from snow white to green and pink in the Fall and

    then hold the snow in winter in the shape of snow clus-

    ters. In colonial mes, the owers were o7en cut, a san

    bow ed to the stem then placed in the Christmas tree.

    Flowers grow on new wood so you can prune in the

    Spring. As you trim, remove a few older stems from the

    bo!om to allow more light and air circulaon into the

    shrub. When pruning cut at an angle, just above a set of

    leaf buds. New owering branches will sprout here, as

    well as lower on the stem. Panicle hydrangea are pest

    resistant. Very shady locaons are its worst enemy, re-

    sulng in few owers.

    Remember those tulips that I suggested be put in pots

    with neUng so the cri!ers don't

    eat them? Well let me know

    how well that experiment went.

    MONTPELIER HOMEOWNERS: ACCC COVENANT ENFORCEMENT The Architectural Control & Compliance Commi!ee (ACCC) is commi!ed to working with homeowners to ensure

    covenant compliance in Montpelier. The ACCC can review approval requests between meengs and when all

    requested informaon is provided with the form, many approvals can be granted within a week of submission.

    The Architectural Control & Compliance Commi!ee (ACCC) has received, and approved, many requests for installa

    on of solar panels in the last year. While some of us may not like the look of solar panels on a house, the Maryland

    Real Property Code (reprinted below) prohibits restricve covenants that impose limitaons on the installaon of

    solar collecon panels on the roof of your home, provided that the owner owns or has a right for the exclusive use of

    the roof. With this in mind, the ACCC will no longer require prior approval for installaon of roof-mounted

    solar collectors provided that they comply with all State and Local laws. The ACCC requests nocaon

    of the intent to install solar collectors and the approximate date for installaon. Nocaon may be made by email, mail or submi!ed on an approval form.

    Article - Real Property 2119. (a) (1) In this section the following words have the meanings indicated. (2) Restriction on use includes any covenant, re-

    homeowners association; (v) A security instrument; or (vi) Any other instrument affecting: 1. The transfer or sale of real property; or

    2. Any other interest in real property. (3) Solar collector system means a solar collector or

    other solar energy device, the primary purpose of which is to provide for the collection, storage, and distribution of solar energy for electricity generation, space heating, space cooling, or water heating. (4) Solar easement means an interest in land that: (i) Is conveyed or assigned in perpetuity; and (ii) Limits the use of the land to preserve the receipt

    of sunlight across the land for the use of a property own-ers solar collector system. (b) (1) A restriction on use regarding land use may not

    impose or act to impose unreasonable limitations on the installation of a solar collector system on the roof or exte-rior walls of improvements, provided that the property owner owns or has the right to exclusive use of the roof or exterior walls.     unreasonable limitation includes a limitation that: (i) Significantly increases the cost of the solar col-

    lector system; or (ii) Significantly decreases the efficiency of the

    solar collector system. (c) (1) A property owner who has installed or in-

    tends to install a solar collector system may negotiate to obtain a solar easement in writing. (2) Any written instrument creating a solar easement

    shall include: (i) A description of the dimensions of the solar

    easement expressed in measurable terms, including verti-cal or horizontal angles measured in degrees or the hours of the day on specified dates when direct sunlight to a specified surface of a solar collector system may not be obstructed;

    (ii) The restrictions placed on vegetation, struc-tures, and other objects that would impair the passage of sunlight through the solar easement; and

    (iii) The terms under which the solar easement may be revised or terminated. (3) A written instrument creating a solar easement

    shall be recorded in the land records of the county where the property is located. (d) This section does not apply to a restriction on use

    on historic property that is listed in, or determined by the Director of the Maryland Historical Trust to be eligible for inclusion in, the Maryland Register of Historic Properties.

    The 2014 senior golf season begins Wednesday, April 9

    at Patuxent Greens Golf Club, just minutes from Mont-

    pelier on Rt. 197. If you are looking for an opportunity

    to get some regular exercise and parcipate in friendly

    compeon, consider joining the Senior Mens Golf As-

    sociaon (SMGA) at Patuxent Greens.

    As a member of Maryland Interclub Senior Golf Associa-

    on (MISGA), the Patuxent Greens seniors group oers

    weekly play on Wednesdays, plus oponal opportunies

    to travel to other nearby golf clubs for addional friendly

    compeon. Golfers of all ability levels are welcome.

    Patuxent Greens has undergone a major upgrading over

    the past 3 years and it is one of the few area courses

    that allow golfers to walk; riding carts are available, but

    not mandatory for this golf league. The senior (age 50+)

    group plays early on Wednesday mornings from April

    through the end of golf season. April 9 will be an

    informal day of golf and the season will ocially begin

    April 16.

    Our membership includes some life-long golf lovers,

    while others are returning to the game a7er not having

    had much me to play in the past, said John Bertak,

    president of the SMGA and a

    Montpelier resident. Sll other

    players are brand new to the

    sport, but no ma!er what the skill

    level, they enjoy the challenge and

    exercise that an early morning

    round of golf can provide. All

    players establish handicaps that

    allow them to compete on an

    equal basis with others in a variety

    of team and individual formats.

    MSGA membership is just $15 per year and Patuxent

    Greens oers several types of club memberships includ-

    ing INsider Plus category at just $39 annually. Weekly

    greens and cart fees depend on the players membership
